Southold Town Planning Board, Southold Town Board of Appeals and Southold Town Board on December 5 , 1972 ; at 7 :30 p.m. , at the Supervisor' s Office, 16 South Street, Greenport, New York. There were present: Messrs. Henry Moisa, Vice Chairman; Henry Raynor; Frank Coyle - Planning Board. Messrs. Robert W. Gillespie, Jr. , Chairman; Robert Bergen; Charles Grigonis; Fred Hulse - Board of Appeals. Supervisor Albert Martocchia; Councilman James Rich; Justice Louis Demarest - Town Board. Also present: Howard Terry, Building Inspector; Robert Tasker, Esq. , Town Attorney. Southold Town Planning Board Southold Town Board of Appeals - 2 - December 4 , 1972 Southold Town Board The Planning Board, Board of Appeals and Town Board discussed the following proposed amendments to the . Zoning Ordinance; (1) Article I - Definitions - add definition of Elevation - to be established from floor level of building. (2) Article III , Section 300 B-14 - Delete Section B-14 and make new Section 300 C-7 to read as follows : "Yard sales, garage sales, attic sales, auction sales or similar sales of personal property, provided not more than one (1) such sale shall be conducted on any lot in any one (1) calendar year. Such sale shall be: (1) limited to personal property of owner or tenant; (2) limited to one specific date and/or one specified rain date; (3) applicant shall provide supervision of parking so as to not block traffic on public street or neighbors ' driveways , etc; (4) one "on premises" sign not larger than 3 ' x 4 ' may be displayed for one week prior to such sale and removed immediately thereafter; (5) a permit required from the Building Inspector for such sale, fee for same to be $15 . 00, paid in advance. (3) Article III, Section 300 C-5 - Change to read: "Horses and domestic animals other than dogs , shall not be housed within 50 feet of any lot line. Housing for flocks of more than 25 fowl shall not be constructed within 50 feet of any line. " (4) Article III , Section 303 - Change to read: "Where property in the vicinity is improved with permanent dwellings with a front yard area of less than that required by the provisions of this ordinance , the front yard setback shall be the average setback of the existing dwellings within 300 feet of the proposed dwelling, on the same side of the street, within the same block, and the same use district. " (5) Article III , Section 305 - Change (a) to read: "When located in the front yard, along front yard property line , the same shall not exceed four (4) feet in height. " Delete (d) of Section 305 Southold Town Planning Board Southold Town Board of Appeals - 3 - December 4 , 1972 Southold Town Board (6) Article VI , Section 602- 7 : change to read "Parking shall be provided in offstreet paved parking areas which shall provide for one (1) parking space, three hundred fifty (350) square feet in area, for each one hundred (100) square feet of sales floor area or office £1Qor,- area in each building. " (7) Article XI , Section 1101- 1 : change to read "Schedule of Parking Requirements: Accessory offstreet parking spaces , open or enclosed, shall be provided in all use Districts for any use specified below. Any land which is developed as a unit under single ownership and control shall be considered a single lot for the purpose of these parking regulations . Reasonable and appropriate offstreet parking requirements for structures and uses which do not fall within the categories listed below shall be determined by the Planning Board upon consideration of all factors entering into the parking needs of each use . Each parking space shall be not less than three hundred fifty (350) square feet and unless otherwise specified parking area will be subject to Planning Board on site plan approval and Board of Appeals on a use exception requirement. (a) Places of worship, libraries , and other public buildings -. at least one parking space for each 200 square feet of floor area, but not less . then one space for each five seats where provided. (b) Golf courses and other country blubs at least one parking space for each two members or accommodations (such as lockers) whichever is greater. (c) Secondary Schools - at least two spaces per classroom plus one space for each five seats in any auditorium or place of assembly. (d) Elementary Schools - at least two spaces, per classroom plus one space for each five seats in any auditorium or other place of assembly. Southold Town Planning Board Southold Town Board of Appeals - 4 - December 4 , 1972 Southold Town Board (e) Hospitals, sanitaria, nursing homes, philanthropic, or eleemosynary institutions at least one par ing space per bed. (f) Rooming houses - at- least one parking space per guest room. (g) Eating and Drinking places - at least one parking space per five seats . (h) Undertakers and Funeral Homes - at Least one parking space per