PUBLIC DARING: Upon question of. approval of the following plat of property: 1. Plat of property owned by H.J::S. Land &Development Corp. , and LT.M:S: Landand Development Corp. , entitled Eastern Shores at Greenport,- Section III, at Greenport, consisting of a parcel of land of 7. 96 acres, situated at Greenport, in the Town of Southold, Suffolk- County, New York,. and more particularly bounded and described as follows: Southold Town Planning BoEil -3- June 29, 196_ dedicating land to the Town of'Southold for park and playground, puxposes, and a copy of the permit to connect the road in the subdivision to the County Highway. The Chairman read the legal notice ofhearing and the affidavit attesting to the publication of the legal notice. THE' CHAIRMAN: is there anyone present-who wishes to speak in opposition to this subdivbion? (There wassno response. ) THE 'CHAIRMAN: Is therez:anyone present who wishes to be heard in favor of this subdivision to be known -as-, "Eastern- Shores at Greenport, Section III. " ? LEFFERTS P. EDSON,­ ES¢:: We ask that the .Board give favorable consideration -to the final approval of this subdivision, subject to the signing of the performance bond. THE 'CHAIRMAN: There are a couple of other things that need to be cleared up. First, What-.about the water? Do you want to. submit to the Town Boarda contract with the Village of Greegport? Also there is the park- -and playground provision. If you recall, when you got approval of Section Il, you gave us a -letter of intent and the time is getting closer whenwe feel that the property should be dedicated to the Town. Now, I am not sure just how to go about this, but something should be done. (Lefferts P. Edson, Esq. advised the Board that he would provide the documents for the installation of the water mains. I have property on the other side of'New' Suffolk-Avenue, next to land of:Russell Tuthill. I believe that there is a culvet that drains under New Suffolk Avenue. This culvet allows the water ' to drain by my property. I am here to ask questions. What is the intention of the real estate developer in reference to this culvet? I realize that they have already made improvements on this land. There; is one house already constructed and there is another house under construction. - What I would like to know, is there going to be any change in. the present arrangement for drainage? MR.- UNKELBACH: Do you face on Deep Hole- Creeks south or north of New Suffolk' Avenue: C. EDWARD NELSON: South, next to Russell Tuthill. Nat. UNKELBACH: You are aware that. we demand. that all surface water be returned to the ground. C. EDWARD NELSON: There are constructed basins that are on the road. Now, on thenorth side of the road, this 3 water runs under a culvet,. adjoining land where I am. I want to know 'if there is going to be any change in the water pattern when this development is opened. Another thing ITAsh to state, it was necessary. for me to leave my job at 1: 00 this afternoon to attend this meeting. Now, I would like to know what the intentions are as far'.as the water drainage is concerned. - . THE CHAIRMAN: We cannot advise. you what their intentions are. Edson appeared before the Board with Vitaliano Caroleo.. to discuss his proposed change of . zone from "A" Residential and Agricultural District to "B-2" Business District-.on property located at-Cutchoguef This property is bounded -and described as follows: All that certain plotr piece or 'parcel of land situate lying and being in the Town of'Southoldr.. at--Cutchogues County of Suffolk and State of New Yorkt bounded and described as follows: BEGINNING at a monument on the southerly line of Middle: Road marking the division of lands of. the applicants herein and L. William'Wickhams Esq. appeared before the Board to inquire' if any further, actioh had been taken. on the property. of=Martin Nelson for a .change of zone in Greenport. Mr.- Wickham was advised that no formal action was taken on this propositions it had only been generally approved by the Planning Board. William Wickham Esq. also wished to discuss the property of Anna Hansen, located at Mattituck. Mr.• Wickham wanted to know if the Planning Board would lock.nore favorably upon changing to business a smaller parcel of land than was previously-requested. The' Chairman advised Mr. Wickham that the Board would like to see some kind of plan as to what would-be done with the property. Howeger, Mr. Wickham advised the .Board. that_Mrs. Hansen requested the property changed to business property,; in order to sell it. Mr. Wickham said that he would file another application for the land of:Anna Hansens, however, he would requestea smaller parcel of land to be zoned to business district. On motion by Mr. Moisa, seconded by Mr. Young, it was RESOLVED that the' Southold Town Planning Board recommend to the Southold Town Board a performance bond of $12,000.00 for the completion of the roads and the watermains in the subdivision to be known as' Eastern Shores at Greenport, Section __;Is:- Greenport,- New York,. owned and developed by. H.J S.:-Land and Development' Corp. , and JM.'S� Land .and Development Corp. Vote of 'the Board: Ayes:- Mr.