SOUTHOLD TOWN 'PLANNING BOARD
October 5s 1965
A regular meeting of the Southold Town Planning Board
was held at 7:30 P.M. , Tuesday, October 5, .1965, at the Town
Offices Main Road, Southold, New York.
There were present: Messrs: John Wikkham, Chaimmans Henry
Moisa, Archibald Young, Alfred Grebe.
.. Absent: William Unkelbach
Also present: Messrs: Howard Terrys. Building Inspectors
Otto van Tuyls Consultant; Lawrence Tuthill, _ proffessional
Engineer.
Lefferts P. Edsons Esq. , Mr.. Stern and Mr. Morgan appeared
before the Board to discuss the dedication of landin, connection
with the subdivision "Eastern Shores at Greenporto "

FRANK STERN: I "present the map for dedication of the
200 feet; no more, or less. Our -problem is being faced with
regard to this area., ( pointing to map) . This area is not
ready for develppment. That is the reason we have left on
file with the' Planning Board our letter of intent. In the
meantime we feel that it will be a handicap to discuss a
right of way. The Mayor of Greenport is agreeable to give {
right of way over this property here. Since this is difficult )
to discuss, we will give you 200 feet in the area. ( pointing
to map) . You will have immediate access across the- Sound
Drive Territory. Eastern Shores has always been willing to !
negociate. We have met with the Planning Board and The Town
Board. Our decision is 200 .feet, no more or no less.
THE 'CHAIRMAN: We can play the same game. We have- said
that we will require at least 200 feet, and I am just laying
this on the table for my opindeon. This will fullfill our
requirements, but his does not fullfill the Town Board's
requirements. As far as dedication is concerned, access means
nothing to the Planning Board at the present time. So that
.the right-of-way is of no particular consequence at this time,
and we could say very easily we will accept your offer. This
will fullfill our requirements for Section 1, 2, 3, 4, and 5.
We will require an instrument in writing, but you still have
the hurdle.. What you do with the roads we can't accept. That '
is the Town Board, that is their responsibility and priv&lege.
MR. STERN: I don't ..follow you about the roads.
THE- CHAIRMAN: 'Have you dedicated any of the roads yet?
MR.� STERN: Yes, the roads in Section`"I.
THE CHAIRMAN: We have .no authority to accept roads. We have
the right to specify what will be required, . and' we can specify
the park and playground area, but his does not guarantee dedication.
I see no great problem. If the Town Board continues to fe&l
the way they do now, you will have to make further arrangements
with them for dedication. This would make sence to me. If you
don't wish to go along with them,. that is your ,privilege.

MR. STERN: The only thing I can say in regard to this, this
will be put into the lawyers hands. Mr. Van Tuyl, and Mr. Edson
will make all the ,arrangements. The revised map of Sound Drive
will get the preliminary approval. If you wish to give us
preliminary approval on the refined map at the same time the
lawyers are working on this, you can fall back on this. It will
all be done by the time the map is up for final approval. I
am now referring to Section IV. We made minor changes in this
section and we feel that it is up to us to inform this Board
so there will be no great surprises when we file for the final
approval. . Because of the erosion problem we had to angle down
the road.
(The Board viewed the original. map of Section IV, Eastern
Shores and Mr. Van Tuyl and Mr. Stern pointed out the changes. )
MR. YOUNG: DOes this 50 foot road dead-end on the east line?
Mr. Van Tuyl: Yes.
MR. YOUNG: Is this with anticipation of carrying the road
through?
MR. VAN TUYL: Yes.
MR. STERN: Some adjustments need to be made because of the
erosion.
MR. VAN TUYL: At the Town Board discussion of this, there
was some question if they would accept this with the 100 foot
turnaround at this point.
THE CHAIRMAN: We have discussed this, and I told Mr. Morgan
the Town Board is in no mood at the present time to accept
dedication of this road on the terms that you have outlined.
They told me that they felt they should have at least 600 feet
because you have six sections. . I told them that this was un- I
reasonable and they agreed. They feel that they should have
100 feet on the sound for each section of the subdivision.
This is their requirement.

MR. STERN: This is beautifuly beach we are giving you. " All
sand, no rocks and stones. This is the cream of our beachfront.

THE CHAIRMAN: This I agree with. Nevertheless, the Town
Supervisor stated that he would not accept this as presented'.
I haven' t talked to him since. My feeling is, he is of no mood
to accept this. You know that applications for dedication come
to us. In this case we have no alternative but to . say this should
not be accepted until they give 100 feet. You will fullfill '
our requirements. This is what we require. If the Town Board
wants to take another 100 feet that tis their privilege.
MR. STERN: I will not argue with this Board, but we have
asked you to state your demands on Section I and Section II. � We
have a letter for 200 feet. We have agreed and lived up to our
promise. That is the agreement. People have the right to change
their minds. Eastern Shores stands ready at all times to cooperate.
We have lived up to all our promises. We could just drop this
. whole thing. There are five members in this and in two years
no one has drawn out anything. . This has been an asset to the
Town and the Town of Southold has received triple the amound of
taxes on this land. We feel we are doing our part by dedicating
what the Planning Board has asked for. The Town Board, when we
were there approved it, and then the next day I find it isn' t so.
THE CHAIRMAN: Maybe I haven 't made it clear. This fullfills
our requirements. This is all that we will require. We too are
gentlemen and have moral obligations which we accept. The point
I want to make clear is that the Town Board stands ready to
require more shorefront. We are just talking about the Planning
Board. You are willing to take care of the Town Board and dedicate
when it comes time. May I say that you are a little short-sighted.
The Town Board is ready to give you a statement in writing .on a
300 foot deal that this fullfills all the requirements for all
shorefront access in the subdivision , for all sections. We
think this will be of value to you.
LEFFERTS P. EDSON, ESQ. : This is in fullfillment of the
Park and Playground area also?
THE CHAIRMAN: Yes, this makes sense. In looking at this)
sketch, there is something that has to be changed a little. The
way this sketch is laid out, it comes to a point where the
Greenport property meets the mean tide line. You can't have
access over a point.
MR.. VAN TUYL: If they get a right-of-way fromthe Village'
over to this point (indicating place on map) , they will give
right-of-way when it is laid-out.

