E TERMS AND CONDITIONS The Permittee,Mark Baxter,residing at 5805 Main Bayview Rd Southold,NY, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages;or claims for damages,of suits arising directly or indirectly as a result of any operation performed pursuant to this permit,and the said Permittee will;at'his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect.thereto,to the complete exclusion of the Board,of. Main Rd. &Youngs Ave.) JOSEPH L.TOWNSEND COU Southold, NY Telephone: 631765-1938 Fax: 631 765-3136 PLANNING BOARD OFFICE TOWN OF SOUTHOLD October 17, 2006 Mr. Mark Baxter 5805 Main Bayview Road Southold, NY 11971 APR 2 2 2009 Re: Proposed Standard Subdivision of Mark Baxter Located n/o Main Bayview Road, 325' e/o Smith Drive-SoLith,'J6.8 6'u'thold,_­__..___� SCTM#1000-78-7-5.3 and 5.4 Zoning District: R-40 Dear Mr. Baxter: The Southold Town Planning Board, at a meeting held on Monday, October 16, 2006, adopted the following resolutions: WHEREAS, this standard subdivision proposes to subdivide a 6.78-acre parcel into 2 lots where Lot I equals 4.4417 acres and Lot 2 equals 2.3841 acres, inclusive of the wetlands; and WHEREAS, an application for sketch approval was submitted on September 10, 2004; and WHEREAS, during the initial review of the application, the wetlands boundary was re- flagged by the Town Trustees and a 50'-wide non-disturbance buffer was delineated on the subdivision map; and WHEREAS, on May 6, 2005, the Southold Town Planning Board received a memorandum from the Town Trustees dated May 4, 2005 indicating that the subdivision map was satisfactorily revised to show the amended wetlands line and a 50'-wide non- disturbance buffer with the proposed structure to be outside of the Trustee's jurisdiction; and WHEREAS, on June 13, 2005, the Southold Town Planning Board granted conditional sketch approval upon the map prepared by Howard Young, L.S. dated December 15, 2005 and last revised on December 22, 2005; and WHEREAS, on June 13, 2005, the Southold Town Planning Board granted a Negative Declaration for the project pursuant to SEQRA; and WHEREAS, on August 1, 2005, the Southold Town Planning Board received comments from the LWRP Coordinator; and Y Baxter Subdivision Page Two October 17, 2006 WHEREAS, on November 7, 2005, the Southold Town Planning Board granted conditional preliminary plat approval upon the map prepared Howard Young, L.S. dated September 23, 2005; and WHEREAS, on November 15, 2005, the applicant submitted eight (8) paper prints and five (5) mylars of the final plat, prepared by Howard W. Young, L.S. dated June 10, 2002 and last revised on November 14, 2005, each containing the Health Department stamp of approval; and WHEREAS, on January 26, 2006, the applicant submitted the application and fee for final plat approval; and WHEREAS, on January 30, 2006, the applicant submitted one (1) copy of recorded Declaration of Covenants and Restrictions as filed in the Office of the County Clerk; and WHEREAS, the final public hearing was held for this application on February 13, 2006 where a number of neighborhood residents objected to the proposal due to severe flooding problems on the subject property and their concerns that the wetlands line was inaccurately delineated; and WHEREAS, the opposition submitted photographs and written statements pertaining to their concerns about the potential for increased flooding problems by the creation of another building lot in a flood-prone area; and WHEREAS, due to the considerable amount of evidence submitted to Planning Board, the hearing remained open until July 10, 2006 in order to give the Board time to re-evaluate the site conditions and ask the New York State Department of Environmental Conservation, the Suffolk County Department of Health Services and the Southold Town Trustees to also re-evaluate the site conditions and the permits/approvals they issued for the project; and WHEREAS, on March 6, 2006, the applicant submitted the park and playground fee in the amount of$7000; and WHEREAS, April 24, 2006, the Southold Town Planning Board received a memorandum from the Town Trustees indicating that the parcel was re-inspected and that the wetlands line as shown on the final map is correct; and WHEREAS, in the Spring of 2006, representatives from the New York State Department of Environmental Conservation re-inspected the subject property and surrounding area,found no changes to the wetlands boundary and therefore validated the permit issued by the agency on March 26, 2003 (permit#1-4738-03072100001); and WHEREAS, on July 17, 2006, the Suffolk County Department of Health Services submitted a letter dated July 11, 2006 indicating that their approval for this project is valid based on the Town's SEQRA Determination, the issuance of a NYSDEC wetlands permit and the filing of a covenant to raise the grade of the site to accommodate the sanitary system; and r Baxter Subdivision Page Three October 17, 2006 WHEREAS, in a letter dated July 11, 2006, the Suffolk County Department of Health Services indicated that the project, as proposed, complies with the requirements of the County's Sanitary Code; and WHEREAS, on September 12, 2006, the Engineer for the project submitted a letter dated September 11, 2006, indicating that the construction of a single-family residence would not exacerbate the flooding problem and therefore would not have any deleterious effects on the adjacent properties; and WHEREAS, the Southold Town Planning Board has considered the comments and evidence submitted by the neighboring property owners; and WHEREAS, the applicant has complied with Chapter 240, Subdivision of Land, of the Southold Town Code; be it therefore RESOLVED, that the Southold Town Planning Board hereby grant Conditional Final Plat Approval upon the map prepared by Howard W. Young, L.S. dated June 10, 2002 and last revised on November 14, 2005, subject to the following conditions as per the LWRP Coastal Consistency Review: a. Submission an Affidavit which states that the applicant is fully aware that the parcel is located within the coastal barrier flood zone and that the Planning Board has advised the applicant of the risks associated with this designation and is requiring that the proposed structure constructed within this area be designed to withstand and avoid expected flooding to the greatest extent possible. b. Submission of additional Covenants and Restrictions which limits clearing on Lot 2 to 25,572 square feet and requires that the driveway be constructed of pervious materials. During construction, concrete or leachate shall not escape or be discharged,nor shall washings from transit mix trucks, mixers, or other devices enter tidal wetlands and/or protected buffer areas. 