Planning Board was held at 7: 30 P.M. , Monday, February 1, 1971, at the Town Office, Main Road, Southold, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Nice-Chairman; Henry Raynor; Frank Coyle; Alfred Grebe. Also present: Howard Terry, Building Inspector- Mr. Gottlieb Nickles presented the Planning Board with final maps for the proposed minor subdivision of 011ie M. Overton, property located at south side of Terry Lane (Founders Landing) , Southold, New York. The map showed 6 lots, lots 1-5 contained 29,000± sq. ft. of area, lot # 6 contained 40,.00Otsq. ft. of area. Mr. Nickles stated that this area is serviced with public water, gas, and electricity. Upon inspecting the map the Chairman suggested that the area of the lots be increased by eliminating one of the lots. Mr. Nickles- ex- plained that the reason that the lots were laid out in this manner is because they want to have as much land as possible to convey to the-Southold Park District. Mr. Nickles informed' the Board that he has no confirmation as to exactly how much land the Park District; Southold Town Planning Board -2- February 1, 1971 is interested in purchasing, he suggested that the Planning Board, send a letter to the Park Distriat inquiring just how much land; they plan to purchase. The Chairman agreed to send such an inquiry, to the Southold Park District. The Chairman inspected the file on this subdivision and read_ the following correspondence contained therein: , Letter received from Alden Young, Engineer, dated January 21, 1970, in answer to Planning Board' s request for more informa-ttijon o3z the level of the pond. Letter received. from the Superintendent. of Highways:, dated January 23, 1970, approving the road lay-out. Bond estimate received from Lawrence Tuthill, dated February 4, 1970, in the -amount' of $116,000.00 Planning Board recommendation to the Suffolk County Board of Health, dated February 26, 1970. Letter received-_ from H.W. Davids, dated March 10, 19709 acknowledging receipt of Planning Board recommendation. Letter received from the Village of Greenport notifyilng the developer that they cannot extend water to that area. Letter received from the Superintendent of Highways, dated October 8, 1970, approving the road lay-out of the revised sub- division plan.. Certification of approval received from the Suffolk County Dept. of Health, dated October 26, 1970. Revised bond estimate received from Lawrence Tuthill, in the amount of $58,000.00, dated October 26, 1970. Letter of December 3, 1970 which the Planning Board sent to the developer stating suggestions for improving the map. Letter of January 15, 1971, which the Planning Board sent to the developer notifying him of the amount of the subdivision fee. The Chairman also read the Information Sheet attached to the inside of the front cover of the file. THE CHAIRMAN: Upon inspecting this file, I find it complete in all respects. Is- there anyone present who wishes to speak im opposition to this subdivision? Southold Town PlanrL,.wg Board -4- February 1, 1971 (There was no response. ) THE CHAIRMAN: Hearing none, I would like to recommend on the part of the Planning Board that this subdivision be approved. I would also like to state that the Planning Board feels that the engineer, the developer, and the lawyer have spent a great deal of:' time working on this subdivision, ' and we regret the length of time that it has taken and we also regret the determination of the Board- of Health after submitting our recommendation for approval to them. THE CHAIPUAY.: Is there anyone present who wishes to speak.-: im favor of this subdivision? RICHARD CRON, ATTORNEY a/c Leeward Acres at Bayview, Inc,,. : I think the recordi speaks for itself. I quite agree with you that it is unfortunate that the Health Dept. did not accept the first map. After disapproving that map, they should have accepted the cluster zoning map which they also turned down. We are not happy with the subdivision that we have here. The first map that was presented. with lots of 20,000 sq. ft. was far better than this one, it is very unfortunate that the Health Dept. did not accept it. THE CHAIRMAN: . Is there anyone else present who wishes to speak in favor of this subdivision? MRS. JEAN TIEDKE (L.W.Q. ) : What is cluster zoning? The Chairman briefly explained the concept of cluster zoning. MR. CRON: In an effort to resolve what we thought would be a better plan, we had the map for cluster zoning prepared. The idea was to retain a greater portion of the land in open area. `fie were advised by the Health Dept. to prepare such a map, but when we presented it to them they turned it down. THE CHAIRMAN: I agree that it was unfortunate that they did not accept it, not to criticize the Health Dept,. , I am sure that they had. reasons of their own for. not accepting it:. Basically, we that the main problem is the highway lay-out. The cluster zoning, map would have made possible a better highway lay-out and better shaped lots. HENRY RAYNOR: It would have been a considerably better land. use- than what we have here now. It is unfortunate that the develop- er- and the County Board of Health could not come with a better land. use. I think that the County should have gone down and taken a closer look at this property before turning down the first map. I object to this subdivision on the basis that the developer did not meet., the requirements set forth by the Planning Board� at their meeting held- on November 5, 1970, which concerned, among other things, the dimensions of the lots. This map is an example of poor planning, the lots are too deep for their width. VIR. CRON: The engineer, the developer, and I agree with you on your last point. The Health