Southold Town Planr, a Board --2- February 4r, 1970 Richard Larks, Esq. appeared before the Planning Board to request that a performance bond in the amount of $65,,,:000, be recommended to the Southold Town Board for the completion of roads and other .improve- ments in the subdivision to be known as "Laurel Country. Estatesr. Inc. " located at north side .of Peconic Bay B1vd.,O. Laurels; New York. The Board was presented with the two following signed and executed contracts: Paul Corrazini & Sons - roads - $17,,,,350.; Riverhead Cement Block Co,, Inc. -- curbs, ; drainage;, etc. - $36,230. These two combined give a figure of $53-580s plus a 20/ administrative and increase cost of $10,,716, the grand total being $64i296. On motion by Mr. Raynor, seconded by Mr. Moisa it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board a performance bond in the amount of $65:*000. for the completion of roads and other improvements in the subdivision to be known as "Laurel Country Estates, Inc. ", . located off north side of Peconic Bay Blvd., Laurelz New York. Vote of the Board: Ayes:- Messrs: Wickhamj, Maisa,m Raynor-i Coyle. On motion by Mr. Wickham,,. seconded by Mr. Raynor j. it was RESOLVED that the Southold Town -Planning Board set the date for final hearing on proposed subdivision. "Laurel Country Estatesr, Inc. " as the first meeting -in March. Vote of the Board: Ayes:- Messrs: Wickham, Moisap.. Raynor.. Coyle, in reference to "Wheatfield Parke. proposed subdivision located at Griffing Street,.., Cutchoguec.. New Yorke, Mr. Lark . informed the Board that the Board of Health has given their approdal. The Chairman suggested recommending bond as per Larry Tuthill®s estimate and setting it up for hearing. Mr. Lark requested that the Board post- pone any action at this time to enable him to secure contracts to present at the next meeting of the Planning Board to be held on February 25th. Mr. Lark said that he will either f;resent contracts for the work at the next meeting or he will go along with Larry Tuthillts bond estimate in the amount of $67r;000. On motion by Mr. Wickham... seconded by Mr. Moisas. it was RESOLVED that the Southold Town Planning Board set the date for the hearing on proposed subdivision "Wheatfield Park" as the first meeting in March. Mr. Lark-has not secured the Board .of Health Approval. As soon as the bond is accepted by'the Town Board .and Health Dept, Approval .is received this subdivision will be set up for final hearing.' ' "Proposed subdivisions "Mattituck Hills" and"Mattituck Ridge" have not received approval from the Health Dept,,,, there seems to be a nitrate problem. On motion by Mr. Wickham-& seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant final approval to the minor subdivision of Casbor,; Inc..,; located at Middle Road (CR27) and Westphalia Road; Mattituck*r N:Y ', subject to receiving fee of $50.00. , 'three (3) copies -of ..final maps: and Health Dept. approval. This motion shall include authorization for the Chairman- to sign map when fee,,, final mapsa. and. Health Dept® Approval are received. Vote of the Board: Ayes-.- Messrs: Wickhama, Moisa, Raynor,. Coyle, in regard to minor subdivision of Jenny' Lesteri located at NIS Westphalia Road, Mattituck,,,,,. N:Yo, final approval has been previously granted subject to receiving fee of $30,:�,. final maps,, and Health Dept, approval. The recent death of the applicant has delayed action on this. It must now be legally processed through the administrator' of the estate, on motion by Mr. Wickham,; seconded by Mr'. Southold Town Plann,' -1 Board -4- February 4, 1970 THE CHAIRMAN: I hereby reconvene this February 4th meeting of the' Planning Board. I would like to welcome everyone present. I would also like, to make it clear that- this is a Planning Board meetingsi- onlyj, it is not a public hearing. All .of our' Planning Board meetings are open to the public. We wish every time we had a consideration of a change of zone or' a subdivision application we- could have a turn out 'like this..; we all could learn something. The' Chairman introduced the members of the Planning Board. THE CHAIRMAN: The' Planning Board is a part time job. We ordinarily meet once a month,$' sometimes twice. Additional meetings are held for- Town matters which concern us. Tonight- we have a consideration of a change of zone, The applicant has petitioned the Town Board and the Town Board has referred it to the Planning -Board to ascertain the .conditions and facts and make a recommendation. Our job is to ascertain the facts and conditions. Before we get through the Planning Board will reach a decision whether to recommend it to the Town Board or not to recommend it to the- Town Board..; or to recommend some parts and not others. As I have said before this is not a hearing. The usual procedure for a hearing is to take the opposition first. First I will read the petition for this "dhange- of- zonez. then we will hear anyone wishing to speak. in favor,. and then the opposition. I will ask you to be factual. We are interested .in. facts only.., not numbers. Basically a.f one person says something' and no one objects* I will assume that everyone, agrees. Your petitions and opposition should be directed to the Town Board. We only make a recommendation to them and then they hold the hearing_ . We have no jurisdiction. Our responsibility is to ascertain the conditions and facts of the application. We are going to put pads and' pencils at the entrance.,: upon leaving we would like everyone to sign their names. The' Chairman