Y. 11971 PLANNING BOARD MEMBERS John Wickham, Chairman Henry Molsa Alfred Grebe Henry Raynor Frank Coyle M I N U T E S SOUTHOLD TOWN PLANNING BOARD February 28 , 1972 A regular meeting of the Southold Town Planning Board was held at. 7 :30 P.M. , Monday, February 28 , 1972 , at the Town Office, Main Street, Southold, New York. There were present: Messrs : John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Frank Coyle; and - Alfr--ed Grebe. Also present: Howard Terry, Building Inspector; and Lawrence Tuthill. P.E. Rudolph Bruer, Attorney a/c Henry L. Fleet appeared before the Planning Board in reference to the proposed subdivision of Henry L. Fleet, to be known as "Pequash Acres" , located at E/S of Fleet' s Neck Road and W/S of Track Avenue, Cutchogue, New York. Mr. Bruer presented the Planning Board with final maps containing the signature of the Health Dept. by H. W. Davids, Southold Town Planning Board -2- February 28 , 1972 Director of the Division of Environmental Sanitation, and the signature of the Suffolk County Dept. of .Environmental Control- by John Flynn. However, this map did not contain the note as suggested by the Planning Board at the last meeting, "The lot lines on subdivision maps , as filed, cannot be altered without specific permission from the Planning Board; and lots must be sold as shown on the subdivision map. " The Board questioned Mr. Van Tuyl as why this note was not on this map. Mr. Van Tuyl said that these maps were made up before he received the notice from the Planning Board. The Board advised Mr. Van Tuyl that the note must be added to this subdivision map. Mr. Bruer requested that this subdivision be set up for a final hearing. On motion by Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board set the next regular meeting of the Southold Town Planning Board, to be held at 7 :30 P .M. , Monday, March 21, 1972 , at the Town Office, Main Street, Southold, New York, as the time and place of hearing upon approval of the following plat: 1. Plat of property owned by Henry L. Fleet, entitled "Pequash Acres" , consisting of a parcel of land of 6 . 161 acres, situated at Cutchogue, in the Town of Southold, Suffolk County, New York, and bounded and described as follows: BEGINNING at a point on the easterly line of Fleet' s Neck Road at the southerly corner of land now or form- erly of G. Fiore, which point is also the westerly corner of the premises herein described; running thence along the said land of G. Fiore and land of the Estate of Hand North 46 degrees 24 minutes 00 seconds East 392 . 20 feet to the westerly line of Track Avenue; running thence along the said westerly line of Track Avenue South 44 degrees 42 minutes 40 seconds East 493 . 36 feet; running thence. along land of Rynieg and Annabel the following two courses; (1) South 44 degrees 42 minutes 40 seconds East 189..13 feet and (2) South 42 degrees 24 .minutes 00 seconds East 148 . 93 feet to the northerly line of .Stillwater. Containing 6 .161 acres. Southold Town Planning Board -3- February 28 , 1972 Vote of the Board: Ayes : - Messrs : Wickham, Moisa, Raynor, Coyle , Grebe . Rudolph Bruer; Attorney appeared before the Planning Board in regard to the proposed minor subdivision of David L. Gillispie, located off N/S Main (State) Road, East Marion, New York. Mr. Bruer is . representing the purchaser of lot 5-5A - Charles & Ruth Campbell. The Planning Board . informed Mr. Bruer that this minor subdivision has not been granted final approval to date. The final approval of this minor subdivision is still pending presenta- tion of the following items by David L. Gillispie:- (1) Necessary maps and completed Health Dept. forms for referral to the Health Dept. as described .in Planning Board' s Letter of. January 18 , 1972 to Mr. Gillispie. (2) Two (2) copies of formal . application; and (3) Application fee of $50 . 