(631)765-1809 •Fax(631)765-9064 J U L 5 2011 FINDINGS,DELIBERATIONS AND DETERMINATION , ' MEETING OF DULY 21,2011 SoUt o •® CIZrk ZBA FILE: 6461 NAME OF APPLICANT: Mary Beth Henson - SCTM#1000-33-1-6 PROPERTY LOCATION: 3300 Sound Drive,(adj.to Long Island Sound) Greenport NY. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 8, 2011 stating that this application is considered a matter for local determination as there appears to.be no significant county-wide or inter-community impact. LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review of the-Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP, this is due to the mitigating factors imposed by the Board of Trustees. PROPERTY FACTS/DESCRIPTION: The subject property is improved with a two story framed house and garage, it contains 14, 330 sq. ft. of buildable area. It has 100 feet along Sound Drive, 363.51 feet on the western property line, 124.62 on Long Island Sound and 285.04 feet on the eastern property line as shown on the survey dated Revised June 16, 2011 prepared by John C.Ehlers,LS. BASIS OF APPLICATION: Request for Variances from Art. XXII Section 280-116A(1), Art. XXIII Section 280- 124 and Art. III Section 280715F and the Building Inspector's Dec. 9, 2010, Updated February 25, 2011 Notice of Disapproval based on an application for building permit to construct alterations/additions, accessory in-ground swimming pool and decks at; 1) less than 100 foot setback from top of bluff for alt/add, 2) less than the minimum code required side yard setback of 15 feet, 3) less than the code required combined side yards of 35 feet, 4) Accessory structures proposed location other than the code required front yard on water front property. .RELIEF REQUESTED: The applicant proposes to construct additions and alterations, an in-ground swimming pool and decks requiring variances for setback to the bluff of 39 feet where the code requires 100 feet, single side. yard setback of 11 feet where the code requires 15 feet and combined side yards of 24 feet where the code requires 35 feet and an accessory swimming pool in a side yard location where the code requires a rear yard or in the case of water front properties a front yard location. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. On July 6, 2011,the applicant submitted a revised survey by John Ehlers dated June 16,2011 f Page 2—July 21,2011 ZBA File46461-Henson CTM: 1000-33-1-6 increasing the proposed bluff setback to 55 feet, eliminating the single side yard setback variance, and increasing the total side yards to 28 feet, thereby bringing the plan into more conformity with the codes. ADDITIONAL INFORMATION: The applicant has obtained a wetland permit and coastal erosion hazard permit #7414 from the Southold Town Board of Trustees dated October 10, 2010. On November 4, 2010 the NYSDEC issued a letter of no jurisdiction for this proposal. The Board requested comments from County of Suffolk Soil and j Water, in a letter dated May 4, 2011, it states they find the bluff to be in stable condition, they suggested a rain garden for storm water runoff and the applicant should allow the pool water to sit in sunshine for two days without adding any.chemicals or to use an additive to de-chlorinate the water before draining. They further stated in summary that there are no natural resource concerns. As requested by this Board the applicant submitted a prior decision #5523 dated June 3, 2004, in which the Board granted a 5 foot side yard setback for a swimming pool in the side yard of a neighboring home. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The ZoningBoard of Appeals held public hearings on this application on May 5 2011 and Jul 7 2011 at which PP P g PP Y Y time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: ! 1. Town Law 4267-b(3)(b)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The house has existed in its current location since 1970; the applicant reduced the amount of relief requested. Similar variances have been granted by this board within this neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the area variances as applied for. The board proposed reducing the need for a side yard setback on the proposed porch and the applicant has agreed to eliminate the need for any variance on this portion of their project. The Board also requested that the existing deck on the rear (waterside) of the house be reduced or eliminated and the applicant has responded by eliminating the existing deck in favor of a masonry patio on grade which resulted in an increase in the existing bluff setback from 39 feet to 55 feet. The placement of the swimming pool would require a variance in almost any location proposed on this property due mostly to the proximity of the house to the top of bluff I 3. Town Law §267-b(3)(b)(3). The variance granted herein for the proposed swimming pool is substantial and i represents a 100% variance from the code requirement that prohibits accessory