read letter of referral addressed to the Planning Board from the Town Board_.. application for change of zone,; and reason for request. Richard Cron.. Attorney for George Semerjianr presented the audience with an-'artistr'•s rendering of the proposed lay-out and operation. RICHARD -CRON,,' ESQ : Chairman_.; members of the .Planning Boards and interested citizens of the Town of- Southold..; I appear on behalf of my client George• Semerj ian. I think it ig' important before' we get into the merits of' this application_. .t. o go into the concept of what is being set forth here. I thank it 'is .urgent and important for..the- Town. Board..;. the- Planning Board... and all the people of the Town of- Southold to determine if the Southold Town Plana 'I Board -5- February 4, 1970 the concept we, have here is in- harmony with the Town, of= Southold. The Town of Southold .does not care to have any obnoxious industry. We try. to have tourist trade.z, it is .our belief that- what we are presenting is not contrary to this. We believe it• is in accord with the Townzs policy. I have heard and I know it- must be true that there' a lot- of,-wild rumors going around. a I -am convinced that the application which has been made is done so in• good faith. I as a person believe it will be done. If what we propose 'is not in accord with the Town of-Southold we should cease - it-right- now, If anyone feels that this is not in the best- interest of the, Towns. if 'there is anyone-who thinks that-we should not go any further, with this applications, tell me now and I will stop right here? THE CHAIRMAN: The development of our.' water front -is- very important. Our,' Master Plan study proved that -most of our" summer residents. are here because of- the rural nature and the-waterfront. We seem to be satisfied to have tourists as our industry. "The Planning Borrd .is interested in hearing the .facts of this application. Our job is to ascertain the conditions and facts. I would like to say again that this, is not a public haaring. RICHARD CROUO,- ESQ:: If I may continue. I think it .is important that we. look at the entire,'sttuation. Looking 'at the zone use comprising the- entire 132 acre parcel -as it - is presently zoned,, we have 27 acres zoned "C" :(which was formerly used for' a sand pit. operation-) 9 2 acres zoned "B"s 10 acres zoned "M" and the balance of the property 852 acres zoned- "A"s so there are .now 4. different--zone uses. The most distasteful to you- would be the '"C" zone. - We propose to re-zone it as follows: 36 .acres, "M",v; 32 .acres, "B".s, 64' acres "A". of the 36 acres of "M" approximately 10'. acres are already zoned ':M":. We think-that-we are making -this particular-parcel a lot better than it now exists. We are taking away the "C" zone and making , it"A" There is a greater degree of control over' "B" &. "M" zones than- could be imposed on the present- "C" zone. Question: Where are the jetties going to be? Mr. Cron explained the lay-out of -the- operation on his drawing. MR. CRON: It is my belief that the applicants will do--exactly as they say. The Town of Southold is not. going to stay the, way it is right now.. Nobody is going to stop the influx= of people into Southold Town Plann' Board W6-- February 4r. 1970 this Town. Our greatCst tax base is summer residents. Inflation . is here to stay. Residential property cannwt support the Town in the future. Our neighboring communities are welcoming industry of all types into their area. I think there is going to be, a school tax problem in. the future. We have to have something to give the Town a wider tax base. This proposal should not be down-graded .just because you don3t like the person making the application. To prove that Mr. Semerjian is a human being'.and not a monsters, I .would like to introduce him to you. Mr. George' Semerjian presented himself .very briefly before the audience. THE CHAIRMAN: The' Planning Board feels that we don'tt need commerical industry. The fishing stations bring out quite, a lot of peoples; our industry is the tourist trade, What did you refer to when you said that- the .residential tax base cannot support us? RR ' CRON: Many people are moving into this area . the Town of Southold is growing in population. The school tax is golr,)g to be very large, We must have something to equalize, this. This project will help even it out. The' Chairman stated that about 2/3 of the land in Riverhead Town is zoned for industrial use. He predicted that- Riverhead Town will become an industrial center,, and Southold 'Town and other neighboring towns .will be bedrooms for Riverhead Town. They will collect all the industrial taxes and the neighboring towns will be heavily taxed for residential. The Chairman agreed .that something should be added to our- tax baser' something that will not be .obnoxious to the, Town. 