Reeve Henry Moisa Alfred Grebe Archibald Young M I N U T E S Southold Town Planning Board April 7, 1959 A regular meeting of the Southold Town Planning Board was held on Thursday, April 7, 1959 at 7:30 P.M. at the .Town Clerks Officd, Main Road, Southold, New York. There were present: Messrs. John Wickham, Chairman, Harold R. Reeve, Henry Moisa, Alfred Grebe, and Archibald Young. Also present: Mr. Howard M. Terry, Building Inspector. Mr. Walter Luce and Mr. Roy Schelin appeared before the Planning Board with relation to a proposed trailer park Mr. Schelin contemplates starting. The property in question is a parcel of land located on the west side of Westphalia Road, Mattituck� just above where the bridge was located, and consists of 11 acres. Mr. Schelin has not purchased the property as yet and would like to get the Boards approval of the plan before doing so. A plan of what the proposed park would look like if approved was sub- mitted to the Board for its consideration. There will be lots 50 x 60 foot plus, for approximately 82 trailers. On the boundaries there will be planted trees or fence will be erected. Mr. Schelin has checked with the Health Depart- ment with relation to cesspools and water supply. Southold Town Planning Board -2- April 79 1959 After considerable discussion it was agreed that Mr. Reeve and Mr. Young would visit the site and look further into the matter of the proposed trailer park and make their report at the next meeting of the Planning Board. Mr. Wilfred Ruland came before the Board for a dis- cussion relative to their taking some steps to modify the Zoning Ordinance with relation to handicrafts as provided for and described therein. Mr. Ruland wishes to build a new home on Route 25 in Mattituck, east of the high school on the north side of the road, and relocate his sign paint- ing in the cellar of his new home. He presently resides on Sigsbee Road, Mattituck. Prior to this Planning Board meeting Mr. Ruland went before the Board of Appeals for a variance to do this but was denied same, since the Board of Appeals feels it is a business rather than a handicraft. Mr. Ruland was advised by the Planning Board that steps would be taken to make a recommendation to the Town Board that the regulations be liberalized on the matter of side- line businesses. Mr. Stanley Sepko also appeared at the meeting and voiced his opinion in this matter. After a lengthy discussion relative to an amendment to the Building Zone Ordinance, the following was agreed upon by the Planning Board: uArticle III, Section 300, Subsection 8, Line 11 - used for home occupations, hobbies, handicrafts, and counseling services, PROVIDED --- etc. Article I, Section 100, Subsection 12, Definitions, a new subsection to be 12B - Home Occupations - Dressmaking, millinery, home baking, hand laundry, and similar occupations. Handicrafts - Minor electrical and mechanical repairs, sign painting, model making, minor furniture repairs and refinishing, and occupations of a similar character. Counseling Services - Advice on investments, insurance, and the like. This subsection shall not be construed to cover any sales offices or display rooms and all services shall be rendered by the property owner or his immediate family. " On motion of Mr. Moisa, seconded by Mr. Grebe and carried, it was RESOLVED, that the Planning Board recommend to the Town Southold Town Planning Board -3- April 7, 1959 Board the aforementioned proposed amendment to the Building Zone Ordinance of the Town of Southold. The application for a change of zone from 9lk" Resid- ential - Agricultural, to IIB" Business, was received by the Planning Board from Genevieve Naugles, Mattituck, New York. Change of zone is requested on the following described property, legal description by Otto W. Van Tuyl, dated January 3:17 1949 and amended March 127 1959: Beginning at a point on the northerly line of Naugles Drive, 1638 feet, more or less , easterly along said northerly line from Luther 's Road, said point of beginning being the southeasterly corner of land of Dellulf; from said point of beginning running northerly along said land of DeWulf, 431 feet, mcr e or less, to the southerly line of a 301 right of way; thence easterly along said southerly line of said 301 right of way, 60 feet, more or less ; thence northerly across said 301 right of way and along land of Cavaliere and Pardo, 310 feet, more or less, to Mattituck Inlet; thence southeasterly along said Mattituck Inlet, 650 feet, more or less , to land of Chambers ; thence southwesterly along said land of Chambers, 360 feet, more or less, to said northerly line of Naugles Drive; thence west- erly along said northerly line of Naugles Drive, 107 feet, more or less, to the point of beginning. Containing 4 acres, more or less. The change is request in order that applicant may establish a fishing station. After a thorough discussion it was decided that Mr. Reeve and Mr. Young would visit the property in question and make a report at the next Planning Board meeting. Application for a change of zone from "A" Residential - Agricultural, to "B" Business, was received from John and Alexandra Drossos, Arshamomaque, Town of Southold, New York. Property is described as follows: A parcel of land on the northerly side of Main Road (Route 25) with 528 feet frontage on said foad, with the easterly boundary of said parcel being 850 feet westerly from the intersection of Chapel Lane and said Main Read; being irregular in depth, but approximately 175 feet