PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William Unkelbach M I N U T E S Southold Tom Planning Board December 159 1959 A regular meeting of the Southold To-vm 'Planning Board was held 7:30 P.M. , Tuesday , December 157 1959 at the Town Clerk Office, Main Road, Southold, New York. There were present: Messrs. Archibald Young, Acting Chairman, Henry Moisa, Alfred Grebe and 'William Unkelbach. Also present: Messrs. Howard M. Terry, Building Inspector, and Otto Van Tuyl, Consulting Engineer. Absent: Mr. John Wickham. On motion of Mr. Grebe, seconded by Mr. Moisa and carried, it was RESOLVED that Mr. Young act as Chairman at this meeting in the absence of Mr. Wickham. Mr. Costas Stars, East Marion, New York, appeared before the Planning Board seeking approval to cut a 50 ft. road through his property from the north up to lots 11 and 50. Mr. Stars asked for tentative approval of the map on file in order that he might start cutting the roads at this time. Southold Town Planning Board December 15, 1959 On motion of Mr. Grebe, seconded by Mr. Unkelbach and carried, it was RESOLVED that the Planning Board recommend to Mr. Stars that he have the map redrawn showing the exact location and width of the proposed road and submit same at the next regular meeting of the Board. On motion of Mr. Grebe, seconded by Mr. Unkelbach and carried, the minutes of the Meeting of November 17, 1959, were approved as submitted. Mr. Grebe reported that the Race Point Association wished the matter of the zoning of Fort H. G. Wright property held over until further notice. The Planning Board received a letter from William Wickham, Esq® stating that they wished to withdraw the application of Janet David for a change of zone on the David property at Peconic, New York: On motion of Mr. Moisa, seconded by Mr. Grebe and carried, it was RESOLVED that the Planning Board recommend to the Town Board that the $25.00 fee be returned to Mr. Wickham as there has been no action taken on this matter. Upon m by Mr. Unkelbach and carried, it was RESOLVED that Mr. Terry be commended for his excellent and informative report of the proceedings. It was further RESOLVED by Mr. Unkelbach and seconded by - Mr. Grebe that a letter be forwarded to -Mr. Joseph P. Plonski, Chairman of the Zoning Board 'gonvention, stating that the Planning Board members vjhO attended the Zoning Convention at Patchogue, New York on December 51 1959 wished to extend their congratulations on an extremely well organized meeting. Our members gained a great deal from it . They wished, however, to submit one constructive criticism. It is felt that greater stress should be placed upon the Planning Boards attendance, as a lot of constructive work can be done prior to cases going before the Board of Appeals. The Planning Board received ,notification from the Town Southold Town Planning Board -3- December 15, 1959 Board that the petition of Arlin DeGuimaraes for a change of zone from "A" Residential and Agricultural District to "B" Business District was granted effective December 19, 1959• Notification was also received that the. petition of Henry G. Wenzel, Jr. , for a change of zone from "A" Residential and Agricultural property to "B" Business District was granted on Parcel No. l on the south side of County Highway 27A effective December 19, 1959. A letter was received from the Suffolk County Planning Board transmitting a copy of a resolution adopted by the Suffolk County Board of supervisors on November 30, 1959 which establishes the "Official Highway Map" (adopted April 27, 1936 under Section 320-b of the Highway Law)' as the "Official County Map" under Section 239h of the General Municipal Law. This letter and resolution was ordered filed with the outline and report received by the Planning Board dated September 11, 1959• The Planning Board was advised by the Building Inspector that the Petition, No. 64, of Angelos and Evelyn Kalimtgis upon which the Board made a recommendation October 6,1959, has been referred back to the applicant Upon motion of the Town Board, with instructions to amend the application giving the corrected Igal description of the lot and indicating whether Mr. Kalimtgis actually owns same or h s it under contract. It is believed the application will again go before the Town Board on December 30th. The matter of the petition of Walter C. Grabie for an Open Development Area was again brought before the Board. Mr. Grabie had submitted a petition to the Planning Board and it was sign by 9 