A regular meeting of the Southold Town Planning Board was held at 7:30 P. M-
on Tuesday, December 3, 1957, in the Town Clerks office, Southold, N. Y.
There were present: Mr. Harold R. Reeve
Mr. Henry Moisa
Mr. Alfred Grebe
Absent: Mr. John Wickham and Mr. T. Paul Montgomery
Also present: Mr. Howard M. Terry, Building Inspector
Mr. Harold W. .Price, Supt. of Highways
Mr. Otto W. VanTuyl
Mr. R. G. Terry, Jr., Town Counsel
Mr. Herbert Rosenberg, Member Board of Appeals
On motion duly made, seconded and unanimously carried, Mr. Reeve was elected
Chairman for the evening in the absence of Mr. Wickham.
On motion made by Mr. Grebe, seconded by Mr. Moisa and carried, Minutes of
the November 19th meeting were approved.
For the first Ij,--lf hour of the meeting Mr. Norman E. K1ipp, Town Supervisor,
and the following members of the Town Board; Messrs. Louis Demarest, Lester
Albertson, Henry Clark and Ralph Tuthill, convened with the Planning Board to
discuss flOpen Development Areas" under the provisions of Section 280•-a of the
Town Law of the State of New York.
After the Town Board members adjourned further discussion was held in regard
to Section 280—a of the Town Law by the Planning Board.and on motion duly made
and unanimously carried the following resolution was adopted:
1,10 EAS, pursuant to the provisions of Section 280•-a of the Town Law, no
building permit may be issued for the erection of any building unless such
building be adjacent to a public highway, and

WHEBEAS, the Town Board may by resolution establish an open development area
or areas wherein permits may be granted where access is given by right of way or
easement, and
WHEREAS, such resolution shall be subject to the conditions and limitations
prescribed by the Planning Board
NOW, TINREFOIIE, BE IT MESOLVED that the Planning Board does hereby prescribe
the.following conditions as prerequisites to the establishment of such an open
development area:
1. The applications for such establishment shall be accompanied by a survey
map setting forth the right of way or easement, and such right of way or easement
shall not be less than 50 feet in width, unless the enforcement of such provision
would entail practical difficulty or unnecessary hardship.
2. The street or highway or right of way or easement shall be suitably
improved to the satisfaction of the Planning Board.
The Planning Board then discussed petitions for a change, modification or
axlendment of the Building Zone Ordinance of the Town of Southold. It was the
unanimous decision of the Board to
RESOLVE That all petitions for a change of zone should be accompanied by a
letter of intent, such letter clearly defining how the property is to be used.
It was the unanimous decision of the Board to hold all future meetings in the
Town Clerkis Office in Southold and Mr. ,Klipp was advised to discontinue rental of
the former office in Greenport.
The board studied petition of Cleaves Point Corporation for a change of zone
from "All Residential to "B" Business and it was decided to hold this matter over
until the next meeting.
Board_ discussed application of L. Barron Hill and Adelaide H. Hill of
Creekside, Southold, N. Y. to establish an "Open Development Area" under the
provisions .of Section 280-a of the Town Law. 251 right of way, as per map,
except in front of Lot No. 5 and from end of lot No. 5 to the west side of
Hendrickson's lot where the present road is 16-1/2 ft. in width. It was the
unanimous decision of the Board to
BESOLVE That they were not willing to recommend the present right of way and
suggest that the property be developed to include a fifty (50) foot right of way.
Petition of Charles M. King, East Marion, N. Y. , for a change of zone from
"AU Residential and Agricultural to "Bn Business district. Property situated at
Greenport, N. .Y., bounded on North by Rte. 25, Main Road, 1861 , on west by land of
Ernest Wiggins, 2001, on South by other lands of applicant and on East by land of
Charles Cornibert, 2001. Request made for the following reasons: I wish to put up
a new modern gasoline service station similar to the Shell Station on Hamilton Ave.
in Mattituck. It was
BESOLVED That the Planning Board recommend to the Town Board that this request
be granted.

