.... A regular meeting of ths' Southold Town Planning Board
was held at- 7:'30 P.M. , Tuesday, July 18,' 1967, at 'the Town
Office, Main Road, Southold, new York.
There were present: Messrs: Henry Moisa,;, Acting' Chairman,
William Unkelbach, Alfred Grebe, Frank- Coyle, 'Jofin Wickham
appeared at- the meeting later in 'the evening.
Also present: Messrs: Otto Van Tuyl, P.E. ,- Consultant; f
Howard Terry, Building Inspector.
PUBLIC HEARING: Upon question of approval of the following _
plat: Plat- of property owned by Henry J. & Stella M.- Smith,
entitled Peconic Homes,- Section II, consisting of a parcel of
land 9.48 acres, situated at Peconic, in the Town of Southold,
Suffolk County, .New - York, and bounded and describes as follows:
BEGINNING at a point on the westerly line of .a proposed
high way to be known as "Henry' s' Lane", 1505.24 feet northerly
along said westerly line from-Middle Road,said point of beginning
being the northeasterly corner of. lot 12, as shown on' 'map of
Peconic' Homes% filed in the' Suffolk- County' Clerk' s office as
Map' 04181;. from said point of-beginning running along said lot
12' as. shown on. said map,- S. 44" 53' 30" W.- -209. 98 feet:-to"%land of
C.P.F. Land Cop; thence along said land of C.P.F.. Land Corp;`N. 47°

The. Chairman opened the hearing.by reading the legal notice
of hearing, and the affidavit.- attesting to its publication in the
official newspaper of the- Town.
THE:-CHAIRMAN; : .Is, .the3B, anyone present-who wishes to speak
in opposition to iais: application for a subdivision?
NELSON AXIEN: I live in, Peconic. I have, w�ith. condition
a right of way that is going to be• closed off by lot 18 in the
new subdivision. -This will show the right- of way as, we .have it.
There .is. about 15' feet- which is needed to: get. contact'° w ith
this public highway through this right of way. (Mr.- Axien
read from-his deed giving access to his property.); Mr. Krupski
suggested a pretty easy way out- herer.. .that .is to ,have Henry
to get a'quit' claim deed over a piece: of property"that-wou-ld
incorporate the right of way in, this pieces. .to be entered -into
this particular'-property that we would touch with -the
highway and that- is all we would want..
-MR. UNKELBACH: Would you- abandone this part of' the right
- of-way?
MRO AXIEN: Yes. A. quit- claim deed. would be the best
solution. I also .saw'Mr. Edson` and I explain this to.him
and he seemed to nod his"head' in consent. This would actually
shut-.us off.
MR.VAN TUYL: If he was. to acquire a right of way. over' this
and abandone this& it- would be a fair solution.

MR ' UNKELBACH: A quit .claim deed should be- shown on the
map.
MR:- AXIEN: Yes' Mr. Krupski said it should be- on', this map.,
MR. VAN-'TUYL: This lot is subject to a right of:way.
MR -AXINE: No it- does not. This is part- of.what- used to
be' Stepnoski's property, This is an old deed. Once---,YOU ,
touch a public highway that it. that. The lawyers understand
that perfectly.
MR ' UNKELBACHL I think `that- right- of way will have to
be abandoned by description.
MR.' VAN' TUYL: If on this property,,. Mr.- Axien had' a right- of
way I can't see where anything needs.. to be done .on the .map.
MRS UNKELBACH: You have to' £ile, a legal 'instrument- to
abandone it.
MR. AXIENi, That- doesn z t- have to be done.
MR,' UNKELBACH: It will have to be done if someone searches
the title.

AXIEN: There is a deed' that- states when or if it= at
this point this road touches and goes into a public highway �thid'
will. cease.
HENRY' SMITH: When the Tonn .accepted this: this wall all
abandoned.
MR UNKELBACH: .Has an abandonment- beezi filed in the County
Clerk's Officez"
MR SMITH: Yes. This road will continue to go: through
there.
(_A discussion was held on the question of the rightof
way,_ and who had' right of way to what property.)
THE' CHAIRMAN: We will xecess:-the hearing' at this point
,until "this matter can'be settled. When the matter is settled
we willtake up the hearing again at our' next regular meeting.