00 . Mr. Bruer explained that the Campbell ' s have purchased this lot and obtained Health Dept. approval and they want to start building on it. They have sold their house and they have a. time factor to work with. The Board discussed the situation. It was suggested that if the complete fee for this minor subdivision was put up, to be held in escrow, the Building Inspector could be instructed to issue a building permit on lot 5-5A. The Chairman stated that we must have a copy of the Health Dept. approval for the file. On motion by Mr. Coyle, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board table determination on the above matter for further deliberation of the Board later in the evening. Vote of the Board: Ayes:- Messrs : Wickham, Moisa, Raynor, Coyle, Grebe. Jack Driscoll and Alfred J. Kron presented the Planning Board with a preliminary map for proposed minor subdivision of five (5) lots on property located ,at N/S Bay Avenue, Cutchogue, N.Y. This property is presently owned by Leon H. Standley - Mr. Kron is contemplating the purchase of this property. This property fronts on the S/W end of Little Creek and W/S of County dredged canal. The Board inspected this proposed minor subdivision map. Lot no. 1 contains 35 , 000 sq. ft. of area; lot no. 2 contains 41, 000 sq. ft. of area and a one family dwelling and garage; lot no. 3 contains 35 , 800 sq. ft. of area. These three (3) lots front on the north side of Bay Avenue. Lot no. 4 contains 70, 000 sq. ft. of area; and lot no. 5 contains 54, 000 sq. ft. . of area. These two (2) lots are interior lots with frontage on the dredged canal, and right- of-way off Bay Avenue for access. The Chairman informed them Southold Town Planning Board -4- February 28 , 1972 that the area shown as lots 4 & 5 was owned by the "Commoners" up until about 2 years ago when they traded it for other land across the canal. The Chairman stated his opinion that they would probably never get an approval from the Health Dept. on these lots (4&5) .. Only about one-third of . the area of these lots is buildable. upland, the remaining two-thirds is meadow- land. They .wo.uld :also have to .get an .approval from the Town Board to develop these lots: . Mr. Kron stated that he doesn't want to develop these lots because. he lives directly across Little Creek to the west and would not want .to block his view of the Bay. The Chairman suggested that he. put a scenic ease- ment on these lots and a Covenant & Restriction to be filed with the deed stating" "That this lot is not to be further subdivided or developed in the future. " Then Mr. Kron subsequently stated that he wants to get at least four building lots out of this property and would like to sell this area (lots 4 &5) as one building lot. The Planning Board stated that they might possibly allow them to develop this area as one building lot, subject to obtaining Health Dept. approval, and approval from the Town Board to. develop this area. The area of lots 1 & 3 must be increased to.. at least 40, 000 sq. ft. each. The Board suggested that they eliminate the portion. of the right=of-way shown on this map. as running east and west and add this area to lots 1, 2 , . & 3 . , As lots 4 & 5 , as shown on this map,aare to be combined, the right-of-way could be continued northerly (on. the easterly side of the property) for at least 100 ft. to give the interior lot the necessary frontage . The Planning Board advised Mr . Van Tuyl .that they will require contours , to at least 5 ft. , to be shown on the revised map. Mr. Kron to contact the Health Dept. to obtain approval for the interior lot, and to present revised map at next Planning Board meeting. _Jack Driscoll appeared before the Planning Board in regard to the proposed change. of zone application of Edward R. Rolquin on. property located at S/W corner of Middle Road (CR 27) and Cox ' s Lane., Cutchogue, N.Y. This application has been referred to the. Planning Board, for their recommendation, by the Town Board. Mr. Driscoll requested that the Planning Board make their recommendation at this time. The Southold Town Planning Board received from the Southold Town Board . the amended petition of Edward R. Rolquin, .Harb.or Hill Drive, Lloyd Harbor, Huntington, New York, relative to change of zone from '.'A" Residential and .Agricultural District to "B" Business District on certain property situated. at Middle Road (CR 27) , and Cox' s Lane, Cutchogue, .New. York, together with the in.