structures in the side yard. However, the board finds that placing the swimming pool in the side yard reduces impact on the bluff and the applicant has no room for the swimming pool in the front yard. The bluff setback of 55 feet is substantial, representing 45% relief, however, the entire house is within the 100 foot setback and any addition to the rear or side of the dwelling will require a variance. .The proposed combined side yard setback of 28 ft, as amended, where the code requires 35 ft is deficient by 7 feet and is not substantial since the proposed westerly single side yard setback in the area of new construction has been changed to be conforming, and the existing house has a non- conforming easterly single side yard that cannot be altered without demolition. i 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The mitigation factors imposed by the Town Trustees have reduced the environmental impact.. The side yard location of the swimming pool is more environmentally sound then placing the pool in the rear yard, which is closer to the top of the bluff. 5. Town Law V67-b(3)(b)(5). The difficulty has not been self-created. The difficulty is created by the pre- existing non-conforming location of the dwelling. Page 3-July 21,2011 ZBA File#6461 -Henson CTM: 1000-33-1-6 6. Town Law &267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, screen porch additions/alterations and rear yard patio while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dinizio, seconded by Member Schneider, and duly carried,to; DENY, as applied for, and GRANT ALTERNATIVE RELIEF, as noted below: The setback from the bluff will be 55 feet, the single side yard setback request is eliminated, as shown on the survey dated Revised June 16,2011 prepared by John C.Ehlers,LS. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final architectural drawing conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Ehlers Land Surveyor, last dated June 16, 2011, which has been revised as follows: 1. The width of the pro Posed porch has been reduced by 4 feet from 17.1' to 13.1',resulting in an increase in the proposed minimum side-yard setback from 11' to a conforming 15', thus eliminating the preexisting nonconfs:rming side-yard setback and the need for any side-yard setback relief. 2. The proposed watev ide deck in place of the existing deck has been replaced with a proposed masonry patio on grade, thus increasing the proposed bluff setback Roan 39' to 55',a 16' increase to the existing blur setback. As requested by the Board, also attached is a copy of the Board's decision No. 5523, which in 2004 granted Peter and Arlene Manos thA; relief necessary to construct a 16' x 32' inground swimming pool 5 feet from the property line in a noneonf:rming side yard. Ms. Henson proposes to construct an approximately 11' x 19' swimming pool 12.5 feet :I from the property line in a nonconforming side yard. As already stated in our application and at the pubs ,e hearing, the reasons for Ms. Henson's request for relief are the same as those which were the basis of the Board's granting relief to Mar. and Mrs.Manos. Specifically,"the benefit sought by the applicant cannot be acl sieved by some method, feasible for the applicant to pursue, other than an area' variance because if located W the requimd rear yard, there is insufficient area to locate the pool without a variance from the code's 1 C.10 & setback from the top of the bluff..[and]...without the variance the proposed pool would not be possible. .[and]...the side yard location is more environmentally sound than placing the pool in the rear yard area, which .s closer to the top of the bluff." We hope that the above des.gn changes and information will enable the Board to grant the relief requested. We thank you for your considers aion. Box 1179 Southold,New York 11971-0959 30ARD OF APPEALS FtE,ZBA File REF. No 6451(Henson) Dear Chairperson Weisman: As per your request, a site evaluation was conducted at 3300 Sound Drive in Greenport; SCTM 4 1000-33-1-6_ The site was evaluated for potential natural resource concerns with regard to alterations to the home, and the installation of an in-ground swimming pool and deck. The home sits on the high point of the property and there is a gentle slope, north towards the bluff edge and also south towards the road. The bluff is well vegetated;no active erosion was observed on the bluff face. The toe of the bluff is not protected by a bulk head but high tide does not reach the bluff toe and no erosion was observed at the toe. it appears as though the majority of storm surges do not reach the bluff toe either. At the time of this site visit the bluff was in stable condition. There are existing gutters on the home which outlet directly on the ground surface. The site plan calls for a drywell to infiltrate the roof runoff. Please be aware that rain gardens are an aesthetically pleasing, environmentally friendly method to manage roof runoff and should