Y. 11971 PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Henry Raynor Frank Coyle M I N U T E S SOUTHOLD TOWN PLANNING BOARD April 3, 1972 A regular meeting of- the Southold Town Planning Board was held at 7: 30 P.M. , Monday, April. 39 1972, at the Town Office, Main Road, Southold, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Frank Coyle; Alfred Grebe.. Also present: Howard Terry, Building Inspector; Lawrence Tuthill, P.E. , Construction Engineer. Mr, Bernard -Caplan & Another appeared before the Planning Board in response to the Planning Board's letter of December 10, 1971 regarding the condition of the roads in Cleaves Point, Section III. The Chairman read this letter which stated that the roads in this subdivision were not up to specifications for which they were bonded, and also informed them that this Southold Town Planning Board -2- April 3, 1972 subdivision was not included on the list of approved subdivisions set forth in the amended Zoning Ordinance by the Town Board. The Chairman stated that the Planning Board has no authority to com- promise at, all. The Zoning Ordinance, as amended by the Southold Town Board, now states 40,000 sq. ft. of area per lot, The Chairman stated that . this case is further compromised by the fact that the bond is in default. Mr. Kaplan said that he pointed out, in his response to our letter, that the County Health Dept. had granted them an extension and that the County Planning Commission stated that they have no jurisdiction. The Chairman informed him that, regardless of the County' s approval, this is not an approved subdivision as far as the Town of Southold is concerned. Mr. Kaplan stated that the first official notice that they ever re- ceived advising them that there was any default was from Mr. Tasker, and Mr. Tasker did not state what the default was. Mr. Kaplan stated that he feels that he has acted in good faith in this matter and that he would .like to prove this to the Planning Board. Mr. Kaplan read the letter which he received from Mr. Tasker dated October 16, 1970 and his response to Mr. Tasker dated October 19, 1970. In Mr. Kaplan's letter he inquired what his default was, however, Mr. Kaplan said that he never received an answer to this letter. He said that. he spoke with Mr. Tasker once after this and Nor. -Tasker- informed him that the matter had-been referred to the Highway Committee of the Town. Board and that they would contact him. Mr. Kaplan said that the Highway Committee nor any other member of the Town Board ever contacted him. Mr. Kaplan said that he could not get a response as; to what highway specifications had to be complied with. Mr. Wickham stated that he was presented with a copy of the highway specifications at the time of the public hearing. Mr. Kaplan stated that he does not remember ever receiving a copy of the highway specifications. Mr. Kaplan presented the Planning Board with a copy of the inspection engineer's report (Chas. Abrahams) dated September 71 1970, which he said referred to the wrong roads in this subdivision. Upon inspecting this report the Planning Board found that the report was concerned with Wiggins Zane and Dawn Drive, although reference was made to Maple Lane and -Snug Harbor Road. Henry Raynor questioned what percent of lots were sold prior to the enactment of the Zoning Ordinance. Mr. Kaplan stated that a total of 7 lots were sold prior to ;the enactment of the Zoning Ordinance Amendments. The Chairman read the estimate for performance bond as prepared by Lawrence Tuthill on December 15, 1965 in the amount of $19,000. The Chairman asked Mr. Kaplan who his contractor was. b1r. Kaplan stated that East End Excavation did the rough work (cutting in roads and rough grading) , and Corazzini did the fine grading and oiling of the roods. Mr. Kaplan read letter which he sent to Corazzini advising him of Charles -Abrahams report, and he said that he never received a reply to this letter from Mr. Corazzini. Mr'. Kaplan explained that this is the first opportunity he has had to meet with the Town of Southold on this matter. He said that this. is a -relatively small and inexpensive matter and that he is willing to comply, all he wants is a list of the requirements which must be complied with. Mr. Kaplan said that he was advised many times that he was in default, but he could never find out what had to be corrected. Henry Raynor questioned what the requirement is for shoulders and turn-arounds in the 1965 specifications. The 1965 specifications o Southold Town Planning Board -3- April 3, 1972 call for 5 ft. shoulders on each side of the road and 100 ft. turn-Grounds. Mr. Kaplan said that. there were no houses in this subdivision at that time, therefore, he did not see a need to oil the roads, they would only have to be cut up to lay wires when houses were built. The Chairman said that the turn-arounds must be 100 ft. according to the 1965 specifications. Mr. Kaplan said that the Planning Board varied this requirement. The Board inspected the filed map and found that there were no turn-arounds shown. Mr. Kaplan said that he is not appearing before the Board at this time to ask for any changes in the specifications, he only wants to know what work has to be corrected or completed. The Chairman told Mr. Kaplan that the Planning Board will send him a list of the work to be corrected or-completed in this subdivision. However, the Chairman told him that the -real problem is the fact that this is- not an approved subdivision under the present Zoning Ordinance and he is now required to have 40,000 sq. ft. of area per lot. The Chairman advised him that this is a Town Board matter not a Planning Board matter. If he wishes to make an effort to have this subdivision added to the approved list under the present Zoning Ordinance he must petition the Town Board. After lengthly discussion, the Planning Board instructed that the following list of work to be corrected or completed be sent to Mr. Kaplan: "According to the Highway Specifications as dated December 15, 1965, the following work is yet to be completed or corrected in the' subdivision known as "Cleaves Point; Section III" : 1. On Wiggins Lane from Stations 1-5, the penetration is less than 4" -. Section 12 of the Highway Specifications requires a penetration of 411 . From stations 4 & 5 the average width of the pavement is only 22 ft. - Section 12 of the Highway Speci- fications requires 24 ft. width. 