Southold Town Planning Board
February 177 1959
A regular meeting of the Southold Town Planning Board
was held on February 17, 1959 at 7:30 P.M. at the Town Clerk's
Office, Southold, New York.
Present were: Messrs. John Wickham, Chairman, Henry
Moisa and Alfred Grebe.
Absent: Messrs. Harold R. Reeve and Archibald Young.
Also present: Messrs. Howard M. Terry, Building Inspector
and Otto Van Tuyl.
Mr. Edward T. Costello appeared before the Planning Board
regarding application dated February 17, 1959 of Deane K. Fox
for an Open Development. Area of property located on Youngs
Road, Orient, New York, and bounded north by Long IslandSound,
east by Youngs Road, south by C. L. Young Estate, Edwin H. King,
Tage Palm, Warwick, Main Road, and west by John .Dyer. Map of
Otto W. Van Tuyl & Son dated July 2, 1951+ and revised February
239 1955 and May 6, 1955•
The map was described by Mr. Van Tuyl, and Mr. Costello
explained the history of the property to the Board. He also
presented the declaration of the restrictions which were
recorded in the County Clerk's Office in 1955 in the names of
Reybine and Horne.

After considerable discussion it was the determination of the
Board on motion of Mr. Grebe, seconded by Mr. Moisa and carried to
RESOLVE, that the Planning Board recommend to the Town Board
approval of the request for an Open Development Area on the property
included in the legal description of Otto W. Van Tuyl & Son dated
July 2, 1954 and revised February �3, 1955 and May 6, 1955. The
Planning Board also recommends approval of the 30 foot rights-of-way
as shown on the aforementioned map.
This property was restricted by declaration dated April 23,
1955 and recorded in the County Clerk's Office, Liber 3892 of
Deeds, Page 202, with the map being filed with this deed. The
Planning Board has studied the declaration and finds that the res-
trictions are. more stringent than those of the Zoning Ordinance of
Southold Town, and in view of the above feel that there should be
no problem.
Mr. Edward T. Costello also presented the application of Edward
W. Lathamgindividually and on behalf of Woodrow and Edna Angell for
an Open Development Area on property located on Youngs Avenue, also
known as Youngs Road, Orient, New York, lying northerly and south-
erly of a 20 foot right-of-way as shown on map of Otto W. Van Tuyl
& Son dated February 16, 1959•
Mr. Costello explained the background of the property and
answered questions posed by the Board,
On motion of Mr. Moisal seconded by Mr: Grebe and carried, it
was the determination of the Board to
RESOLVE, that recommendation -be made to the Town Board for
approval of this application. In view of the fact this right-of-
way has been serving two or three houses for approximately 30 years
and the total length is less than 600 feet, the Board feels. the 20
.foot width is adequate.
On motion of Mr. Grebe, seconded by Mr. Moisa and carried,
the minutes of the January 27, 1959 meeting were approved as sub-
mitted.
A copy of Howard M. Terry, Building Inspector 's report to
the Town Board of his attendance at the meeting of Association of
Towns was read. It was by unanimous vote that the Board commended
Mr. Terry for his thought, suggestions and extreme thoroughness in
the preparation of this report. The Board held considerable dis-
cussion on this report. One point in particular was a Master Plan/or
General Outline for Development for the Town of Southold.

A communication was received from the Town Board stating that
as a result of their meeting of January 20, 1959, the petition of
Warren F. and Barbara B. .Bittner, for a change of zone from "A"
Residential & Agricultural to I'M" Multiple. Residence, was granted.
effective February 99 1959.
A letter was received from the County Clerk's Office dated
January 261 1959 stating that the subdivision map of Bay Haven
at Southold was filed in that office on January 22, 1959 under
the file number 2910, abstract number 3164, Book 102 Page 81 Town
of Southold.
After further discussion relative to the request of Walter C.
Grabie, Mattituck,' for .an Open Development Area (described in min-
utes of December 169 1958, and referred to in minutes of January67
and January 279 1959), the Board decided to write Mr. .Grabie
suggesting that steps be taken to improve the condition of the
roads in the near future, as two members of the Board have visited
the property in the past two weeks and find the roads in an un-
satisfactory condition.
The matter of the application of N.S. Robinson for an Open
Development Area, Map of Paradise Point at Bayview, was again
discussed at some length by the Board. On motion of Mr. Moisa,,
seconded by Mr. Grebe and carried it was
RESOLVED, to recommend to the Town Board approval of the access
only to the extent marked in red and signed December 16, 1958 on
Map of Paradise Point at Bayview, Southold by Otto W. Van Tuyl and .
Son surveyed September 15, 1947.'
In the recommendation the Board specifically pointed out that
the other roads shown on this map are not actually in existance as
shown and should not be considered satisfactory. The part approved
by the Planning Board is all paved to a width of about 25 feet and
is a 50 foot right-of-way. This has been inspected by our rep-
resentatives several times.
A communication, addressed to the Board of Assessors, from Mr.
James F. Matthews, M.A.I. , was read. This letter indicated that Mr.
Matthews was asked to appraise property known as North Dumpling Island ,
off the north coast of Fishers Island in Fishers Island Sound. He
stated that he did not find it on the zoning map and indicated that
it should be zoned as, although it is owned by the government, it
may be on the market for sale some time in the future.
After considerable discussion and thought on this matter,
on motion of Mr. .Moisa, seconded by Mr. Grebe and carried, it was

RESOLVED9 that a recommendation should be made to the Town
Board proposing an amendment whereby any small islands within the
boundaries of the Town of Southold, whether natural islands released
by State of Federal governments or whether man-made shall be con-
sidered "A" Residential and Agricultural Districts.
The Secretary was instructed to reply to Mr. Matthews stating
the Bca rdts action in this matter.
The next meeting of the Southold Town Planning Board will be
a joint meeting with the Town Board on March 3, 1959 at the office
of the Supervisor, South Street, Greenport.
The matter of identification cards for the members of the
Board .was brought up. It was decided to hold this matter and
present it at the joint meeting on March 3, 1959•