in depth. In the application the following notation was discussed by the Board: And further, that the said Town Board upon its own motion change said map to denote all prop- erty on the North side of Main Road (Route 25) between Chapel Lane and Albertson Lane to a depth of 200 feet as "B" Business District instead of "A" Residential and Agricultural District. On motion of Mr. Grebe, seconded by Mr. Reeve and carried, it was RESOLVED, that the Planning Board recommend to the Town Board that the application of John and Alexandra Drossos for Southold Town Planning Board. -4- April 7, 1959 a change of zone from "A" to ''B" be granted and on the Town Board 's own motion, the business area be extended from Chapel Lane to the railroad to a depth of 250 feet parallel to the State Highway. Property owners to the west of Albertson bane have been contacted and they approve of the change from "A" to "B" by the Town Board ' s own motion. Mr. Van Tuyl read a letter to the Planning Board with reference to securing a strip of land wider than 25 feet from Mr. Hilton Epp, Bay View, Southold, New York. The letter stated that it is felt that the owner, Mr. Epp, Mr. Wickham, Chairman of The Board, and Mr. Price, Superintendent of Highways should meet and discuss the situation. It was decided that Ins. Van Tuyyl and the Superintendent of Highways would meet with Mr. Epp. Mr. Terry reported that the Town Board had discussed the purchase of the parking lot north of the post office in Cutchogue, and it is felt that they should purchase the 100 ft lot including the 50 ft. which will be highway in front of it, but are unwill- ing at this time to take part in building of Griffen Street.. They find that it should be up to the property owner to build the street and then turn it over to the Town.of Southold. They also think that there will be a serious drainage problem in connection with building the proposed road. The next meeting of the S•outholdTown Planning Board will be held on Tuesday, April 28, 1959 at 7:30. P.M. at the Town Clerk' s Office, Man Road, Southold, New York. A communication from Mr. M. E. Goul, District Engineer, State of New York Department of Public Works, was read. This had reference to the widening or realignment of Route 25 with particular reference to the area of the Mccarthy Sand Pit. Another letter from Mr. M. E. Goul, District Engineer, State of New York Department of Public Works was read. This had reference to Section2, Orient By The Sea. The letter advises that there is no record in that office of a permit issued to Woodhollow Properties' Inc. , nor for a street con- nection to the highway shown as Plum Island Zane on the Sub- division map. No such connection can legally be made until a State Highway work permit is in their possession for the work involved. After considerable discussion it was agreed that a letter should be sent to Woodhollow Properties, Inc. stating that it has 'come to the attention of the Planning Board that the development at Orient By The Sea has failed to obtain permission from the State Highway Department of Public Works for connection to Route 25, and feel that the matter should be attended to. Also since there is no access to the water as has been repeatedly suggested, the Planning Board is not willing to give even a tentative approval to Section 2. Southold Town Planning Board -5- April 7, 1959 The minutes of the meeting of March 17, 1959, on motion of Mr. Grebe, seconded by Mr. Young and carried, were approved as submitted. Mr. Reeve reported that he has not yet made contact with Mr. Elmer Ruland .relative to selling several more feet to Mr. Walter Grabie (Open Deveopment Area) to facilitate a more satisfactory road. A letter from Mr. Francis T. Doyen, President, Fishers Island Civic Association, was received by the Planning Board and read. The letter had reference to previous correspondence between the Fishers Island Civic Association and the Planning Board pertaining to their request that aid be given on Fishers Island for a beach facility and park program. The Fishers Island Civic Association feels that since they have no State Highway or parks on Fishers Island that State aid should be sought. The matter was thoroughly discussed and it has been the experience of the members of the Planning Board that State parks are not entirely satisfactory and they feel that County parks would be the solution. On motion of Mr. Young, seconded by Mr. Moisa and carried, it was- RESOLVED, to recommend to the Town Board that inasmuch as the County is initiating a program of County parks, the Planning Board feels it would be well to look into the Fishers Island property and suggest that the Town Board or the Supervisor approach the Board of Supervisors in this regard. A copy of the aforementioned letter was sent to the Suffolk County Planning Board and a letter to Mr. Francis T. Doyen stat- ing that we are taking this matter up with the Southold Town Board and the Suffolk County Planning Board in hopes that this may be the answer to their problem. Communications were received from the Town Board stating that as a result of their meeting of March 10, 1959 the petition of N. S. Robinson for an Open Development Area was granted, as well as the petitions of Edward 14. Latham and Deane K. Fox, these also being for Open Development Areas. As a result of their meeting of February �77 1959 the petition of Valentine Ruch IV for a change of zone from "All Residential - Agricultural, to I'M" Multiple Residence, was denied.
