held at 7:30 P:M.�. Mondays, January 12s, 1970.s. at the Town Office$
Main Roads; Southold& New York.

THE CHAIRMAN: I will call the meeting to .order and read the
legal notice of hearing.
NOTICE IS HEREBY GIVEN that pursuant to- Section 276 of the

The developer has meet all of the requirements of the Planning
Board .with numerous meetings- with us. I will now open the. hearing.

RESOLVED:.;_:WHEREAS: Stanley Sledjeski.,.; Mattituck ; New York,,`
has petitioned .'the Southold Town Planning Board for . final approval
of his subdivision "Sunset Knells:- Section -located off west
side -of Breakwater (Luthers) Roadj,�,' .Ma.ttituck- New York- and
WHEREAS: The Superintendent of Highways `has' approved the
lay--out of .-the roadsa, and 'the' Planning Board accepts -his report:-,

_WHEREAS: The,- Southold Town Boardw s accepted a bond in 'the
amount of $68;.,i000.00 for the roads and other improvements in this
subdivision.
NOW,e' 'THER'EFORE BE IT` RESOLVED: that final approval be granted
to the subdivision known as- "Sunset Knolls-" Section .Il-, subject to
applicant presenting -the Planning Board with a revised -copy of 'the
amended legal description and, a statement' of correction.
This, motion shall include authorization for the Chairman to
sign map when amended legal description and statement of. correction

In regard to "Laurel Country Estates$t, a hearing date will be
set up when the amount of .the bond to be required is established.
Gary Olsenr, Esq.j, and Martin Weglicki appeared before the- Planning
Board in reference to the proposed subdivision of Martin Weglicki:i.
located. on north side of Peconic Bay Blvd.,.. Laurel,,.; New York. The
Board stated again their opinion that the adjoining .property will be
developed and there must be• connecting roads to it. Mr. Weglicki
informed the Board that- he does not wish to give Lot # 17 'for park
and playground area as required by the Board at their last meeting.
He offered -the Board a choice of any other 2 lots in place of Lot
# 17. The Board decided upon Lot- #,t's ' 12 & 13,E plus the beach area
to .be .set aside .for park and playground area. The Chairman advised
Mr. Weglicki that the- Town will not accept the responsibility of the
beach area. Park. and playground area is 'the' responsibility of the
developer or preferably a property owners association should be' formed.
The Board recommended that the property owners association.be made
the owners of the beach area at the,, same time.
. The Chairman presented Mr. Olsen and Mr. Weglicki with a letter
from the� Superintenden't of -Highways which stated that no' exceptions
to the Highway Specifications will be made on. this subdivision.
On motion by Mr. Moisa seconded by Mr. Raynort. it- was
RESOLVED that the Southold Town Planning Board grant preliminary
approval to the proposed subdivision map of Martin Weglicki.p dated
Feb. 20.8. 1967 & July 15i. 1969 as. amended Sept. 4a 1969:r: property
located at- north side of Peconic Bay Blvd.•a, Laurel,; New York.
The Chairman signed map.
Vote of the Board: Ayes: Messrs:. Wickham, Moisa,� Raynor:a; Coyle.
Philip Druhl appeared before the' Planning Board to request
.final approval of; his proposed minor subdivision located at" West
&- Lake Drive,,.: Southold,, New. York. The Board inspected map which
showed 5 lots and a 40 ft.-. private right--bf Way.,I Two of `these
lots front on an existing town highway. The Chairman referred.
back to the minutes of- the last meeting which stated that the
Board would approve of 5 lots if he extended the, width of ''the
right-of-way to 50 ft. The Chairman informed him that-, the road
must meet the requirements for a town highway even though they
are to be private. Mr. Druhl resolved to widen the right-of-way
to 50 feet. Map to be revised to show 50 ft. right-of--way.

