Planning Board was held Wednesday, August 26, 1959, 7:55 P.M., at the Town Clerkts Office, Main Road, Southold, New York. There were present: Mr. Archibald Young, Acting Chair- man, Henry Moisa, Alfred Grebe, and William Unkelbach. Also present: Messrs. Howard M. Terry, Building Inspector, Robert W. Tasker, Town. Attorney. .Absent: Messrs. John Wickham, Chairman, and Otto "Van Tuyl, Consulting Engineer. The first matter before the Board was the petition of Henry G. Wenzel, Jr. for a change of zme from ",A." Residential and .Agricultural to "B" Business District on certain real prop- situated at Southold and more particularly bounded and described as follows: Parcel I North by North Road; East by land of Helmut Hass; South by Mill Creek; West by land of William Rich- mond. Parcel II - North by L. I. Sound; East by ToVm of Southold; South by North-Road; and West by land of Dubin* Mr, Young, Acting Chairman, read the letter appearing in Southold. Jr'. giving the':views of .the Planning Board toward the change of..ZMe and requesting, a reply• from Judge Wenze�. extending his views on the matter and his, intention of possible use. of. the ,pr.operty• The reply •from Judge Wenzel was' read stating that the 70 ft., setback .requirement as suggested by the Planning Board seems rather_ sizable in view of the' gore of• that land already deeded. to the County a few -years when the road was straightened and whereas the property is on a hillock sloping up from 'the' road' any building would :probablybe ;erected on the crest of the rise and such a setback would destroy the motels and cottages recently erected east of .him.' Fudge Wenzel 's-tated that his present feeling is that the property would bean ideal location• for a restaurant, summer ,hotel, or both. He advised he would• be at the next re eting of -the Planning Board to, answer any questions the Board might have. MR. RENNSEISAR G.MRRY5 JRQ: Mr. Wenzel is,, present here now. I think it was -your Chairman who wan ted 'to hear from. Judge Wenzel as to what conditions he would be. willing , to accept arid' as to his -intended use. .of the property. . ' I. think that you.'were to have a_ committee inspect the property' and make their recommendations to, night and you .indicated by letter and at the last meeting that you: .. looked favorably upon the application. Judge Wenzel is. here tonight and -agreeable to tell you about the property or anything you wish to know .about it. I' think you are- all _familiar with the area and . know the commercial use of the .location and.-the' fact that it is not desirable for any, use., other than business, ,,and we certainly hope that you will look with. favor . upon the application ,and make some recommendation to the Town Board at this meeting tonight . because of the fact. that time:is going on and .'the. Town Board would, have to hold a public hearing and to do `that they 'would have. to make a .decision at . their next meeting 'as to'.whetlier they would. hold such .public .hearing or not Mr. Grebe asked Judge Wenzel how much land his parcel con tained and Judge Wenzel stated th parcel, on the upland is 225 feet by 510 feet and runs •right; to the'.:c,reeko.' He also. .has, -a smaller , parcel on- the other- side of the road® Judge Wenzel stated' that..the,'County had, taken a ,.wedge shaped piece of property when the road was 'straightened so that there would- be possibly only 500 feet there at the present time. He also stated that 'any ,build. ng. -to be 'buil_t would be on the hill and not below. The history of the' property was discussed with the Boards In answer to the Boards questions, Judge Wenzel stated he doubted if- he would erect - the• building himselfs but hoped;.he: mightAnter into something with someone interested in doing some thing with the property, or he- might, do' it, with one of his sons. Members of '.the Planning Board have inspected the property and Judge .Wenzel has met. with us .at our regular meeting and we feel that. it- is logical .that this be 'zoned 11B" .Business and in view of the fact the property to the Bast is.,Bizsiness 'and the property lying immediately to the- .West is zoned' Residential, but in actuality, is non-conforming, "M" Multiple. Residence, with `cottage rentals. This would in ef_fect' create - a. natural intermediary zone. between the residential property lying. _further to. the westward. When- all of the above has been 'com:plied with - 'and at least fifteen (15) days before a regular -monthly meeting of the Plan- ning Board- the developer or his agent will file with the. Planning Board the finished cloth prints approved by the New York State- Department of Health, together with all other necessary- details required -by the Planning Board When the Planning Board receives this information, the Town Superintendent of Highways will report' to the Planning Board after a field' inspection of the propo's,ed subdivision and, the Planning Board' will compile a final report, which will, include among other things a detailed list of all improvements and con structioh items, also an estimate of the cost of -constructi on; a public hearing shall then be held by the Planning Board pursuant to the'-requirements -of' Section 276 of the.-Town Law. Within 45 days after. the date of ' the public hearing the Planning Board will thereupon .approve 9 modify and approve, or. disapprove such plat. If such plat is disapproved .the' grounds . 'therefore shall :be stated on 'the records of the Planning Board. The report of the Superintendent of Highways ..will also be approved or-disapproved- and included in the Final resolution of, the Planning Board. Each ,subdivision":will be required to indicate an area, of -at least one (1) acre per 100 building lots for such purposes. In cases where-a .subdvision is too small to establish a.: substantial .'site� ,or where the comprehensive plan or good planning judgment would not locate such a .public area, the subdivider will be required to 'provide a. cash equivalent deposited ' to .the account of the Playground and Park Fund ' to .be used in suit- able places for such facilities b.
