April llr 1967.e,- at the Town Officee Main' Road, Southold. New York. There were present: Messrs: John, Wickham,, Chairman; Henry Moisar Alfred Grebe. William' Unkelbach. Frank"Coyle. Also present: Howard Terry, -Building Inspector; Otto Van Tuyls Consultant, Lawrence' Tuthill.- Engineer. • PUBLIC HEARING: NOTICE .IS HEREBY GIVEN that pursuant to Section. 276 of the Town- Law, public hearing will be held by the SoutholdTown Planning Board at- the Town= Officer Main Road, Southold, New York. in said Town• on the llth day of April, 1967. at 7:30 o'clock in the evening_ of. said day on the question of approval of the following- plat: Plat of property owned by Birch Propertiesr Inc. ,, entitled Map, of Birch Hills at Cutchogue, consisting of a par- cel of land of ' 11.126 acres., . situated at 'Cutchogue, in the Town of Southold, Suffolk Countye .New Yorke, and bounded and described as follows: Southold Town Planning Board -2- April 11, 1967 BEGINNING• at a monument on the southwesterly line of Duck Pond Road,,. 2638. fat northwesterly along said south- westerly line from 'Oregon Road,, said point of beginning being the -northeasterly corner- of' land of Krupski; from said point of beginning running along said land of Krupski,,, S. 520 281 20" W. 488.50 feet to a monument and land of Domaleski; thence along said land of' Domaleski� N. 37' 33 ' 40" W. 1616- feet,, more or less, to ordinary high water mark of Long Island Sound; thence northeasterly along said high water mark, 495 ' feets. more or less,, to land of Vincent; thence along said land of Vincent,, S. 390 00" E.- 727 feet more or . less,, to a monument on- the northwesterly line of said Duck Pond Road; thence .along said northwesterly line- S. 33' 041 0011 -W.- 26. 05 feet to said southwesterly line of said Duck- Pond Road; thence along said southwesterly line,, S. 390 00' E.- 209.82 feet- to the point- of beginning. The Chairman read the legal notice ofhearing and the affidavit attesting to its publication in the official newspaper of 'the Town of Southold. THE CHAIRMAN: The final map .has been signed by the Director of. Eviromental Sanitation,, under date of February 28,, 1967, The park and playground provision has been met,, and per, our discussion of the last meeting an additional condition has been met on the map area between the beach and northerly most road as park' and playground area. At this time is there anyone present who wishes to speak- in opposition to this- Subdivision? ,(There was no response. ) HOWARD TERRY: Do the drainage basins and so forth show on this map? MR. VAN TUYL: Yes. THE CHAIRMAN: Is there anyone present who wishes to speak in favor of this Subdivisbn ? MR. VAN TUYL: We had a telephone conversation with Mr. Grimes, who is the attorney for the subdivision .and he said he expected to be at .this meeting here tonight. He ask that someone from our firm be here to answer questions. Southold Town Planning Board -3- April '11a1967 THE CHAIRMAN: We will recess this at- this point. - So far as I am able to determine there is nothing out of order. If'Mr. , Grimes is going to attend we had better wait until- that time. Mr. Henry' Smith and Lefferts' P1 Edson,, Esq. , appeared before- the Board in, regard to the' subdivis.ion to be known as Laughing Water..- Section II. The PlanningBoard advised the applicant they would require a copy of the proposal on the dredging to be done. The applicant stated that he had -been before- the Town Trustees with a proposal for dredging, how- ever they were holding their decision pending the recommendation of the Planning Board. . The' Chairman. stated they needed a full. plan of the dredging proposition so that-the -Board could have a, full picture of the proposal. Mr. Van Tuyl drew in on. the survey map submitted the existing salt pond. The question of progress on the road were raised. The applicant stated that the roads were pretty well roughed in. The question of ' laying. of the water mains was also raised. The applicant stated that 'the Village of Greenport-Water Company will lay the water