Mr. Harold-Reese appeared before- the Board: with a plan :for
a parcel of land located off' Silvermere Road," Greenport, Mr.
Reese wanted to know if it.would' be permissible to run a road
down the middl'e: of' this property. Said road would' run. parallel
to and' be 300, feet, south of. the- Main. Road. On motion by Mr.
Coyle:, sdconded by'Mr. Uhkelbach,, "and unamieusly carriedD, it
- was agreed this proposal be, approved.
Messrs: Richard A. Sheldona,- Louis. Ferrdttis. &,William
Jessup appeared before the .Board with a preliminary subdivision plan
on property located on the east side Cox" Lanes. Cutchogues, New
York. The plan showed 12 building lots on the parcel. The
three- .lots on the existing road would only be 12:s,500 square .
feet -in area. These would- not- be included. in the filed,
subdivision map. The map did not. show a 100 foot-. turnaround.
Instead the 100 foot dead--end'was angled. It was suggested
that- possibly--there will have" to be fewer lots and make, the
l00 foot turnaround and. the lots on the-.existing street- larger
to be made part of the filed subdivision map. The' Chairman
advised, that: the Planning" Board would have to check with the
Superintendent- of Highways on the question of. the turnaround
and they will advise the applicants ofthe determination.`
A. delegation. of-property owners from the Deep' Hole Creek
area in Mattituck.,_ appeared before the Planning Board. Mr.
Harold° L.--Crowell,, 2850' Deep Hole` Drive was the spokesman -for
Mthe" group. The major complaint- concerned the drain pipes of
r." Zaleski. • It seems the water is draining,:from the vacant
land in iDeep- Hole' Creek" Estates onto the property of residents
on `Deep' Hole' Drive, which is a Town Road: . .Cbmplaints included
the-water: draining into residents-. cellars and�s'flooding cellars"
driveways washed outs, mud .running over land; flower beds
destroyed. It ,was felt this condition was a public hazard on
- the- road corner beacuse of' the" skid. The road is also � collasping
on the side. It was also- reported that- it. was proposed that
a marina for' 71" boats .was to be put in Deep- Hole Creek. Everyone
present- was assured that this would notbe permissible. The residents
were advised that the Subdivision was presently under bond and
the bond has not- run out. Mr. Zaleski has az other-: year and one
half to complete all improvements in. the. subdivisione The residents
were assured that- the- Planning- Board would have' Mr.. Lawrence Tuthill,"
P.E. Construction inspector make a. progress report and advise the

LI.,, the following resolution was unanimously adopted by the --
- Trustees:
"RESOLVED that- the' Southold Town' Trustees, require• that
Mr:_ William Victoria proceed'..without delay to. remove-. from. the
town .waters .of= Corey Creek all that -fill beyond the boundaries
contained' in,-the following description. and in- 'the manner out-
lined'therein:
"Beginning at': a point on the boundary line between land of
William' Victoria and land of` Koke' Estate,, said ]point. being, ,1038.77
feet southwesterly along said line from the, southwesterly' line. of
Main Bayview Road: running thence southeasterly on, a line at
right• angles to said boundary line 200 feet, thence deflecting to
the left sixt degrees";(60°) and running northeasterly about 530
feet to the, westerly side of a- boat- basin,_ .the last two courses
above described to define ordinary high- water mark.- following
necessary dredging and filling,,,.which .process shall result- in a
normal slope of the beach line.,. .leaving a depth of about 128
of water along. the- line of the existing high water mark.

RESOLVED that- the minutes of- the' Southold Town' Planning
BGwd- dated' June 20.,, .1967,,. be approved as submitted.

Mattituck': and have found them to meet the specifications
of the' Planning Board 'except for the construction, of
curbs. Thecost_ of approximately 100 feet- of curbing .
to complete the requirements of the Planning Board is

RESOLVED that- the Southold Town' Planning' Board approve

New York,,. to . 00.00 in accordance with the letter from
Mr. Lawrence, -,Tuthill.e; P�E.'
It was further' RESOLVED that- the' Southold Town Planning
Board _advise the' Southold Town Board of' their action on' this
matter.

. The- next- regular meeting. of. the' Southold Town Planning

.The' Planning Board.-list the following items to be
included in the Capital Improveibent. Program in the- Master' Plan:
1., Adequate Townrioffices for; all departments.
2. A continuing. program for improvement and .expansion of
public beaches.spparks and playgroundss,launching ramps& improved
docking facilitiess.. possible town marinas,. etc.
3.- Purchase of well. fields for furture public water supply;
including all ava1albe land on: Laurel Lake,
4.- Creation- of.water districts and capital funds for each.

5. Sidewalk,, curb®, and gutters,,, and an adequate drainage
' controll program.
6.- Street tree planting and replacement. program.
7. .Program for diking drainage areas to conserve as much

recreation areas.