be considered as an alternative to drywells. A rain garden is a shallow depression generally about 6 inches deep that allows roof runoff to infiltrate slowly into the ground over a 24 hour period. A rain garden can be planted in the sun or the shade but should always be planted with native plants. A properly constructed rain garden retains and infiltrates approximately 30%more runoff than a grassed lawn. As a general rule of thumb, for every 6 square feet of roof,I square foot of garden is required_ A helpful reference is available from the University of Connecticut and can be found at http://www.sustainability.uconn.edu/pdf/raingardenbroch.pdf it is also noted on the site plan that a drywell is proposed to drain the swimming pool. While we do recommend draining pool water into a dry well, if chlorination is the method of disinfection it is also recommended to de-chlorinate the water before discharging it into the drain. High concentrations of chlorine such as that from swimming pools can be toxic to the environment. This can be done quite simply by allowing the water to sit for 2 days in sunlight without the addition of chlorine or bromide. Alternatively an additive can be used to chemically de-chlorinate the water. it is recommended to consider healthier more environmentally friendly alternatives to chlorine disinfecting such as saltwater, ionization, and oxidation. in summary there are no natural resource concerns regarding the proposed construction at the subject property. STEPHENS NOTARY PUBLIC STATE PF NEW YORK COMMISSION NO . 5015931 QUALIFIED IN SUFFOLK COUNTY EXPIRES AUGUST 2 , 20L3 ftd® FEB 2 5 2011 Mary Beth Henson"Area Variance Reasons"Page 1 of 2 PEALS Robert 1 . errmann 1. The granting of the requested relief from §280-116(A)(1) for the proposed deck and porch additions to the waterside of the existing 2-story dwelling will not have an adverse impact on neighboring properties or the character of the community, as the developed shoreline community along Sound Drive is characterized by two-story dwellings located similarly nonconforming distances from the bluff, including the only developed parcel to the west and the four neighboring properties to the immediate east. The project will not create any significant change even to the character of the subject property, as the proposed deck will maintain the existing minimum bluff setback on the east side of the house, and the proposed porch will be constructed substantially in place of an existing attached garage on the west side of the house, where the separation distance between the house and bluff is maximized. Four feet of minimum side-yard relief is required pursuant to §280-124(B) in order to reduce the existing nonconforming 14' side-yard setback to 11 feet where 15 feet is required, which in turn creates the need for relief to reduce the existing nonconforming total side yard of 27 feet by an additional 3 feet to 24 feet where 35 feet is required. Although the overall side-yard relief required is not negligible, the additional encroachment relative to what exists is limited to 3 feet. And because this additional encroachment is limited to the west side of the property, the easterly adjacent property is not affected by the change whatsoever; and the westerly adjacent property is vacant. Therefore, the additional encroachment will not create a significant change to the site,to neighboring properties, or to the character of the community. The relief necessary from §280-15(F)to situate the proposed swimming pool in a side yard also will not create a detrimental impact to the character of the community or neighboring properties. At least four of the bluff-front properties along Sound Drive have swimming pools located in the side yard, including the one located three properties to the east and one located farther to the east that was constructed with the benefit of variance relief(Case No. 5523). Due to the proximity of most of the existing dwellings to the bluff along this developed shorefront, the need to situate a swimming pool in a side yard is not unusual. 2. All of the requested relief is necessitated directly or indirectly by the proximity of the existing dwelling to the bluff. Specifically, the owners want to maximize the connection of the house to the outdoors and to the water as part of a renovation that will improve the dwelling for use as a permanent waterfront home on Long Island Sound. If not for the dwelling's proximity to the bluff, they would achieve that benefit by constructing the porch and deck onto the rear side of the house and locating the pool between the house and the water, all in conformance with traditional zoning requirements. But because of both the regulatory and practical need to stay as far from the bluff as practicable, the ability to maximize the use and views of the waterfront side of the house are constrained, resulting in a pressure to place to the side of the house structures that would