'He stated that the above condition .now. exists in the neighboring towns of Hartford: Connecticut.,r.: which is an industrial town. Wm. Schrieverr, Oriente,: I buy the concept'`of it. I think we have to do something like this. I agree with the petitions we need the tax base. I think it is a� good location. The golf course,t. the restaruantsr: the shopsr; etc.. will be desirable. The only thing that bothers me is the .marina. We .have 2 examples of the undesirability of marinas in the Towns, at Plum IslangVand Mattituck. To build a manna in the sound would be costly and .very hard' to keep open. Question: How many units would this motel--complex contain? MR CRON: 6 units=, 100 apartments in each. The' Chairman questioned Mr. Terryr: the Building Inspector.. if this: density would be allowed under the Zoning Ordinance. Mr. Terry stated that this number of units: would be allowed in transient occupancy only. Southold Town Plarr ig Board -7- February 4s. 1970 Question: How long will it take to. complete the construction? Mr. Cron said that- this question could not be answered at this time. THE CHAIRMAN: I will now open this meeting to anyone wishing to speak in opposition. Jamesr. Vaughnr. Attorney appeared before .the Board on behalf of East- Marion property owners.. who live near or have property in the vicinity of the subject property. The petitioners believe that this proposal is not in the public interest. There is no time table for- developments, the map is not - complete... nothing is backed up by engineers reports. it will be an over burdening of ,,the East- Marion water' supply. It will cause salt- water intrusion r. to the fresh water supply., it will cause erosion to the east of the pmpased jetties and a general change in the ecology of the area. Mr. Vaughn read letter of opposition to the proposal from Dr. Robt. Cushman Murphy of the Museum of Natural History, Julius Schubert P.E. plans to represent- some of the Southold . Town residents. He stated that he would testify on the effect of jetties extending into the Sound as soon as the applicant comes forward with engineers plans. John Flynnr; Engineer for the Health Dept. stated that the Health Dept, is concerned with water use and waste disposal, and the effects of water- use on the water supply of an area. He discussed the effects such an operation would have on sewerage disposal and water supply. The most detrimental would be the effect on the water supply. Mr. Flynn read a section out of the Malcolm & Pirnie Water Report explaining the effect. dredging wolld haveon the water supply. ,. He explained the damagg the Jamesport operation has done to the water supply. He warned that any change in the amount of re-charge and storage of water can be critical to the area. James Monsell.., Village of Greenport. The Village of Greenport operates a water utility and an electrical supply,: which serves over 1/3 of the population of the Town ok Southold. He stressed the fact that the water supply on the Town of Southold is critical. Previous dredging in the Gull Pond area had raised the chloride content of the water. If the proposed dredging in the application were, carried out... it would cause salt water intrusion. - There are y Southold Town Planr g Board . -8_- 'February 4,,; 1970 10 public water supply wells from Greenport to East Marion which would be adversly affected. Mrs. Mary Bradyt, Mattituck - owns property on the sound bluff not too far east of' Levon Properties operation in Jamesport. Mrs. Brady referred to the application. made by Mr. Semerjian to the Riverhead Town Board in which he stated that th:e project would not be offending to adjacent property owners. She cited the problems they are having in regard to erosion and pollution caused by' Levon Prop. After numerous personal attacks on the applicant (of which the Chairman forewarned her) the Chairman asked Mrs. Brady to sit down. The Chairman read letter of opposition from Jos. Boken* Sr. the adjoining property owner to the south & east of the proposed operation. Said letter� was. placed on file. The Chairman informed the people that any permit to dredge inland would have to be obtained from the Planning Board and a mining permit .from the Town Board, Dominic Aurichio,,p, Attorney a/c George & Irving Newman.. Petty's Bite,, Orient, Mr. Aurichio- cited his. clients opposition to this proposed change of zone, The Newmans own about 20. acres of land in Orient with about. 900 feet of waterfront on the sound. The League of Women Voters presented a list of 7 questions which they 'felt should be answered before any consideration should be ,made -on this change of zone, Said list was placed on files. to be answered later by Planning Board or Town Board at the public hearing. Wm. Schriever spoke in opposition to the marina again. - He suggested '.that- it be eliminated from the application. Edward Kajeski�: spokesman for the Southold Town Baymens Assoc. spoke in opposition to the. petition. Letter received from the ' Assoc. stating their objections is on file. Bob Rothman' and others questioned the applicant's intent and schedule for development. On motion by' Mr. Wickham Seconded By- Mr Moisa.j,, it- was RESOLVED that the Southold Town Planning Board table recommendation on this proposed change of' zone for further deliberation- of the Board: Vote of the Board-.. Letter of' acceptance to be sent to them. A meeting of the Planning Board' Board of Appeals., and Town Board will be held at 7:30 P M ; ' March 10', 197.0, at the Supervisorts Office'.. Greenport. Amendments- to the Zoning Ordinance will be discussed. Supervisor Martocchia and John Wickham to attend the hearing of the Army Engineers RE: Levon Properties operation at- Jamesports; to be held at 7:30 P M.:',. " in regard to the notice of violation which we sent'` on the permit they obtained from the Town Trustees for dredging. Letter to be .sent to them advising that they cease work immediately and consider ..replacing the land in its original condition. III" Letter to be sent 'informing them that we are• notifying our• Town Attorney that they are in default and instructing the Building Inspector not to issue any permits on their holdings .until they have fulfilled the requirements of the Planning Board.