2. On the entire length of Dawn Drive the depth of the penetration does not exceed 3" and is as low as 2N" - Section 12 of the Highway Specifications requires a penetration of 4" . Section 12 of the Highway Specifications requires a 24 ft. road width. No part of this road is 24 ft. in width, some sections are as narrow as 21 ft. I. On Wiggins Lane the road bed is all sand for a distance of 200 ft. Section 9 of the Highway Specifications reads as follows: "9. Where the surface is sandy, either naturally or by. virtue of grading to the elevations established., loam, free from all vegetable matter, shall be used for a depth of six inches below the finished grade on the road section. " 4. There must be 5 ft. shoulders on each side of all roads according; to Section 13 of the Highway Specifications which reads as follows: "13. On both sides of-the oiled surface or. road section of the highway area, there shall be a five foot shoulder which shall be graded, shaped, rolled and free from debris of all kind." Southold Town Planning Board -4- April 39 1972 The .Southold. Town Planning Board received from the Southold Town. Board the original petition of William B. Conway, Horton's Lane, Southold, New York, relative to change of zone from "A" Residential and Agricultural District to" 11B-1" Business District on certain property situated at Southold, together with the in- structions to prepare an official report defining the conditions contained therein. This property is situated at Southold, in the Town of Southold, County of Suffolk, New York,. and more- particularly bounded and described as follows: North by Middle Road (County Road 27) about 900 feet; East by Horton's Lane 400 feet; ' South by other land of William B. Conway about 900 feet; West by land of Donahue 400 feet. The Planning Board discussed this proposed change of zone briefly, however, a recommendation cannot be made on it until the maps are received from Van Tuyl. On motion by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board table recommendation on the above proposed change of zone until such .time as the accompanying maps are received from Van Tuyl. Vote of' the Board: Ayes; Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The Southold Town Planning Board received from the Southold Town Board the- original petition of Gordon and Lucy J. Ahman , Fishers Island, New York, relative to change of zone froiH "-TO- Residential and Agricultural District to 11C-1" General Industrial District on certain real property situated at N/E Corner of` Madeline Avenue and Central Avenue, Fishers__Island, New York, together with the instructions to prepare- an official report defining the conditions contained therein. This property is situated,at Fishers Island, .in the Town of Southold, County of Suffolk, New York, and more-particularly bounded and described as follows: N - Madeline Avenue E - Central Avenue S - Zabohonski W - Zabohonski The Planning Board discussed this proposed change of zone at some length. Southold Town Planning Board -5- April 3, 1972 On motion by Mr. Grebe, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board favorably recommend to the Southold Town Board the change of zone from "A" Residential and Agricultural District to "C-1" General Industrial District on the above described property. . This property is completely surrounded by the "C-1" General Industrial District. on the south and west. This change of zone would include this property within the same zoning classification, thereby completing the "C-1" General Industrial zoning on the block. Vote of' the Board: Ayes: Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The Planning Board informally discussed -the proposed change of zone application of Leisure Greens, Inc. , for change of zone from "Al' Residential and Agricultural District to "B" Light Business District- en property located at west side of Griffing Street, Cutchogue, New York. It was -noted that Stanley Sledjeski has an interest in this corporation and that no disclosure statement was contained in the file, being that he is a member of the Southold Town Housing Board of Appeals,. There was -some discussion as to whether or not he has resigned from his position on the Housing Board. Howard Terry said that Stanley Sledjeski has - sub- mitted his resignations- to the Town. Board but he is not sure that it has been accepted as of this time. This matter to be further discussed later in the evening when Richard Lark, Attorney a/c Leisure Greens, Inc. is present. Henry Raynor and Alfred Grebe were appointed at the last- Planning Board meeting to inspect the drainage and plantings as shown on the revised site plan of Bohack Village, located at' north side of Main Road, Mattituck, New York. They reported that, the drainage seems to be suffic:tent and that it looks as though they meet the additional square feet of plantings as required. The only thing wrong is that there is one break in the curbing which is a minor repair. On motion by Mr. Wickham, seconded by Mr. Raynor,. it was RESOLVED that the Southold Town Planning Board accept the revised site plan of Bohack Village, subject to correct number Southold Town Planning Board -6- April 3, 1972 of plantings as shown on revised map and repair of break in curbing. Mote of" the Board: Ayes: Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Dominic Aurichio, Attorney appeared before the Planning Board in regard to the subdivision "Petty' s Bight" , located at Orient, N.Y. The Planning Board informed Mr. Aurichio that no word has been received from the Suffolk County Planning Commission. Mr. Aurichio said that he is waiting to receive the description so that he can resolve the deeds to this property. Mr. Aurichio requested that he be notified when a determination is received from the Planning Commission. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board authorize Lawrence Tuthill to prepare estimates for performance bonds for the construction of roads and completion of other necessary work in the following subdivisions: 1. "Big Green Acres" , located at EIS Fleet's Neck Road and W/S Stillwater Avenue, Cutchogue, N.Y. , owned by Clarence Fleet. 2, Revised map of "Blue Horizons" (dated February 281 1972) -- located off north side of Middle Road (CR 27) , Peconic, N.Y. , owned and developed by C. P. F. Land Corporation:: 3. "Little,17eck Properties" , located at west side of Little`Neck Road, Cutchogue, New York, owned by James Reeve & others, Vote of` the Board: Ayes: Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. . Lawrence -Tuthill appeared before the Planning 'Board in regard to making a study on shoreline erosion in -the Town of Southold, The Town Board has requested an estimate of how much work should be done and what Larry will charge for it. Southold Town Planning Board -7- April 3, 1972 Discussion was held on the amount of work to be done on this matter and several figures were suggested for the cost of the study. It was agreed that harry Tuthill give us an estimate for his proposed work and we will in turn present it to the Towa. Board. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board authorize Lawrence Tuthill to prepare a projected proposal for a study of shoreline- erosion in the Town of Southold, proposal to be submitted to the Planning Board for their presentation to the Town Board, Vote of° the Board: Ayes: Messrs: Wickham., Moisa, Raynor, Coyle, Grebe. The Southold Town Planning Board received from the Southold Town Board the original petition of Leisure Greens, Inc. , Main Road, Mattituck, New York, relative change of zone from "At' Residefttial and Agricultural District to "B!! Light- Business District on certain property situated at Cutchogue, together with the instructions to prepare an official report defining the conditions contained therein. This property is situated at Cutchogue, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as follows: Beginning at the point of intersection of the northerly line of Main Road with the westerly line of Griffing Street and running thence along said westerly line of Griffing Street two courses: (1) North 40* 23' 10" West 73.50 feet and (2) North 42* 29' 30" West 218.70 feet and thence along land of Leisure Greens, Inc. , South 51* 02' 20" West 189.14 feet to a concrete monument and the point of beginning, and from said point of beginning running along land of the Roman Catholic Church of The Sacred Heart at Cutchogue, four courses and distances: (1) South 76* 22' 50" 'Vest 225.0 feet; (2) North 69* 35' West 67.0 feet; (3) North 37* 141- 50" West 640.0 feet and (4) North 52* 34' 50" East 237. 59 feet; thence along said land of Leisure Greens, Inc. , South 37* 34' East 787.53 feet to the point of beginning. Richard Lark, attorney, a/c Leisure Greens, Inc. and John Gradowski of -Leisure Greens, Inc. appeared before the Planning Board in regard to the above proposed change of zone application. A very lengthl.y discussion was held by the Planning Board con- cerning the proposed site plan, drainage, parking, etc. John. Southold Town Planning Board -8- April 3, 1972 Gradowski of Leisure Greens, Inc. stated that he intends to develop and manage this project himself, and he also stated that he does not intend to re-sell this property if the change of zone is granted. The Planning Board requested that the foregoing statements be put on record. After the Planning Board submits their recommendation, this change of zone must then be referred to the Suffolk County Planning Commission for their determination. A performance bond will be required_ for the proposed road. There was some descretion about the topography of this property. The Planning Board appointed Henry Raynor and Henry Moisa to make a physical inspection of this property and submit a statement on the topography at the next Planning-Board meeting to be held on April 18th. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that 'the Southold Town Planning Board table recommendation on the above proposed change of zone for further deliberation of the Board, and that Henry Raynor and Henry Moisa be appointed to make a physical inspection of this property and submit a statement on the topographyy at the. next Planning Board meeting to be held on April Nth. Vote of' the Board: Ayes: Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Letter was received from the New York State Department of Transportation in regard to: their attendance at the Planning Board meeting on April 18th. hey informed us that they will not be able to attend the meeting on- April 18th, and requested. that .we-notify them of the date of the following Planning Board meeting. Letter- to be sent advising them to attend the next meeting on May 1, 1972 at 7: 30 P.M. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the minutes of the Southold Town. Planning Board dated February 28, 1972 and March 7, 1972 be approved as submitted. Vote of the Board: Ayes: Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. Southold Town- Planning Board -9- April 3,. 1972 On motion by Mr. Coyle, seconded by Mr. Grebe, it was RESOLVED that an executive meeting of the Southold-,-Town Planning Board be held at 7: 30 P.M. , Tuesday, April 18, 1972, at the Town Office, Main Road, Southold, New York. Note of the Board: Ayes: Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the next regular meeting of, the Southold Town Planning Board be held at 7: 30 P.M.L, Monday, May 1, 19729 at: the Town Office, Main Road, Southold, New York. Vote of the Board: Ayes: Messrs: Wickhami, Moisa, Raynor, Coyle, Grebe. The meeting was adjourned at 10: 35 P.M.
