PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moira Alfred Grebe Archibald Young William Unkelbach M I N U T E S Southold Town Planning Board November 172 1959 A regular meeting of the Southold Town Planning Board was held 7:30 P.M.- , Tuesday; November 17, 1959, at the Town Clerk Office,Main Road' Southold' New York. There were', present: Messrs. John Wickham, Chairman, Henry Moisa, Alfred Grebe, Archibald Young, and William Unkelbach. Also present: Messrs. Howard M. Terry, Building Inspector, and Otto Van Tuyl,Consulting Engineer. Mr. F. Rogers Ketcham, Halesite, New York, accompanied by his attorney William Wickham, Mattituck, New York, appeared befor e the Planning Board relative. to Mr. Ketchamts appli- cation for a change of zone from "All- Residential and Agricultural to "B" Business District on certain real property situated at Mill Road, Mattituck, New York, and bounded and described as follows: Beginning at a point on the West side of Mattituck Creek about 12001 South of Mill Road, running thence along the Northerly side of property known as Map of Shore Acres (Map #41) on the following six courses and distances: N 77°55'50"W for 248.1 N 83°3�2.6017 110"W for 31.25 = , N 80o27r�;-011W for 56.101 , N 89020126"W for S 78040 t 2011W for 67.34 t , N 87036150w, for 76.59t to a monument; thence - along the - Easterly side of property of Nicholas Chudiak on the following Southold . On May 26.9 1959 Mr. Bruce MacDonald .had- appeared before the Planning ,Board on behalf of this applicant "and. stated that . the. proposal'.was.. to develop the water front as , a boat yard with motel units and cottages on the bluff. At the time the Board advised Mr. MacDonald that they, felt the entire parcel was too. large to. be completely .zoned .11B.11 Business and would be only, willing to consider that portion which -would- be used as the boat yard itself.. Mr. Ketcham stated. to the Board that at that time Mr. . MacDonald 'and two other partners were about .to lease the property from him. However, this. did not. work out for Mr. MacDonald and the 'two 'other .'individuals. and the matter was' dropped® At this' time Mr. Ketcham has engaged, Mr. Edward Zoneski to clear the 'area along the ,water this- winter so that it, will be much 'more presentable than it is no�I, and: he hopes to rent the property for a commercial venture by spring. . He does not feel it could be. developed residentia.11y.� The .Board- agreed with Mr. Ketcham on this point, It was, suggested to Mr. Ketcham and' Mr. Wickham .that the Board felt 200 ft. back . from the beginning 'of- the' bank and along the property' in a . ` reasonably straight line would be the solution. If in the future there were plans for- a .mo-tel something could be worked out at that time. The usu.al .:business -district through the'. Tozm - is 200 ft. on 'the'„street or. water fronts however, that is not a hard- and fast 'ru1e Mr. Van. Tuyl 'stepped forward and briefly sketched out a strip' above the' bank .which might be the area zoned "B". After considerable discussion Mr', Wickha%-- attorne' for Mr. Ketcham, advised ' they would have an`accurate . description of the property desired to be changed to "Bt1 prepared and then amend the application to ,that area.. Southold 'Town Planning Board November l7, 1959 the Planning, Board received a letter from Superintendent of Highways Harold. Price relativeI� to Seawood Acres. " Mr: Price stated that he. does. not.-see how this proposed highway can' be built unless `there is a 70., ft.- right--of-way, namely two 20 ft. roads each side with 1.0 ft. sidewalk. area .and- 10 .ft. center island .reserved ,for. trees.. At this time the Planning Board'' had nothing further" from Mr. Kapp relative .to the letter forwarded to him October 28th advising .:him of the above decision cf the Superintendent of Highways. Thee minute's of ,the .meeting.',of October 27, 1959, on motion of Mr Young, seconde`d'' by Mr' � Grebe, and carried; were approved as corrected. The Planning 'Board, received '.a' letter from 'the Suffolk County Planning Board dated .November 41 1959 transmitting a resolution passed at their meeting on October 29, 1959. The. resolution stated that a .comrAittee consisting of Messrs. Otto We Van Tuyll' Me, S�cud6er Griffing, and Charles P. McFadden had made a study. of the property on Fishers Island presently owned by Southold "Town and after considerable study and personal inspec� tion by the committee the Suffolk , County.' Planning Board recommends that the site by retained in its present status of public owner- ship 'by the Town of Southold' for' the use, enjoyment and development by said Town of Southold." On