A special meeting of the Southold Town: Planning Board was
held at 7:30 P;M i; Wednesdays; February 3s, 1965s, at the Town
Offices, Main Road, Southolda, New York.

Absent: William .Unkelbach, due to poor_weather 'conditions.
Also present: - Otto Van Tuyls.- Consultants, Howard Terryj., Building
Inspector.
On motion by Mice' Moisas, seconded by--Mr. Grebes,. it was
RESOLVED that the following amendments be made to the "Town
of Southolds, Rules and Regulations for the Subdivision of=Land":
Southold Town Planning Board -2-- February 3s, 1965
1.. Amend Section 5,,, "IMPROVEMENTS" ! by adding a new item,,,
to be item 48 to read as follows:
SECTION 5r, ITEM 4: A construction inspector -representing
the Planning Board shall inspect all improvements while in
the process of construction and it shall be the duty of the
subdivider to notify the' Planning Board when the improvement
is to be commenced and subsequently before it is completed.
2.� Amend Section 58' "IMPRROVEMENTS"i by adding a new item
to be item Sr, to read as follows:
SECTION 5,,, ITEM 5: The construction inspector shall
cex certify, to the Planning Board when all improvements are
'bompleted as required by the regulations and specifications
of the Planning Board.
3, Amend Section 5.,,: "IMPROVEMENTS"z, by adding a new item
to be item_'(b 1) f, to read as follows:
SECTION 5,r ITEM ;(bl) : All highways terminatmng at
tidewater shall have a width of not less than 100 feet
back from themain high water riiark .! All highways on
waterfront property must have the*'-same. access to the
water as above required.
4. Amend Section 5e, "IMPROVEMENTS"8, Item 2 ei, to read as
follows:
SECTION 5,,, item 2e: A width of not =less than 70/
of the bounds of the highway shall be hereinafter known
as the highway area from .which all trees', brushy rockst,
stumps', and other obstruction shall be tYioroughly cleared
and' all such material shall be removed from the bounds
of the highway.
5.- Amend Section 5;E;"IMPROVEMENTS",R; Item 2 j,,. to read as
follows:
SECTION 5,,, ITEM .2j: After. the highway area has been
property graded, rolled and shaped to the approval of
the 3uperintendent-_of 'Highwaysa. the twenty-four ,(24)
.foot section in the center of the highway area;(herein-
after referred to as the road section). shall be' stabilized

with an application of one ;(1) gallon of. SC-1 ;(Bituminous
Cut Back)per square yard mixed to, a depth of "(4) inches.
Within: two (2)_ months g, and not less than one "(1) month
after stabilization, the road section shall be rolled and
properly prepared and an application of one-half ;(jk
gallon of MC-2' !Wituminous Cut Back) per square yard
shall be applied with sufficient sand to absorb the .excess
oil. In case of dry weathers; the subgrade shall be wet-
down before the. oil is applied.
6. Amend Section 5' "IMPROVEMENTS"s, Item.2Mr, to read as
follows
SECTION 5 ; ITEM 2m: Sidewalks shall be standard
four foot in widths, four inches thick except in. driveways
where they must be not less than .s.3.x inches thick. - All
curbs- and gutters to be built to standard forms as may
be directed by the Superintendent of. Highways, On existing
Town. Highways the town will furnish the necessary engineering
grading,; fill and labor; the property owner or ' owners
shall .furnish the necessary ready mixed concrete and shall
deliver such concrete to the site as directed by the ,
'Superintendent- of Highways. The amount .of side walk
construction throughout the ,Town .shall be determined by
the Town .Board.
7 . Amend Section 92, "DETAILS OF CONSTRUCTION IMPROVEMENTS'&,
item is to read as hollows:
SECTION 9't, ITEM 1; The entire sewage system and the
disposal of sanitary and storm .sewage shall be planned and
built to meet the approval of 'the proper- admin__istriative
officials,, but in all cases,, all liquids must be returned
to the soil.
8.- Amend Section 9s. "DETAILS OF CONSTRUCTION IMPROVEMENT",,,
item .2,, to read as. follows:
SECTION 99' ITEM 2: The water distribution system shall
be designed to meet the approval of the' New York- State
Department of Health and the Suffolk' County Department of
Health.

9. . Amend' Section 9s, "DETAILS OF CONSTRUCTION IMPROVEMENTS"s.
Item 3s; by adding. a- new item 3,; and thus moving all remaining
items, up one numbers,, New item 13 to read .as follows:
SECTION 98, ITEM 3s in subdivisionss, including the
development of property fronting on salt water '.or contemplated
saltwater .frontage, the plans for such developm.ent . shall
be approved by the Planning Board and the Town "Trustees as
it affects the fresh water- resources- of the' Towns, and
other town regulations.
10. Amend Section 9s, "DETAILS OF `CONSTRUCTION IMPROVEMENTS",s;
the new item .6a, to read as follows by adding the following phrase:
SECTION 9,. ITEM 6: In lieu of -making the improvements
as specified-___- -------------------of the .parties `thereto.
If the Planning Board shall decide at- any time during the
term of the performance bond,, upon nspection'by its constructiot
inspector, that the extent of building development- that has 'taken
place in the subdivision is not sufficient to warrant----"
,._..._____...._.._....____ of such proueeds.
11. Amend Section on, "PROCEDURE" In regard to the_ fees for
applications:
109acres or less- - base fee of $50.'00;. Over 10 acres -
base fee plus $5.00 for each additional acre or` ffxaction '
thereof in excess of 10 acres.
- Also by adding a new paragraph under the fee:
in addition, a highway inspection fee, of- $50,00
per mile or fraction thereof will be charged s, but,.a
mininum charge of: $40.'00 will be made in. all cases.
The Planning Board request- immediate attention to all the
recommended amendments,. so that these may be presented to the
public- at a public 'hearing.,, and the Rules and Regu3tmons for the
Subdivision . of Lane may be brought up to date.

and Mr. Young.