2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands or protected buffer areas. 3. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 4. All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation (grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to the season,then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. 5. The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary. 6. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt curtains(or other NYSDEC approved devices)placed on the seaward side between the fill and the wetland or protected buffer area. Tarps are authorized to supplement these approved methods. 7. Cover material used for the footpath is limited to natural wood/bark chips, stone, gravel or sand. 8. The use of wood treated with pentachlorophenol or other wood treatment not specifically approved by the Department for use in wetlands and/or marine waters,is strictly prohibited in the construction of structures that will be in contact with tidal waters. 9. This permit does not authorize the installation of floats. 10. The authorized structure is provided for access to the waterway and is not intended for the mooring or launching of vessels. Prop dredging, resulting from motorized vessels intentionally powering in shallow waters, is a regulated activity and is not authorized by this permit. 11. To protect the values of the tidal wetlands,a permanent vegetated buffer zone shall be established.There shall be no disturbance to the natural vegetation or topography within an area extending 50 linear feet landward of the tidal wetland boundary. 12. A row of staked haybales or other approved erosion control devices shall be placed as per the NYSDEC approved plan, prior to commencement of any regulated activities and remain in place and in good,functional condition until the project is completed and all disturbed areas are stabilized with vegetation. 13. Roof runoff shall be directed into dry wells a minimum of 75 linear feet landward of the tidal wetland boundaryfor immediate on-site recharge. 14. Dry wells for pool filter backwash shall be located a minimum of 75 linear feet landward of the tidal wetland boundary. 15. There shall be no draining of swimming pool water directly or indirectly in tidal wetlands or protected buffer areas. 16. Driveways and parking areas shall be constructed of NYSDEC approved pervious materials. 17. Roads, driveways and parking areas shall be graded to direct runoff away from tidal wetlands and protected buffer areas. 18. Sanitary systems (bottom of the tank and leaching pools) shall be located a minimum of 2' above seasonal high groundwater. 1.9. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of, and understand all terms and conditions of,this permit. Within 30 days of completion'of project,the bottom portion of the form must also be signed and returned, along with photographs of the completed work. If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters orflood flows or endanger the health,safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work,obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit,the structure,fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation,or for other purposes,and no claim or right to compensation shall accrue from any such damage. 3. All necessary precautions shall be taken to preclude contam ination of anywetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 4. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles,ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 5. There shall be no unreasonable interference with navigation by the work herein authorized. 6. If upon-the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require,remove all or any portion of the uncompleted structure orfill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 7. If granted under 6NYCRR.Part 608,the NYS Department of Environmental Conservation hereby certifies that the subject projectwill not contravene effluent limitations or other limitations or standards under Sections 301,302,303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met. 8. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work and, if required, a survey. 9. Permittee Accepts Legal Responsibility and Agrees to Indemnification 'The permittee, excepting state orfederal-agencies, expressly agrees to indemnify and hold harmless the Department of Environmental Conservation of the State of New York, its representatives,employees,and agents("DEC")for all claims, suits,actions,and damages,to the extent attributable to the permittee's acts or omissions in connection with the permittee's undertaking of activities in connection with,or operation and maintenance of,the facility or facilities authorized bythe permit whether in compliance or not in compliance with the terms and conditions of the permit. This indemnification does not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. Item B: Permittee's Contractors to Comply with Permit The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee. Item C: Permittee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may be required to carry out the activities that are authorized by this permit. Item D: No Right to Trespass or Interfere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department)to determine whether the permittee is complying with this permit and the ECL.Such representative may order the work suspended pursuant to.ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate written application.to the Department for renewal, modification or transfer of this permit. The owners name is Mark Baxter, SCTM 1000-78-7-5.6. We are deeply concerned about the increased flood risk and the resultant devaluation this will have on our property. The property identified as"Lot 2 Mark Baxter" in the Board of Trustees letter is susceptible to severe flooding in a storm event. This fact was well documented by photos and testimony provided by adjoining neighbors during a Southold public hearing held in the spring of 2006. This documentation can be provided at your request. According to the proposed site development plan, prepared by Young &Young Surveyors, the proposed high water wall Mr. Baxter plans to build for his septic system and the elevated access driveway will create a pooling affect on my property during a storm event and prevent the natural seaward drainage that currently exists. This inevitable flooding will cause damage to my property and create an undue financial burden to me. In addition, Mr. Baxter's proposed 5 bedroom house will obscure my view-shed of Goose Creek that my family has enjoyed for over 60 years. When my family purchased the property at 5485 Main Bayview Rd the property behind us was by all accounts a wetland based on habitat and vegetation. Characterized as a wetland, the land could not be developed. This unrestricted view of the water provided a greater valuation of my property. Development of the subject property will obscure the waterfront view from my property and decrease its value. I would also like to call to your attention that the site plan we were provided does not indicate that "Lot 2 Mark Baxter"is waterfront property. To my knowledge Lot 2 does have clear access to Goose Creek, and should be considered waterfront property. Therefore, any development of the property requires review and approval by the Department of Environmental Conservation. Lastly, given the damaging effects that this proposed land development will have on our property we are compelled to notify you that if my property is damaged by flood waters,to a degree that the property would not have of otherwise experienced,we will hold the Town and the property owner of"Lot 2 Mark Baxter"legally responsible. However, even with this information Mr. Ghosio, (Mr Bergen agrees)feels that the board must issue a permit because Mr. Baxter has three letters from the previous Board of Trustees approving his sub-division and has been working on this project for seven years. Mr. Ghosio was asked by board.member Peggy Dickerson, if he could live with,his decision even though L%W has presented new information indicating a permit should not be given. His response was yes., What is this saying to the people in the Town of Southold. Keep trying eventually someone will make a mistake.and you'll get what you want whether it is right or wrong. There is a reason why it has taken Mr. Baxter seven year to get where he is today.And it's not because this project will have no effect on the wetlands and surrounding property as Mr. Baxter states. The sanitary system.as proposed will involve grade changes�Othe subiect parcel and construction of a permanent concrete water wall which may alter the existing storm water drainage patterns therefore redirecting storm water flow to the neighboring properties to the South,South East and West. Policy 5 Protect and improve water quality and supply in the Town of Southold. 5.2 Minimize non-point pollution of coastal waters and manage activities causing nonpoint pollution. A. Minimize non point pollution of coastal waters using the following approaches,- which are presented in order of priortty. 1. Avoid non-point pollution by limiting non-point sources. b. Avoid activities which would increase off-site stormwater runoff and transport of pollutants. c. Control and manage stormwater runoff to: • achieve no net increase of runoff where unimpaired stormwater runoff conditions exist e.Preserve natural hydrologic conditions. Pursuant to 4 275-11 the applicant may be required to submit a drainage plan for the entire site detailing how all surface waters generated from impervious surfaces shall be kept onsite through infiltration or retention pursuant to 4 275-11 as referenced below. §275-11 Construction and og�~-tion standards. A. General.The following standards are required for all operations within the jurisdiction of the Trustees: (1) Drainage upgrade. Applicants for a permit for any form of construction may be required to upgrade the site's drainage system such that all surface water generated from.impervious surfaces shall be kept onsite through infiltration,or retention. This plan must indicate how all existing and proposed on-site drainage from a two-inch rainfall is retained within the subject parcel-landward of the wetland boundary. Retention can include but is-not limited to infiltration or impoundment. All drainage plans shall show the calculations used to develop the plan. At the discretion of the Board said plans may require certification from a licensed engineer. If the A2ency, (Board of Trustees) makes a contrary determination of consistency, the Agency shall elaborate in writing the basis for its disagreement with their recommendations Pursuant to Chapter 268 Waterfront Consistency Review. §268-5. Review of actions. H. CRITICAL ENVIRONMENTAL AREAS --All sites previously nominated by the Town of Southold and designated by the New. York Sate Department of state as Critical Environmental Areas worthy of protection including: Cutchogue Harbor Wetlands, Hallock's Bay, Dam Pond, Downs Creek, Orient Creek, West Creek, Richmond Creek and Beach, Brush's