RESOLVED that the Southold Town' Planning Board grant- final
approval: to the minor subdivision map of Philip' Druhl,, property
located at West & 'Lake, Drive, Southoldi; New York.m, subject. to the
applicant presenting: revised final map showing 50 ft. right-of-way.
Vote of the Board: Ayes:-» Messrs: Wickhama Moisaa Raynora, Coyle,
Mr. . Wm. Smith and Mr. Otto Van Tuyl appeared•before the Planning
Board on -request of Valentine' Ruchl in- reference to his proposed
subdivision "Shorecrest"a: located on south side• of Middle Road (CR27)'z'
Greenport:� New York, Mr. Ruch has abandoned the idea of� reducing the
area of Lot- * l to enlarge the easterly side yard-.area- oh, the existing
house. Mr, Van Tuyl presented the Board.with a revised map '.as such.
,(same .as original map.) The Chairman read letter of agreement' between
Mr. Ruch' and the Village of Greenport to supply water. to this subdivision,..
and letter from the Supt._ of Highways' approving 'of the road lay-out'.
We have in our files a letter from the- County" Dept:, of Public' Works
stating 'that' they may take about 70 feet to widen -the County Road on
the south side of.' the existing road bed, Three ;(3) copies. of this
subdivision. map are to be, sent to the Suffolk County Planning Commission
;(to the attention of .Chas. Lind): as a referral urider Section 239 K 3
for• their approval or disapproval.
Richard Cron,i,- Esq. and Frank Borne appeared before the' .Planning
Board to request preliminary approval for the proposed subdivision
to be known as, "Leeward Acres. " a. located at Bayview,�. Southolda_ New York.
At the last, Planning ,Board meeting they were informed that- Jacobs' 'Lane
must be a 50 ft.. road. Since- that time they have contacted.Mr. Dickerson
and asked him to convey an additional 10 ft. to. widen `this road. They
presented ,the• Board with his reply which stated that'he- did not° wish
to give any additional land at this time. In any event the roadmill
have to -be widened to 50 ft,., The Board was presented with revised
preliminary mapsis, showing road profiles and drainage structures. The
Chairman requested that a rod readings at mean water levelb be taken
of the pond. The Planning Board is in terested 'in all the fresh •,water
they can get. , because this area is. -Usaically short of water'.-- �Mr. :Borne
stated that the County Health Dept.- has approved the test holes and
that the water is perfect. Larry Tuthill was :instructed to do a bond
estimate .on this subdivision.
On motion by Mr. Wickham, ,seconded by` Mr. Raynor ,r it was
RESOLVED that the- Southold Town' Planning Board grant preliminary
approval to the proposed subdivision map of "Leeward Acres"-:; property
located at Bayview . Southold,t New York.t, subject to the approval of the
road lay-out by the' Superintendent of Highways.

Mr:. Edwin King appeared before the' Planning Board,'again to
request"'approval of.his` proposed' minor subdivision of 4 ,lots;6; 'located
off south .side of Main Road. "Orients; New :York'. -The Chairman informed
him again that this must" be 'a major subdivision. " The .Board •cannot
grant approval -for. a minor subdivision 'in a case where -the' applicant
owns" surrounding land which is not to be included" in the minor sub-
division. - A minor subdivision shpuld not contain over 4 'lots. The
Board informed Mr, King of .the new County rule effective January
1970 requiring 40', .000 sq.. ft. of- area per lot., unless. ,the" .subdivision "
is to contain public water and sewerage. The "Board' informed Mr. King
that he had'; 3 alternatives: 1. Insist that the Planning" Board reconsider
their decision made at 'the last- meeting, 2. File "for a major subdivision
of 2; acre 'lets. 3". File for a minor subdivision. with 40.,a!,000 sq. ft,
of area per lot. 2 lots on EJS of-:,road and 2 lots 'on W/S of road.
Mr. King 'insisted :that the Board .re-consider his ,application .for minor
subdivision of 4.. lots as originally presented. The Board informed
him that.they .just w'ill. not approve" a minor subdivision when'he owns "
the surrounding land which is not included in• 1t: The 'Board advised
Mr. King to consider. a Major subdivision with lots of, 20..000 sq., ft,
of area and have estimates prepared for the -cost of roads and other
improvements. They suggested that he prepare a major subdivision map
-
, , and and perhaps divide it into sections to be filed 'seperately one - section
at a time,
John" Krukoski presented the' Planning Board with a -preliniinary
map for proposed minor subdivision of property of Charles: Krukoski.Z
located on. south side of Fanning Road., .New, Suffolk* New York. Thee
map showed. 4 lots:.; each containing less than 15,,a,,,000 sq. ft, of" area
except for Lot # 1 which" contained 15:.300 sq, ft, of" area. The
Chairman.:,atated that the Board could not accept'lots containing
under: 20.000 sq. ft, of area. The Board advised Mr. Krukoski"that
they wild have to consult the Town' Attorney:.; The Board 'ot. Health,,!
and the "County' Planning.- Commiss-ion. Chairman: dated the map as
received January 12�' 1970.
Chet-Orlowski presented the Board with preliminary map for
proposed subdivision of his� prop:erty located -on .west side of Harbor
Lane. .Cutchogue'c, New' York. ' The map was an .old surveyi made by
Van Tuyl,.;.-dated 'March '1961. The map showed 9 lots fronting on
Harbor' Lane,, scattered between ,property already built on. The
Board advised him• that they would consider -granting. -approval of
these lots-ir but the' balance of the property f interior lots); will
depend on providing roads and will have to go under 'the new County
regulation of 40.�000 sq, ft, of area per-lot.

