SOUTBDLD TOWN 'PLANNING 'BOARD
April 6, 1965
A regular meeting of the Southold Town Planning Board was
held on Tuesday,, April 6,, 1965 j, at the Town' Office?' Main Road,
Southold,,; New York.
There were present: Messrs: John 'Wickhamr. Chairman; Henry
Moisa,. Alfred Grebes. Archibald Youngs William Unkelbach.
Also present: Messrs: Howard Terry=, Building Inspectors
Otto Van T4ylz, Consultant.
The Planning Board received numerous objections to the
change of zone from 'rA° .Residential and Agricultural District
to "B" Business District on property of North Dumpling Island,,
located off the coast of Fishers Island. Th was a request
fora change of zone by Robert -Waddington. Mr. Alfred Grebe
reported that Mr. Waddington intends to withdraw his application
and he will send a letter to the Planning Board and-Town Board
advising them of 'his withdrawal of said application.

Mr. Wickham advised the other members of the,Board that
J.M.S: Land & Development,Corp.tr, and H.J.S, Land and Development
Corp. had _received a contract for the water mains from the
Village of Greenport for water in the subdivision;."Eastern
' Sho:Oess, Section II"ir, He also advised that-he had written a
letter'to the Town Board stating that the Planning Board would
waive the performance bond for the water mains in view of
the fact that the subdividers had a contracts; or if the Town
Board .wished to do so* they could set the bond for ' the roads
and the water mains separately. Howard Terry advised the
Planning Board that- the Town Board had taken no action on
the performance bond.
Alexander'Chases Esq.r. appeared before the Board. in regard
to the subdivision to be known as Mattituck- Estatess located on
the south side Main Roads Mattitucks; New York. Mr. Chase presented
the map showing test holes for�water .made by the Board of Health.
. The roads in this subdivision have been approved by Harold Pricer,
Superintendent of 'Highways. The*Chairman advised Mr. Chasethat
the map should show the area reserved for the Towns, and 1.at the
Board would require a letter of intent for the file. Mr.. Chase
advised the Board. that the deed restrictions had been agreed upon=,
and a copy of 'same would be mailed to the Board. Mr,- Chase
also advised that they planned to dedicate the roads in the
subdivision to the Town.
On motion by Mr. Unkelbachr, seconded by. Mr. Grebes, it-was
RESOLVED that tentative approval be given to the subdivision
to be known as "Mattituck Estates"�r, located on the south side
of the Main- Roads Matti.tuckr New Yorke owned and developed by
Mattituck Estates; Inc.
Vote of the Board: Ayes:-Mr. Wickham.,, Mr. .Moisar Mr. Grebe,,
Mr. Youngs, and Mr. Unkelbacho
Mr, Remson Ostranderr., Esq.,r; Southampton appeared before
the Board to object to the petition by Robert-Waddington -for
a change of zone on North Dumpling island=: off Fishers- Island=,
New York. The Board. advised Mr. Ostrander that the applicant
had withdrawn the application._
The Planning Board received from the. Town Board the
original petition of Jack and Irving Levini Greenport's, New
Yorks; for a change of zone from "A" Residential and Agricultural
District to "B" Business' District with instructions to. prepare
an official report defining the conditions described therein.

This change of zone is requested on certain real property situated
.at-Middle Roadt;- Arshamomaquet, and more particularly bounded
,and described as follows:
All that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected:: situate,,; lying.,. and
being near 'Greenportt, Town of 'Southold.., County of 'Suffolk and
State of 'New- York,,: bounded and described as follows:
Beginning at .a monument on the northerly line of 'Middle Road
at the southeasterly corner of land of -Jack Levan and Irving
Levin and the southwesterly corner of land of Sarah R. Feeney and
Katherine M. Feeney; from said pointof beginning running along
said northerlyline of the land of the Middle Road, N. 620 00=
E,�2` 010 feet .to a monument; thence along said land of Feeney.,

On motion by Mr. Moisa., seconded by Mr. Unkelbachr it was
RESOLVED that the Southold Town Planning 'Board recommend
to the Town Board the change of zone from "A" Residential and
Agricultural District to "B" Business District on the property
of Jack and Irving Levin as described above.
This change is part of the overall plan to continue the
Business` District for the use of a. motel.

