A. For new building or new use:
1. Final survey of property with accurate location of all buildings,property lines, streets, and unusual natural or

2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building,multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing"land uses:
1. Accurate survey of property showing all property lines, streets,building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is

f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property
under consideration in this application and determines that. this review falls
under the Type II category of the State's List of Actions, without further steps
under SEQRA`.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as
required under ;the Suffolk County Administrative Code Sections A 14-14 to 23;
and the Suffolk County Department of Planning issued its reply dated January 2;
21009 stating-that this application is considered a matter for local determination
as there appears to be no significant county-wide or inter-community impact.
BASIS OF APPLICATION: Request for Variances under Section 280-15, based.on
the Building Inspector's November 12, 2008 Notice of Disapproval for,a proposed
accessory swimming pool in a front yard instead of the code-required rear yard,
and for a fence at a height which will exceed the code limitation of four (T) feet
in a front yard location adjacent to C.R. 48 (a/k/a North Road).
AREA VARIANCE RELIEF REQUESTED: The applicant proposes an in-ground
swimming.pool in a front yard, instead of the code-required rear yard. The
property contains two street frontages, resulting in two front yards. Also, the
fence is.proposed to exceed code limitation of four feet in height for a fence in a
front yard, located at south side and part of west side of this parcel as shown on
the site survey prepared by Wallace T. Bryari,L.S.
FINDINGS OF FACT
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
I
submitted acid personal inspections, the Board makes the following findings:
1. Towri Law Section 267-b(3)(b)(1) Grant of the variance" will not produce an
undesirable change in the character of the neighborhood or a detriment to
nearby properties. The 6' fence is used as a privacy barrier between the proposed,

18' by .36' swimming pool and CR48,. and the pool. will be at least.65 feet from
southerly front lot. line, at-least 20,feet from the westerly side lot line 'which is
also screened; and greater than 25 feet from the easterly side lot line. The Board
feels that the granting� of this application will not cause a detriment to the
immediate.neighborhood,"because several lots in the.immediate area were found
to share the same unique situation, in that they.all front on two public streets:
2. Town Law Section 267-b(3)(b)(2). The .benefit sought'by the applicant cannot
be achieved by some other method for the applicant to pursue; because there is
no other place on the applicants' :property to build an accessory structure
without a variance. .
3: Town Law Section 267=b(3).(b)(3). The amount of-relief is not substantial based
upon the unique nature of-two front yards that are back to back on this property. .
4: 'Town Law Section,267-b_(3)(b)(5). No evidence was present-d.to indicate that
the granting of variances would create a hazard 'on this property,.or surrounding
properties.
5. Town Law Section 267=b(3)(b)(4): Based. upon the immediate area of
... .residential homes with two front yards, the variances requested will not impact
either the physical or.environmental characteristics of the immediate district:

necessary and...adequate to enable Ahe applicant to enjoy ,the benefit of adding a
swimming pool, .while, preserving and -protecting .the neighborhood and the
health, safety and welfare of the community.
