P.M:'t, Thursdays. June 31,1 19658, at .the Town Office,; Main Road, Southoldr, New York. There were present: Messrs: John Wickham... Chairman,; Henry Moisas Alfred Grebe, Archibald Young j acting chairman until Mr. Wickham was present,; and William' Unkelbach. Also present: Messrs: Otto Van Tuyl;, Consultant,. Howard Terry, Buld.ing Inspector. Lefferts- P, Edsont Esq. . and Mr. Schneider appeared before the Board to request- a date for a final hearing on Eastern" Shores, at Greenportr, Section III. Mr. Youngs; acting 'Chairman,r.- advised Mr. Edson that a letter ofapproval was needed from Harold Pricei. Superintendent of Highways' on the 'layout .of the roads. Also,. the Planning Board had not yet received an estimate fora per- formance bond for the completion of the roads and water mains in the subdivision. Mr. Young,, acting Chairman, further advised Mr-. Edson that they would set a date for a hearing after' Mr. Wickham was present. Plan ing Southold Town oar -2- June � 196,- - Lefferts P. Town of Southold,,- County of Suffolk and State of 'New York, bounded and described as follows: BEGINNING at .a point at the ordinary high water mark-of Long Island Sound marking division of lands of 'F.H.S. On motion by Mr. Unkelbach,. seconded by Mr. Moisat, it was RESOLVED that- the subdivision to be known as "Eastern Shores at Greenport, Section IV' ,. located at- Greenports. containing approximately 12 acres'., owned and developed by H.-J S: Land & ' ' Development Corp., be given preliminary approval. Vote of the Board: Ayes: -Mr. Young, Mr. Grebe, Mr. Moisa, Mr. Unklebach. ` Southold Town Planning Bc;.:�3 -3- June 196' Edward Abitz appeared before the Board to request a date - for ' a 'final hearing on the subdivisions_ "Mattituck Estates". Mr. Young,, acting Chairman, advised him that 'they-tatould set a date fora hearing as soon as possible, but would have to wait for Mr. Wickham to seta definite date. Mr. Abitz also presented the Board with photographs of the type of entrance he would 4e to have to the subdivision. He stated that this -entrance 'would be five feet to six feet .back from the road and requested the Board's opinion on the matter. Mr. Young advised Mr. Abitzs that .a wood entrance would be more acceptable than abzbbewy shrubbery. There is a chance that the shrubbery would become overgrown and obstruct vision of the traffic. Southold Town Planning BC.:..-d -5- June 3, 196, Bernard and Theodore Kaplan appeared before the Board to discuss the proposed subdivision to be known as "Dawn- Estates",, located at Greenport, in the Town of Southoldt: Suffolk-County,' ' New, York, -owned and. developed by DawnEstates Builders .Corp. This -subdivision will contain approximately 28 lots.' Mr. Kaplan was advised that the Board would wait until they had a report from Mr. Young on the meeting with the Town Trustees. This meeting dealt-with the creation of man made cards ,, ., such as proposed in the subdivision- "Dawn- Estates". It was felt that themeeting' with .the trustees should not be discussed with the applicants. Mr. Wickham advised the applicants that the Planning Board would try to have an answer for them at their next meeting. Mr. Wickham felt that the lots in the subdivision were too small, however, Mr. Kaplan felt that there was no real basis to determine whether lots were too small or too .large. He also felt that there are many people-who request smaller lots. Mr. Young advised that the water table was a- serious question and should be given very serchous consideration. Mr. Kaplan didn't feel that the proposed canal in the subdivision - would harm the water table,: in. vaew of 'the .fact- that the subdivision would have village-water. Mr. Wickham further advised that there are �tules and regulations for the provision. of a park- and playground area in the subdivision. . He also..Iiformed Mrs Kaplan that said park and playground area would 'have to be for the public and not just for 'the lot owners in the subdivision. Lefferts P. Edson,.. Esq.•,' and Mr. and Mrs. Clayton Clarke next appeared bebre the Board to discuss the following change of zone application of Mr. amd Mrs. Clarke. All that certain tract or parcel of land situated at- Peconic,, in the Town of' Southold,, Suffolk'County,' New York.,, and more particularly bounded and described as follows: Beginning at a monument on the northerly line of North Road marking the division of land of Clayton H., and'Rose M. Mr. Edson stated that the applicants were not- asking for the whole farm to be changed to business. They only wanted a small parcel of 'the farm,,, in order- to conduct their business,' namely ] an antique shop, - Mr. Edson also stated that to the east .of the property .in question is Kaelin's Farm Machinerys.. Doroski=-s and Myers Factory,; all zoned business. The property of :Charles Hubbard,' non-conforming business, is across the street from the property in question. The applicants were advised that the :. Planning Board was not willing to go along with this change of zone. Such a change in this particular location would constitute spot zoning. This would be a small business district in the middle of a residential section. The Planning Board also pointed out that-County 'Route 27A was to'be a high-speed highway and should not have small businesses on the route, Lefferts P. Edson appeared before the Board to discuss the following change of zone application. The petition of Vitaliano� Caroleo and others for a change of zone from "A" Residential and Agricultural. District