The next meeting of the Southold Town Planning Board will
be held at 7:30 P,,M,,, Tuesdays, May ll,, 1965,, at the Town Officg,
Main Road.. - Southold. New York.'
On motion by Mr. Grebe,,. seconded byMr. Young, it was
RESOLVED that the minutes of the Southold Town Planning
Board dated March 161 1965,, be approved as submitted.

Mr.. William' Pollert appeared before the Board to discuss ._
with them property on the North Road. Mr. Pollert has some
160-170 acres of land with approximately one half mile of
water frontage. He thinks that he will most -probably divide
this for residential purposes. He advised the Board that there
was a small pond .on the property which is separated from the
sound by only a small amount of gravel. ' Mr. Pollert wants to open
up this pond into the sound and construct anon-commercial marinas.
for the residents of the area,..; when the .land is subdivided. The
Chairman advised Mr. Pollert that the Town Trustees are the
ones that controll inland waterways. The' Chairman also advised
Mr. Pollert that the Planning Board isvery much concerned with
the creation of man-made canals in view of the fact that such
canals endanger the fresh water supply of the Town. The
Chairman also advised Mr.. Pollert that he should look further
into this matter; that he would probably have a di-ificult problem
keeping such a .channel open. A lenghty discussion was held on the
,feasibility of having such a channel and keeping it open. There
was also the question of who would maintain this channel after
the land was subdivided. Mr. Pollert did not know the answer
to this .question yet. The Chairman advised Mr. Pollert that
he should look further into this matter and then present. his
plans to the Board.
. Mr. Pollert was also concerned with another piece of
property on the south side of the North Roadr 'at Greenport.
This _contained an area of 17.038 acree.' . Mr,; PollertIs idea
was to put some type of professl6nal building in this area.. and would
want a .light cI&ss of ' "B" zoning. This property is located within
a mile of Greenport .Village. - Once again the Board advised that
Mr, Pollert should submit. bb final plans to the Board.
The Board. again took up the matter of "Harbor 'Lights' Estatest
Section V* The' Chairman read the minutes of the Board of September
21r, 1964r, which recorded the hearing on "Harbor 'Lights' Estates&,
Section I". The hearing had been recessed at that time because
the subdivision had not received the- approval of the County Board
of Health. This property is bounded and described as follows

Mr. Reese -advised the Board that provisions -are being made
for a park and playground area in the next section of this
subdivision to be filed. Vr. Reese will submit a letter' of
intent to the Board in. regard to said park and playground
area. The Board will act on this subdivision when they receive
a letter of intent .from Mr. Reese and an estimate for a
performance bond for the roads to be completed. The Chairman
requested that the record show that the Board advised Mr.. Reese
that it-would not be necessary for him "to. appear at the next
meeting. in view of the fact that the subdivision has met all
the requirements ..of theBoard. The- Planning Board is merely
waiting for said letter of intent and estimate for performance
bond.

William.-Wickhamt esq. , appeared before the Board to discuss
property located on the south end of the McCann property' on the
south - side of the North Road (CsR. 27)", Greenport�. N,ew York. This
property is now owned by.-Martin -Nelson. This property backs up
against the--Village of Greenportl It-was thought that this
property could be used for a light business area. This involves
some 18 acres which the' Chairman advised Mr. Wickharrrw is too
large to be changed to business. However, the thought arose
that the future development of CR 27 would take approximately
75 -feet on the south side of the' road. The Chairman- also
advised Mr. Wickham that the,County would not `look favorably
upon access coming out directly on the 'C' R 27. Howe veer; access
could be obtained .from Moore`is Lane. Mr. Young brought, out the
fact that if this was made a" business area: h.e would like to
see plenty of ,parking area. The' Chairman also sated that he
would. want said parking area landscapred as much as possible.
It-was the Board"s .opinvn that they would like 'to see a tentative
layout of the complete plans for theproperty.
On motion by Mr. Moisa, seconded by Mr. Grebet, it was
RESOLVED that the- Southold Town Planning Board recommend
to the Town Board .a performance bond of '$25.2000.00 for the
completion of the roads and drainage in the subdivision known
as "Harbor ,-Lights .Estates r, Section I"c, owned' .and developed
by. Frederick and Harold Reese,

Mr. Youngr and Mr. Unkelbach.
