TERMS AND CONDITIONS
The Permittee,Susan Maarigo-Dunning residing at 925 Stephensons Rd Orient NY as part
of the consideration for the issuance of the Permit does understand and prescribe to the following:
l. That the said Board of Trustees.and the Town of Southold are released from any and all
damages,or claims for damages,;of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties,and the said Permttee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date. _
3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its .
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the.removal and/ alterations.in
the location of the work herein authorized,or if,in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required,upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion.-of the work
authorized.
9. That the Permittee will obtain all other permits and consents'that may be required
supplemental to this permit,which may be subject to revoke upon.failure to obtain same.

Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on Wed.,
December 14, 2011 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of SUSAN MAGRINO-DUNNING
applied to the Southold Town Board of Trustees for permits under the provisions of Chapter 275
of the Southold Town Code the Wetland Ordinance, and Chapter 111 Coastal Erosion
Management, applications dated November 17, 2011, and,
WHEREAS, said applications were referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the application for the existing structure
located seaward of the Coastal Erosion Hazard Line be found Inconsistent with the Local
Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said applications
on December 14, 2011 at which time all interested persons were given an opportunity to be
heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning these applications, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code, and,
WHERAS, the Board of Trustees determined that the existing structure located seaward of the
Coastal Erosion Hazard Line was constructed prior to the enactment of Chapter 111 Coastal
Erosion Hazard Area Law by the Town, and therefore does not require a Coastal Erosion
Permit, and,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that based on all the history, documentation, and personal inspection of the
property, and other evidence, the Board of Trustees deems the action to be Consistent with the
Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code,
and,
BE IT FURTHER RESOLVED, that the Board of Trustees approves the application of SUSAN
MAGRINO-DUNNING for the rehabilitation of the existing dwelling and deck including deck
replacement, new siding, new windows, porch enclosure, expanded entry, new roof,.and to
repair the existing foundation on the eastern portion of the dwelling, and as depicted on the
survey prepared by John C. Ehlers dated November 20, 2010.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

NAME OF APPLICANT: Susan Magrino-Dunning. SCTM#1000-17-1-2.1
PROPERTY LOCATION: 925 Stephenson Road(adj..to Long Island Sound)Orient,NY.
SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated August 31, 2011 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town
--of Southold Town Code and.the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP
Coordinator issued his reply dated December 1, 2009. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is EXEMPT from Coastal Consistency Review.
PROPERTY FACTS/DESCRIPTION: Parcel is a non- conforming 37,405 sq. ft lot improved with two as built
dwellings and a small garage. It has 93.80 feet on the L.I. Sound, 416.91 feet along the westerly property line,
125.00 variable feet along the southern property line and 431.16 feet along the easterly property line. It is noted
that this is an odd shaped lot as shown on the survey dated 11-20-2010 prepared by John C.Ehlers,LS.
BASIS OF APPLICATION: Request for Variance from Article XXIII Code Section 280-124 and the Building
Inspector's May 31, 2011, updated August 11, 2011 Notice of Disapproval based on an application for building
permit for "as built" addition/alterations to a single family dwelling at, 1) side yard setback of less than the code
required 15 feet.
RELIEF REQUESTED: The applicant built an addition of approximately 61 square feet onto the front of
the dwelling with 7.6 foot side yard setback where the code requires 15 feet.
ADDITIONAL INFORMATION: It is noted in the LWRP memorandum that it appears that renovations and a
new deck were made to the seaward side of the dwelling without a Chapter 111 Coastal Erosion management
Permit or a Chapter 275 Wetlands Permit.During the hearing the applicant's agent confirmed that there are
discrepancies between the plan attached to the existing CO and the survey submitted to the Board of Appeals in
connection with the variance request.Moreover,he acknowledged that additions and alterations were completed on

