(631) 765-1809 •Fax(631)765-9064 4q .17 FINDINGS,DELIBERATIONS AND DETERMINATION • MEETING OF JUNE 21,2012 Sout old Town Clerk ZBA FILE: 6567 NAME OF APPLICANT: Southold Historical Society PROPERTY LOCATION: 54127 Main Road, Southold,NY CTM: 1000-61-2-7.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 27, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The Applicant's property is a .195 acre parcel in the HB Zone. The northerly lot line measures 42 feet, and the easterly lot line measures +/- 203 feet along adjacent properties. The southerly lot line measures 42 feet along Main Road, and the westerly lot line measures +/-202 feet along an adjacent property. The parcel is improved with a 26.4 ft. X 22.3 ft. principal structure, and a 26.4 ft. X 20.3 accessory structure, as shown, with a proposed new front porch addition for the principal structure, on the survey drawn by Wallace T. Bryan, Licensed Land Surveyor, dated Aug. 9, 2011. BASIS OF APPLICATION: Request for Variance from Article X Code Section 280-46 (bulk schedule), based on an application for building permit and the Building Inspector's March 9, 2012 Notice of Disapproval concerning proposed front porch addition to existing building located in the HB District, at; 1) less than the code required minimum front yard setback of 15 feet,2) less than the code required minimum side yard setback of 10 feet, 3) less than the code required total side yards of 25 feet. RELIEF REQUESTED: The Applicant requests variances to construct a+/- 100 sq. ft. open, roofed porch addition to be located on the front of the principal building facing Main Road. The Applicant requests a variance for a front yard setback of 3.75 feet, when 15 feet is required by Code, requests a variance for a 2.2 feet single side yard setback, when 10 feet is required by Code, and further requests a variance for a combined side yard setback of 17.5 feet, when 25 feet is required by Code. ADDITIONAL INFORMATION: The Applicant proposes to build the new porch within the original footprint of a porch that had existed at the same location on the structure for many years in the past, prior to being damaged by a storm. After the storm, the porch was partially removed, leaving only the roof and entrance stairs intact. The i ! I Page 2 of 3—June 21,2012 ZBA File#6567—Southold Historical Society CTM: 1000-61-2-7.2 ;. Applicant, the Southold Historical Society, and the new owner since 2011, now wants to restore the porch to this historic building as it had existed in the past, by utilizing the remaining roof overhang of the old porch. The Southold Historical Society expressed an intent to utilize this building as a small exhibition gallery for historic items now housed within their nearby headquarters building on Main Road. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 7,2012, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A porch had existed on this building for many years in the same location as the proposed new porch. The porch construction will restore an original feature to this building in the exact footprint where it had existed for many years. Many of other the buildings in the adjacent neighborhood along Main Road have nonconforming front and side yard setbacks. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible j for the applicant to pursue, other than an area variance. The roof for the proposed porch already exists with nonconforming front and side yard setbacks. The front porch can not exist again without the granting of variances. 3. Town Law V67-b(3)(b)(3). The variance granted herein fora 3.75 feet front yard setback is mathematically substantial, representing 75% relief from the Code required 15 feet setback. The variances granted herein for a single side yard setback of 2.2 feet and combined side yard setback of 17.5 feet are substantial since this represent a 78% relief from the Code required single yard setback of 10 feet, and a 30% relief from the Code required 25 feet combined side yard setback. However, the pre-existing porch roof and entrance stairs already have a nonconforming footprint, and this footprint will not be increased by the addition of a porch within the same area. i 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The porch will have a storm drainage system that conforms to Chapter 236 (Storm water Management)of Code. i 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The original porch of this pre-existing, nonconforming historic building was destroyed by a storm, with only the roof and steps remaining, and now the Applicant wants to re-build the porch in the same footprint that it had occupied in the past. I' 6. Town Law 267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a restored front porch on an historic building, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Schneider, and duly carried,to f GRANT, the variances as applied for, and shown on the survey drawn by Wallace T. Bryan, Licensed Land Surveyor, dated Aug. 9, 2011. CONDITIONS: The restored porch shall not be enclosed by walls, and shall remain open except for support posts and railing similar to those shown in the file photo dated circa 1910. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. J I I I Page 3 of 3—June 21,2012 ZBA File#6567—Southold Historical Society CTM: 1000-61-2-7.2 Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Vote of the Board: Ayes:Members Weisman(Chairperson),Dinizio,Schneider, Horning. This Resolution was duly adopted(4-0). Member Goehringer was absent. Application of ROBERT W.