mains up to the subdivisions, and the applicant will lay water mains in the subdivision. The Planning' Board advised the applicant they would require a copy of' the contract- with the water company for the installation of the water mains. The applicant stated he would send a copy of theplan submitted to the Army 'Engineers and a copy of the application to the Town- Trustees will be made an($161aced on file. Mr. Henry Smith and Lefferts P. Edson,, Esq. , appeared before the Board in regard to the extension of Sound View Avenue in Peconic. Mr. Van Tuyl presented an overall plan of the area in question and the property to the west. The line followed by-::the' Long Island Lighting Company'Power' Line. was" shown from Peconic west to•Mattituck. The Chairman suggested that- the proposed road be started five feet away from the Long Island Lighting'Company power line. The future extension of Sound View Avenue west.,, was discussed at some lenght. Southold Town Planning Board -4- April 11, 1967 On motion by Mr. Moisa, seconded by Mr. Grebe, it was, RESOLVED that preliminary approval be given for the extension of Sound View Avenue as proposed by Henry J. Smith.. Peconic, New York, shown on survey map by Otto Van Tuyl & Son, map dated March 24, 1967, The proposed extension for Sound View Avenue shall be started at least five feet away from the Long Island Lighting 'Company power line on the northerly side as directed by the Planning Board. Vote of the Board: Ayes:- Mr. Wickham,.- Mr. Moisa, Mr. Grebe, Mr. Coyle.. Mr. Unkelbach. " I i Planning Southold Town/Board .) :<° .. _: : , =-5- April ll:a. 1967 This application was discussed by the' Planning Board On motion by Mr. Wickham® seconded by Mr. Unkelbach,, it was RESOLVED that- the' Southold Town Planning Board recommend to the' Southold Town Board the acceptance of Winthrop Driver. Fishers island,, New York,, as a- Town Highway,, said highway being described in- Exibit A in the- application for' dedication to the Town' of Southold. The' Planning Board recommends the acceptance by the Town Board as soon as all the improvements recommended by the' Superintendent of Highways are met. Vote of 'the Board:' Ayes:- Mr. Wickham, Mr, Moisa, Mr. Grebe, Mr. Unkelbach, Mra, Coyle. Mr. George Ahlers and Irving'Latham: appeared befaore .the Board' in regard to dredging in Jockey"Creek, Southold. This dredging is to .be done at Hill Road in Southold. The applicant proposed to dredge a canal 550 feet long. There is a natural . gutter 50 feet wide. The applicant 'intends to dredge 25 ''4eet and there will be 25 feet of the gutter remaining which in his opinion willserve as a barier. The chairman advised that he had inspected the property in' question� and found there was sand very close to the surface. The' Chairman did not recommend dreding in this area. Much discussion was held on this. The:- Board agreeded to have Mr. Lawrence- Tuthill,, . Engineer, to look into this matter. The Board requests the engineer to take a soil- sample of the area, of both the sand . and.mud and prepare a proposal on how a mud seal may be used and establish- hydrological radiance and so forth. : On motion' by Mr. Unkelba4e seconded by Mr. Grebe, it was RESOLVED that the minutes. of the- Southold Town' Planning Board dated March 7,. 1967, be approved as submitted. Vote of the Board: Ayes:- Mr.- Wiccham,. Mr. Moisa, Mr.,,_ Grebe, Mr. Unkelbach, Mr. Coyle. Southold Town Planning Board -6 April llt 1967 A letter was written to, the Town of Vestal recommending the siarvices of Raymond & May Associates for a Master Plan. ' A letter was written to' Dawn Estatesr Inc.advising them they should provide for easement- for thedrainage pipes when the .sell the lots that the pipes now cooss. The .hearing on the Map of Birch Hills At-Cuthhogue was recessed until the next- meeting of the' Southold Town' Planning Board. The next meeting of the' Southold Town Planning Board will be held at 7:30 P.M.,, Tuesday,, May 9,, 1967, at the Town Officer Main Road, Southold` New York. The meeting was adjourned at 10:30 P.M.
