The portion of the referenced property that is landward of the"TOP OF BANK" in excess of 19 feet in elevation,as shown on the survey prepared by Nathan Taft Corwin III last revised on 3/19/09,is beyond the jurisdiction of Article 25 Tidal Wetlands. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations(6 NYCRR Part 661)no permit is required under the Tidal Wetlands Act.