Creek, Cedar Beach Creek, Corey Creek, Deep Dole Creek, Goldsmiths Inlet, Halls Creek, Goose Creek, Little Creek, Mill Creek and Pipes Cove Creek. §275-11 Construction,and operation standards. (7) Critical environmental areas. At the discretion of the Board of Trustees, any operations proposed in critical 'environmental areas (§275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations,. shortening.,or reducing the size of structures, and increasing the width.of nondisturbance buffers. The applicant must demonstrate that the following dock standards pursuant to 4 275-11 Construction and operation standards have been met. §275-11 (2) Docks. (d) Review and,approval of dock applications. Before.issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [IJ Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfrshing, waterskiing and other water-dependant activities; [31 Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; [41 Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock; [51 Whether the dock will cause degradation of surface water quality and natural resources; [61 Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats, The proposed docking facility if approved will result in habitat fragmentation and impairment with the physical loss of fish and wildlife habitat within a Critical Environmental Area. If the dock is constructed the loss of high and low intertidal marsh habitats will occur. The proposed action and associated impacts could be mitigated by seasonally mooring a vessel in public waters. This alternative would lessen the potential impacts to the habitat within Goose Creek a Critical Environmental Area. [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass(Ruppia maritima) or shellfish; [8] Whether the dock will unduly restrict tidal flow or water circulation; [9] Whether the dock will be safe when constructed; [l0] Whether the dock will adversely affect views, viewsheds and vistas important to the community; [11] Whether .the cumulati., ;mpacts of a residential,and commerc.-' -lock will change the waterway or the environment and whei alternate design, construction, and loc 'a of the dock will minimize cumulative impacts; and [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.1 Protect and restore ecological quality throughout the Town of Southold... R Protect and restore ecological quality by adhering to the following measures. 3.Avoid fragmentation of ecological communities and maintain corridors to facilitate the free exchange of biological resources within and among communities. a. Each individual resource area should be maintained as complete contiguous areas to protect the area's natural resource values. Specifically, actions that would fragment the ecological community into separate ecological islands should be avoided. A Where fragmentation of ecological communities has already occurred, the adverse effects of fragmentation can be mitigated by maintaining or providing connecting corridors to allow exchange of biological resources. Habitat fragmentation can be avoided through other public.land access alternatives such as vessel moorings. The action,as proposed,will result in the continued fragmentation of a Critical Environmental Area. If approved,the. proposed action will result in the physical loss of habitat within Goose Creek an ecological sensitive area. Policy 9 Provide for public access to, and recreational use of,coastal waters, public lands, and public resources of the Town of Southold. The proposed action is private; noncommercial and will not support a pattern of development that.enhances community character nor preserves "Public"access or public recreational activities Policy Standard 9.4 Assure public access to public trust lands and navigable waters. A. Provide free and substantially unobstructed passage along public trust shorelands. R Provide access-to, and reasonable recreational use of, navigable waters and public trust lands under water. 3. Obstruction of navigable waters and underwater lands is limited: b. to the minimum necessary for access to navigable waters. The minimum is determined by evaluating the following factors: (ii) the range of tidal water level fluctuation, The proposed docking facility at its terminus will achieve 0.79 feet of water at MLW as depicted on the survey. Prop dredging from a vessel navigating in limited water depths, will cause the suspension of sediments and " contaminants within the surrounding water body of Goose Creek. Mooring a vessel in an area with appropriate.water depths is an alternative. (vi) whether or not alternative means-to gain access are available. The applicant currently enioys access to Goose Creek through an established walking path. The applicant also has an alternate means of access to Goose Creek via the Town's boat ramp off Gagen's Landing Rd. §275-2 Definitions;word usa ' y ACCESS PATH --An area, cleared by hand or hand--held equipment, no more than four feet wide, left in its natural state and devoid of any man-made structure, to provide a walkway to a body of water.. In the event that a docking facility is approved in this location, the following BMP's (design standards) are recommended: 1) Use grid decking having greater than 50% light penetration(irradiance)to the substrate. 2) Low profile catwalk 2 feet above MHW and grade over vegetated wetlands. 3) The dock structure at its terminus must achieve a minimum of 2.5 feet at MLW. -4) Prohibit the use of building materials containing CCA, creosote, penta or homemade wood preservative products. 5) Design standards allowing for the pass and re-pass by the.public for accessing trust lands, public waters. and the foreshore. 6) Minimize the size of the docking structure to the greatest extent practicable: a. to provide for reasonable access to the water body. b. ' to minimize the loss of navigable waters and use of underwater lands.. c. to minimize the fragmentation, impairment and physical loss of wetland habitat.