individuals who are owners of real property at Luptonts Point, Mattituck,New York. The petition states in part as follows: "Our properties front on a twenty (20) foot private road extending from Deep Hole Creek to Marratooka Road. This road or X right of way was granted to all lot owners who purchased from the Lupton family, the developers. We are satisfied with the width of this roadway and do not wish to have it enlarged since that would mean the elimination of a number of fine shade trees; the acceleration of speed of traffic on the road; the greater expense in maintenance. It would also tend to open up the Point to trespassers and others having no acceptable reason for using the roadway. We therefore petition the Town Board of Southold Town and the Town Planning Board to allow the roadway to remain in its present size." The Board again examined the map appear- in the file and the facts in the matter. It was felt that Mr. Grabie has made a reasonable effort and did the best he could. a Southold Town Planning Board -4- December 15, 1959 On motion of Mr. Unkelbach, seconded by Mr. Grebe and carried, it was RESOLVED that a letter be forwarded to Mr. Grabie request- ing that he 'be present at the next meeting of the Planning Board and in the meantime endeavor to secure the other three signatures he indicates are lacking from the petition. It was also RESOLVED that a letter be forwarded to Robert W. Tasker, Esq. , Town Attorney, requesting that he also be present at the next meeting. The Board was advised by -the secretary that Mr. John Wickham had asked that they think seriously about, and be prepared to discuss at the next meeting, the matter of- a possible amendment to the Zoning Ordinance, Article V, Section 503 which states as follows: " 1C4 FRONT YARD--In the "C" Industrial District, • the required front yard shall be at least thirty (30) feet, provided further that where property is bounded on any side by a railroad right-of-way or on a rear line by a .railroad right-of-way, there shall be a setback along the entire length of such railroad right-of-way or private right-of-way of at least thirty (30) feet." Mr. Wickham feels 'that a building should be permitted to be erected so as to take advantage of a railroad siding and need not conforming to the setback provisions in that regard. The matter of the petition of Jean Fenmore for a change of zone from "All Residential and Agricultural District to "C" Industrial District was again brought up. Mr. Young reported that he had visited this property in the company of N1r. Wickham. Mr. Wickham advised the secretary that he had been told by 1,1r. Silkworth that Mr. Thomas DeWulf had been in touch with him and stated he would be agreeable to this change of zone including his own property. After further discussion and consideration it was moved by Mr. Grebe, seconded by Mr. Unkelbach and carried, 'that the Planning Board recommend to the Town Board that the change of zone from "All Residential and Agricultural District to "C" Industrial District be made on the property of Jean Fenmore and on the property of Thomas H. DeWulf on the Town Board's own motion. The entire parcel recommended for change to "C" Industrial District is described as follows: Beginning at a point on the northerly line of Naugles Drive at the southeasterly corner of the existing "C" Industrial Zone and running thence along said "C" Industrial Zone northerly about 200 feet, then easterly Southold Town Planning Board «-5' December 15, 1959 about 400 feet, then northerly about 200 feet to Mattituck' Creek; thence easterly along said Mattituck Creek about 250 feet to the northwesterly corner of the existing "B" Business Zone; thence along said existing "B" Business Zone southerly about 310 feet, then westerly about 60 feet, then southerly about 431 feet to the northerly line of said Naugles Drive; thence westerly along said line of Naugles Drive about 650 feet to the point of beginning. -legal description by Otto Van Tuyl & Son dated December 16, 1959• The Planning Board members have visited this property and are thoroughly familiar with it. This property is between other "C" Industrial property owned by Mr. Fenmore and next to Mr. DeWulf e s ,property which adjoins a "B" Business District. It is felt by the Planning Board that by zoning these properties "C" Industrial it will be the best use of this land with the future development of the area in mind. The petition of,Lillian M. Brush-,, 57.:Woodhull Road, Huntington, New