Dept. should have granted us a variance. The rules and regulations did not do justice to this 4 Southold Town Plann-..g Board -5- February 1, 1971 particular subdivisiom. THE CHAIRMAN: Is there anyone else who wishes to speak on this subdivision (There was> no response. ) THE CHAIRMAN: Hearing none, I will now declare: the hearing closed at this time, decision will be made by the Board later in the evening. Richard Cron, Attorney presented the Planning Board- with three (3) copies of the final map for the proposed minor subdivision of Clausen Construction Company, Inc:. , property located at northiside of Main Road (Route 25) , Orient, New York. The map showed 5 lots,- each containing approximately 2.3- acres:. The map showed the dimen- sions of the lots:, but there were no courses on it. Mr. Cron said. that he would obtain maps showing both the dimensions and the courses and would send copies to the office. On motion by Mr. Wickham, seconded by Mr. Raynor, it waa, RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Clausen Construction Company, Inc:. , property located at north side of Main Road (Route25) , Orient, New York, subject to receipt of' three (3) copies of final map showing dimensions and courses� of lots4. The above resolution shall include authorizatf= for the Chairman. to sign, final maps: at suchi, time when above conditiaoni is met. David Horton of' Peconic Homes, Inc. at Mattituck, presented the Planning Board;: with final maps for their proposed subdivision to be known. as "Eas:twood -Manor" ; property located at south side of Main Road (Route 25) , Mattituck, New York. The Board- inspected the maps and found that all necessary revisions had been made,as suggested by the Board.. Southold Town Plann_g Board -7- February 1, 1971 Robert Schroeder presented the Planning Board with a revised map for the lay-out of Soundcrest Woods, Section II, dated January 18, 1971. Upon inspecting the revised map, the Chairman found that the road going into the park and playground area is only 30 feet.-- wide. The Chairman advised TZr. Schroeder that; the Planning Board cannot accept a subdivision for consideratioxi when the map shows a road that- cannot be dedicated. to the Town. The Board; diiscussed the lay-out of the roads at some length. The Chairman suggested moving the connecting roadi. to the adjoining westerly roperty fromlthe north side of lot # 36 to the south side of -lot 36. The Boards- once again advised Mr. Schroeder that this map will have to be submitted to the County Board of Health for a variance because -of the 20,000 sq. ft. lots, and that his chances: of receiving a variance are slim. Nir: Schroeder stated that he plans to request a variance on the basis that Section II is shown, onithe filed map of Section I. BIr. Schroeder stated that he will have map revised and present it at the next meeting. The Planning Board was presented with- final maps for the, pr-opose& minor subdivision of Nelson- Axien, property located off north.-.side of Middle Road< (CR27) , Pecon$c, New York. The maps showed 3:, lots-,+lot # 1 contains 35,000- sq. of area, lot # 2 contains 36,000- sq. ft. of' area, and lot # 3 contains 379000- sq. ft. of area, all fronting on pre-existing right- of way. At the last Planning Board meeting held on January 11, 1971, the map was not accepted because it did not show adjacent property owners. A11 adjacent property owners were shown on these final maps . The Planning Board agreed that they will not accept another minor subdivision in this area. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Nelson A"xien, property located off north side of Middle Road (CR 27) , Peconic, New York. The Chairman signed the final maps;.- Vote of the Board:: Ayes :-Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The Planning Board was presented with preliminary maps for the proposed minor subdivision of John Scheel, property located at north side of Bay Avenue, Cutchogue, New York. The map showed poorly planned division of the property into 4 lots, lot # 3 was splinter shaped with 4.0 ft. of frontage on the Bay. The Planning Board is of the opinion that this is a very unrealistic; approach for the division of this property. Map to be returned to applicant with notification of the Board' s- disapproval. Southold._ Town Planni_=,; Board.. -8- __:bruary 10 1971 The Chairman read notice received from the Cooperative Extension Association of Suffolk County in regard to new movies now available on the subject of .planning and solid waste dis- posal, and notice of summer school to be held on how to interpret the soil maps for specific land use. The .Chairman read the determination received from the Suffolk County Planning Commission on proposed change of zone petition of Gus Schad. The Planning Commission considered it' a-. matter for local determination and offered several comments on it.. On motion by Mr.. .Grebe, seconded by Mr. Wickham, it- was RESOLVED that the Southold Town Planning Board hereby re-states their recommendation of approval to the Southold Town Board of change of zone petition of Gus Schac% property located at north side of Route 2:5,, Greenport, New York, for change of zone from "A" Residential and Agricultural District to M Multiple Residence District on Parcel I, and from "A" Residential and Agricultural District to. "B-2" Business District on Parcel II, as originally stated in recommendation of December 28, 1970.. The Planning Board further recommends that this petition for change of zone be set up for a public hearing at the next meeting of the Town Board.. The above recommendation to be sent to the Town Board together with a copy of the County recommendation. Vote of the Board: Ayes:-Messrs: Wickham, Moises; Raynor, Coyle, Grebe. The Chairman read letter received from Eugene A. Oliva in reference to dredging operation and rock Jetty at Major' s Pond, Orient, New York. Letter to be sent mtoiMr. Oliva stating that the matter is in the process of being investigated, at the present time we have no confirmed in ,formation on it. The minutes of the Village of Greenport Planning Board, dated January 23, 1971, were read by the Chairman and the following letter was sent to the Town Board: Southold. Town Planning Board. -9- February 1, 1971 Southold Town Board 16 South Street Greenport, New York Gentlemen: We are in receipt of a copy of the minutes of the Village of Greenport Planning Board, dated January 23, 1971, which state,..