= :- structions to prepare an official report defining the .conditions contained therein. This property is. .situated at Cutchogue, in the Town of Southold, County of Suffolk, New York, and more partic- ularly bounded and described as follows : Southold Town Pl—ning Board -5- _'ebruary 28 , 1972 ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Cutchogue, Town of Southold, County of Suffolk, and State of New York, bounded north by Middle Road, east by Cox Lane, south by land of A. Pietrewicz , and west by land of said Pietrewicz; containing by estimation one-half (1/2) acre, be the same more or less . The Planning Board discussed this proposed change of zone at some length with Mr. Driscoll. On motion by Mr. Wickham, seconded .by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board table determination on the above proposed change of zone application for further deliberation of the Board later in the evening. Ken Marshall and Jim Eagle a/c Farmingville Associates appeared before the Planning Board in reference to the site plan of "Bohack Village" , located at N/S Main Road, Mattituck, New York. They presented the Planning Board with a revised site plan showing a right-of-way on the westerly side of the property (thereby cutting down on the plantings) for the houses to the west. The Chairman was very unhappy with the engineering.-done on this project, there should have been provision for a right-of-way on the first presentation of the site plan. Engineering work was done by Rosedale. The Planning Board stated that they must pave the right-of-way but they must also meet the requirements for planting. The. Chairman specif- ically stated that the planting must be done on the easterly side of this paved right-of-way to make it estatically attrac--. tive. : Mr. Eagle asked if the right-of-way could be opened, through the planting, for access to the rear of. the stores for delivery trucks, etc. The Planning Board said that this would create problems with the State, they would have to discuss it with them. Mr. Eagle said that they would just as soon forget it then. Lawrence Tuthill P.E . brought up a question in reference to the drainage, he said that the water was running out on the state highway. The Planning Board stated that this must be corrected, all water must be retained on their own property. Mr. Eagle said that they will put a ridge in the pavement to retain. the water. Larry Tuthill said that this would be satisfactory. The Planning Board advised them that revised maps must be presented. Southold Town Planning- Board -6- February 28 , 1972 Nicholas J. Leonard presented the Planning Board with preliminary maps for the proposed minor subdivision of property of Frank Stillo (formerly Peter Sledjeski) , located off NIS Main (State) Road; Orient, New York. The map showed a minor subdivision of five (5) lots with 30 ft. right-of- way from the Main Road for access . Lot no. 1 contained 50 , 320sq. ft. of area, lot no. 2 contained 46 ,500sq. ft.- of area - both fronting on L.I .Sound. Lot no. 3 contained 40 ,380sq. ft. of area, lot no. 4 contained 40, 410 sq. ft. of area, acid lot no. 5c, contained 40,190 sq. ft. of area. The Planning Board advised Mr. Leonard that a condition of granting this minor subdivision would be that 50ft. connecting roads for "reservation for possible dedication to the Town of Southold" must be provided for connection to adjoining subdivisions . The Board advised Mr . Leonard that this minor subdivision map will have to be put on their key map to determine where the 50ft. reservations should be placed, so that they will be kept in line with the connecting roads in the adjoining subdivisions. Mr. Leonard was advised to appear at the next Planning Board meeting. If determination is made before that date, the Planning Board to send letter to Mr. Leonard at 555 Oakwood Drive, Southold, N.Y. Dominic Aurichio, Attorney appeared before the Planning Board in reference to the proposed subdivision "Petty ' s Bight" , located at NIS Main (State) Road, Orient, New York. Mr. Aurichio referred to the Planning Board memorandum of February 15 , 1972 , concerning the Suffolk County Planning Commission' s requirements for this subdivision. In regard to Item # 1 - intersection design of Petty.' s Drive & . Bight Road - Mr. Aurichio presented : Exhibit "A" - . his -design, and Exhibit "B" - the Planning Com- mission' s design. Mr. Aurichio yet to present the Planning Board with his supporting statements for argumentation of superiority of his design. Otto Van Tuyl P .E. stated that he agrees with Mr. Aurichio ' s design for the intersection. In regard to Item # 2, . Mr. Aurichio presented Exhibit "C" - the drainage plan for the entrance at the State Road. The Planning Board informed Mr . Aurichio that they will transmit Exhibit "A" , "B" , & "C" of this subdivision to the Suffolk County Planning Commission for review upon receipt of Mr. Aurichio' s supporting statements for argumentation of superiority of his intersection design. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board transmit . Exhibit "A" , "B" ,' & "C" of the proposed subdivision "Petty' s Bight" to the Suffolk County Planning Commission for review of the drainage plan and intersection design of Petty ' s Drive and Bight Road. This resolution is made subject to receipt of Mr. Aurichio ' s Southold Town Planning Board -7- February 28 , 1972 supporting statements for argumentation of superiority of his intersection design. Vote of the Board: Ayes : - Messrs : Wickham, Moisa, Raynor, Coyle, Grebe. Charles Raffee, Attorney and Richard Young appeared before the Planning Board in regard to proposed subdivision of Mr. Young ' s property located at north side of Bay Avenue, Cutchogue, N.Y. The Planning Board was presented with a preliminary map showing the subdivision of this property into 22 lots, all lots containing 40 , 000+ sq. ft. of area, according to surveyor ' s note. The map showed proposed 50 ft. road running from Eugene ' s Road north, and running easterly between lots 10 & 17 to lots 13 & 14 . The snap showed a round cul-de-sac at the ends of each of these roads . The Chairman informed them that our Supt. of Highways doesn' t like cul-de-sacs, they will be required to square off the turn-arounds . The Chairman also informed. them that the square footage of each lot must be printed on the map. Park area was shown north of lot # 10 . Mr. Raffee inquired the exact requirement for park area. The Board informed him that you must set aside one (1) subdivision lot for each 50 lots. The map showed a parcel of property (outside of the subdivision, east of lots 14 & 22) as owned by Richard Young. The Planning Board informed them. that this parcel must be incorporated into .the subdivision. The Planning Board also suggested that he try to purchase the property east of this , owned by Mike Shepish (with frontage on Bay Avenue) in order to give the, subdivision an entrance or . exit on Bay Avenue. The Planning Board informed them that the Supt. of Highways would probably prefer another entrance- or exit for this sub- division, either on Eugene ' s Road or Bay Avenue, if property can be purchased from Mike Shepish. The Planning Board ad- vised them to take a copy of this map to the Supt. of Highways for his approval of- the road lay-out. Mr. Raffee asked about curbing on Eugene ' s Road, the Chairman said that this will be up to the Supt. of Highways and advised him that the Supt. of Highways has recently made up some recommendations for requiring improvements on existing Town roads . Mr. Kurt Jensen a/c Bayview Development Corporation and Mr. Angliese, Architect appeared before .the Planning Board and presented a proposed site plan for "modular homes" on .property of Bayview Development Corp. located off south side of Bayview Road, Southold, New York. Mr. Jensen stated that Southold Town Planning Board -8- February 28 , 1972 the present use of the property is a transient. motel, this plan would transform it into a permanent residence colony. There will be 36 additional units constructed, all two bedroom apart- ments. The total number of units , .upon completion, will be less than or equal to 50 . The proposed plan involves the tearing down of. the existing 20 cottages plus the demolition of the office building, and renovation of the existing motel unit - updating of the plumbing and heating facilities and installation of air-conditioning. The recreational facilities will be im- proved as follows : (1) the swimming beach will be stabilized; (2) a tennis court will be . constructed; (3) a swimming pool will be constructed; (4) the property will be bulkheaded for use as a private .marina. They. presently have. a variance appli- cation before the Board of Appeals to increase the denisty of each building. If they are . satisfied with the popularity of it­.as a year round residence, they will proceed to construct the others the following spring. Mr. Jensen said. that they are in the process of submitting the sewerage treatment plan to the Health Dept. The Chairman informed them that the Health Dept. is now requiring both package public water and sewerage treatment plants, for- developments . of. this type . Mr. Angliese said that they have been discussing it with the Health Dept. and they stated that they will require package