Metzger last dated June 11, 2008 and determined the proposed alterations to the existing dwelling and proposed construction of a retaining wall off the northerly corner of the dwelling to be out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary best management practices are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. A line of staked hay bales and silt fence must be installed 100' landward from the top of the bluff, and inspected by the Board of Trustees or the Code Enforcement Officer, prior to any construction activities. 2 You are required to contact the office 72 hours prior to commencement of the work to make an appointment for a pre-construction inspection. The applicant is seeking jurisdictional determination for proposed alterations to the existing single family dwelling at the above referenced location. The house will be raised approximately 3', the exiting deck will be removed, drywells will be added to cure existing drainage problems and a retaining wall will be installed off the northerly corner of the house. Attached is a survey depicting the existing conditions and proposed activity. The proposed activity is approximately 200' from the high tide line, depicted on the survey as "edge of beach" and more than 100' from the "top of bank" seaward of the inground pool. It should be noted that the "bank" is not a natural geologic feature. It was created during installation of the pool when the area was regraded. Also enclosed is a copy of a 1986 survey that was submitted with the. building permit application for the pool construction. The existing natural contours are shown thereon. Further, the NYSDEC limit of jurisdiction was determined to be the 10' elevation contour. A copy of the 10/28/86 letter of non- jurisdiction is also attached. Kindly advise.
