Y. 11971 PLANNING BOARD MEMBERS John Wickham, Chairman Henry,Moisa Alfred Grebe William Unkelbach M I N U:T' E S SOUTHOLD TOWN'PLANNING BOARD October 3, 1967 A regular meeting of: the Southold Town' Planning Board was held at 7:30 P.M. , Tuesday, October 3, 1967., at the Town' Office, Main Road,- Southold, .New York. .There were present: Messrs: John :Wickham, Chairman; Henry'Moisa, William Unkelbach, Frank"Coyle, Alfred Grebe. - Also present: Otto W.- Van Tuyl, Consultant; Lawrence Tuthill, Construction' Engineer. Lefferts P. Edson,- Esq. appeared before. the Board in regard. to the waiving of -the performance bond for' Peconic Homes, Section II, since the road has been completed. The chairman advised that this would ,need -the 'approval of: the Town Board in view ofthe fact the amount of the bond had been :set and accepted.by the Town Board. Mr. Edson was advised that when the Planning Board has: the letters of approval of the roads from, Lawrtnce Tuthill, Construction' Engineer, and Raymond Dead, Highway- Superintendent, and these are accepted the' Vown Board, themaps could be signed. Southold Town Planning Board -2- October 3, 1967 On motion by Mr. Coyle, seconded by Mr. Grebe, it was RESOLVED the' Chairman of the Southold Town Planning Board be authorized to sign the final subdivision maps of Peconic - Homes, Section 11, located at- Peconic, New York, owned and developed by Henry J. Smith, when the letters of approval of the roads from.Lawrence Tuthill, and Raymond Dean are in the files' of the Planning Board, and when said approvals are accepted by the Southold Town Board. Vote of the BoardE- Ayes:- Mr. Wickham, Mr. Moisa, Mr. Unkelbach, Mr., Coyle, Mr. Grebe. Mr. 'George Barzac, Jr. , appeared before the Planning Board with a sketch plan for a subdivision located on the east side Boisseau' Avenue, Southold, New York. The area involved in this plan is' approximately 12 acres. The map showed an area of the property not included in the subdivision plan. Mr. Barzac felt this was not suitable for residence since it was adjoining Cassidy property, however if the` Planning Board felt this should be included it could be done. The sketch plan showed 18- lots. The Planning Board does not like to see an oversize lot left , over because at some future date someone might want to divide the property into two lots and there would be a problem of access to the second lot. it was suggested that- the park area be enlarged so that' an oversized lot is not left'. Mr. Van Tuyl showed and overall plan of the adjoining properties, indicating aceess to Sawicki's property and Moffat's property. Mr. Barzac was advised that he should file a preliminary application for the property under question. Mr. Barzac stated he would like to Bart building a speculation house on one of the lots facing Boisseau Avenue. The Board advised that nothing should be constructed until more definit lot lines are established. The Southold town Planning Board received from the Southold Town Board the original petition of Helmut Hass of North Road, Greenport, New York, relative to a change of zone from "A" Residential and Agricultural District to "B" Business District on certain property situated in Peconic, New York, with the instructions to prepare and official report and define the conditions described therein. Southold Town Planning Board -3- October 3,, 1967 This property is described as follows: All that certain peice or parcel. of land situated at Peconic. in the Town of Southold, Suffolk- County, New York and more particularly bounded and described as- follows: BEGINNING at a point on the southerly line of' Middle Road, .as -widened, at the northeasterly corner of land of the 3rxx� party of the first part, said point' of beginning being about 1400 feet easterly along said southerly line from'Carroll Avenue; from said point of beginning running along land of Charles Hubbard and along land of Suffolk County, S. 230, 531 30" E.- 437.10 feet; thence along land of the party of the first part, two courses as follows: ,(1) S. 5.80 30' 30" W.-- 100.29 feet; thence (2) N. 23° 53 ' 30" W.- 439..53 feet to said southerly line of Middle. Road (as widened) ; thence northeasterly along said south- erly,- line on a curve to the left, having a radius of 5789.58 feet, a distance of 100. 0' feet to the point- of beginning, containing 1. 00, acre. The Board held a lenghty discussion on the property in question. It. was felt this would be spot zoning;and the fact-'that property adjoins Long Island Railroad property, characterized as Industrial property, should not be andetermining .factor in view of the fact- the Long Island Railroad is a special franchise._ The Beard looked at the maps showing what the County was taken for the widening of. County Road 27. On motion by Mr. Moisa, seconded.by Mr. Grebe, it was RESOLVED that the' Southold. Town Planning Board does not favorably recommend .to the Southold Town Board the change of zone from "A" Residential and -Agricultural-District-to "B" Business District on the above described property. The' Planning Board is not .willing to recommend a business zone on, the south side of County Road #27, even under the circumstances described in .the- petition. it is the' Planning Board' s feeling that County 'Road 27 should be maintained as a high-speed arterial without business build-up except- in areas such as Mattituck, Southold, and in the immediate vicinity of Peconic Lane, Peconic. - As a matter- of fact, Mr. Clarke, who lives on the north side of County Road #27, about where this property is located, presented a request for a business zone some time ago and we refused to recommend that. Regardless of the spot Southold Town Planning Board -4- October 3, 1967 zoning question, if a small business. zone is established in this vicinity, we can logically expect a tremendous expanded business area adjacent to this within two or three years. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, . Mr. •Unkelbach, Mr. Grebe. Mr.- Coyle abstained from voting. The Southold' Town' Planning'Board received from the Town Board the original petition of John Geier, North Road, Greenport, . New ' York, relative to a change., of zone from- '.'A" Residential and Agricultural District- to "B" Business District, on certain property situated at''Greenport, New York, with the instructions . to prepare an official report defining the conditions described therein. This property. is described as follows: All that .certain tract, piece, or parcel of land situated at Greenport, Town of Southold, County of Suffolk, State of Net York, and more particularly bounded and described as follows: BEGINNING at a point- on the southerly side of Middle Road (C.R... 27) North Road, where the same is intersected by the westerly, side of land' now or formerly of Village of Green- port, which point is distant 350.68 feet- westerly from the. corner formed by the intersection of the southerly side- of said Middle Road with. the westerly. side of Moore' s Lane, and from said point of' beginning., running thence along said land south 40 01' 10" east, 1106.60 feet; running thence still along said land south 840 53 ' 30" west, 474..24 feet; running thence ' still along said land north 40 06 ' 1.0" west- 830.50 feet. to the southerly side of- said Middle Road ; running thence along the southerly side of said Middle Road north 550 01' 10" east, 554.24 feet- to the point or place of bdginning. The Board briefly discussed this application. � aouthold Town' Planning Board . -5- October 3, 1967 On motion by'Mr. Unkelbach, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board does not favorably recommend to the Southold Town Board the change of zone from "A" Residential and Agricultural District to "B" Bui_ness property on the above described property. -The Planning. Board is unwilling to recommend this change ,'-:of zone because the application is for the wrong zoning for the type of' business intended. This change would constitute spot zoning, and the Planning Board feels . the parcel in question is too large to be considered under this application. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa,. Mr. Unkelbach, Mr. Coyle, Mr. Grebe. The Planning Board received from the Town Board the original petition of Benson S. Telsey, Greenport, New Yo2r, relative to a change of zone from "A" Residential and Agricultural District- to "B" Business' District- on certain real property situated at Greenport, New York, and are instructed' to prepare an official report defining. the conditions described therein, This property is described as follows: All that ..certain tract, piece, or parcel, of land situated at Greenport_ in the Town of= Southold,- County of- Suffolk,. and State of' New York, and more particularly bounded and described as follows: BEGINNING at a monument on the northerly line of' North Road, adjoining land of the Village ,of Greenport; from said point of-beginning running along. said land of the Village of Greenport three courses :' Cl) north 330 47; 30" west, 373. 04 feet to a monument; thenee ,(2) north 40 23 ` 20" east, 154.46 feet to a monument; 'thence- ,(3) north 50 46' 10" east, 114.80 feet to a monument; thence along land of H.J.S.- Land and Development Corp. , three courses: (1) south 85012150"' east:, 92.12 feet; thence south 180 51' 20" east 356.15 feet; thence (3) south 370 59' 20" east 167.82 feet to a monument on said northerly line of North Road; thence along '.said northerly line two courses: ;.(1) south 510 17' 40" west, 157.10 feet; thence 12) south 520 37 ' 20" west, 5 feet to the point or placeof beginnings containing 2. 03 acres. Southold Town Planning Board -6- October 3, 1967 On motion by Mr. Moisa, seconded by Mr. Unkelbach, it was RESOLVED that the' Southold Town Planning Board does not favorably recommend to, th a Southold Town Board the changeof zone from "A" Residential and Agricultural District to "B" Business District on the above described property. The. Planning Bca rd is of the opinion it- would be a mistake to establish a business zone adjoining the property- of the 4illage of Greenport, and the residen£ ;ally, zoned property. This, .of course, would be spot zoning,. The Planning Board also points out that- the' County Road will probably'be subject- to wide&1at some future date in this particular area. - Vote of the Board: Ayes-:- Mr. Wickham, Mr. Moisa, Mr. Unkelbach, Mr. Coyle, Mr. Grebe. On motion by Mr. Moisa, seconded by Mr. Unkelbach, it- was RESOLVED that the' Southold Town 'Planning Board does favorably recommend .to the' Southold Town Board: the change fof Zone from. "A" Residential and Agricultuaal District to "C" Industrial District- on the above described property, The Board agrees with the reasons. for a Chan ge, of zone as presented in the petition. Vote of the Board: Ayes; - Mr. Wickham, Mr. Moisa, Mr. Unkelbach, Mr.