• GILLISPIE III, by Stephen R. Angel, Esq., 108 East Main Street, Riverhead, NY for a Variance to the Zoning Ordi- nance, Article VII, Section 100-71, Bulk Schedule, for approval of insufficient area, width and sideyard setbacks.of building in this proposed. two-lot division of property located at the northeast corner. of Main Road and Beckwith Avenue, Southold, NY; County Tax Map Parcel Nos. 1000-61-02-005, 00.6 and 007. The board. made the following findings and determination: Appellants, under Appeal #p3139, appealed a determination of the Building Inspector which denied Appellants' application to divide the subject premises into more than one parcel. On August 23, 1983, this board granted Appellants' appeal to divide the premises with insuffi- cient area and width, and with insufficient setbacks of existing buildings, subject to two conditions, to wit: (1) That Parcel 1 shall contain no, more than two separate .(unrelated) professional businesses [or one non-professional business] ; (2) That Parcel 2 . shall contain no more than one business; '(i.e. real estate) , with accessory use only of existing barn building. Appellants' application for a •rehearing of Appeal No. 3139 'was. granted and a rehearing was held on October 27, 1983. At the rehearing, Appellants raised essentially two. issues: (1) • That the conditions imposed were improper, and (2) That the . board did not render any determination with respect to Appellants application to construct an addition to the principal building located on-Parcel 2. - There appears to be no dispute as to the facts in this appeal. They are fully set forth in the board's August 23, 1983 decision. With respect to the conditions imposed by the prior decision, it is Appellants contention that such conditions do not relate to the use of the subject premises, .but to its ownership, since the uses are permitted uses under the provisions of the .Code, and, but for the change in ownership, are allowed by the Zoning Code. Upon (CONTINUED ON PAGE TWO) . DATED: December 20, 1983. CHAIRMAN, -SOUTHOLD TOWN ZONING BOARD OF APPEALS Form ZB4 (rev. 12/81) ~ Page 2 - Appeal No. 3139 Rehearing: Matter of Robert W. Gillispie III Decision Rendered December 19, 1983 reconsideration of this appeal, the board concludes that Appellants position has merit and, accordingly, rescinds the conditions imposed in its August 23, 1983 decision and substitutes in their place the conditions hereinafter set forth. The second issue raised on the rehearing of this appeal is that the board did not decide Appellants' request to erect an addition to the principal building on Parcel 2. The proposed addition, as . shown on the plot plan filed with the board is to be 21 ft. wide from east to west and 28 ft. long from north to south, to be set back 10 feet from the east side lot line and 12 feet from the west side lot line, and to be attached to the rear of the existing principal build- ing: Permission to construct such addition is hereby granted, provided that the same does not exceed the above dimensions and complies with the above specified sideyard requirements. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Sawicki, it was RESOLVED, that Appeal No. 3139, application of ROBERT W. GILLIS- PIE III and others, BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS, TO WIT: 1. The division line shall be as shown on the map entitled, "Map of Proposed Minor Subdivision made for Robert W. Gillispie III, Irwin R. and Ceil Kaplan, and Shirley and Paul Caminiti at Southold, Town of Southold, New York" prepared-by Roderick VanTuyl, P.C. as surveyed on March 7, 1983; 2. That off-street parking for each parcel shall be provided and shall conform to the provisions of Section.100-112 of the Southold Town Zoning Code; 3. That the division of the premises be obtained by the Southold Town Planning Board as a setoff or subdivision; 4. That the Appellants obtain Site Plan approval for each parcel from the Southold Town Planning Board pursuant to Article VII, Section 100-70(A) and Article XIII of the Code; 5. That this determination be referred to the Suffolk County Planning Commission for its review, pursuant to the provisions of the Suffolk County Charter. Location of Property: Northeast corner of Main Road .and Beckwith Avenue, Southold, NY;. County Tax Map Parcel Nos. 1000-61-02-005, 006 and 007. Vote of the Board: Ayes: Messrs. Appli- cant proposes to locate the sign 1 '6" from the southerly edge of applicant's front property line, north of the concrete sidewalk area, and will meet all other 5'-minimum yard setbacks. The parcel in question contains an area of 0.195 acre, or 8,510 sq. ft. with a frontage along the Main Road of 42 feet. The premises is improved with a one-story frame building which will be used for real estate sales and an accessory barn building located at the rear of the property. This property was the subject of a prior action of this board rendered October 27, 1983 in Appeal No. 3139. In view of the position of the existing building and the limited frontyard area, the board, agrees that practical difficulties do lend to the granting of this application. In considering this appeal , the board also determines: (a) that the relief requested is not substantial ; (b) that by granting the requested relief, the character of the neighborhood will not be adversely affected; (c) that by allowing the variance, no substantial detriment to adjoining properties would be created; (d) that no adverse effects will be produced on available governmental facilities of any increased population; (e) that the relief requested will be in harmony with and promote the general purposes of zoning; and (f) (CONTINUED ON PAGE TWO) DATED: June 18, 1984.
