FROM: James A. Schondebare, ,,:Town Attorney DATE: April 20, 1988 REF: Minor Subdivision of Sa`dick and Schlussel Pursuant to your request, I reviewed this file. It appears that ,the three lots were reduced to a two - lot subdivision when presented to the Planning Board due to a denial by the Suffolk County Health Department for three lots. The Planning' Board approved two lots subject to ZBA approval. You have advised that the application for ZBA approval was withdrawn by the applicant in 1983 . Also noted ,in file is a permit from the DEC for construction .of three single family dwellings, dated 2/29/88. . . Did the applicant submit the original three lots to DEC? Has the Suffolk County Health Department changed their position? In any event, vacant lot C.O. ' s should not have been issued for either the two lot subdivision, since that has not been completed, nor for the three original lots. JAS: jas !. t4` a G `. The variance application pending before this board is for area and lot width as shown on the 4/16/82 survey in our file. Since the applicants will be amending their original plan, the amendment should. be re-filed with the Building Inspector in order to determine whether or not a setback variance will be needed. On August 9, 1983 the Town Board adopted Local Law No. 9 . . in Relation to Area and Yard Regulations. . . . " One of the amendments includes a minimum 35-foot frontyard setback for lots under 40, 000 square feet in area (depicted as "A" on the attached schedule) . We are forwarding a copy of this letter to the applicants' attorney and request that three copies of the amended and approved survey/plan .be filed with our office in order that _ the board may review same for further processing. Schlussel and Marion Sadick Dear Mr. Grigonis: I am writing to you as a result of the State's August 16, 1983 decision conference for the above tidal wetlands application. We have decided to issue a permit and grant an average 10' variance to our setback requirement of the Tidal Wetlands Land Use Regulations. This would entail moving the proposed dwellings closer to the road. Therefore, the dwellings will be located 40' from the road rather than the proposed 50' . This would necessitate that you grant them a 10' variance to to local zoning requirements (setback from road) . We be that granting of these variances (both State and Town) would be leastm detriental to the environment. It would allow for a 50' undisturbed, upland buffer zone and still provide a 15' wide area between the house and buffer zone for the applicant's lawn. In this case, we believe that a 65' setback from the high marsh is necessary to preserve and protect the present and potential values of these tidal wetlands (i.e. , marine food production, wildlife habitat, flood and hurricane and storm control, cleansing ecosystems, and absorption of silt and organic material) . We hope you agree and are willing to grant a variance for the above. Enclosed is a copy of the permit. If you have any questions, please contact me at 751-7900. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (X) A Variance to the Zoning Ordinance is requested for the reason that each proposed lot would have insufficient' area (1) 30, 100 sq. feet; and (2) 32 , 600 sq. feet in 40 , 000 sq. feet zone, and each 135 feet frontage where requirement is 150 feet and that . . Form zsl (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the overall parcel of land consists of two building lots , one being the easterly lot having frontage of 70 feet and area of 22 ,000 sq. feet which was approved under Zoning Board Appeal No. 1174, March 29, 1968 , and the other being the westerly lot having frontage of 200 feet and area of 40,500 sq. feet. To meet the re- quirements of the Suffolk Count Health Department , two lots (1) 30 , 000E sq. feet and (2) 32 ,600E sq. feet are required. (see at- tached survey with approval. ) . Also, to maintain conformity of lot sizes in the area, the smaller lot should be increased in area. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because prior to the up zoning of the area, the sub-sized lot containing the 22 , 000 sq. feet and 70 feet frontage was created under Variance by approval #1174, March 29 , 1968 , with the up zoning to 40, 000 sq. feet. The smaller lot does not conform to the size of most of the other parcels in the area. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because most lots in the immediate area are approximately 30, 000 sq.' feet in area. Zoning Department Town Hall Southold, New York 11971. Attention: Mr. George Fisher Re: Sadick & Schlussel - Minor Subdivision Dear Mr. Fisher: Eclosed please find photocopy of minor subdivision map for Murray Schlussel and Marion Sadick seeking to create two lots , the one on the east containing 32, 600 square feet and the one on the west containing 30 ,100 square feet. I believe you must disapprove the request to build on these parcels in order to give rise to an ap- plication before the Zoning board of Appeals for a variance to build on . the undersized lots. You may recall that on October 19 , 1982, I met with you relative to this proposed subdivision wherein you found that the overall parcel had been peviousl_y subdivided pursuant to a determination of the Zoning Board of Appeals under appeal No. 1174 dated March 29 , 1968 , wherein there now are two legal lots , one being the most easterly portion having a 70 foot frontage and the other compris- ing the westerly portion having a 200 foot frontage. As you can see from the survey, it is the intention of the owners to create two lots , the easterly lot having frontage of 135 feet and the westerly lot having frontage of 135 feet. I would appreciate your denying our application for a building permit on these two lots so that I might proceed with the vari- ance. Very truly yours , 1 i . I /'_ ol '' SHEPARD M. On July 27 , 1972, Richard L. Sadick and Murray Schlussel purchased three lots on the north side of Stillwater Avenue in Cutchogue, New York. Enclosed herewith please find photocopies of map of property surveyed for Richard L. Sadick and Murray Schlussel, said survey dated June 9 , 1972 and showing three lots . The most westerly situ- ate lot was taken in the name of Murray Schlussel. The center lot was taken in the name of Richard L. Sadick and Murray Schlussel and the most easterly lot was taken in the name of Richard L. Sadilck. Each