- Wickham, Ms._ Moisa=. Mr. Grebes. Mr. Youngs and Mr. Unkelbach.. . On motion by Mr. Wickham,, seconded by Mr.- Grebes_ it-was RESOLVED: WHEREAS H J S. Land &* Develcpment Corp. ,. and J.M S Land and Development-.Corp. , has petitioned the South dd Town' Planning Board for final approval of their plat known as "Eastern- Shores at Greenport, Section III", at Greenport,, New York, and WHEREAS the- Superintendent of Highways of the' Town of Southold has inspected the map and approves the highway layout of ' the roads' to be constructed, and his report is hereby approved by the Planning Board, and Southold Town Planning B­_ -d -7- June 29, 1�__ ' WHEREAS the Southold Town Planning Board pursuant to due notice thereof, held a public hearing on the matter of approval of the plat at which time all interested persons were given an opportunity to be heard, and WHEREAS the subdividers have agreed to submit to the Planning Board legal documents for ' the- dedication of-land to the Town of-Southold, for the purpose of park and play- ground area, and °WHEREAS­the-signing of the final maps by the Chairman of:the Southold Town Planning Board is waive until such time as a performance bond is posted for the ro&8S///smai�i' 9iff&'Wbnd is accepted by the' Southold Town Board; NOW THEREFORE BE IT 'RESOLVED that- the subdivision. to be known as Eastern Shores at Greenport, Section III, owned and developed by H;J.'S Land & Development-Corp. , and J M.'S Land & -Development-Corp. be approved, subject to the following conditions: 1. A copy of :a contract 'MX= with the Village of' Greenport for the installation of the water mains. 2. A copy of ' the permit from- the' County for permission to connect the road in the subdivision to the- County -Road. 3. The presentation of: a legal document dedicating land to the Town of-Southold for park and playground area as required in the rules and regulations for' the subdivision ,of land. 4. The posting of :a performance bond for the installation of the roads and watermains in the subdivision, and its acceptance by -the- Southold Town Board. Vote of the Board: Ayes:-Mr. Wickham,, Mx, Moisa, Mr. Grebes Mr.- Young, and Mr. Unkelbach. ' The' P.lanning Board received from the Town Board the . original petition of Katherine J. Schafer, for -a change of zone from . "A"Residential and Agricultural District- to "B=2" Business District with the instructions to prepare an official report defining the conditions described therein. This change of zone is for certain real property situated at East-Mation, in the Town of: Southolde,- Suffolk, Coutny, New York, and more particularly bounded and described as follows: Southold TownPlanning- Boaru -8- June 29, 1965 , Beginning at a monument on the northerly line of Main Road at the southwest corner, of landr»w or formerly of�Cowan; thence - N. 90 271 00" W.-124.2 0 .feet; thence N. 100 - 01= 00" W.-60.00 feet, more. or less; thence N. 78° 471 20" E.- a distance of 200.00- feet, more or less, to a monument; thence S. 120 29' 50" E.-159.80 feet to the said northerly line of Main Road; thence' S. 830 41' 00" W.-100.55 feet; thence' S. 88° 03' 00" W.-92.00 feet. to­ theI. point or place of beginning, containing 3/4 acres, more ow less. On motion by Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board does not favorably recommend. to the Town Board the change of zone from "A" Residential and Agricultural District to "B=2" Business"District on the property of Katherine J•. • Schafer, as descuibed above. The- Planning Board points out that the proposed change -of zone- would constitute spot zoning, since there are no other business distrio-ts in the immediate vicinity. The Planning Board further points out that .theproperty in question is directional across from a church. VotOf :the Boarc7?Ayes:-Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young,. and Mr. Unkelbach. The' Planning Board briefly discussed the change of zone application of HR: Reeve &- SON, for a change of zone from "A" Residential- and- Agricultural District- to "B-2"I Business - District on property situated- at Mattituck- on the'Westerly side of Wickham Avenue. The Planning Board agreed to write Mr. Reeve a letter requesting his presence at the next - planning Board meeting so that they may discuss the proposed change of zone with him. On motion by Mr. Grebe,' seconded by Mr. Moisa, it was RESOLVED that- the minutes of the Southold Town Planning Board dated June 31' 1965, be approved as submitted. Vote of the Board: Ayes:-Mr. Wickham,.