motion of Mr. -Unkelbachl' seconded' by Mr. Moisa, and carried, it was RESOLVED that a letter be forwarded .to 'the. Fishers Island Civic Association advising of the resolution passed by the Suffolk County Planning. Board and stating that in view of the. fact the Planning .Board has recommended to the Town Board of Southold in tiriies past that a, park district might be- set up'„ to operate the 'areal' but such plan_ h'as �not received favorable . consideration, it would seem that -a solution might, be for .ownership of, this. property to remain with the Town of Southold but operation under co4tract ar agreement might lie by the Fishers T"eland Civie' Association or some other -agency. t was pointed out the public beach involves the responsibility-!fora life guard or life guards both as to maintaining the services .and paying for 'it and in all probability. the Town would .expect the operating agency to carry-public-,;liability. The letter further stated that the Planning Board would, b.e .willing to recommend such an . arrangement -to .the .Town Board if the Civic Association felt it were feasible and they or some other responsible agency would be-willing to undertake, it. . It -was further suggested that before final decisions are reached - on this matter the Town Attorney should be.. called- in to make sure the arrangements are in order. A letter was also forwarded to the Southold Town Board transmitting . a copy of the Suffolk,C ounty Planning ,Board Ts Southold .Town Planning Board, November. 17, .1959 resolution and advising. we are pursuing ,this mat ter' further with the people ,of the Fishers Island Civic .Association . and ' will make.. our ,recommendat.ion based on �our findings at a..later date The Chairman advised the members of the Planning Board of the death. of Mr., John M. .Muddeman. and 'read the letter he had 'instructed the secretary to write to' Mrs. Muddeman extend ing the sympathy and understanding. of- the Planning Board of Southold .Town. ' 'The Planning Board received• a letter from the Suffolk ._ County 'Planning Board forWarding a copy of. regulations of the Suffolk County.•Department of Health pertaining to Criteria for the Determination of Adequate Satisfactory Water Supply Facilities .in Realty Subdivisions. Also received by the. Board from the Health Department were new tentative regulations on individual water supply systems, dated October 229 1959. All of- ,the abovementioried data was' ordered filed for` ready reference in the future. A letter was received from .the Southold Tovm Clerk trans witting the petition of Janet. David,, Peconic, . New York relative to a change . of zone from ."A" Rej.idential and Agricultural property to "B" Business District! _.cettain real property situated at. Peconic, - Ne' w..Yo-r'k, and more particularly bounded 'and described as follows: Northerly by. the North Road, _Fasterly by Carroll Avenue, Southerly by lard. formerly of Josiah. C. . Case now of .Hairston and Westerly partly by land now of Alexandra Wolosik and partly by land formerly of Turner, Map of- land of .Janet.David, at Peconic by .Otto W. Van Tuyl & Son dated ,November 2, 1959a It was the determination, of the Board that -a. team of members would 'investigate the property and make, their, report -at the next meeting of the Planning Board. The Planning Board also received petition of Jean Fenmore, Naugles Drive,,, Mattituck, N,ew York, from the Town Clerk and . was instructed to.' prepare 'an' official report defining the conditions -descr.ibed' in the petition 'and determine the area so affected with the' recommendatibn of this Board. Request is for a change of zone from non-conforming- "A" Residential and Agricultural District to "C" Industrial District, certain real property situated, at Mattituck Inlet and more particularly bounded .and described as follows: Bounded on the East' by .property of DeWulf approximately 447 ft. ; then. on the South by .land of. Fentore., Ayeardi and Naugles Drive approximately- 350 ft.,; then on. the West by. a right®of'�way and land of P. Vigne's 'a distance of• approximately -470 ft., to Mattituck Inlet, running along Mattituck Inlet approximately 300 ft. 'Board decided that a' team of members should investigate the property ,and make, :a report at, the next Planning Board meet- _ ing, and also a .letter`, should-1 be -forwarded. to Mr. Thomas H. DeWu3f, . 