York, for a change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District was received from the Town Board with instructions to prepare an official report defining the conditions described in the petition and determine the area so affected with the recommendation of the Board. After considerable discussion, it was- moved by Mr. Moisa' seconded by Mr. Unkelbach and carried' that the Planning Board recommend to the Town Board the change of zone from "A" Res- idential and Agricultural District to "M" Multiple Residence District on certain real property situated at Orient, New York, and more particularly bounded and described as follows: Begin- ning at a monument at the intersection of the Westerly line of Main Street with the southerly line of the Main Road; from said point of beginning running along said Westerly line of Main Street, South -14 degrees 30 minutes east 94.42 feet to a monument; thence along land now or formerly of Cor coran, 2 courses as follows: (1) North 63 degrees 20 minutes West m 70.0 feet; thence (2) South 26 degrees 14 minutes West - 57.0 feet to land now or formerly of Hale; thence along said .land now or formerly of Hale, 3 c ouxm s, as follows: (1) North 63 degrees 20 minutes West -- 51.62 feet; thence (2) South 26 degrees 49 minutes West - 28.02 feet; thence (3) North 80 degrees 18 minutes West - 20.93 feet to an iron pipe; thence along land of the party of the first part, North 21 degrees 45 minutes East - 130.54 feet to an iron pipe on said southerly line of the Main Road;. thence along said southerly line of the Main Road, 2 courses as follows: (1) South 82 degrees 02 minutes East - 25.57 feet to a monument, thence Southold Town Planning Board -6- December 15, 1959 (2) South 83 degrees 15 minutes Bast 70.31 feet to the point of beginning. There is only a 50 ft. lot between this property and a "B" Business District on the west, and there are other non-conforming "M" Multiple Residences in the area. In the matter of the petition of Frederick R. Ketcham for a change of zone from 'IA" Residential and Agricultural District to "B" Business District was again reviewed. As a result of the last Planning Board meeting, at which time Mr. Frederick R. Ketcham and his attorney William Wickham were present, the Board received a letter from Mr. Wickham transmitting an amended Segal description of the property in question. Finding the description in order and covering the area agreeable to the Planning Board, on motion of Mr. Unkelbach, seconded by Mr. Grebe and carried, it was RESOLVED that the Planning Board recommend to the Town Board that the petition of Frederick R. Ketcham for a change of zone from "A" Residential and Agricultural District to "B" Business District on certain real property situated at Mill Road, Mattituck, New York, be approved. The property is more particularly bounded and described as follows: Beginning at a monument on the southerly line of Mill Road at the north- . westerly corner of land of the applicant and the northeasterly corner of land of Maurice Galburt; from said point of begin- ning running along said southerly line of Mill Road, 3 courses , as follows: o (1) N. 730 521 30" E. -39.22 feet; thence (2) �. 82 O1: 1011 E. -138.46 -feet; thence (3 ) S. 550 23 ' E. -77.64 feet to the existing "B" Gone; thence along said existing "B" zone 2 coures as follows: (1)zone, 140 OOT E. ^-400.0 feet; thence (2) S. &0 001 E- 150 feet, more -or less, to Mattituck Creek; thence southerly along said Mattituck Creek, 1000 feet, more or less, to the northerly line of Lot P as shown on I"Map of Shore Acres", filed in the Suffolk County Clerk's Office as Map N. 41; thence westerly along said Lot P. 300 feet, more or less; thence 'thru land of the applicant, 3 coureses, as follows: (1) N. 110 501 E. 720 feet, more or less; thence (2) N. 80 151 W. 435 feet; thence (3 ) N. 530 231 W. a-165 feet Southold Town. Ketcham) December 61 1959• The Planning Board has visited this property and feel that since the area has been used for nothing but business and is bounded on the northeast corner by "B'1 Business, and all four corners of the intersection of Mill Road and Mattituck Creek where the old bridge was removed is zoned "B" Business, this would be an enlargement or extension of the present "B" Business District. Further) the Planning Board is of the opinion that some business: development of the waterfront is in the best interests of the Town of Southold. The next meeting of the Southold Town Planning Board will