On motion by Mr. Moisa, seconded by Mr. Grebe, it.was
.RESOLVED that the following amendments to the Southold
Town Building Zone, Ordiance be recommended to the- Southold
Town Board;
1. By amending-'Article III, Section 300g by adding thereto ,
a new section to be lb, to read as follows:
ARTICLE IIIT' SECTION 3008 SUBSECTION lb: The construction
of a new two family dwelling Will- be permitted in the "A"
Residential and Agricultural District by special. exception
of the Board of Appeals. as hereinafter provided, if the .
building lots contain twice the required square footage
area and twice the frontage G_ a required '75or, a single
family dwelling.
2. By amending Article VIZ, Section 703, to read as
follows:
ARTICLE VII," SECTION 703s. A permit-will be required
prior to the commencing of work- for the erection or" additi.ons
to all buildings.
3. By amending Article VII,, Section 705e to read as follows:
ARTICLE Vlhe', SECTION "705 - ,For each application or
Appeal to the Board of Appeals as hereinafter providedathere
shall be a fee of fifteen dollars ;($15.00) accompanying the
application or appeal.
4. The Planning Board recommends that the fee for copies
of the- Southold Town Building'Zone Ordinance be raised from
.25� per copy to atleast . .5.01� per copy.
5. The Planning`,Board feels that a sand and gravel ordinance
should be put into effect as soon as possible,

The Planning Board again took up the matter of the change
of zone from "A"Residential and Agricultural District to C.
Industrial District ,; on the property of William'Wickham,,. located
. in Cutehogue.,
On motion by Mr. Moisa,, . seconded by Mr. Grebe,; it was
RESOLVED in the matter of the petition of William 'Wickham
for a change of zone from "A" Residential and Agricultural District
to "C" IndustritkI. District. on certain. xeal property located in
' Cutchogue,. in the Town of Southold,, Suffolk-County,: New York,and
more particularly bounded and described as follows:' bounded north
by Middle Road,;: east by Moore,, south by -Long Island Railroad,
west- by Tuthill, containing approximately 18 acres more or less.
it is hereby 'RESOLVED 1-that the Planning Board favorably
recommends to the Town Board the change -of zone from "A Residential
and Agricultural District to "C" Industrial District on the
property of'William'Wickham as described above.
This is Parcek 11 on the original application_ of Mr. William
Wickham,, submitted tothe Board in June, 1959. Mr. Wickham .has
been more than cooperative in this matter- and we feel that the
time has come for this to be given some consideration for
change.

On motion -by -Mr. Grebe,. seconded by Mr. Young, it- was
RESOLVED that the Planning Board recommend to the Town '.
Board the, change of zone from. "B" Business District to "A"
Residential and Agricultural: 3,is.trict and from: "B" Business
District to• "M" Multiple Residence on the above described
property of Cove Beach- Estatess Inc.East-Marion,. New York.
The Planning Board held a lenghty discussion with the
president of=Cove Beach Estates&; Inc.&, and the Supervisor
'was also present.at this meeting to discuss the chang.e of
zone. This. change of zone meets the approval of .all parties
involved.
Vote of the Board: Ayes:Mr. Wickham,, Mr., Moisa&, Mr. Grebe,
and Mr. Young.
The Planning Board received from the Town Board a petition
fora change of zone. from. "A" .Residential and Agricultural District
to "B" Business District by,Woodhull Properties&; Inc. , with the
instructions to prepare an official report .defin'ing the conditions
described in the petition and determine the area so effected with
the recommendation of the Planning Board. This property is .
bounded and described as follows:
PARCEL I - Beginning at the corner .formed by the intersection
of the southerly side of Park- Vi.ew" Lane and the easterly side
of= Plum Island Lane and from. said point .6f beginning running
thence easterly along the said southerly side of Park View Lane

On motion by Mr Young&-seconded by Mr. Grebei. it-was
RESOLVED that the Southold Town Planning Board favorably
recommends to the Town Board this change of zone from. "A"
Residential and Agrd=ltural District to "B" Business District®
The Planning Board further recommends that the Town Board on
its ,own motion include in this change the property of Young to the
east. The property of Young will be the only remaining residential
property between- the proposed change and the business property cf
the Orient Point Inn,, if it is not included.
Vote of the Board: Ayes:-Mr. Wickham#, Mr. Moisas Mr. Grebe,,
and Mr. Young.

RESOLVED that the minutes of the Southold Town'/9;aRai4 .
dated January 15,, 1965 s, be approved as submitted.
