INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale.Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises,relationship to adjoining premises or public streets or
areas, and waterways.
c.The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f.Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months.Thereafter, a new permit shall be required.

Building Zone Ordinance of the Town of Southold, Suffolk County,New York, and other applicable Laws, Ordinances or

Re: Relocation of a pool fence from around my property to around my exciting pool.

I am writing to you today for an amendment to my building dept CO permit#Z-31893. In October 20081
received a violation notice from the D.E.C. In this letter it was brought to my attention that I was in
Violation of the permit they issued to me in May 2006.
These violations were that one end of my fence which I had on my property was not in the same place
as the permit had shown also I had failed to do the planting that were required and finally that I had
failed to register the permit changes with Suffolk County clerk office. In a meeting with the D.E.0 on
February 19th 2009 it was decided that I had made all the necessary corrections therefore they reduced
the violations to a warning.
As stated above one of the areas that I was not aware of was that one end of my fence was too close to
the wetlands area and when I had the area surveyed again, it was clear they were correct. I hired
Briarcliff Sod to remove all items from within the wetland area including an area of my pool concrete
patio and as soon as the weather warms up they will return to complete the planting requirements.

My goal is to get permission to remove all the fences around this area and replace it with a round
the pool itself outside the wetlands buffer area. I have included copies all the letters from the D.E.0 and
copies of my permits&Certificates from the Southold Buildings&Trustees depts. Including Photo's of
the work that was completed and survey maps of the areas.
I have already submitted and application to the Trustees and I am waiting for their permissions.The
D.E.0 has already issued me an amendment to my permit stating that the fence can stay where it is or
move it to around the pool.

Dear Mr. Cowan:
During a compliance site inspection at your property located at 435 Mockingbird Lane it came to this
Department's attention that you are in violation of NYSDEC Permit#1-4738-03526/00001 in that you
failed to follow stamped approved plans as stated in General Conditions #9 of your permit. Also, the
plantings were not completed as required in Special Conditions#11.
At this time the Bureau of Habitat will not pursue the violations. However,the Department would like to
see the plantings required by permit to be completed by 5/15/09. Please submit photos of the work
required to the Department within ten(10)days of its completion. The fence may remain as built or be
relocated to immediately around the pool and outside the buffer.
In the future any unauthorized changes will be treated as serious violations punishable by fines and/or
removal of structures and/or restoration of the area. Regulated activities include but are not limited to:
construction of buildings, roads, driveways, parking areas and other structures; filling and excavating;
clearing of vegetation; grading or ground disturbance.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, March 18, 2009:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit#6165 to remove the fencing near the wetland area and install a new
fence around the existing swimming pool, and as depicted on the site plan prepared by
Briarcliff Landscaping last dated February 17, 2009, and received on March 6, 2009.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.