emp oyee plus 25 parking spaces for each chapel . (i) Hotels and Motels - at least one parking space per guest room plus one parking space for each employee. (j ) Bowling alleys - at least one parking space for each five alleys . (k) Home occupation or accessory professional office except physicians and denti-sts - at least three spaces per each ome occupation or accessory professional office. (1) Professional offices of physicians and dentists at least five spaces per physician or en is . (m). Factories, assembly plants , etc. - parking at ratio of one square foot par 1ng for each square foot floor area. parking (n) Storage and warehouses - at least one/space for each 1 , 000 square feet floor area and increase by one space for each additional 5 , 000 square feet floor area. (o) Contractor ' s yards .- at- least one parking space for each 100 square feet office floor area and one space for each employee. (p) Public utility structures - at least one parking space for each employee plus five spaces for general use. (r) Bus Terminals - Parking as may be required by the Planning Board in site plan and Board of Appeals in special exception; in no case less than one space for each 100 square feet of office and waiting room area. (s) Ferry Terminals - Same as Bus Terminals (t) Boat building, etc. - One parking space for each employee and as floor area ratio for Factories . (u) Airports and airfields - Parking as may be required by Planning Board in site plan and Board of Appeals in special exception; in no case less than one space for each tie down or hanger space. (v) Apartments or multiple residences - atl.least one and 7-.one-half parking spaces for each dwelling unit. (w) Marinas and boat moving - at least one and one-half parking spaces. per each slip or mooring area. (x) Places of Amusement - Open air type - as , required by Planning Board in site plan approval and Board of Appeals in special exception; in no event less than five spaces . (y) Fishing Stations - at least one space for each charter boat or rental boat or mooring space and in no event less than five spaces. (8) Article XVII , Section 1702 - Add to list of subdivisions Orient-By-The-Sea, Amended Section II . (9) Bulk and Parking Schedule - Add, in regard to side yards : "All lots held in single and separate ownership prior to the adoption of this Ordinance with less than required area and less than required width, the side yards may be reduced 30% . Southold Town Planning Board Southold Town Board of Appeals - 6 - December 4 , 1972 Southold Town Board There was some discussion about eliminating the "B" category of A Resident District for lots with both public water and public sewer on tracts of 100 acres or more. These lots would have to be 40 , 000 square feet, but the houses could be clustered. The Planning Board, Board of Appeals and Town Board next discussed the proposed amendments to the Subdivision Regulations. Supervisor Martocchia read a letter from John Wickham with his suggestions on these proposed amendments . The amendments discussed were : (1) There was discussion about eliminating minor subdivisions from the regulations . A suggestion:-, was made to allow minor subdivisions only on existing streets. On minor subdivisions with lots of two acres or more the Planning Board will require the recording of restrictive covenants that the property will never be subdivided. Mr. Tasker suggested that the covenants be for a period of ten years with automatic extension for ten years unless the majority of lot owners agree to change them. He also said the property could not be divided by applying for a variance to the Board of Appeals . (2) Article III , Section 1 , A - change to read: "Applicant shall submit to the Planning Board (at least two weeks prior to the regular meeting of the Board) twelve copies of a Sketch Plan of the proposed subdivision with road profiles and topographic elevations at 5 foot contour elevation. " (3) Article III , Section 3 , D - change sixth line to read "the requirements of the Master Plan, the Official Map, and Zoning Ordinance. " (4) Article III , Section 3 , E - change second paragraph to read: "The action of the Planning Board shall be noted on three copies of the preliminary layout. One copy shall be returned to the subdivider; one copy sent to the Town Board Highway Committee, together with the resolution of the Planning Board. " Rest of paragraph same. (5) Article III , Section 4 , C - change first sentence to read: "Water and sewer facility proposals contained Southold Town Planning Board Southold Town Board of Appeals - 7 - December 4 , 1972 Southold Town Board in the Subdivision Plat shall be ,properly- approved a and endorsed by the Suffolk County Department of Health ,and the Suffolk County Department of Environmental Control ." Change line five to read: "subdivision plat shall be submitted to