be held Monday, January-111 1959, 7:30 P.M., at the Town Clerk Office, Main road, Southold, New York. Mr. Terry advised the Planning Board that the Suffolk County Highway Department required a 50 ft. setback on a new house to be built on the south side of Route 27A. On the Molin Motel to be built on the north side of Route 27A Greenport- there will be a 100 ft. setback as desired by the applicant, and a $300 bond is required to make the connection to the highway. A brief discussion was held relative to house numbers for Southold Town. The Planning Board received an application for approval of plat from Harry E. Mason. Applicants being William M. Beebe, Estate of William H. Mason and Harry E. Mason. The name of the subdivision is to be "Moose Covell and contains 302 acres, at Cutchogue, New York, in the "A" Residential and Agricultural District. Mr. Van Tuyl presented a preliminary map of "Moose Cove" at Little Neck, East Cutchogue, New York for preliminary approval of the roads by the Board so that the applicants may cut roads through and build one or two houses. Application fee due on this petition is $65.50. The property is bounded and described as follows: Beginning at a point on the westerly line of Little Neck Road 1529 feet, more or less, southerly along said westerly line from Eugene 's Southold Town Planning Board -8- December 15, 1959 Road, said point of beginning being the southeasterly corner of land of the party of the first part and the northeasterly corner of land of Zeneski; from said point of beginning, running along said land of Zeneski and along land of John Beebe, South 77 degrees 27 minutes 40 seconds West, 890.88 feet to an ix)n pipe; thence along said land of Beebe, South 76 degrees 43 minutes 40 seconds West, 309.3 feet to the Shore of Eugene 's Creek; thence along said shore of Eugene 's Creek, northerly-and then westerly and then .gain northerly about 1300 feet to a point North 26 degrees 48 minutes 50 seconds West, 1159.61 feet from the last described point and being land now or formerly of Ball; thence along said land now or formerly of Ball, North 27 degrees 03 minutes East �40.0 feet to a stake and land of Ralph Sterling Estate; thence along said land of Sterling Estate, 9 courses as follows: (1) South 58 degrees 17 minutes 20 --zeconds East, 85.46 feet to a stake; thence (2) North 59 degrees 52 minutes 40 seconds East, 76.56 feet to an iron pipe; thence (3) North 13 degrees 15 minutes 40 seconds East 149.50 feet to an iron pipe; thence (4) North 88 degrees 34 minutes East 40.0 feet to an iron pipe; thence C5) South 6 degrees 19 minutes West, 78#64 feet to a stake; thence (6) North. 82 degrees 37 minutes 40 seconds East, 61.37 feet to an iron pipe; thence (7) North 33 degrees 23 minutes 10 seconds East, 129.64 feet to an iron pipe; thence (8) North 13 degrees 47 minutes 10 seconds East, 136.63 feet to an irpn pipe; thence (9) North 12 degrees 51 minutes 50 seconds West, 70.0 feet to an iron pipe on the southerly line of said Eugene,ts Road; thence along said southerly line of Eugenets Road, 2 courses - as follows: (1) North 77 degrees 08 minutes 10 seconds East, 426®30 feet; (2) North 76 degrees 50 minutes 30 seconds East 52.19 feet; thence along land of the party of the first part, 4 courses, as follows: (1) South 40 degrees 45 minutes 30 seconds East, 126.75 feet to an iron pipe; thence (2) South 10 degrees 45 minutes 10 seconds East, 469.06 feet to an iron pipe; thence (3) South 13 degrees 09 minutes 40 seconds East 908,49 feet; thence (4) North 77 degrees 27 minutes 40 seconds East, 43 5.37 feet to said westerly line of Little Neck Road; thence along laid westerly line of Little Neck Road, South 12 degrees 53 minutes 30 seconds East, 35.0 feet to the point of beginning. Together with all the right, title and - interest of the party of the first part of, in and to land under water of Eugene Creek adjacent to said premises. Southold Town Planning Board V%9a December 157 1959 -On-motion of Mr. Moisa, seconded by Mr. Grebe, and carried, it was RESOLVED that the Planning Board grant preliminary approval to the preliminary map of Moose Cove subject to the applicants filing a map in the County Clerk's Office in accordance with the Rules and Regulations for the Subdivision of Land. On motion of Mr. Unkelbach, seconded by Mr. Moisa and carried it was agreed by the members of the Planning Board that Mr. Young be authorized to approve for submission to the Southold Town Board the Planning Board 's annual report.