to "B-2" Business District on certain real property situated' at-Cutchogues in the Town of Southold, Suffolk-County, New York, and more particularly bounded and described as follows: Beginning at- a monument on the southerly line of Middle Road marking the division of lands ' of the applicants herein and L. Glover; running thence along lands of the said. L. Southold Town..Planning ' ,__.rd -7- June 3,, 19-., The Planning Board advised Mr. Edson that the change of zone would also constitute spot zoning.: This change of zone is . also on the' County Route '27As, which the'Planning 'Board feels should be maintained as a high-speed highway. Mr. Edson requested that the Planning Board hold-up their recommendation on this application until they receive a report from the 'County on a study being made of County Route 27A. On motion by Mr. Modsa, seconded by Mr. Grebe*,'. it was . RESOLVED that-Lawrence Tuthill,, professional engineer. be authorized to make an estimate for a performance bond for -the completion of the roads and water mains in the subdivision -to -be known as ' Eastern_ Shores at Greenport,, Section III, There shall be a total for the completion of the roads,, and .a total for .the water °mainsr. and the grand total. Vote of the Board: Ayes:- Mr.- Wickhamr. Mr. Moisa,, Mr. Grebe,. Mr. Young, and Mr. Unkelbach. The Planning Board received from .the Town Board the original petition of-.Anna C. Hansen as described above. The Planning Board feels that the property in question is too large of an area to be zoned for business. Vote of the .Board!" Reeve & Sons. Inc.,. until the Southold Town Board takes action of the petition of Vina Baker and George Van Buren,; for a change of zone from "A" Residential and'Agricultural District to "B-2" Business 'District. This property is'�.in the same vicinity as the property of 'H.R.' Reeve's Sonst Inc. Vote of-the Board: Ayes:- Mr. Wickham... Mr.. Moisa, Mr Grebe,. Mr. Young.. and Mr. Unkelbach, The Planning Board again took up the matter of the: pe-it4en petition of William J. Pollert . for a change of zone from "A" Residential and Agricultural--District to "B-2" Business District&, on certain real property situated at Greenport, in the Town of Southold,. Suffolk,County, New- York,, and more particularly bounded and described as follows: BegirxAing at a point on the westerly line of Manhanset Avenue where the same- is intersected by the northerly line of Champlin� Place and thence .running along said northerly line of Champlin Place, south 580 35" 20" west,, 489.90 feet to a pointj, running thence. north 31 243" 40" west, 832.03 feet to a point .on the southerly line of the' North­ Road; thence along the southerly line of North Road two courses,, as follows: (1) north 660 36240" east, 291.24 feet,, and (2) north 650 23` 50" east,: 228.44"feet; thence abng land now or formerly of Benze,, two courses, as follows: 1) south 22° 30' loll east,, 191.59 feet, and (2) north 660 en 40" east 116:,,l.4 feet to the westerly line of- Manhanset Avenue; thence along said line,, south 20 121 30" east... 569.68 feet to the point or place of beginning. On motion by Mr. Wickham, seconded by-Mr. Grebe, it was RESOLVED that the Southold Town Planning Board does not favorably recommend to the Town. Board the change of zone from "A" Residential and Agricultural District to "B-2" Business District-.on the property of Wil9.iam J. Pollert as described above. It is the opinion of the Planning Board that a business zone of this size and in this particular vicinity doesn't appear to be needed at this time. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr, Young,, and Mr. Unkelbach. Southold Town Planning B&� d -10- June 3., lsz_ A letter was sent to Hermon F. Bishop. commissioner, Depart- ment of Public Works,- County of Suffolk, requesting a copy of the plans for the future extension of 'County Route 2'7A, as soon as they are available. Howard Terry, Building Inspector,, reportedthat he had talked to Mr. Williamsonr and he had given his approval on the subdivision to be known as ` "blue Horizons". This subdivision had been approved subject to a letter from Mr. Williamson. The Chairman is to be notified when the Town Board accepts: the performance bond ..so that he may sign the final maps. On motion by Mr. Grebe, seconded by Mr. Young,.' it was RESOLVED that the minutes of the Southold Town Planning Board. dated May 11,: 1965, be approved as submitted. Vote of the' Board: Ayes:Mr. Wickham. Mr. Moisa, Mr, Grebe.. Mr. Young., and Mr.Unkelbach. Mr._ Young- reported .on his meeting with the Town Trustees,: Town .Attorney Robert Taskerr, Esq. , and Supervisor *Albertson., At the meeting the creation 'of man-made canals was discusseae Mr. Young reported that Robert Tasker, Esq. informed them that a man can dig in his back yard and create a canal- if he wants to. The Planning Board then held more discussion on this particular subject. Mr. Young also reported that there should be an exchange' of-minutes between the Town Board, Board of:Appeals, ' Planning Board and Town Trustees. A letter was sent to Brookhaven Town Planning Board and Southampton Town Planning Board asking. them what their policy has been in connection with the creation of man-made canals. A letter was written to Bernard and Theodore Kaplan in regard to the proposed subdivision "Dawn Estates. Section I� = They were advised that the Planning Board would have a more definite answer for them at their meeting in July. They will be notified of 'the exact date.
