The deck addition was never constructed. The proposed screened porch is noted at 12 feet from the side property line, the dwelling currently exists at 4.5 feet from the side property line. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7, 2011,at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection.of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing one story dwelling is 19 ft. high to the roof ridge and the proposed screened porch on the rear of the dwelling is only 17 ft. high to the ridge. Therefore, it, and the proposed adjoining deck, will not be visible from the street. Also,the rear and side yards of the subject property are heavily screened by mature evergreen trees. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could reduce the size of the screen porch I addition and achieve a conforming side yard setback. However, the existing siding and doors on the rear elevation j of the house were located to accommodate the eventual construction of a deck based upon the side yard variance that was previously granted. Removal and relocation of these features would be a cost burden to the applicant. , 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial at a requested relief of 20% from the code. However, the proposed setback of 12 ft., is more conforming than the 4.5 ft. side yard setback of the existing house and maintains the setback previously granted by the ZBA. i 4. Town Law $267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed screened porch will meet the onsite drainage code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. However, the existing dwelling is situated 4.5 feet from the side property line. The proposed porch is requested at 12 feet from the side property line and the configuration of the rear door is such that the proposed location is most cost effective. i 6. Town Law �267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a screen porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
