A regular meeting of the Southold Town'Planning Board was held at the office
in Greenport at 4 P.M. on Tuesday, August 6, 1957.
There were present: Mr. Wickham; Chairman, Mr. Van Duzer, Mr. Grebe & Mr. Moisa.
Also present: Mr. Klipp, Town Supervisor, Mr. Terry, Building Inspector,
Mr. Price, 'Supt. of Highways, Mr. Rosenberg and Mr. Gillispie, members of the Board
Of Appeals, and Mr. Otto W. Van Tuyl.

Mr. Russell Broach, Vice—President and Mr. Harold E. R ussel, Secretary of
the corporation known.as "Cove Beach Estates, Inc. ", representing Mr. Otto Uhl, Jr. ,
President, stated that it liras their understanding that the board was not trilling to
recommend zoning the 85 acres of "Cove-Beach Estates" as !IBIT Business and they,
appreciated the reasoning for this action. They stated .that they were primarily
interested in getting approval of the 851 on the highway and 2001 back from the
highway as nBn Business in order that. they might use this parcel of the land as
an appropriate entrance to the development. The remainder of the road would remain
"All zone. They would also like a certain portion of the 85 acres to be zoned nBu
in order that they may develop that certain portion as a Motel and Restaurant site.
The Board advised that a new sketch be made of the property in question,
located on the north side of the Main Road in East Marion, showing in detail the.
areas they wish to change to 11811 zone and after this is done the Board would then
make their recommendation to the Town Board.
The Chairman then asked Mr. Gillispie to read his letter of August 1, 1957,
addressed to the Southold Planning Board, regarding the Board of Appeals sugges—
tions for the improvement of the Zoning Ordinance.
On motion made by Mr. Van Duzer and seconded by Mr. Moisa, it was unanimously
RESOLVED, That the Southold Town Planning Board recommend to the Southold Town
Board that the following be incorporated in the Building Zone Ordinance:
NON—CONFORMING USES:
Unsafe structures -- Any structure or portion thereof declared unsafe
by a proper authority may be restored to a safe condition.

Alterations --- A non—conforming building may not be reconstructed or
structurally altered during. its life to an extent exceeding in aggregate
cost. 50% of the assessed value of the Building unless said building is
changed to a conforming use.
Restoration -- No building damaged by fire or other causes to an extent
of more than 75p of its assessed value shall be repaired or rebuilt
except in conformity with the provisions of this Ordinance without
special exception granted by the Board of Appeals.
SIGNS;
We are definitely of the opinion that some provision should be made for the
location of business signs, other than in the Business Districts, which are
very few in number and area. The Planning Board might designate appropriate
areas for the location of additional business signs. The business people
of the Town are greatly interested in advertising in order to properly
conduct their activities. For example; it would not be readily possible to
locate business signs between Greenport and Orient Point.
The Building Inspector and one of the members of the Board of Appeals have
completed, a tour of the major highways of the Town and noted the widespread
erection.of business signs in areas where they are not permitted under the
Ordinance. Twenty seven specific instances were noted. It is our thinking
that all signs, with the exception of signs advertising agricultural products,
require permits end that these permits be issued through the Building In—
spector with a metal identification tag, serially numbered, to be auplied to
the sign by the Building Inspector. We believe that the fee for this -permit
should be $3.00 on a sign 31 x.41 (12 square feet or smaller) and a, fee of
$5.00 be required for signs of larger dimensions.
ARTICLE IV — "Bn BUSI1\MSS DISTRICT:
Not withstanding any other provisions of this Ordinance — No permit will be
granted for the erection of a dwelling in "B" Businese' Distr9.ct on a lot
of an area less than twelve thousand five hundred (12,500) square feet and
having a frontage of less than one hundred (100) feet.
RESOLVED FURTHER, That the Southold Town Planning Board recommend to the
T own Board the following changes to the Building Zone Ordinance:
ARTICLE I, Section 100, Paragraph 3 -- BOARDING AND TOURIST HOUSES.
It is suggested that this be changed to read: "A building other than a.hotel
where lodging, with or without meals, for five or more persons is furnished
for compensation. "
This change suggested in order to conform to the Multiple Residence Law of
the S tate of New York.

ARTICLE III — "A"-RESIDENTIAL AND AGRICULTURAL DISTRICT — Section 303--"A" SIZE
OF LOT—AREA.
We recommend that this section be changed to read as follows;
"In the "A" Residential and_ Agricultural District, no building shall be
erected or altered on a lot of an area, less than twelve thousand five
hundred (12,500) square feet and having a frontage of less than one
hundred (100) feet. "
ARTICLE IV '',` "B" BUSINESS DISTRICT — Section 4.09 - "B" SIZE OF LOT—AREA.
We recommend that this section be changed to read as follows;
"In the "4, Business District, no. building shall be erected or altered
on a. lot of an area less than seventy—five inuidred (7,500) square feet
and having a frontage of less than fifty (50) feet. !',
The Board then discussed the question of Gas Stations. It was decided that
instead of changing the Ordinance the Board would make recommendations to the
Board of Appeals regarding specifications which might be applicable, such as;
pump setbacks, building setbacks, signs, size and location of tanks, etc.
Mr. Klipp advised that they are trying to repeal the Trailer Camp
ordinance and include it in the Tourist Camp ordinance and .suggested that the
Planning Board be prepared in the near future to make their recommendations.
Board studied petition of Ursula Sledzieski and Lawrence T. Waitz for a
change from "A" Residential zone to either 'B" Business or "C" Industrial
property on north side of Main South Road, Southold, N. Y. On Motion made by
Mr. Van Duzer, seconded by Mr. Grebe and unanimously carried it was
RESOLVED, That the Planning Board is not willing to recommend either of
the proposed amendments and suggest to the Town Board that the location of
kennels and exercise pens be referred to the Board of Appeals as a special
exception.
Board studied petition of Robert H. Preston and LaGrant Chapman for a
change from "A" Residential to either "B" Business or "C" Industrial District
property on the westerly side of Manhansett Avenue near Greenport, N. Y. On
motion made by Mr. Van Duzer, seconded by Mr. Grebe and unanimously carried, it
was
RESOLVED, That the Planning Board recommend to the Southold Town Board
that this property, described in paragraph 1 of original petition, be changed
to "B" Business District.
Minutes of the July 16th.meeting, having been previously mailed to all
members of the Board, were reviewed. There being no omissions or corrections,
on motion made by Mr. Moisa,. seconded by Mr. Van Duzer and carried, minutes were
approved.

Map,' dated May 23, 1957, of sub—division of land, Cleaves Point, East
Marion, N. Y. , was presented for BoardIs approval by Mr. -Van Tuyl. On motion
made by Mr. Moisa, seconded by Mr. Grebe and unanimously carried, it was
RESOLVED, That this.map be given final approval as it is the feeling of
the Planning Board that this is the best that can be done on the layout of
this particular property.
In lieu of the regular meeting, the next meeting of the Planning Board
will be held on the trip to Fishers Island on Tuesday, _August 20th, at which
time Mr. Van Duzer will act as Chairman. Members attending meeting will leave
from G-reenport at 9 A.M. on the morning of August 20th.