the seqward side of the dwelling and that an updated CO should be obtained. He also explained that the current
non-conforming side yard setback of 7.6 feet was the result of an error by the applicant's builder.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application October 6,2011, at which time written and
oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and
surrounding neighborhood,and other evidence,the Zoning Board finds the following facts.to be true and relevant
and makes the following findings:
1. Town Law Sec.267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of
the neighborhood or detriment to nearby properties. The applicant is requesting a variance for a non-conforming
side yard setback for "as built" alteration of 60.7 sq. ft. to this seasonal dwelling. The parcel is accessed by a
private right of way and is heavily vegetated with privacy screening. The addition is adjacent to a walking footpath
to the beach and is not visible from other nearby dwellings. .
2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. The side yard setback prior to the addition was at 9 feet,
any additions to this side of the dwelling would require a variance.
3. Town Law §267-b(3)(b)(3). The variance granted herein is substantial. However, the additional encroachment
of 1.6 feet is not substantial based on the original 9 foot non-conforming setback and the fact that there is a R.O.W.
to the beach adjacent to the subject side yard rather than a dwelling.
4. Town Law V67-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
dwelling is fitted with gutters and leaders to control roof runoff on site as per code.
5. Town Law V67-b(30)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law �267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of the alteration to this dwelling while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267=B, motion was offered by Member Goehringer, seconded by Member Weisman
(Chairperson), and duly carried,to
GRANT, the variance as applied for and shown on the survey prepared by John C. Ehlers, Surveyor, dated
11/20/2010.
Subject to the following condition:
1. The applicant shall apply for the required Coastal Erosion Management permit, wetlands permit and
building permit for the additions and alterations to the seaward side of the dwelling and obtain an updated
CO for the subject dwelling.
Any deviation from the survey,site plan and/or architectural drawings cited in this decision will result in delays and/or a
possible denial by the Building Department of a building permit,and may require a new application and public hearing before
the Zoning Board of Appeals.

Any deviation from the variance given such as extensions,or demolitions which are not shown on the applicant's diagrams or survey site
maps,are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or
condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of
nonconformity.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., June 18, 2008:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of SUSAN MAGRINO
DUNNING applied to the Southold Town Trustees for an Amendment to Wetland Permit
#6257 under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, and Coastal Erosion Permit#6257C under the

WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program.Coordinator for their findings
and recommendations, and,
'WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Code,

health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
BE IT FURTHER
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #6257 and Coastal Erosion Permit#6257C to demolish the existing
single-family dwelling and rear deck/steps, and construct a new single-family dwelling,
rear decking, swimming pool and hot tub, and as depicted on the survey prepared by
John C. Ehlers last dated April 21, 2008.

The Board of Town Trustees took the following action during its regular meeting held on
Wed., March 23, 2011 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of SUSAN MAGRINO-
DUNNING applied to the Southold Town Trustees for permits under the provisions of
Chapter 275 of the Southold Town Code the Wetland Ordinance, and Chapter 111
Coastal Erosion Management, applications dated March 1, 2011, and,
WHEREAS, said application was referred to the Southold Town.Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 23, 2011, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees APPROVES the applications of SUSAN
MAGRINO-DUNNING to repair the foundation of the existing single-family dwelling, and
as depicted on the survey prepared by John C. Ehlers dated November 20, 2010.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Suffolk Environmental Consulting, Inc. on behalf of SUSAN MAGRINO-DUNNING requests a Wetland

The proposed action has been reviewed to Chapter 268, Waterfront.Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program.(LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the LWRP policy standards and therefore INCONSISTENT with the LWRP.
The property owners did not build the structure to the plan approved by the Board of Trustee permit
NO. 6257, which relocated the entire structure landward of the CEHA, rather they chose to renovate the
structure in place with repairs to the foundation. In 2011 repairs to the foundation was applied for and
granted by the Board of Trustees under permits NO's 7503 and 7503C. However, it appears that
renovations of the structure and a new structure (deck) were built seaward of the Coastal Erosion
Hazard Line (see Figures 6 through 9).
Policy Standards
1. Avoid development other than water-dependent uses in coastal hazard areas. Locate
new development which is not water-dependent as far away from coastal hazard areas
as practical.
a. No development is permitted in natural protective feature areas, except as
specifically allowed under the relevant portions of 6 NYCRR 505.8.
It appears that renovations to the structure and a new structure (deck) attached
to the residential structure were built seaward of the Coastal Erosion Hazard Line
and adjacent to a low bluff without a Coastal Erosion Management Permit or
Wetlands Permit (See figures 6— 9).