-state that the Southold Town Planning Board suggested to them that they annex into the Village of Greenport 48.7 acres of land on the corner of North Road and Moores Lane, Greenport, owned by a corpor- ation known as East End Associates. The above statement which they made does not make sense to us because we have never given such advice to them or anyone else. We feel that this matter is not within our jurisdiction and we are forwarding a copy of the Village of Greenport Planning Board minutes of January 23, 1971, which were sent to us. Letter sent back informing them that the state enabling legisla- tion does not rpovide for notifiaction of some interested parties of change of zone applications . It was suggested that they send a_ representative to the public hearing to be held on this matter. They were informed that the Planning Board has no development plans available at this time. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board, a raise in the salary of the Planning Board Secretary, Betty Neville, and reimbursement of her expenses while attending evening classes for intermediate shorthand at the Riverhead Extension of the Suffolk County Community College. The Chairman appointed Henry Raynor and Frank Coyle to negotiate with the Town Board on this matter. Vote of the Board: .Ayes;-Messrs: Wickham, Moisa, Raynor, Grebe. Nay: Mr. Coyle Southold. Town. Planning Board -10- February_ 1, 1971 Mr. Coyle stated that he did not think that the Planning Board should set precedent on such a. matter. Henry Raynor stated that precedent has already been set by the Police Dept. Copy of letter which C .H.. Wickham sent to the Town Board. was received and read .:by the Chairman. Said letter placed on file. Lawrence .Tuthill, P.E. submitted reduced estimate, in the amount ofn $5,410..00, for the remaining work to be completed ,on the roads and other improvements in the subdivision "Rosewood Estates . On motion by Mr. .Moisa, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board a 50% reduction in the performance bond, from22,,000. to -o11,000., for_ the completion of the roads in the subdivision "Rosewood Estates" , located at Cox Neck Road and Bergen Avenue, Mattituck, New York. Vote of the Board: Ayes :-Messrs: Wickham, .Moisa, Raynor,: Coyle, Grebe. Lawrence Tuthill, P.E. submitted reduced estimate, in the amount of $2t,500.00, for the remaining work to be completed on the roads and other improvements in the subdivision "Northwoods "' On motion by Mr. Grebe, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board recommend to the Southold .Town Boardd'. a reduction in the performance bond from 43,600.00 to $2, 500.00, for the completion of the roads in the subdivision ."Northwoods", located atE/S Cox Lane, Cu.tchogue, New York. February 1,. 1971 RESOLVED: WHEREAS: Leeward Acres at Bayview, Inc., Hilltop Road, Southampton, New York, has petitioned the Southold Town Planning Board for final approval of their subdivision "Leeward . Acres at Bayview" , located at S/S North Bayview Road & E/./rS Jazob's Lane, Southold, New York, and WHEREAS: The Superintendent of Highways has approved the lay-out of the roads, and the Planning Board accepts his report, and WHEREAS: The Southold Town Board will accept a; bond in the amount of $58,000.00 for the roads and other improvements in this subdivision, NOW, THEREFORE BE IT RESOLVED: that the Southold Town Planning Board grant .final approval to the subdivision known as "Leeward Acres at Bayview" , subject to the following conditions: 1. Receipt of notice from the Southold Town Board that they have received. and accepted a bond for this subdivision. 2. Developer presenting the Planning Board with subdivision fee of $2,655.00. This motion shall include authorization for the Chairman to sign final maps upon receipt of notice from the Town Board, and receipt of subdivision fee from the developer. Vote of the Board: Ayes;-Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The Planning Board inspected the large scale colored Master Plan Map prepared for us by the County. It was decided that this map should be displayed at the next "Information Meeting." The Planning Board discussed the date for the next Information Meeting on the Master Plan. It was tentatively agreed that it should be held on either March 5rd, 4th, or 5th, preferably the 5th, at the Southold High School. Howard Terry to call Southold High School to find out which date will be available to us. Southold. Town Planning. Board -12- February 10 1971 On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that next regular meeting of the Southold Town, Planning Board be held at 7:30 P.M. , Tuesday, February 23, 19719 at the Town Office, Main Road, Southold,New York. Vote of the Board; Ayes:-Messrs : Wickham, Moisa, Raynor,. Coyle, Grebe. On motion by Mr. Wickham,. seconded by Mr. Raynor, it was RESOLVED that the minutes of the Southold Town Planning Board, dated January 11, 1971, be approved as submitted.