Application of Robert L. Hyatt of Hortonts Point, Southold, N. Y., to establish
an Open Development Area under the provision of Section 280—a of the Town Law of
the following property: Lot north of Roussin lot on west side of right of way on
Revised map of property'of Walter E. Hyatt, dated 1/18/55.- .Description of right
of way: 301 right of way running North from Sound View Avenue. It was the unanimous
decision of the Board to
RESOLVE That they recommend to the Town Board .the approval of the right of tray
as it stands.
Petition of Henry G. and Evy C. Stenson of brill R6ad, Mattituck, N.Y., for
change of zone from "Au Residential and Agricultural to ,113n Business all that tract
of land described on accompanying map as follows: 2911 on southerly side of Mill
Road, Mattituck, N. Y., approximately 5001 on Mattituck Creek x 3671 on the easterly
side. Change of zone requested to enable owner to bulkhead westerly side and rent
mooring space for small boats. It was
RESOLVED That the Planning Board recommend to the Town Board that this request
be granted.
Petition of Mrs. Veronica Frohne of Silvermere Road, Greenport, N. Y., for a
change of zone from 11An Residential and Agricultural to 11311 Business district that
property described as follows: Beginning at a pipe set at the north east corner of
this property at Silvermere Road a. distance of 350 ft. to the Bay on the east, a
distance of 80 ft. on the Bay to the west line, a distance of 320 ft. on the west
line and a distance of 88 ft. on an angle to Silvermere Road, then a distance of
18 ft. 6? to point of beginning. Request is made in order to install miltiple
dwelling units and to improve and expand existing units. It was
RESOLVED That the Planning Board recommend to the Town Board approval of
this change of zone.
Petition of Albert A. Sacco of 34 Hull Avenue, New Hyde Park, N.Y., for a
change from "All Residential and Agricultural to "B11 Business district. Property:
5001 on the South Side of Rte. 25, Peconic, N. Y. Corner lot bounded on East by
Indian Neck Road, a distance of 2001 and on the West by land of Koroleski. This
change requested to allow owner to raise and sell shrubs, with store, etc.
It was the unanimous decision of the Board to
RESOLVE That they recommend to the Town Board approval of this change of
zone, .
Petition of Winifred and Ellsworth Grathwohl of Pine Neck Road, Southold, N. Y.,
to establish an Open Development Area under the provisions of Section 280—a of the
Town Law of an
on Worth Side of line Neck Road on accompanying map, dated
August 23, 1955 and revised June 18, 1957. Description of right of way: 20, right
of way (entrance from Pine Neck Road and across rear of divided lots for egress and
ingress) see attached map. It was
RESOLVED That the Planning Board recommend to the Town Board that approval
be given to this right of way.

The Clerk then read the suggested regulations, submitted by Mr. Rosenberg
of the Board of Appeals, covering Tourist Camp, Camp Cottages, Trailers and
House Cars. It was the unanimous decision of the Board to submit these
regulations to the Town Board for their approval and adoption.
Discussion was held regarding l�Orient-by-the-Seale, Section One and letters
from Mr. TJhlfs attorney and the Suffolk County Clerk's office were read by the
presiding Chairman. It was the decision of the Board to hold this matter Iver to
the next meeting for further discussion'.
The Chairman then read a letter from Fishers Island Estates, Inc., which was
in answer to the Boardls letter of November 22nd concerning gravel pit operations.
The Clerk was instructed to reply to Mr. May' s letter of November 25th advising
that the matter will be discussed at the next meeting of the Board.
Mr. Howard Terry then presented and read numerous letters received concerning
the petition of Angelo G. and Georgette Petrucci for a change of zone from "A"
Residential to nBrr Business property situated at Bay Avenue, Peconic, N.Y.
Letters in question to be submitted to the Tobin Board for their action at the
Public Hearing to be held on Thursday, December 5th.
Letters concerning petition of James Wasson of Mattituck, N.Y., for a change
of zone from "A° Residential to"Bll Business were read. Mr. Terry was to submit
these letters too to the Town Board for their action at the Public Heading on
Thursday, December 5th.
The next meeting will be subject to the call of the Chairman, Mr. Wickham.
Meeting adjourned at' 10:30 P.M.