sewer only. The Chairman said .that the water and sewer plan must be clarified with the .Health Dept. Mr. Angliese left- copies of the site plan with the Planning Board. The Chairman informed them that we will contact the Health Dept. on this matter and should have an answer for them within several weeks . Richard Lark, .Attorney and John Gradowski appeared before the Planning Board for an- informal discussion on the proposed change of zone application to be- submitted on the -property located at W/S of Griffin Street,. Cu.tchogue, N.Y. This change of zone request yet to be presented to the Town Board and ' referred by them to the Planning Board. Steve Mitacchione .presented the Planning Board with three (3) copies of revised final maps, 2 copies of formal application, and fee of $20 . for his proposed minor subdivision located at S/S Eugene ' s Road, Cutchogue, N.Y. The revised final maps showed a division of the property into two (2) lots as suggested by the Planning Board at their last meeting. On motion by Mr. Wickham, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board table determination on the above proposed minor subdivision for Southold Town Planning Board -9- February 28 , 1972 further deliberation of the Board later in the evening. Vote of the Board: Ayes : - Messrs : Wickham, Moisa, Raynor, Coyle, Grebe . Fabrizio Gentile presented the Planning Board with site plan for his proposed restaurant to be located at N/S Middle Road (CR 27) , east of Cox Neck Road, Mattituck, N.Y. This property is presently zoned as "B-1" heavy business, so no change of zone will be necessary. The proposed plan showed proposed restaurant, to be operated by Mr. Gentile, and two (2) proposed stores for rental purposes . The Planning Board inquired if there would be any lighting in the parking area. Mr. Gentile said that the lighting will be on the buildings only and will not illuminate into the highway. The access road for the Expressway is east of this . Fee of $25 . for review by the Planning Board has been received from Mr. Gentile. On motion by Mr. Raynor, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board table determination on the above matter for further deliberation of the Board later in the evening. Vote of the Board: Ayes :- Messrs : Wickham, Moisa, Raynor, Coyle, Grebe . Howard Terry advised the Planning Board that Professor Lewis of the University of Illinois is scheduled to speak at the University of Hartford, Conn. on March 9th. Professor Lewis conducted an excellent program at the Eastern States Meeting, and it would be beneficial if someone from the Planning Board attended the program to be held in Hartford. Supervisor Martocchia appeared before the Planning Board and requested that a detailed study be made on the . proposed "Annexation to Greenport Village" in regard to it! s effect on Southold Town' s zoning, population, and water supply. Parcel I - E/S Moore ' s Lane and CR 27 ; Parcel II - E/5 Chapel Lane to Main Road & North Road. Public hearings are scheduled to be held by the Village Board on April llth & 13th. This report must be submitted by the Planning Board to the Town Board on or before March 28th so that the Town Board can submit their Southold Town Planning Board -10- February 28 , 1972 recommendation to the Village Board. The Chairman stated that since this property is within 500ft. of the Village line, and state and county highways , it will come under the County Planning Commission' s jurisdiction and we should request the County to make a study of it. The Greenport Village Board and Planning Board to be notified that we are requesting an impartial study to be made by the County. Supervisor Martocchia advised the Planning Board that the Town Board is expecting to receive an application for a change of zone on property of Joseph Krukowski, located at south side of Main Road, Southold, N.Y. The Planning Board discussed again the proposed minor subdivision of David Gillispie in regard to the hardship case as presented earlier in the evening by Rudolph Bruer, Attorney a/c purchaser of lot 5-5A, Chas . & Ruth Campbell. With regard to the hardship involved in this case, the following resolution was passed by the Planning Board: On motion by Mr. Grebe, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board hereby instruct the Building Inspector to issue a building-, permit on Lot # 5 & 5A of the proposed minor subdivision of David L. Gillispie, located off NIS . Main (State) Road, East Marion, New York, subject to receipt of the following: - 1. Complete fee for this minor subdivision in the amount of $50. 