of the lots was a legal building lot by reason of the decision of the Zoning Board of Appeals under appeal number 1174 dated March 29 , 1968 , a copy of which is at- tached hereto. Messrs Sadick and Schlussel had made application to New York State Department of Environmental Conservation for approval to fill to bring to grade and for the construc- tion of three houses on the subject properties . Said permission was granted on November 6 , 1974 , with the pro- viso that no construction or fill be within fifty feet of the line of the mean high water mark. A copy of said approval is attached hereto. Town of Southold Planning Board October 4 , 1982 Page 2 Messrs . Sadick and Schlussel then applied to the Suffolk County Department of Health for Health Department permits to construct the three houses . The Suffolk County Health Department, however, denied their application by reason of the fact that the Health Department would not approve the construction of the houses by reason of the fact that cesspools and wells could note be placed on the three lots which would maintain a one-hundred foot distance between cesspools and wells as well as maintain a one-hundred foot setback of the cesspools from the dredged canal. In the year 1978 , Richard L. Sadick died and his Will was probated naming his wife, Marion W. Sadick as his Executrix as well as the owner of his interest in the subject real property. By reason of the disapproval by the Health Department of the application to construct three houses on the property, Marion W. Sadick and Murray S'bhlussel submitted to the Suffolk County Health Department an application to construct only two houses on the area comprising the three lots . Approval was granted on June 18 , 1982 for the construction of two houses on the area comprising of the three lots , pro- vided that two lots be created out of the three lots . At- tached hereto is a copy of the survey of the subject proper- ty showing the approval by the Suffolk County Health Depart- ment. The within application to your Board seeks permission to subdivide the center lot owned by Sadick and Schlussel into , two segments wherein the westerly portion of the center lot would be merged with the westerly lot owned by Schlussel and the easterly portion of the center lot would be merged with the easterly lot owned by Sadick so as to create two lots out of the three lots . Neither Marion W. Sadick, Murray Schlussel , nor the under- signed, nor any of their immediate Families are members of any governmental agency, whether Town, County or State, which would have jurisdiction over the within application. Town of Southold Planning Board October 4, 1982 : Page 3 The undersigned, on behalf of Marion W. Sadick and Murray Schlussel , requests your Board to approve the minor sub- division as requested herein, provided that the two newly created parcels are merged with the adjoining lots so as to create two lots out of the pre-existing three lots . DESCRIPTION OF ACTION The minor subdivision of Richard' L. Sadick & Murray Schlussel, is a two lot subdivision located at Cutchogue . The project has been determined not to have a significant effect on the environment for the. following reasons : An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Applicant should be aware that a permit may be required because of the proximity to the wetlands . The Suffolk County Department of Health Services has indicated its agreement with the lead agency designation. The installation of subsurface sewage disposal systems will require the removal of any impervious materials and the re- placement with clean sand and gravel . Information on private wells in the area indicate a sufficient quanity of potable water. Prior to occupancy of the proposed houses , a complete water analyses will be required. Raynor , Jr.',, Chairman Re : Sadick G Schlussel Minor Subdivision Dear Mr . Raynor : Receipt is acknowledged of your letter dated December 6, 1982 relative to the above-entitled matter, granting approval of the sketch map of the minor subdivision referenced above, sub- ject to receipt of approval of an area variance from the Zoning Board of Appeals . I have had new maps made which set forth the following informat.ion: 1. The legal lot line as -determined by George Fisher in our meeting with him of October 19, 1982. You will note that it is Mr ., Fisher 's determination that at this point in time, the overall property has heretofore been divided into two lots, one with a 70 ' frontage comprising the lot containing 22, 000 square feet and representi, ing the most easterly portion of the property and the other legal lot comprising the balance of the property lying to the west incorporating the two par- cels, having 20, 000 square feet and 20, 500 square feet . 2. The three lots are described under deeds placing owner- ship of the most easterly lot in Murray Schlussel , the center lot in Richard L . Sadick (now Marion Sadick) and Murray Schlussel and the most easterly lot in the name of Richard L . Sadick. 3. The proposed subdivision of the property into two lots, the westerly lot containing 30, 100 square feet and the wester- ly lot containing 32, 600 square feet and said lots being iden- tified as # 1, the westerly lot and #2, the easterly lot . 4. The proposed houses on each of the proposed lots show- in_q setbacks and side yards and the location of pools and wells . Planning Board Town of Southold December 14, 1982 Page 2 After having these new maps prepared by Roderick Van Tuy1 wherein Mr . Van Tuy1 had only sent us six copies of same, we had requested of Mr . Van Tuy1 to send us an additional 24 copies to have sufficient copies of same to present to your Planning Board, the Zoning Board of Appeals , as well as the Department of Environmental Conservation. I have been advised that Mr . Van Tuy1 no longer is An business and have been . un- able to obtain those additional copies and as such , am forced to send to you two original surveys and four copies of surveys to be forwarded to the State and County Agencies . I am utili - zing the other original copies in conjunction with our appli - cation to the Zoning ' Board of Appeals and the Department of Environmental Conservation . I hope that the photocopies will meet the requirements of these agencies but it appears that we have a practical diffi - culty which we are hard pressed to overcome. Very truly yours , SHEPARD M.
