Reeve Henry Moisa Alfred Grebe MINUTES Archibald Young Southold Town Planning Board October 14, 1958 A joint meeting of the Town Board, Planning Board and Board of Appeals of the Town of Southold was held at the Town Clerk's Office, Main Road, Southold, New York, at 7:30 P.M., Tuesday, October 14-# 1958. There were present: Members of the Planning Board: John Wickham, Chairman Presiding Harold R. Reeve Alfred Grebe Archibald Young Members of the Board of Appeals: Robert W. Gillispie, Jr., Chairman Robert Bergen Herbert Rosenberg Charles Grigonis, Jr. Serge Doyen, Jr. Members of the Town Board: Lester M. Albertson Ralph W. Moisa Henry Clark .-2- Southold Town Planning Board October 14, 1958 MINUTES, Continued Mr. John Wickham, presiding chairman, called the meeting to order and stated that the meeting was called at the request of the Planning Board primarily to have a joint discussion by all interested parties to the proposed amendments to the Zoning Ordinance. He then asked Mr. Gillispie, Chairman of the Board of Appeals, to present the matters. Mr. Gillispie stated that the following amendments had been proposed in the interest of clarity: 1. By amending ARTICLE I, Section 100, by adding thereto a new paragraph: 9A - FAMILY - One or more persons occupying premises as a single housekeeping unit. 2. By amending ARTICLE VII by adding thereto a new section to be section 703B — CERTIFICATE OF OCCUPANCY - (a) It shall be unlawful to use or permit the use of any building or premises or part thereof, hereafter created, erected, changed, converted or enlarged, wholly or partly, in its use° of structure until a Certificate of Occupancy shall have been issued by the Building Inspector. Such certificate shall indicate that such building or premises or part thereof and the proposed use thereof are in conformity with the provisions of the Ordinance. (b) Under such rules and regulations as may be established by the Board of Appeals a temporary Certificate of Occupancy for a part of any building or premises may be issued by the.Building Inspector. (c) Upon written request from the owner or occupant the Building Inspector shall issue a Certificate of Occupancy for any existing lawful use and occupancy of a building or premises. 3. By amending ARTICLE X by adding thereto a new section to be section 10001 - A lot, as defined in this Ordinance, may be sub-divided provided that each resulting lot and all structures thereon comply with the provisions of the Ordinance. On motion duly made by Mr. Reeve, seconded by Mr. Grebe, and carried, it was RESOLVED, That amendments 1 and 2 be recommended to the Town Board for approval. RESOLVED FURTHER, That amendment 3 is not to be recommended for approval as the Planning Board feels that the spirit of the Ordinance will be fulf.ialldd without an additional amendment. ..3_ Southold Town Planning Board October 14, 1958 MINU97,S, Continued Discussion was held regarding accessory buildings, such as potato storage houses; primarily the size and height of such structures. On motion made by Mr. Reeve, seconded by Mr. Grebe, and carried, it was RESOLVED, That such accessory buildings be handled by the Board of Appeals under the guise-of a variance. The joint meeting of the three boards then adjourned. The Planning Board proceeded with their regular meeting. Petition of Edwin H. King of Orient, New York, for a change of zone on certain real property situated at East Marion, Long Island, and more particularly bounded and described as follows, was reviewed: Approximately 14.91 on the north bounded by land of Guimaraes, 516' on the east bounded by land of Irving Latham, 14-1' on the south bounded by land of Irving Latham and 500' on the west bounded by land of the petitioner, Edwin H. King. It was the determination of the Planning Board that they would look favorably on the request for a change from °A° Residential and Agricultural to °C" Industrial and it is the understanding of the Board that petitioner wishes to put in a gravel screening pit. It was therefore, on motion made by Mr. Grebe, seconded by Mr. Young, and carried, RESOLVED, That the Planning Board recommends to the Town Board approval of this change of zone. Mr. Walter G. Kapp, attorney for Mr. Wells, presented a revised preliminary plat of the sub-division of Mr. William Wells, known as Bay Haven At ;:Southold, located at Bay View, Southold, N. Y., a revised map by 0. W. VanTuyl dated September 30. 1958. Mr. Kapp said they were asking for preliminary approval at this time and when final approval was requested they would present copies of the deed and all other necessary papers. Mr. Kapp'stated that Mr. Price, the Supt. of Highways, indicated he was satisfied with the roads and the drainage system. The Chairman then directed the Clerk to write Yx. Price asking for a brief statement as to whether he considered the highways in acceptable condition. The Chairman asked Mr. Kapp for a letter of intent regarding the 140' on the Bay which will be available for future dedication in case the highways are dedicated to the Town of Southold and Mr. Kapp replied that a letter of intent would be furnished at the time of final approval. On motion made by Mr. Grebe, seconded by Mr. Reeve, and carried, preliminary approval of Revised map by O. W. VanTuyl, dated September 30, 1958, was noted and it was RESOLVED, That preliminary approval be given to this plat. -4- Southold Tovm Planning Board October 14- 1958 MINUTES, Continued _ On motion made by Mr. Reeve, seconded by Mr. Young, and carried, it was RESOLVED, That the Planning Board recommend to the Town Board- that Mr. Alfred Grebe, member of the Board from Fishers Island, be reimbursed for his meals and any other out of pocket expenses in connection with his attendance at meetings of the board. Petition of Arnold S. Sacks, Ma.ttituck, New York , for a change of zone from "A" Residential and Agricultural to "B" Business districtwas studied. Property in question located on Sound Avenue, Mattituck, N. Y. Mr. Young in company with Mr. Grebe or Mr. Wickham will investigate the property and make their report at the next meeting and it is suggested the the Papish property and the Sepko property be included in a single business area. A proposed division of land of William T. King, dated September 262 1958, was presented to the Board.. The Clerk was directed to write Mr. King at Lake Park, Florida, advising that the Board is not willing to recommend approval of anything less than the minimum size lots at this time. A pteliminary plan of property of Robert H. Preston at Sandy Beach near Greenport, New York, dated October 7, 1958, was studied and the Clerk was directed to write Mr. Preston advising that. the Board is not willing to recommend 50' lots at this time and suggesting that Mr. Preston apply to the Southold Town Board of Appeals on each undersized lot. The next regular meeting of the Board is to be held at 7:30 P.M. on November 18, 1958, at the Town Clerk's Office, Southold, New York. Meeting adjourned at 11:15 P.M.