otherwise be more desirably located to its rear. And in order to maximize the waterfront exposure of the porch, its width must be maximized, resulting in the need for side-yard setback relief, and the pool gets pushed into a defined side rather than rear yard. In either location(rear FEB 2 5 2011 Mary Beth Henson"Area Variance Reasons"Pa eg_2 of 2 ®0®E. pPA Robert rrmann or side), the structures would require area variance(s), so the owners are pursuing what we believe to be the less significant relief, i.e., side setback and yard relief and minimized bluff setback relief as opposed to significantly more substantial bluff setback relief, as would be required if all structures were proposed to the rear of the house. Consequently, the chosen design seeks the minimum relief necessary to achieve the desired benefit where the benefit cannot be achieved except by area variance relief. 3. The relief requested from §280-116(A)(1) is mathematically substantial (61 feet)but not substantial relative to existing conditions because the renovated principal structure will not encroach any further upon the bluff than the existing principal structure. Also, because the minimum bluff setback will continue to be established by an unroofed deck, the use nearest to the bluff will also remain unchanged. The expansion of roofed structure will occur on the westerly side of the house, which is the side of the house located farthest from the bluff. The side-yard setback relief required from §280-124(B) for that expansion (porch) is arguably minor(4 feet or 26%relief) and creates only 3 more feet of an encroachment than existing conditions. Because the pool would be located no closer to the side yard than the dwelling and because the pool's designated location in a side yard is primarily the result of the roadward protrusion of the proposed conforming front-yard addition, the yard relief for the pool pursuant to §280-15(F) is not substantial. 4. With respect to the physical and environmental conditions of the property and surrounding neighborhood, the project will not create any significant change to the developed nature of the property, and as a result of the incorporated mitigation measures, there will be a net improvement to the ecological condition of the site and adjacent waterway. Specifically, the existing minimum setback from the bluff to the principal structure will not be diminished; the only structure located closer to the bluff, a detached hot tub, will be permanently removed; and lot coverage will increase only minimally by 335 square feet. Existing lawn greater than twice this area will be removed in favor of a 10' wide nonturf buffer adjacent to the bluff. The property's ability to reduce and absorb runoff adjacent to the bluff will be further enhanced by the introduction of a drainage system of leaders, gutters, and drywells to capture and recharge roof runoff. The project is located landward of the jurisdiction of the New York State Department of Environmental Conservation but has been approved by the Town of Southold Trustees pursuant to the Town Wetlands Law. The project was also deemed by the Trustees to be consistent with the Town's LWRP after the Town's LWRP Coordinator similarly recommended that the project be deemed consistent as designed. 5. The difficulty with locating the proposed expansion without necessitating variance relief is not self-created due to the nonconforming location of the existing dwelling. APPLICANT'S PROJECT DESCRIPTION FEB 2 5 2011 (For ZBA Reference) BOARD (OF APPZALS Applicant:MARY BETH HENSON Date Prepared:2/18/11 I. II. New Construction Areas (New Dwelling or New Additions/Extensions): Dimensions of first floor extension:See attached site plan and floor plans. Dimensions of new second floor:Front addition,8'x 14; 17'x 30'roof deck over porch. Dimensions of floor above second level: None. Height(from finished ground to top of ridge): 23'-5" Is basement or lowest floor area being constructed? If yes, please provide height(above ground) measured from natural existing grade to first floor: 2'-4' III. Proposed Alterations or Interior Structural Changes without enlargement/extension (attach extra sheet if necessary)-Please describe building areas: Number of Floors and General Characteristics BEFORE Alterations: Two-story,one-family,gambrel-style dwelling with garage, deck, and hot tub. Number of Floors and Changes WITH Alterations: Two-story,one-family,gambrel-style dwelling with porch, deck, hot tub, swimming pool,2nd-story dormers, and covered front porch. IV. Calculations of building areas and lot coverage (from surveyor): Existing square footage of buildings on your property: 2,375 S.F. Proposed.increase of building coverage: 335 S.F. Square footage of your lot: 14,330 S.F.