A regular meeting of- the Southold Town Planning' Board
was; held Tuesday, August 4, 1959, 7:30 P.M., at the Tom Clerkts
Off ice' Main Road, Southold, New York.
There wer a present: Messrs. John Wickham, Chairman,
Alfred Grebe, and Archibald Young.
Also present: Messrs. Ho-�lard "M. Terry Building Inspector,
Otto Van Tuyl, Consulting Engineer, Robert iasker, Town Attorney,
and William Unkelbacr, prospective member of the Planning Board.
_ Absent: Mr. Henry Moisa.
The-petition of John J. Fleming, Mattituck, New York, for a
change of zone from "At' Residential-Agricultural to "B" Business
district over certain "real property situated at Mattituck and
more particularly bounded and described as follows: 'north by-
Sound Avenue, east- by Pacific Street, south by- land f.formerly of
Bond and by land of Rolfes, and west by land of1Long Island Rail-
road, The Board was instructed to prepare an official report
defining the. -Conditions described in the petition and determine
the area so affected with the recommendation of the Board.
Mx. -Louis Griffing, prospective tenant of the property in
question, which will be used as a heavy duty overhaul garage,

appeared before the Planning Board to answer questions. Mr.
Griffing stated that the garage -will 'be used. mainly as heavy
du.ty ,overhaul garage and hot As a service'• station. The build®
ing will be 50 ft.-by 60 •ft. with three 13 ft® doors •on one. side.
There will be pumps, but they. will be used mainly to serV ce •the
equipment being ,worked on The' •property is below. the' grade of1.y.
the railroad and is not suitable .for residential .use. Mr. Griffing
was advised',by the' Planning Board that a decision would be .reached
at this meeting and he would -be advised of their decision •at a
later, date.
Upon motion of Mr. Grebe: ,seconded, by 'Mr.. Young Wand. carried'

RESOLVED that the-L'Planning Board,'recornmend to• the1 Town Board
that the .appleication-of John" J ' Fleming for a. change of zone from
"A" Res idential-Agricultural. 'to QB" Business District be 'granted
on. property bounded and 'described at; follows:. north by'Sound'
Avenue' east by Pacific Street' south by land 'fornierly of Bond

In view of the fact that 'this prope.ty' is surrounded' on three
(3) sides' by "B" Business and,- liC" Industrial property and. is, imme-
diately adjacent, to the railroad which would seed that it should
logically be zoned "Bf Business and 'certainly. would not be 'suited '
for residential ptarposese ,

The Board 'was instructed to prepare 'an official report defining the
co$iditions described in the petition and determine the area so
affected with the recommendation of the Board.
Mr. Reiinselaer G. Terry, Jr."; attorney for the applicant,
appeared before the Board .f.orthe . purpose of, answering questions
the Board mikht .have' Mre Terry.-stated that at the ,time zoning
went into effect .the "B"' 'Business area only gent to' the •property

of the thought of erecting a restaurant on the property. According
to Mr. Terry, ' in view of they'character of. the'. neighborhood ' and 'the '

the Southold Town Beach and .next to the property are the Helmuth
Hass cottages®
After cohsiderable discussion, the Board 'advi~s ed Mr. Terry
thata team of members would have to investigate the property'
before a decision could be-made.. - `They also' 'felt that ,a setback
should be at least double the requirements .because 'of the location
of the proposed new highway. . The Chairman advised Mr. Terry. that .
the Board would like. to have correspondence . n our records with
the owner of the property concerning-his opinion of the setback
requirement and proposed use , of the land.
Mr. Young and Mr. Moisa .were, appointed to look at the prop'
erty, Mr. Grebe having done so .prior -to. this, meeting.
The Secretary was instructed to forward a letter , to Mr.
Rennselaer G.' Terry' Jr statin that the Planning Board looks = .
.favorably upon .the change of zone from 'l."" .Resid.,6ntial-Agricultural
to '"B" Business District and 'is having a team,'of,;-members look' at
the. property. In view of the' fact that the.- Middle Road (County
route 27A), will }?ossibly be widened .by an- 'appreciable amount' . the
Planning Board would strongly recommend that any" buildings be set-
back at least 70 feet From the existing highway line. ' Mr. Wenzel's
reply to -the Boa.rdls. letter. extending' his view. on the matter, and
his intention of probable use of the premises. was requested. .
The minutes of. the meeting of. July. 21 '9 1959, on motion, of ,Mr. .
Grebe, seconded by Mr. Young and carried, were approved as submitted.
The matter o..r' the petition of-Dante' A. .Lortiwas, '.brought 'up.
Mr. Lorti had been in this are,s last week and' had spoken to Mr.
Terry and Mr. Wickham. , Mr. Wickham advised .that_'Mro Lorti had stated
to' him that he Mould be agreeable to a 'change ®f ne from "AllResid-
sntial�Agricultural to "M'" Multiple Residence District, as - the Totm
Board had recommended' rather than from. "A" to '"B'" Business' as Mre
Lorti had originally applied fora
Upon motion of. Mr. Young,, seconded by Mr. Grebe and carried,
it was
RESOLVED that the . resolution of' the Southold Town Board, dated
July 79 1959, be. approved, changing. from "At" Residential-Agricultural
to "'M'" Multiple Residence District the following described' property: '
Property of Dante-K. Lorti, bounded north- by land of John Malinowski,
east by Second- Street, south' by Main Street and west by Third Street;
as well as the entire block within which .said property is .located.
Heretofore .the Board had made a recommendation upon a petition '
of Mr. Dante Lorti to change- kiis` property from "All Residential-Agri-
cxltural ,to "B" Business District: However subsequent to this' the
Board has made 'a further study .and has communicated with Mr. Lorti

and has disco'�ered that Mr. Lorti is contemplating the use of
his property for those uses in an "M" District and M`r. and Mrs.
Lorti have stated to Mr. Wickham that they would prefer an I'M"
District to a ."B" District over their property.
The Planning Board members, along with Mr, Task6r, Mr® Terry
and Mr. Van Tuyl,` read and 6ompared the Bules and Regulations for
the Subdivision of Land. After a thorough study and discussion,
upon motion of Mr. Young, seconded by Mr. Grebe and carried9 it
was
RESOLVED, WHEREAS the Planning Board has given considerable
study on the Rules and Regulations for the Subdivision of Land
within the Town of Southold, and
WHEREAS the Planning Board now desires. to hold a public hear-
ing on the question of adoption of these Rules and Regulations
pursuant to the provisions of the' Town Law, now therefore be it
RESOLVED that the Planning Board''hold a public hearing on
the question ,of the adoption of the said proposed Rules and Reg-
ulations on the 26th day of Auguste 1959, at 8:00 P.M. of said day
at the Town Clerk's Office, Main Road, Southold, New York.
Be it further RESOLVED that the Secretary to the Planning
Board cause the necessary notice to be published in the Suffolk
Times ' the official Town newspaper at least 10 days prior to the
date of said hearing.
The following Legal Notice. was forwarded to the Suffolk Times
for publication on. August 14, 1959:
NOTICE IS HEREBY GIVEN that pursuant to Article 16 of Town
Law, a public hearing will be held .by the Planning Board of the
Town of Southold, Suffolk County' New York, at the Southold Town
Clerk's Office' Main Road, (Route 25) , Southol'd, New York, on the
26th day of August, 1959 at 8:00 o'clock P.M, of said day in the
matter of the adoption of proposed-Rules and Regulations for the
Subdivision of Land in the . Town of Southold. Said proposed Rules
and Regulations may be examined at the Southold Town Clerk's Office.
All interested persons should appear at the time and place.-above
specified.
