Chairman Henry M oisa Alfred Grebe Archibald Young William Unkelbach MINUTES SOUTHOLD TOWN PLANNING BOARD October 19r 1965 A regular meeting of the' Southold Town Planning Board was held on Tuesday, October 19, 1965, at 7:30 P.M., at the Town Office, Main Road, Southold, New York. There were present: Messrs: John-Wickham,, Chairman, Henry Moisa,- Alfred Grebe..- Archibald Young. Absent: Mr. William Unkelbach (In'Europe on business).. - Akso present: Messrs: Otto Van Tuy1, Consultant; 'Howard j Terry, Building Inspector. Mr. Harold Reese appeared before the Board to,: discuss Section II of Harbor' Lights Estates. _ The Chairman advised Mr. Reese that .the Town Board has been consistent in requiring access on waterfront property. The Chairman also stated that ; if ' there was a canal dug that thb would be considered water- front property. The Chairman advised that in this case the Town Board would require access to the canal. Mr. Reese stated that they had intentions of digging a canal. • I i Southold Town Planning Board -2- October 19,, 1965 The-- Chairman further advised Mr. Reese, whereas he had substantial acreage to develope that the' Planning Board felt they should not wait too long before requiring the park and play ground area. Mr. Reese stated that he had the area for dedication for'-the park and playground area approximately located. He also stated that the rough road leading to this area should be completed within thirtyydayss. however, he stated it might be longer than 30 days. Mr. Van Tuyl will map out- the specific area to be set aside for the park and play ground area. Mr. Reese stated that over a period of. a couple of years he .intents to' develope three or four sections ,of this subdivision. The total acreage of this land being subdivided is approximately. 125 acres. .. Seztion Il of this subdivision is to be approximately 25 acres.. . In: Section II,,. Mr.. 'Reese intents to provide parking area for the residents in the subdivision by the beach. The ' Chairman advised Mr. Reese that-he would like to suggest the possibility of withholding land on the waterfront to fullfill the dedication requirements because the Town must'have' access to waterfront .property. Mr.- Reese stated that he -has already sold some lots and has given these- people rights to the water front. Therefore, he will have to look into the legal aspects, and see to what extent beach rights were given to the people in the' Subdivision. Mr. Reese stated he had set aside 900 feet of private beach for the residents in the subdivision. A very lenghty discussion was 'held on ,the possibilities of providing the necessary beach front and access to fullfill the dedication requirements of ' the Town, and still maintain the 900 feet of private beach for the residents of the. sub- division. Mr.. Grebe asked who would own the botbom of the Canal. Mr. Reese stated that it .was their intention to have the people form some sort-.of 'association and they would maintain the canal. The Chairman made reference to Dawn Estates, to be developed by Bernard and Theodore Kaplan. This subdivision is also proposing a man-made canal and the' Chairman felt that Mr. Reese would be interested to know how they intended to maintain the canal. A copy of the letter from Kaplan is to be sent-- to Mr. Reese. The Chairman advised Mr. Reese that the! ' Planning Board would like to have a clear and concise statement in writing, stating who is to be responsible for the canal. Mr. Reese said he would submit a letter: of .intent in regard td the maintenance of the canal. Mr. Reese statedihat it has been . made clear to the buyers of lots that the entrance to the canal Southold Town Planning, Board -3- October 19, 1965 s, will be kept open by the subdividers for about two years. After there are a substantial'. number of property owners in the subdivision, the carrtlwill be the responsibility of the property owners.. The Planning Board received from the Town Board the original petition of Martin' C. Nelsen relative to a change of zone from A Residential . and Agricultural District to "B--2" Business District with the instruction to prepare an official report defining the conditions described therein. This property is located in Greenport, Town of Southoldsl - Suffolk County, New Yorks and wounded and described as follows: Beginning at the intersection of the southerly line of Middle Road, with the easterly line of �Moores 'Lanej. from said point - of beginning running along said southerly line of Middle Road, three courses: (1) N. 66' 09: 10" E.-96.61 feet; thence (2) N. 69-° 02' 10" E.-985.10 feet; thence .(3) N. 71° 28: --2 0" E.-312.64 feet; thence' S. 160 011 50" E.-600.0 feet; thence S. 69° 203 30" W.-1381.31 feet to said easterly line of 'Moores Lane; thence along said-easterly line, N. 170 151 00" W.- 600.0 feet to the point- of beginning. Containing 19.303 acres. . . On motion by Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that the Planning Board favorably recommend to the Town Board the change of zone from "A" Residential and Agricultural District- to "B-2" Business 'District on the property of ,Martin-C. Nelsen as described above. The Planning Board has had conference with the attorney for Mr. Nelsen and with his engineer. The' Planning Board feels that they have some very promising plans for this property and we feel that it will be a very real asset to thej Town of :Southold. i Vote of the Board:' Ayes:-Mr. Wickham= Mr. Moisa, Mr. Young, Mr. Grebe. Southold Town Planning Board -4- October 191., 1965 On motion by Mr. Grebe, seconded bI Mr. Moisa. it was RESOLVED that the minutes of the ' Southold Town' Planning Board dated October 5, 1965, be' approved as corrected. Vote of the Board: Ayes:-Mr. Wickham,,. Mr. Moisa, Mr. Youngs Mr. Grebe. The next-.meeting of the' Southold Town ' Planning Board will be held on November 9s 1965,. at 7:30 P.M--, at the Town Office, Main Road,- Southold, New York. On motion by Mr. Moisa, seconded by Mr. Youngs it was RESOLVED that a letter be written to Raymond and May Associatea' and to-Cornell University requesting a study to be made of preferential assessment of open spaces,, -including farm land.
