Box 2124 Greenport, NY 11944 RE: MICHAEL & CORINNE SLADE 1435 WEST ROAD, CUTCHOGUE SCTM# 110-7-26 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, September 23, 2009 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of MICHAEL & CORINNE SLADE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, original application dated July 2, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application in part, be found Inconsistent-with the LWRP, and specifically Inconsistent with the following coastal policies: Policy 6 — Protect and restore the quality and function of the Town of Southold Ecosystem, Policy 6.3 — Protect and restore tidal and freshwater wetlands, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 23, 2009, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure, namely the proposed 8' extension to existing finger pier and install two new 10" diameter x 30' long support pilings at offshore end, as applied for, does not comply with the standards set forth in Chapter 275 of the Southold Town Code, specifically Chapter 275-11, Construction and operation standards, C (2)(c)[1][a], only one catwalk may be permitted per residential lot; only one mooring or dock may be permitted per residential lot, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Chapter 275-11, Standards for Issuance of a Permit, as the lot (SCTM# 110-7-26) is zoned R-40 Residential and only one catwalk is permitted per residential lot, and, NOW THEREFORE BE IT RESOLVED, for the foregoing reasons, and based upon the application's failure to meet the standards contained in Chapter 275 of the Town Code, that the Board of Trustees deems the proposed project to be Inconsistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, based on the additions to the existing structure, and, BE IT FURTHER RESOLVED that the Board of Trustees DISAPPROVES in part, the application of MICHAEL & CORINNE SLADE specifically to construct an 8' extension to existing finger pier and install two new 10" diameter x 30' long support pilings at offshore end and as depicted on the site plans prepared by Costello Marine Contracting Corp., last dated September 2, 2009 and received on September 23, 2009. The Board of Trustees otherwise disapproves the application as proposed with respect to anything not described herein. There have been multiple permits issued by the DEC and Trustees for this property and the use of the property has not changed in 50 years. Among other neighbors ready to provide testimony,Mary Anne Huntington provided a letter dated June 29, 2009 and Ray Huntington wrote a letter dated July 9, 2009 in support of Dr. Slade. The owner wishes to return the float to the seaward side of the dock for his sail boat. A float has always been used at the bulkhead, it can be documented in Town Trustee records since 1997. ' sib 5� Mary Anne Huntington _q=A 3175 West Creek Avenue 3 Cutchogue, NY 11935 w, June 29, 2009 Re: Michael Slade Property To whom it may concern: I docked my 22-foot sailboat at the Slade property from 1991 to 2007 (1991 when owned by Sy Stahl) until I sold the boat. Prior to that I docked at Cutchogue Harbor Marina and for years before that was aware of the docks at the Lister/Stahl/Slade property. My full-time residence is about two hundred feet from the boat slips. From the beginning, it was understood that it was not a marina and offered no other services other than access to water and electricity. This was clear all the years I kept my boat there. Most, if not all, of the tenants were local residents who did not need the services of a full marina, but only a place to keep their boats. There were restrictions such as required insurance, finite limits to boat dockage, no live-aboards, no sublets, responsibility for garbage removal, etc. There was no storage or repair on site other than in-water emergency repairs (major repairs or maintenance were done off-site), no restrooms, small dock lights only in use if a boater went out at night and remained off in all other times. In my 21 years living almost adjacent to the Slade slips (and 40 years of visiting on West Creek Avenue) and my 11 years in the slips, I have not noted any increase in the number of slips nor the size of the existing slips. The bulkhead was repaired several years ago, but it did not alter the size nor layout of the slips, but served to shore up the old bulkhead that has been in place since the 1950s where it is shown as existing on a blue print of a proposed "boatel" by the then owner of all the area property (Lister). A rock revetment was put in place along the creek-side to enhance the existing cement and rocks along the east side of the creek. Other than the dock lights, there is no other outside lighting, noise, parking issues, no amenities for onsite picnics, parties, barbecues, sunbathing, etc. It is/was simply a place to keep a boat and feel safe with other local boat owners. Slade To whom it may concern: About 1995 I rented one of Michael Slade's slips at the foot of West Road on Fleet's Neck. I kept my boat there for several years. During that time he had six slips south of West Road plus two or three births directly on