(buildable land) Percentage of coverage of your lot by building area: 16.57%existing; 18.91%proposed V. Purpose of New Construction Requested: To achieve reconstructed waterside deck and new water side porch in place of existing garage;renovated front of house;replacement of hot tub;introduction of swimming pool;and, generally, .improved living space to maximize use of property as permanent waterfront home. VI. Please describe the land contours (flat, slope %, etc.) as exist and how it relates to the difficulty in meeting the code requirement(s): The presently developed portion of the property is flat but abuts a steeply sloped bluff adjacent to Long-Island Sound. Both the practical and regulatory need to maintain a reasonable setback from the bluff forces the pool to be proposed toward the front of the house where, due to the protrusion of a proposed addition, it will be located in a nonconforming side yard. If not for the bluff, therefore, the pool could be located in a conforming rear yard. The presence of the bluff also creates the need for setback relief for the newly proposed deck and porch, which otherwise would require only side-yard relief. Please submit seven (7)photos,labeled to show all yard areas of proposed construction after staking corners for new construction), or photos of existing building area to be altered (area of requested changes). B, DESCRIPTION OF SITE AND PROPOSED ACTION SCTM# 33 - l - 6 PROJECT NAME MARY BETH HENSON The Application has-been submitted to (check appropriate response): Town Board ❑ Planning Board❑ Building Dept. ❑ Board of Trustees Category of Town of Southold agency action (check appropriate response): (a) Action undertaken directly by Town agency (e.g. capital ❑ construction, planning activity, agency regulation, land transaction) (b) Financial assistance (e.g. grant, loan, subsidy) ❑ (c) Permit, approval, license, certification: Nature and extent of action: Construct onto existing two-story, one-family dwelling: dormer additions to the second story; a one-story addition, covered porch, and steps onto the front side of the house, partially in place of an existing, raised masonry patio to be removed; a screened porch in place of an attached garage to be removed from the west side of the house; and a new deck in place of an existing deck to be removed from the waterside of the house;remove existing hot tub and concrete pad; and construct a new hot tub and swimming pool located partially within Chapter 275 jurisdiction, all as depicted on the site plan prepared by John C. Ehlers,L.S., last dated September 24,2010. The installation of a drainage system of drywells and the removal of existing stone walls and a portion of the existing driveway will occur more than 100 feet from the top of bluff and therefore beyond Chapter 275 jurisdiction. Thus,a letter of non jurisdiction or staternent in the permit indicating that all construction activities located more than 100 feet from the top of bluff are outside Chapter 275 jurisdiction is requested. RECEIVED Location of action:3300 SOUND DRIVE, GREENPORT FEB 2 5 2011 0OARD OF APPEALS Site acreage 29,581 S.F. Present land use: RESIDENTIAL,TWO-STORY,ONE-FAMILY DWELLING Present zoning classification: R-40 2. If an application for the proposed action has been filed with the Town of Southold agency, the following information shall be provided: (a) Name of applicant: MARY BETH HENSON (b) Mailing address: 130 EAST 75TH STREET,APT. 7C NEW YORK,NY 10021 (c) Telephone number: Area Code 212-772-6906 (d) Application number, if any: Will the action be directly undertaken, require funding, or approval by a state or federal agency? Yes ❑ No ® If yes, which state or federal agency? C. Evaluate the project to the following policies by analyzing how the project will further support or not support the policies. Provide all proposed Best Management Practices that will further each policy. Incomplete answers will require that the form be returned for completion. DEVELOPED COAST POLICY Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves openspace, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation criteria. ❑Yes 7 No Z Not Applicable Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the 'Town of Southold. See LWRP Section III - Policies Pages 3 through 6 for evaluation criteria 7 Yes ❑ No L[Z Not Applicable FEB 2 5 2011 NUMU OF APPEALS Attach additional sheets if necessary Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III - Policies Pages 6 through 7 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project is consistent with Policy 3 because it limits the proposed structure renovations to areas that are directly in place of existing structures to be removed and/or adjacent thereto and/or as far from or farther from the top of the bluff, thus maintaining the existing visual buffer for the development from Long Island Sound. Moreover, a nonturf buffer will be established in place of existing lawn adjacent to the bluff, which will enhance the scenic quality of the site nearest to the bluff. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ❑ Yes ❑ No ® Not Applicable Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the 'Town of Southold. See LWRP Section III — Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The project will protect and improve water quality and thus be consistent with Policy 5 through the establishment of a 10'-wide nonturf buffer in place of existing maintained lawn area adjacent to the top of the bluff. The existing naturally vegetated slope will remain undisturbed and continue to serve as a buffer adjacent to Long Island Sound. The surface water runoff absorption capacity of the site will be increased not only by the replacement of lawn with this buffer but also via installation of a drainage system of leaders, gutters, and drywells to capture and recharge roof runoff from the entire finished dwelling structure. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the 'Town of Southold ecosystems including Significant Coastal Fish and Wildlife habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable The proposed project includes the renovation and expansion of an existing dwelling located more than 150 feet from the tidal wetlands and waters of Long Island Sound, where all work is proposed more than 150 feet from wetlands and the only existing structure(hot tub) located less than 150 feet from wetlands is being removed. The minimum existing principal structure setback of 39 feet from the top of bluff will be maintained and not further en eked upon. A 10'-wide non-turf buffer will b ablished in place of existing lawn adjacent to the top of the bluff to increase the property's ability to absorb runoff adjacent to the bluff, and a drainage system of leaders, gutters, and drywells will be installed more than 100 feet from the bluff to capture&recharge roof runoff from the entire finished dwelling structure. With the removal of an existing hot tub and raised masonry patio, the project will result in only a 509 square foot increase to the structural coverage of the parcel, approximately 200 square feet less than the area of lawn to be removed. A project-limiting fence and staked haybales will be set in place landward of the Bluff and Coastal Erosion Hazard Area to restrict and contain site disturbance during construction. The project will have to comply with the tenns of a Town Wetlands Pen-nit and is beyond the jurisdiction of the New York State Tidal Wetlands Act due to its location landward of the top of a bluff whose elevation exceeds 10 feet above mean sea level. Although a 100-foot bluff'setback cannot be achieved due to the location of the preexisting nonconfonning dwelling, existing bluff setbacks from the principle structure will be maintained and not encroached upon, and the newly proposed swimming pool will be located partially more than 100 feet from the top of bluff. Therefore, the project will be consistent with Policy 6. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold. SCTM#1000-33-1-6 Dear.Ms. Henson: Based on the information you .have submitted the Department of Environmental Conservation (DEC) has determined.that the property landward of the "top of bluff" line, as shown on the survey prepared by John C. Ehlers dated 8/19/10, last revised 11/1/10, is beyond Tidal Wetlands Act (Art'iCie 25) jurisdiction. Therefore, in.accordance with the current,Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no permit is required. Be advised, no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or other alteration or disturbance,to the ground surface or vegetation within Article.25 jurisdiction which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier, or hale bay berm. Please note that is letter does nodrelieve you of the responsibility of obtaining any necessary per its or ap ovals from other age ies or local municipalities. MEETING OF JUNE 3,2004 BOARD OF APPEALS ZBA 05523—PETER.ind..AtJENE MANOS Property Location: 2001: Sound Drive,Greenpor't;CTM#33-1-18 SEORA DETERMINi MPN: The Zoning Board of Appeals has visited the property under consideration in this a pplication and determines that this review falls under the Type it category of the State's List of Acth ins, without an adverse effect on the environment if the project is implemented as planned. QROPF,,M FACtTS/C ESMU1OK The applicant's 28,884 sq.ft. parcel has 100 ft.frontage along the north side of Sou id Drive, and lot depth of 275.63 feet, Eastern Shores, in Greenport. The property is improved ui i#h a one-family.two-story frame dwelling situated at 99 feet from the front line along Sound Drive, 1fl feet from the westerly side line, 18-5 feet from the easterly side line, and 61+- feet from the top of thif,L.I. Sound bluff. BASIS OF_APPLICA7 ION: Building Department's April 1, 2004 Notice of Disapproval, citing Code Section 100-238.4A in its denial of a building permit application concerning proposed construction of an in-ground swimming pool in the(easterly)side yard. EMPIUM o.FACT The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which time written and oral t vidence were presented. Based