00 2 . Copy of the Suffolk County Department of Health approval of the well and cesspools on lot # 5-5A. This is not a final approval of this minor subdivision. The final approval of this minor subdivision is still pending presentation of the following items by David L. Gillispie: 1. Necessary maps and completed Health Dept. forms for referral to the Health Dept. as described in Planning Board' s letter of January 18 , 1972 to Mr. Gillispie. 2. Two (2) copies of formal application. Vote of the Board: Ayes :- Messrs : Wickham, Moisa, Raynor, Coyle, Grebe. 5' Southold Town Planning Board -11- February 28 , 1972 The Planning Board reviewed again the site plan for the proposed restaurant and rental stores of Fabrizio Gentile on property located at north side of Middle Road (CR 27) , east of Cox Neck Road, Mattituck, N.Y. On motion by Mr. Grebe, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant approval to site plan, dated February 17 , 1972 , as presented by Fabrizio Gentile for proposed restaurant to be located at N/S Middle Road (CR 27) , east of Cox Neck Road, Mattituck, New York. . Vote of the Board: Ayes : - Messrs : Wickham, Moisa, Raynor, Coyle, Grebe. The Planning Board reviewed again the amended petition of Edward R. Rolquin for change of zone from "A" Residential and Agricultural District to "B" Business District on property located at S/W corner of Middle Road (CR 27) and Cox' s Lane, Cutchogue, New York. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board does not recommend favorably to the Southold Town Board the change of zone from "A" Residential and Agricultural District to "B" Business District on the property of Edward R. Rolquinn, located at S/W corner of Middle Road (CR 27) and Cox' s Lane, Cutchogue, New York. (legal description on Page 4) It has been the policy of the Planning Board not to recommend business zoning on County Road 27 , and this parcel is too small in area for useaas a business lot. Vote of the Board: Ayes : - Messrs : Wickham, Moisa, Raynor, Coyle, Grebe. The Planning Board discussed again the proposed minor subdivision of Steve Mitacchione, located at S/S Eugene ' s Road, Cutchogue, New York. On motion by Mr. Raynor, seconded by Mr. Wickham, it was RESOLVED that the Southold Town Planning Board grant final approval to the proposed minor subdivision of Stephen Mitacchione, as shown on survey dated February 8 , 1972 by Young & Young, property located at S/S Eugene ' s Road, Cutchogue, New York. Southold Town Planning Board -12- February 28 , 1972 The Chairman sigged the final maps . Vote of the Board: Ayes : - Messrs : Wickham, Moisa, Raynor, Coyle, Grebe. The Chairman reported that he spoke with Robert Tasker, Town Attorney in regard to the defaulted subdivisions . Mr. Tasker advised that the Planning Board has no right to make any changes or adjustments on any subdivisions that are not on the approved list in the Zoning Ordinance. All subdivisions that are not on the approved list will have to meet the 40, 000 sq. ft. requirement. We can only recommend to the Town Board to make adjustments . The Town Attorney also stated that problems may arise with the minor subdivisions .presently going to the Board of Appeals for variances. He suggested that it might be easier to request that the Town Board approve all minor subdivisions less than 40, 000 sq. ft. which had been approved by the Planning Board prior to December 17 , 1971. The Planning Board approved them in good faith, but the owners didn 't sell out in time. Howard Terry stated that it is more legal for the Board of Appeals to grant variances then for the Town Board to approve them without listing each as was done with the major subdivisions . On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the minutes of the Southold Town Planning Board dated February 7 , 1972 , be approved as submitted. Vote of the Board: Ayes : - Messrs : Wickham, Mois4, Raynor, Coyle, Grebe. On motion by Mr. Wickham, seconded by Mr. Grebe, it was RESOLVED that an executive meeting of the Southold Town Planning Board be held at 7 : 30 P .M. , Tuesday, March 7 , 1972 , at the Town Office, Main Street, Southold, New York. Vote of the Board: Ayes :- Messrs : Wickham, Moisa, Raynor, Coyle , Grebe.