the creek. He was careful to let me understand that he was not running a marina and there was to be no major maintenance, no overnight living aboard and no other use of his property. Finger docks and pilings were provided as was well water for flushing off salt spray. During my stay he had the, bulkhead and wood walkways repaired by a dock builder. Riprap was added to the creek bank to check erosion where there was no bulkhead west of the house. Earlier, in the seventies,I kept a boat further up in the creek and later in Boatman's Harbor Marina. My recollection of the layout of the 110-7-26 property at that time is less ' definitive than my recollection of the nineties, but I recall boats being kept there. I may have assumed then that it was part of the marina. My earliest recollection of the area dates from about 1950.As a frequent guest of the VanderbeckBarning family who had a house on West Creek Avenue, I remember the area as a base for marine recreation. I do recall construction at the marina,the marina's gasoline sign and the house where we ,Jnuld buy bait. All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads or other approved shoreline stabilization structures shall be completed prior to placement of any fill material behind such structures. 7. The new bulkhead shall be constructed landward of the existing structure. The existing sheathing shall not be removed until the landward sheathing is securely in place. Once the new sheathing has been appropriately installed, the old sheathing shall be cut to grade or removed in its entirety. Old sheathing may remain in place. 8. Prior to any construction.or removal of bulkheads or other shoreline stabilization structures, all backfill must be excavated landward of the structure and retained so as not to.enter the waterway, tidal wetlands or protected buffer areas. 9.There shall be no discharge of runoff or other effluent over or through any bulkhead or shoreline stabilization structure or into tidal wetland or protected buffer area. 10. The use of wood treated with pentachlorophenol or other wood treatment not specifically approved by the Department for use in wetlands and/or marine waters, is strictly prohibited in the construction of structures that will be in contact with tidal waters. 11. No permanent structures shall be installed on docks/catwalks/floats without first obtaining written Department approval (permit, modification or amendment). 12. Dredge material approved to remain on-site and/or within the NYSDEC Tidal Wetlands jurisdiction shall be retained so as not to enter any water body,tidal wetlands,or protected buffer areas. Off-site,upland disposal of dredged material beyond NYSDEC Tidal Wetland jurisdiction requires the approval of the Division of Solid and Hazardous Materials(631) 444-0375 and is not covered by this permit. 13. During the dredge operation, the permit holder and his contractor shall prevent spillage of sediment during excavation and haulage. Dredging shall be accomplished with a clam shell or other closed bucket equipment. 14. Excavated sediment shall be placed directly into the approved disposal/dewatering site or conveyance vehicle. No.side-casting(double dipping)or temporary storage of dredged material is authorized. 15. At least 48 hours prior to commencement of the project,the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of, and understand all terms and conditions of,this permit.Within 30 days of completion of project,the bottom portion of the form must also be signed and returned, along with photographs of the completed work. If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters orflood flows or endanger the health,safety or welfare of the.people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work,obstructions,or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit,the structure,fill, excavation, or other modification of the watercourse hereby authorized shall not be completed,the owners,shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation,orfor other purposes,and no claim or right to compensation shall accrue from any such damage. 3. All necessary precautions shall be taken to preclude contamination of anywetland orwaterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 4. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 5. There shall be no unreasonable interference with navigation by the work herein authorized. 6. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require,remove all or any portion of the uncompleted structure orfill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 7. If granted under 6NYCRR Part 608,the NYS Department of Environmental Conservation hereby certifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302,303, 306 and 307 of the Clean Water Act of 1977(PL 95-217) provided that all of the conditions listed herein are met. 8. At least 48 hours prior to commencement of the project,the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. This indemnification does not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits,or actions naming the DEC and arising under article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. Item B: Permittee's Contractors to Comply with Permit The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee. Item C: Permittee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may be required to carry out the activities that are authorized by this permit. Item D: No Right to Trespass or Interfere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department)to determine whether the permittee is complying with this permit and the ECL.Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department'at all times at the project site or facility. Failure to produce a copy of the permit upon request by a' Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate written application to the Department for renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. The.permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. It was stated in the letter that Mr. Slade was unable to moor his sailboat against the bulkhead as a result of a lack of water depth. This inspection was done at low tide on July 7 at about 6:15 PM... It should be noted that full moon was on July 6 and that low tide was scheduled for about 6:30 PM. I found the vessel in question floating up against the bulkhead. I pulled on the vessel's spring lines and found.that it floated freely both forward and backward.. Slade regarding reconstruction of their functional permitted bulkhead. Lori Hulse has advised me that I may proceed with the application prepared by Costello Marine Contracting. I will work with Mr. Costello, who knows more than I do regarding the work to be performed. It is my understanding that at the public hearing the Board was prepared to grant the wetland permit application for the work described on the DEC permit dated October 9, 2008 . However, the Board raised the concern of authorizing placement of more than one float (two floats) along the bulkhead and westerly dock. One 6 ' x 20 ' float along the bulkhead had a valid permit and is shown on amended permit #4440 . The piles for the second float had been at the property since my client started renting from Mr. Stahl in the early 80 ' s and the old floats were replaced in the 1990 ' s . Nevertheless, due to the criminal complaint, he was prohibited from continuing this application unless he removed both floats immediately. He removed both floats as directed. The floats have become necessary because of the accumulation of runoff of sand and fill from the Town Road(West Road) through a storm drain installed by the Town, at the end of West Road, which drains directly adjacent to the boat slips . The road' s runoff has caused the boat slip on the seaward side of the bulkhead to fill in. Dr. Slade did not become aware of the severe silt and sand accumulation under the float and adjacent to the bulkhead until the Board required him to remove the existing float. The float enables C��q the owner to continue to use the slip by the bulkhead. While the Town needs to correct this condition, the practical solution to the property owner who is being damaged by the Towns actions, or Town' s failure to act, is to provide a float. The two floats (5 ' x 241 = 120 sq. ft . ) also permit the sail boats to maneuver more easily to the dock. The floats are positioned and tied up to the pre-existing piles . My clients dredged this area in 1996' and the County dredged in 1997 with maintenance dredging thereafter. The owner has maintained their sailboat at this location for years however, without a float, the sail boat can not be positioned parallel to the bulkhead. (See photo) As you see in the photograph the sail boat remains at an angle due to the sand accretion. At low tide the sail boat is more than 4 feet from the bulkhead. A float enables the owner to continue the use of his property despite the damage caused by the Town' s storm drain. The one float has a permit, the proposed second float which Dr. Slade has known to be at this location since the 80 ' s remains inland of the pier line formed by New Suffolk Shipyard' s floats and boats which are parallel to Wickham Creek (see Google map) . With regard to the permit application, I noticed that all the proposed actions described in the Costello application merely require administrative permits . 275-5 (j ) The construction of a permitted functional bulkhead (k) Minor alterations to .existing permitted shoreline structures including stairs, bulkhead and docks (adding one float to existing bulkhead) (p) Dredging work necessitated by the accumulation of silt from runoff or other circumstances not the result of activity by or on behalf of the owner of the property. They paid for and had a public hearing for a full permit and should receive credit for the overpayment . Please return this application to the calender. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s)shall be determined by the Trustees or their designee.All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. §275-2. Definitions; word usage. SILT BOOM--A structure deployed within the water column that is designed to prevent passage of suspended sediments and contaminants from spreading from the immediate project area to surrounding waters.