upon all testimony, documentation, personal inspection of the prop arty, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RI-LIEF 8gQUE31ED: Applicant wishes to construct a 16' x 32' in-ground swimming pool along the easterly side of the existing dwelling, at 5 feet from the side lot line, at its closest point. No raisi xt decks or other building construction is proposed around the pool, other than a open, sun terrace at;ground level and pool fencing, FREASONS_FOR BOA RD ACTION: On the basis of testimony presented, materials submitted and personal Inspection$,'he Board-makes the folloudng findings: 1. Grant of the relies' requested will not produce an undesirable change in the character of the neighborhood or a deg Ament to nearby properties. The adjoining property owner to the east of the pool Iocatlon stated at the May 20,2004 public haaring that he had no objection to the location of the pool. The pool will be screened from the road by a new front yard garage as well as other neighbors by a planting of scree ling along the pool on the masterly property line. k 07/06/2011 10:29 FAX 6312836136 EN-CONSULTANTS,INC. 16 004 Page 2-June 3,2004 Appl.No.5523-P.and A_Manos 33-1-18 op A PPF4 2. The benefit sought by the applicant cannot be achieved by some method, feasible for CS applicant to pu sue, other than an area variance because if located in the required rear yard, there is it sufficient area to locate the pool without a variance from the code's 100 ft. setback from It top of the bluff rule. W.thout the variance, the proposed pool would not be possible, 3. The reque 3ted area variance is not substantial. The side yard location is more environmentalf -sound than placing the pool in the rear yard area, which is closer to the top of the bluff. 4. The alleged difficulty has been self created and is due to the applicant's desire to enjoy a swimming poi>I_ 5. No evidence has been submitted to suggest that the relief granted will have an adverse Impact on phys cal or environmental conditions in the neighborhood. 6. Grant of th,a requested relief is the minimum necessary and adequate to enable the applicant to or joy the benefit of a swimming pool while preserving and protecting the character of thf, neighborhood and the health, safety and welfare of the community. 7. The applicant assures that there will be no drainage or flow of water from the pool or construction ac Wties toward the bluff and that drywells will be properly installed for this purpose In the i}verall design planning of the project. 89-%%UTION4CTIQN: On motion by Member Tortora, seconded by Member Goehringer, It was RESOL'/ED, to GRANT the variance as applied for, as shown on the 3130/04 site plan poapared by Garrett Strang, R.A., SUaJECT .TO THE FOLLOWING CONDFAONS; 1. The applicant shall plant and maintain a row of screening the entire 32 fL length of the p+rol along the east property line. 2. In th a event that the applicant does not construct an accessary garage in the location shown on the above site plan, the applicant shall plant a row of evergreens the entir a 24 ft.width of the pool to block it from view from Sound Drive. With over 100 road ends terminating at creeks, bays, inlets, or Long Island Sound, as well as all of the lawns and homes lining our miles of shoreline, 100's of thousands of gallons of storm water runoff enters our wetlands every year. Carrying sediment that prevents sunlight from reaching aquatic plants, nutrients from animal waste and lawn fertilizers that promote algae blooms detrimental to shellfish, and bacteria and other biologicals that in high doses can be harmful to swimmers, storm water runoff is one of the Trustees main public safety concerns. So important, in fact, that Southold has a Storm Water Management Code. Southold Town's Chapter 236 provides an outline for how people need to deal with storm water runoff from their properties. For example, new construction or renovation is required to contain any potential runoff to the wetlands from the construction by installing hay bales and silt fencing. This acts as a barrier and keeps our wetlands clean. Another example in Chapter 236 is that every building must have provisions to collect and disperse, ON-SITE, at least a 2 inch rainfall. This is usually handled by installing gutters, leaders and drywells to the home. The Trustees also have a standing policy of requiring pervious non-turf buffers along bulkheads and at tops of bluffs that help keep run off from entering the wetlands and prevents erosion to bluffs. These are important measures to keep our wetlands safe and clean! Before deciding to renovate or build, the Town Trustees urge you to check our website and the other department's websites to make sure what you are planning to do meet the Town's Codes. These codes have been developed for the good of all citizens. And the wildlife all around us too! i .i♦♦i♦♦♦vr .♦♦i'rr I ,♦ A•,." -§ u .'CCi yr r u..'i .'.y - ♦.•`,..` r - r ♦it .