­ Coyle, Mr. ' Grebe. Mr., Lawrence Tuthill, P.E. ,. Construction Engineer, presented the following letter to the Southold Town Planning Board: "Southold Town Planning Board,- Southold, New York, October 3, 1.967. " "REE Peconic Homes, Section II . "Gentlemen: - I- have inspected the roads of Peconic Homes, Section II and have found them to meet the specification of the Planning Board. "Respectfully submitted, /s/ Lawrence M. Tuthill. " on motion- by'Mr. Moisa, -seconded by' Mr. Unkelbach, it was RESOLVED that- the Southold Town Planning Board recommend to the' Southold Town. Boar.d that .the Bond for the roads in Peconic Homes, Section II, Peconic, New York, owned and. developed by Henry' Smith, be waived. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Unkelbach, .Mr. Coyle, Mr. 'Brebe. Southold Town 'Plahbing Board -8- October- 3, 1967 On ,motion by Mr. Coyle, seconded by Mr.. Unkelbach, it was RESOLVED that Henry Moisa .be known as th e .official vice- Chairman of the' Southold Town Planning Board. Ayes:- Mr. Wickham, Mr. Unkelbach, Mr.-., Grebe, Mr.: Coyle. Mr. Lawrence Tuthill, P.E. , Construction Engineer presented the .following letter to the' Planning Board: "Southold Town Planning Board, Southold, .New York&, October 30 1967. "Re: Fordham Acres Sec. II "Gentlemen: I have inspected the roads of Fordham Acres Sec. II and have found them to meet the specifications of the, Planning Board. "Respectfully submitted, /s/ Lawrence M. Tuthill. " On motion by Mr. Unkelbach, seconded by Mr. Moisa, it was RESOLVED that the' Southold Town' Planning Board recommed to the Southold Town Board that they. release the performance bond on Fordham Acres, Section II, Greenport, New York, owned and developed by Ruth Preston, and' Others, subject to receiving a letter-of approval from the Superintendent of Highways. Vote of ' the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Unkelbach, Mr. Coyle, Mr. Grebe. On motion by Mr. Unkelbach,, seconded by Mr. Coyle, it was RESOLVED that the minutes of the' Southold Town Planning Board elated- Septa mber 6, 1967, be' approved as submitted. Vote of the Board: Ayes::- Mr. Wickham, Mr. Moisa, Mr.- Unkelbach, . Mr., Cyle, Mr. Grebe. Southold Town Planning Board -.9- October 3, 1967 Mr. Grebe bresented a map of land located.on Fishers Island,. New York, known as the Pennisula. There is an existing temporary road shown on the map. 'There was a question of access .to certain.lots. 'The present owner of the property, Mr. Elbert Burr, wishes to sell off lots in this area. The following letter was written,,to Mr. Burr: Dear Mr. Burr: The Planning Board has looked over your:7map of the Penninsula, Fishers Island, New York, date d .1913; revised October, 1951; revised July, 1953; and revised September 1967. The Board has determined that this map is so obsolete that a new map must .be filed before any further division of land is - made. All lots will have to have frontage of at least 100 feet on the access road and meet the minimum area requirements. (12,500 square feet with adequate public water, or 20,OOO square feet without public water) . All roads. must be cleared and improved at least to 20 feet wide, possible wider depending on the final number of lots involved. The New York State Real Property Law requires the- filing of a map prior. to the sale of lots, and the Town- of Southold has. just revised their' Rules and Regulations . for the Subdivision of Lan . All property division and sales .from' October. l, 1967, are subject to these .requirements. No building permits will- be issued without this approval. In the Matter of Mr. Burnham's lot, the Board recognizes prior ownership and will recommend that the Board of Appeals handle the approval .of access to this single lot under the provisions of the New York' State Town Law, Section 280A, with a mininum road width of 20 feet, cleared and graded. Mr. Van' Tuyl presented a revised subdivision plan for Richard A. Sheldon, Louis Ferretti, and William Jessup on property located on east side`Cox Lane,- Cutchogue, New York. This plan was very briefly discussed. No action.was taken on the matter. f Southold Town' Blanning Board _ -10- October 31 1967 A plan .for George' Ahler's subdivision. was briefly discussed and.no. action ,w as taken on the matter. Mr. Van' Tuyl showed a sketch plan for subdivision- of property behind Gardiners .Bay- Estates, on Orchard Lane, East. Mation,. New York. The Board .bXiefly discussed this plan. It was determined that any roads cut in would have to be at least 50 feet.-. wide. . The next regular meeting of. the- Southold Town Planning Board .will be held at 7:30 P.M. , Thursday, November 2, 1967, at the Town office, Main Road, Southold, New York.