36-3,7 Union Street', Flushing, New York advising of the request .for' 'a change of zone from non-.conforming "A" Residence and Agricultural to ."C" 'Industrial by, Jean Fenmore whose property is . ad jacent to Mr'.. DeWulf is property-': and stating 'that ' the Naugles property on the other' side has already been rezoned to "B" Business. District.' The letter 'goes on to say that the Planning. Board feels. it is poor policy to have a residential area sandwiched be tie en "B" Business and "C!' Industrial use zones and we would like to .know Mr® DeWul.f t s :reaction to the application of Mr. Fenmore and further if he would be inclined to having the Town Board, on its own. motion, rezone the .entire area, including his, "C" Industrial District. Mr. Va_n Tuyl presented to the Board the preliminary map of Subdivision of Meadow P'oint ,Properties, Inc. at Bayview, Southold; New York. It was requested' that the 'Planning Board give pre- liminary approval to this map -so that the owners may go ahead and have the land cleared` 'and roads pushed through. On. ,motion of . Mr. Grebe, seconded .by Mr. Young, and 'carried, it was RFSOLvED' that the -Planning-Board grant .preliminary approval subject to Meadow Point "Properties-7- Inc.. 'filing a map in the' County Clerk's office in accordance , with filing regulations, showing' grade and roads., etc; The next meeting of .the Southold Town Planning Board will. be held Tuesday) Deeember. 157 1959' 7:30 P.M. , at the Town Clerk• Office,Main Road, Southold,` New York. Mr. Wickham presented to. the .Board a copy of a report from the Suffolk County Planning Board and the. "Official HightTay' Map.." The "Official Highway Map" was , a.dopted .by. the Board of Supervisors_:by. resolution. on April 27., 1936 and the report is a request . to the .County Attorney asking for- clarification on the status of the "Official Highway Map" under Section 115 of the Highway Law and the "Official Map" under section 239k of the General Municipal Law.. The report of the County Attorney is-.also enclosed with the letter from the Suffolk County ' Planning Board. After examining the map. itwas. ordered filed for, ready' reference. in the future. Mr. Grebe• broug'ht before the Board . the Fort H.. G. Wright Post Map and stated., that -there is .tentative- •plan.,,to zone this property. The .Plan is to zone the aviation field section up to a geodetic• marker .on the south side of Whistler Avenue as r Southold Town 'Planning Board -6- Novembdr 17, 1959 "B" Business Districts. From there southerly to Block Island ,Sound, the line intended to clear the runway on the west and existing buildings on the east7 this area known as Parade 'T ounds , with existing buildings' structures , roadways , etc. easterly along southerly side of Nhistler. Avenue to a point approximately 10 ft. west of the theatre: building, running thence southerly approximately parallel to the westerly line of said area to Block Island Sound -to be "A" Residential and Agricultural. District. The balance of the property easterly from said point on Whsterly side of theatre and southerly side of Whistler Avenue and bounded on the, generally southeasterly direction by South. Beach Road to Block Island Sound, -this area with existing buildings, roads9 etc. , to be zoned "B" .Business Distri t® Mr. Grebe stated that the Race Point Association had a meeting scheduled in New York City on November. 18th to decide how they would like the portion they purchsed from the government on the ncr th side of Whistler Avenue to be zoned. At the next meeting of the Planning Board, when the decision of the Race Point Association is known9the Planning Board will make their recommendation to the Southold Town Board. ' The Planning Board received a letter and map from A. C. Construction Co. 9 Fishers Island, New York relative to their plan to purchase the remaining lots on a tract of land known as -he Peninsula at Fishers Island, New York. They wished to know what their responsibility would be to the present owners (other than Fishers Island Estates) in regard to the lots; what :,heir status would be and .would they be considered at a. developer of property and be ' responsible for utilities, etc. A letter was ordered forwarded to Mt. Albert Chaplaski, Proprietor, .A. C. Construction Co® 9 stating that in answer to his questions, he will not be responsible for utilities and paving of roads as long as they are maintained in a passable condition with at least 18 ft. cleared. We do consider him a developer and. he will have to comply with Southold Town Build- ing Zone requirements which call for building lots of 12,500 sq. ft. per lot with at least 100 ft. frontage on an approved access® This is believed to be the Planning Board 's interpretation of Mr® Chaplaski's questions and it was suggested he consult with an attorney_ before any definite decision to purchase and further develop this property is reached.
