Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions; 1. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area i The proposal to backfill err"--I it landward of bulkhead with aAhw 40 cy. clean sand to be replanted with native vege i, w id restored and maintained a tural vegetated buffer ... is INCONSISTENT with policy 4. 1 Minimize losses of human life and structures from flooding and erosion hazards and therefore INCONSISTENT with the LWRP. Applicable policies follow; B. Use vegetative non-structural measures to manage flooding and erosion hazards. 1. Use vegetative non-structural measures which have a reasonable probability of managing flooding and erosion, based on shoreline characteristics including exposure, geometry, and sediment composition. 2. Use vegetative measures to increase protective capabilities of natural protective features. 3. Discourage clearing of existing, particularly indigenous vegetation during siting, design, construction and regrading phases of any development project. The area from the top of bank seaward is protective natural feature. The proposal includes back filling of existing vegetation (see submitted survey dated 10/20/10) that is currently stabilizing the bank (see following photo). It is recommended that the Board further evaluate the need to raise the grade behind the proposed new bulkhead and the backfilling of existing vegetation. 1 l Figure 1. September 20, 2010 image date. I i' Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): The project consists of two components. The first is the ordinary and routine replacement of an existing timber bulkhead,in-place,with a vinyl bulkhead to be elevated 18 inches higher than the existing bulkhead. The existing vegetated embankment behind the bulkhead, which is steeply sloped, eroding, and being i g g g g P Y P g, g infiltrated by invasive vegetation, will be backfilled and regraded to the new bulkhead height at a more gradual slope and replanted with native vegetation so that it may be restored and maintained as a natural vegetated buffer. The second, using stone, backfill, and native plantings,is the partial reclamation and i vegetative restoration of an upland area that was lost avulsively to erosion in the spring of 2010 as a result of two consecutive nor'easter storm events. The i' embankment separating the maintained lawn and upland from the beach has eroded landward by as much as 44 feet since 2001,at which time much smaller i stone was permitted to help stabilize the embankment location at that time. This part of the project will similarly establish a vegetated nonturf buffer between the beach and the current, reduced, lawn area. The project will therefore serve the dual purpose of stemming the erosion and loss of the applicant's upland and jestablishing or restoring vegetative buffer areas between the upland and tidal wetlands and waters of the Town. In addition to providing flood and erosion protection, these buffers provide habitat and increased stormwater absorption capacity and filtration of contaminants adjacent to wetlands. i 617.20 SEQR PROJECT ID NUMBER APPENDIX STATE ENVIRONMENTAL Q ITY REVIEW _ SHORT ENVIRONMENTAL ASSESSMENT FORM for UNLISTED ACTIONS Only PART 1-PROJECT INFORMATION (To be completed by A phcant or Project Sponsor) 1.APPLICANT/SPONSOR 2.PROJECT NAME I LUKE&RITA LICALZI BY EN-CONSULTANTS,INC. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III - Policies Pages 6 through 7 for evaluation criteria ®Yes ❑ No ❑ Not Applicable Insofar as Policy 3 is applicable to the project, the project is consistent to the extent that it will preserve and enhance existing vegetation and establish new indigenous vegetative buffers where upland previously existed but has been lost to erosion. The in-place replacement of the bulkhead is defined under Chapter 268 as a minor action that is exempt from waterfront consistency review. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III- Policies Pages 8 through 16 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The project is consistent with Policy 4 because it seeks to incorporate vegetative non-structural measures,i.e.,vegetative buffer, with a hard structural erosion protection measure,i.e.,stone armor,to stem the loss of the eroding shoreline and partially reclaim and vegetatively restore an upland area that was lost avulsively to erosion in the spring of 2010 as a result of two consecutive noeeaster storm events. The proposed structural erosion protection measure is limited to the minimum scale necessary and must be employed where natural protective features are absent and vegetative means of erosion control have been ineffective. For example, marsh grasses that were was planted when smaller scale rip-rap was permitted and installed in 2001 were quickly lost, and even buffer vegetation planted behind the rip-rap was lost when the smaller rip-rap was overtaken by erosive wave action, resulting in the landward erosion of the upland embankment by as much as 44 feet since that time. As the structure will be located entirely landward of spring high water, the project will in no way impede upon public trust lands or access thereto. The in-place replacement of the bulkhead is defined under Chapter 268 as a minor action that is exempt from waterfront consistency review. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable Insofar as Policy 5 is applicable to the project, the project is consistent to the extent that the proposed natural vegetated buffer areas increase stormwater absorption capacity and filtration of contaminants adjacent to wetlands.
