Town Board was held on Tuesday, January, 20, 1976 at the Town Board meeting room, 16 South Street, Greenport, New York. Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman James Homan Justice Martin Suter Justice Louis M. Demarest Town Attorney Robe _t W. Tasker High Superintendent Raymond C. Dean Town Clerk Judith T. Boken Absent: Justice Francais T. Doyen On motion of Justice Suter, seconded ,by Councilman Homan, it was RESOLVED that the Southold Town Board minutes of January 2, 1976 and January 6, 1976 be and hereby are approved. Vote of the Town Board.: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the next regular meeting of the Southold Town Board will be ehdl at 3:00 P.M. , Tuesday, February 10, 1976 at the Town Board meeting room, 16 South Street, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest This resolution was declared duly adopted. Supervisor Martocchia reported: 1 . Receipt of a letter from Roy M. Latham, Orient, relative to chickens running loose in Orient. 2. Letter relative to flooding off of Cox Neck Lane, north of Route 27A. Highway Superintendent Dean Will study the problem. On motion of Supervisor Martocchia, seconded by Justice Suter, it was RESOLVED that a public hearing will be held by the Southold ToUm Board on the 10th day of February, 1976, at 8:00 o' clock P.M. at the Supervisor' s Office, 16 South Street, Greenport, New York, on the application of Long Island Cablevision Corporation for an amendment to the cable television franchise granted to it by the Town of Southold to increase the monthly residential subscriber' s rate from $7.00 to $7.25 and the monthly motel subscriber' s rate from $2.00 to $3.00. A representative of Long Island Cablevision Corporation will be present at such hearing and all interested persons will be given an opportunity to participate in said hearing and to ask questions of the respresentative of Long Island Cablevision Corp. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. . Supervisor Martocchia reported: 3. Letter from the New York Telephone Company containing agreement for pole rental. 4. Letter from the Corps of Army Engineers stating application has been made to them by Paul Grobin of Cutchogue for permission to construct a dock, ramp and float at Richmond Creek. On motion of Justice Demarest, seconded by Justice Suter, it was RESOLVED that the Southold Senior Citizens be granted permission to rent a, bus to take them to the Flower Show at the Nassau Coliseum on March 11 , 1976. Moved by Justice Demarest, seconded by Councilman Rich, WHEREAS Gus X. Hartofelis and John Giannaris have applied to the Southold Town Board for a permit to operate a tourist camp on the north side of Main Road, East Marion,- and WHEREAS a public hearing was held on said application on the 9th day of December 1975, at which time all interested persons were given an opportunity to be heard, now, therefore, be it RESOLVED that Gus X. Hartofelis and John Giannaris be granted permission to operate a tourist camp on the north side of Main Road, East Marion, New York, property bounded north by land of Island' s End Golf and Country Club, Inc. , east .by .land of Village", of Greenport, south by Main (State) Road, and west by land of Floyd F. King, Jr. , SUBJECT TO THE FOLLOWING CONDITIONS: 1 . The number of persons occupying the facilities within the . trailer and/or tourist camp shall not exceed the number hereinbefore occupying the facilities. " 2. Within 20 days of this date hereof the applicant shall submit to the Town Clerk a list showing each cabin or cottage and the number of persons occupying each such cabin or cottage in the past. Vote of the Town Board: Ayes: Supervisor .Marto.cchia, Councilman Rich, Councilman Homan, Justice Suter, Justice -Demarest. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Homan, it was RESOLVED that Bond No. 73 S-12500 BCA issued by the .Aetna Casualty and Surety Com1,any in the name of Arthur J. Walsh, Commissioner- Treasurer, Fishers Island Garbage. and Refuse District, in the amount of $20,000.00 be and the same is hereby approved as "to its form, manner of execution, and sufficiency of sureties therein. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman - Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that Bond No. 73 S-7377 BCA issued by the Aetna Casualty and Surety Company' in the name of W. Gordon Ahman, Commissioner- Secretary of the Fishers Island Garbage and Refuse .District, in the amount of $1 ,000.00 be and the same is hereby approved as to its form, manner of execution, and sufficiency of sureties therein. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justcie Demarest. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Justice Demarest, WHEREAS Sophie T. Saunders has applied to this Town Board for a single trailer renewsl permit dated January 13, 1976, now, therefore, be it. RESOLVED that the applicationof Sophie T. Saunders to locate a single trailer on her property on the north side of Main Road, Laurel, New York, be renewed for a period of six (6) months. ,Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Moved by Justice Suter, seconded by Councilman Homan, .WHEREAS Carl Frelix, Jr. applied to the Town Board for a single trailer renewal permit dated December 26, 1975, now, therefore, be it RESOLVED that the application of Carl Frelix, Jr. to locate a single trailer on the property of Herman Hubbard, private road off north side of Main Road, Mattituck, New York be and hereby is granted for a period of six (6) months. Vote of the Town Board:. Ayes:. Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Rich, seconded by Justice Suter, 396 JAN- 2 01975 WHEREAS the Burton Potter Post # 185, American Legion, Greenport, New York has applied to the Town Clerk for an Amended Bingo License, and WHEREAS the Town Board has examined the application, and after investigation, duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and-he hereby is authorized and directed to execute on behalf of the Town Board the findings and determinations as required by law, and it is further RESOLVED that the Town Clerk be and she hereby is directed to issue an Amended Bingo License to the Burton Potter Post # 185, American Legion, Greenport, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared' duly adopted. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to advertise for bids and to purchase from the lowest responsible bidder, 500,000 gallons of asphalt road.materials, more or less as may be needed, for the repairs of town highways. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich,, Councilman Homan, Justice Suter,Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Superintendent ' of' Highways- of the Town .of Southold be authorized to advertise for bids and to purchase from the lowest responsible bidder, 10,000 gallons, more or less .as may be needed, for the highway department and disposal area, of diesel fuel. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that Frank Lekich be and he hereby is appointed to the Board of Housing Appeals for a period;. of. three years, effective January 9, 1976, term ending January 9, 1979. ' Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Supervisor Martocchia asked if anyone in the audience would like to address the Board. :1 �y ,1AN 3g 2 01976 Mr. Thomas Jurzenia spoke of his, concern about the lack of identification for the north shore on the. Long Island Expressway, asked to the Board to appeal to the traffic commission for the clearer .signs. Mr. Jurzenia presented polaroid photographs of the existing._signs. Mrs. Gladys Csajko asked if the cages for the dog pound had arrived yet? Supervisor Martocchia stated they .are there now. Mrs. Sherley Katz asked if the Board has any further information on the plans for the town Hall?-- Supervisor Martocchia stated the contract has been signed retaining Weidersum architects. They are now moving to working drawings. Mr. David Driscoll asked vvhy pamphlets are being sent out by K.O.A, P.O. Box 89 in Greenport--of a "plan. " (Mr. Driscoll presented one of the pamphlets, which the Board interpreted as' a K.O.A. directory. ) He read from the pamphlet describing tourist attractions in Southold Town for a K.O.A. site. Mr. Driscoll asked why a discussion of K.O.A. is not permitted here since the public hearing, yet such directories are being put in the mail? Does the Board speak under oath?--They are under oath, stated Supervisor Martocchia. He further stated that they cannot allow the public to continue to rehash a subject after the public hearing has been held and before a decision is made. --Mr. Driscoll continued to pursue this subject. Mrs. Csajko asked if there is a time limit when a decision must be made?-- Supervisor Martocchia stated there is no time limit on change of zone applications; but there is a 20 day time limit on wetlands decisions. Mr. Thomas Jurzenia discussed advertising along the road side. Mr. Henry Lytle of the Southold-Peconic Civic Association stated a letter had been received by the. association written by Mr. Frank Hundley to Assemblyman Perry Duryea about a proposed hunting law' that might affect Southold Town. Supervisor Martocchia stated Assemblyman Dij.ryea is working on a proposed law and the town- has- asked Mr. Duryea to include 'Southold. Supervisor Martocchia stated there will be a hearing at 8:00 P.M. at the Greenport School on the proposed Local Law No. 5 - 1975 entitled "A Local Law regulating the running at large of dogs. " On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that a recess be called at 3:45 P.M. for one half hour. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. Meeting reconvened at 4: 15 P.M. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the Southold Town Board accepts the resignation of Adam Johnson, Dog Warden, as presented to the Town ` l erk on January 20, 1976, to be effective January 31 , 1976. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is ' authorized to sign a street lighting leasing agreement and pole rental and attachment agreement with the Long Island Lighting Company. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. This resolution was declared duly adopted. On motion of Councilman Homan,, seconded by Councilman Rich, it was RESOLVED that Supervisor Martocchia be and he hereby is authorized to sign a standard pole rental agreement with New York Telephone. Vote. of the Town Board: Ayes: SuperviBor, Martoc'chia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. . This resolution was declared duly adopted.. , On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that Supervisor Albert M. Martocch�a be and he hereby is authorized to advertise for bids on a 'street lighting line trucks including hydraulic lift and all necessary equipment; said bid to be in alternates. Vote of the Town Board: Ayes: Supervisor Martocchia-, 'Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Suter, . s.econded by Councilman Rich, it was RESOLVED that .Supervisor Albert M. Martocchia be and he hereby is authorized to engage Pierre Lundberg, Esq. to - represent 'the Town of Southold in the Norris case appeal to the Appellate Division. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest. ' This resolution was declared duly adopted. On motion of Justice Demareest, seconded by Councilman Rich; it was RESOLVED that there being no further business to come before this Town Board meeting adjournment be called at 5:45 P.M.
