This notice is issued pursuant to 6 NYCRR Part 617, and local law# Chapter 44, of
the implementing regulations pertaining to Article 8 (State Environmental Quality Review)
of the Environmental Conservation Law.
The lead agency has determined that the proposed action described below will not
have a significant effect on the environment.

Location: Located on the north side of North Road (C.R. 48),
Southold, New York
Project Description: The project involves a requested change of zone from
"A-C"District to 'B" General Business on a 0.69
acre parcel in Southold. The change of zone
will facilitate the continued operation as well as
the improvement of an existing propane storage
facility operated on the site by the applicant for
over 20 years.

Negative Declaration
Reasons Supporting This Determination:
This determination is issued in full consideration of the criteria for determination of
significance contained in 6 NYCRR Part 617.11. In addition, a Long Environmental
Assessment Form Parts I, II and III, has been prepared by the Town, and has been fully
considered by the Town Board in the preparation of this determination. This Negative
Declaration is issued in compliance with Part 617.8(e)(1)(ii), and in full consideration of the
documentation and other relevant information provided. The following specific reasons are
offered in support of this determination:
1) The change of zoning will allow for the continuation and improvement of an existing
propane storage facility which has been located on the site for over 20 years.
Improvement of the facility may reduce potential impact on public safety. Potential
for impact is considered low due to operation of the facility in accordance with
municipal, state and industry standards. The site is periodically inspected by the
Town Fire Marshall and has been found to be in compliance with standards.
2) The change of zone will not cause a significant intrusion into a residential
neighborhood. Buffering and setbacks can be provided and should be considered by
the Planning Board in conjunction with future land use on this parcel.
3) The precedent setting nature of this action has been considered in the Long EAF Part
III and is not considered to be significant due to the uniqueness of this application,
and the surrounding zoning, land ownership patterns and uses.
4) Thetential impact of the project upon groundwater resources has been considered,
and foupond not to be significant due to the nature of the material stored.