Larry Tuthill P, E.• presented the Planning Board .with a bond
estimate in the amount of $67..,"000.00' for the- completion of _roads
and other improvements in the• proposed subdivision to be,'known -as
"Wheatfield Parks. owned by Frank & Nicholas Mandaroa.; property
located on north side of Griffing Street:. Cutchogues. N:Y: and a
bond estimate 'in the amount of $80,,,.000.00 for the: completion of
roads and other improvements in the proposed subdivision to be
known as "Laurel Country-. Estates" owned by' Leonard C., Emma. & -others
located on north side of Peconic' Bay Blvd.s Laurel.a,' New York:,
Dick Larks,, Esq. .-requested .that.,recommendations .-to, the .Towri:Board. on
these two subdivivions be held up. so. that he can acquire contracts
for the work- to present to the Board and possibly lower the bond
estimates.
: Larry Tuthill PE;- presented the Board with bond estimates in
the amount ' of $106000.00 for "Mattituck Ridge" and .$74s;000.00 for
"Mattituck Hills"* for roads.* drainages; and other improvements .in
-these two proposed subdivisions,. both properties located off north
side of Bergen' Avenue:,.,; Mattituc]ps; N.Y. The Board felt that the
drainage .was . inadequate., bond estimates to be revised.
Larry Tuthill PEE: presented the Board with a bond .estimate
in the amount_ of $511000.00 fvm .the completion• of roads and other
improvements in the subdivision • owned by Martin Weglicki_,.; located
on north side of Peconic Bay Blvd.,.; Laurel., New York.
On motion by Mr. Moisar, seconded. by Mr. Coylea, it. was
RESOLVED that the Southold Town Planning .Board recommend to
the' Southold Town Boards, a performance bond in -the• amount of- °$51s 000.
as prepared by Lawrence Tuthill., Construction Engineers; -for the
completion of roads and other improvements in the subdivision owned
by Martih'Weglicki•s; located on north side of Pe-conic Bay Blvd-:.,
Laurel, New York.
Vote of- the Board: .Ayes.-- Messrs: Wjckham.. Moises.; -Raynora Coyle.

in the amount of $15s;000,00 for the completion of roads and other
improvements `in-. the proposed subdivision to be known as . "Bennettts
Pond",. owned abd developed by' H.R; & Sons.. located.. off Westphalia
Road,; Mattituck* New York.

to the Southold Town Board a performance bond in the amount of
$15.,a,000. as prepared by Lawrence Tuthills; -Construction Engineer,
for -the• completion of roads and other improvements in the sub-
division to be known as "Bennett.$'s Pond"I. owned and developed by
H R.' Reeve & Sonss; property located off Westphalia Roads Matti.tucks:
New York.
Vote of the Board: Ayes;- Messrs: Wickhams, Moisa : Raynors Coyle,
in reference to "Cleave-s Points.,. Section III":,,, a letter of January
6,; 1970 from Dawn, Estates Builders, Corp.,. .was .read and placed.in ' file.
They informed us..that they have made arrangements with Corazzini to
complete the roads this spring. Letter to be sent to them stating
that the Planning Board would be willing to consider an extension of
time for the completion of these roads upon receiving a copy of the
renewed bond coverage.
Letter received from Walter Kappa; Esq. requesting an extension
of the approval of the preliminary map granted for Section: ll of
Harvest Homes Estates.
On motion by Mr. Wickhams, seconded by Mr. Coylea, it was
RESOLVED that the Southold Town Planning Board •grant a one .(1)
year extension of the approval of the preliminary map :of Harvest
Homes' Estates;a, Section .II.

Letter received from Sam Raskin'.'. Esq. a/c' C P.Ve Land Corporation
RE: "Blue Horizons; Section I"s. located at Peoohics,, 'N Y At Raskin
informed the Board that Angelo Curto has passed away'but his corporate
associates plan to proceed with the improvements this summer.. Mr Raskin
requested a one ;(1) .year extension of time on the bond. Letter to be
sent stating that the Planning Board would be willing -to .consider grant--...
ing. a one year extension upon receiving written proof that the bond
coverage has been renewed.
Letter received from' Bleeker Construction Cool' stating that their
bond coverage will. remain effective .until we receive notice' of cancell-

Letter received from Superintendent of Highways approving the
roads in "Birch Hill Estates" for dedication to .the Town. Call received
from' Dick Lark,i Esq. asking us not to release the -bond until he• secures
deed to roads and park area for' Birch Hilis' Property Owners Association.. '
Letter received from Edna Brown stating that she would be walling
to sell -her right-of-way boudding the northerly end of the proposed
subdivision of Andrew Dzenkowski:e, East Marione; NY. Letter to be sent
to Jos. Snellenburg advising him as such.
Letter received from ,Open'.Space Institute.. to be referred to the
' Southold- Town Conservation Council.
The Chairman suggested that the' Southold Town Building. Zone
Ordinance be amended to one ; ), acre zoning in accordance with the
new County regulation.- effective January 1.,, 1970,E requiring 40.,.000
sq, ft. of area -unless the subdivision is to have public water and
.sewerage.
On motion by Mr. Moisa.�, seconded by Mr. Raynor.j; it was
RESOLVED that the mimutes of the Southold Town Planning Board
dated December 8,r, 1969 be- approved as submitted.