THE CHAIRMAN: At high water mark, no one from the Village
could get to this point without tresspassing. It would have
to be an acre instead of 3/4 of an acre. . You can-'t give
access over a point.
(A lenghty discussion was held by all interested parties,
concerning the access. )
MR. YOUNG: We have asked 100 feet of those developments
that only have five or six hundred feet on the water. It would
seem to me that we should try to make each developer and
development give the same amount of property in comparsion
to how much property they have. Only 200 feet of shorefront, !
it would seem to me that we have been more than generous in
this case. It was my understanding that we said at least
200 feet. We would accept at least 200 feet. The area that
you have down in the pond in Section II, that is something
the public is not going to be able to use. That is for the
inhabinants. As far as the town is concerned, in comparsion
to what we have required of other subdivisions, we have been ' ,
generous. If the Town Board takes an opposite view, there is,
nothing we can do.
.THE CHAIRMAN: Would you like to look into the possibility
of getting a guarantee from the Town Board, that if you give an
additional 100 feet that 1"At would fullfill all the requirements
for the whole establishment and for the aprk.
LEFFERTS P. EDSON, ESQ. : It would save alot of- trouble.
(Mr. Stern and Mr. Morgan did not appear agreeable) .
THE CHAIRMAN: I have the authority to state that the 300
feet will fullfill all the requirements for all the sections
of the subdivision.

' William. Wickham, Esq. appeared before the Board with a
preliminary map of "Vanston Park", part ofproperty of Margaret V.
Braatz' This subdivision would countain ,16 lots all to be
20,060square feet and up. There is a right-of-way which runs '
to Wunneweta Pond. This pond would be good for boating but not
for bathing. However, there was . some. discrepency, over the
ownership of the right-of-way. The Chairman advised that
-he wanted the title cleared for the right-of-way. Then further
steps may taken .on this subdivision.
-On motion by Mr. Moisa, seconded by Mr. Grebe, it was
RESOLVED that -:,the following annual estimate be submitted :

No further action was taken on the matter of Eastern
Shores at Greenport.
Mrs. Van Tuyl presented map of Harbor'Lights 'Estates,
Section II. It was determined that- Section II of this
subdivision has been granted preliminary approval. If
the applicant files the application and plat, the' Planning
Board will give tentative approval for this subdivision.
However, the' Planning Board will ask fora park and
playground area, and they will ask that the applicant
commences work on the proposed private marina.
On motion by Mr. Moisa, seconded by Mr. Grebe, it was
'RESOLVED that the minutes of ' the Southold Town' Planning
Board dated September 1, 1965, be approved as submitted..
Vote of 'the Board: Ayes-. r. Wickham, Mr. Moisa, Mr.. Grebe,
and Mr. Young.
No further action-was taken on the application of
Martin Nelson for a change of zone from' "A" Residential and
Agricultural district to "B=2" Business' District on property
located south side North Road, Greenport, New York.
The Planning Board received the following statement
from=Antone Norklun.
"Pursuant to the' Planning Board's- request at their 'mee g
on: September 1st, 1965, I hereby state that in the event the
Town Board changes the zone of the premises on Village Lane, Orient,
which I am purchasing from Mr. and Mrs.- Allen'A. Mickle... from
residential to business,, I will' trans.fer any business tothat
location and discontinue the non-conforming. use of my premises
located on Oyster Ponds'Lane, Orient, N.Y.

. On ,motion by Mr. Grebe, seconded by Mr. Young, it was
RESOLVED: WHEREAS the' Planning Board has proposed amendments
to the "Rules and Regulations for thd'Subdivision of:Lane.,. and
WHEREAS the Planning Board, _ pursuant to due notice thereof
held a hearing thereon, on the lst day of September, at which
time all interested persons were given an opportunity to be
heard,

NOW, THEREFORE, BE IT -RESOLVED that the amendments proposed
by the Planning Board forthe "Rules and Regulations for the
Subdivision of`Land",, be adopted.
The' Planning Board has received no real objections to these
amendments although there were some comments made at the public
hearing.
Vote of the Board: Ayes:=Mr.- Wickhamv Mr.. Moisa, Mr. Grebe,
and Mr. Young.
No further action was taken on the application of"William
J. Pollert, residing at-Southold,, New York,, relative to a change
of zone from' "A" Residential and Agricultural District to "B-2"
Business'Distridt on certain real property situated at Greenport
New York.
it was ordered that- a letter be written to the .
Suffolk'County Department of'Public 'Works requesting maps
of the future extension of-County Route 27A.
The next meeting of the' Southold Town' Planning Board will,
be held at 7:30 P.M. , Tuesday, October 19, 1965, at- the Town j
Office, Main Road,- Southold, New York.
Meeting adjourned at J.0;30 P.M.
