Southold Town Planning Board
January 6, 1959
A regular meeting of the Southold Town Planning Board was
held on January 6, 1959 at 7:30 P.M. at the Town Clerk's Office,
Southold, New York.
Present were: Messrs. John Wickham, Chairman, Harold R.
Reeve, and Archibald Young.
Also present: Mr. Howard M. Terry, Building Inspector and
Otto W. Van Tuyl.
Mr. Walter C. Grabie appeared before the Board and requested
the decision of the Board relative to his establishing an Open
Development Area on property located on Deep Hole Creek, known as
Lupton' s Point, Mattituck, New York, and described in report of
December 16, 1958 meeting of the Planning Board. After consider-
able discussion the Board advised Mr. Grabie they would hold the
matter for further discussion. The Planning Board feels Mr. Grabie
has two alternatives which are as. follows: 1.- It might be more
practical for him to go before the Board of Appeals and request a
variance for each lot as now projected when they are sold, or 2.-
Redraw the map making four lots out of the five, numbers 20 to 24
inclusive, in which case the Planning Board would be happy to
recommend their approval. Secretary was instructed to write Mr.
Grabie to this effect.
A communication was received from William Wells stating he
intends reserving the fee and right of dedication to the roads and

approximately 140 feet of beach at Bay Haven at Southold, as islet
forth in the deed. A communication was also received from Harold
Price, Superintendent of Highways, stating he has inspected the roads
at Bay Haven & Terry Waters and has found them passable for limited
access. I Wells appeared in the company of Mr. Kapp and answered
questions posed by the Board.
A communication was received from Alex Jaeger, County Clerk,
relative to approval of filing of map of Terry Waters.
On motion of IvLr. Reeve, seconded by NIr. Young and unanimously
carried, it was
RESOLVED, that the Planning Board recommend final approval of
the Subdivision Map of Bay Haven at Southold owned by William Wells
of Southold. Map by Otto W. Van Tuyl & S'on from surveys dated
December 10, 1958, approved by Suffolk County Department of Health
on December 17, 1958•
A letter was received from Valentine Ruch IV to the Board re-
questing the following alternate to be included in his petition -
"to . . rezone . . parcels lying north of a line 400 feet south of the
North Road and parallel hereto. " Mr. Ruch's letter stated his
reasons for requesting above are twofold: "a deep depression in the
farm land originates at the North Road and runs back into the farm
nearly 300 feet; and the westerly line would, if 400 feet deep,
reach all of my frontage on Mill Creek."
After considerable discussion relative to rezoning this property
from p? esent category to I'M" district,
On motion of Mr. Young, seconded by Mr. Reeve and unanimously
carried, it was
RESOLVED, that the following recommendation be made to the Town
Board: that the change from "A" Residential & Agricultural to "M"
Multiple Residence District be made on the property included in the
legal description by Otto W. Van Tuyl & Son dated October 27, 1958.
"The Planning Board has visited this property and found there is
a very deep hole in the center and it will need tku 400 foot depth if
very much grading is to be done. Also, this property lies between
the "B" Business zone of Teves on the east and the "B" Business zone
of Haas on the west. We further think that there is no necessity for
widening the established private road because this is all built up
and will probably not be extended. Any further development will
probably have its own separate access. "
The annual report of the Building Inspector was received and
read by the Chairman. The report showed total money received for
1958 - $4248.46, with same amount being paid over to the Supervisor.
Supplemental report shows that the Building Inspector had met

regularly with the Board of Appeals and the Planning Board. It also
stated permits covering buildings estimated at a total of $2290,036.00
were issued.
On motion of Mr. Reeve, seconded by Mr. Young and unanimously
carried the Board commended I�1r. Terry, Building Inspector, for his
outstanding work during the past year.
The Board held off the record discussion relative to a
suggested amendment to the Zoning Ordinance pertaining to migrant
camps.
The Clerk read the minutes of the December 16, 1958 meetirg .
On motion cf KL Young, se6onded by Mr. Reeve and unanimously carried
the minutes were approved.
The next- meeting of the Southold Town Planning Board will be
held on January 27, 1959 at 7:30 P.M. at the Town Clerk' s Office ,
Southold, New York.
Meeting adjourned at 10:00 P.M.