the County Department of Health and County Department of Environmental Control, together" . (6) Article III , .8ection 4 , F - At end of second paragraph add sentence : "Such bond must. be accepted by the Town' Board and Notice of Acceptance received by Planning Board before Subdivision Plat is signed. " (7) Article III, Section 5 , A - Add at end of paragraph; "Notice of such waiver must be sent to the Town Board Highway Committee for approval before it is finally adopted. Notice from such Committee of approval shall be part of the Subdivision file. " (8) Article 'III , Section 5 , B - Change to- read: "If at any time before or during the construction of the required improvements it is demonstrated to the satisfaction of the Town Superintendent of Highways that the unforseen conditions make it necessary or preferable to modify the location or design of such required improvements, the Superintendent may, with prior approval of .the Planning Board and' upon written request of the subdivider., authorize modifications provided these modifications are within the spirit and intent of the Planning Board' s. approval. The Superintendent in issuing an authorization- under this Section, shall ,do so in writing and shall transmit a copy of such ,authorization to the Planning Board at their next regular meeting. " (9) Article III , Section 5 , C - Change to read: "In: order to assure that all Town specifications and requirements are met during the construction of all required improve- ments, and to, assure the satisfactory completion of improvements and utilities as required by the Planning Board, a construction inspector representing the Highway Superintendent and Planning Board shall inspect the improvements during the progress of construction. It shall be the duty of the subdivider to nofity the Planning Board and Highway Superintendent two (2) days prior to date of commencement- or completion of any work Southold Town Planning Board Southold Town Board of Appeals -. 8 - December 4 , 1972 Southold Town Board on each stage or operation of the construction of improvements. Said construction inspector shall- after completion of construction, certify to the Planning Board and Highway Superintendent that all required improvements have been constructed as required by the Board. In addition, the sub- divider shall furnish a certified set of drawings showing all improvements as constructed, in the same detail as required for the approved Subdivi- sion Plat. " (10) Article III , Section 5 , D - Add at end of last sentence: "and method of installation. " (11) Article III , Section 6 - Mr. Tasker will check on adding New York State Requirements to this Section. (12) Article IV, Section 2 , B - Add at end of last sentence : "with approval of the Highway Superintendent and Town Board Highway Committee. " (13) Article IV, Section 2 , F - There was discussion on eliminating this Section on Dead End Streets . (14) Article IV, Section 2 , K - Change to read: "The street plan of a proposed subdivision shall bear a logical relationship to the topography of the property, and all streets shall be arranged sous to obtain as many of the building sites as possible at or below the grade of the streets. Grades of streets shall conform as closely as possible to the original topography. " (15) Article IV, Section 3 , B - Change line four to read: "with.-,approval of the Superintendent of Highways and Highway Committee of the Town Board waive, subject to appropriate conditions, such improvements as it con- siders may be" . Add to last sentence"and Town Board Highway Committee. " Article IV, Section 3 , D - Change last sentence to read: "Such easements shall be cleared, graded and seeded where required. " C � Southold Town Planning Board Southold Town Board of Appeals - 9 December 4 , 1972 Southold Town Board (16) Article, IV, Section 3 , F - Change to read: "Where dead end streets are designed to be so permanently, they should in general, not exceed 800 feet in length, and shall terminate in a circular turn- around having a minimum right of way radius of 50 feet and full pavement six feet from all property lines or curb to curb. At the end of temporary dead end streets a temporary turnaround with a full pavement of six feet from property lines or curb to curb. 9hall be provided, unless the Planning Board approves an alternate arrangement. " (17) Article IV, Section 3 , G - After first two para- graphs add "and Planning Board. (18) Article IV, Section 6 , B - Change last sentence to read: "The, Town., Superintendent of Highways and Planning Board shall approve the design and size of facility based on anticipated run-off from a "six inch rainfall per day" under conditions of total potential development permitted by. the Zoning Ordinance in the watershed. " (19) Article IV, Section .7 , A. - Change first sentence to read: "The subdivider shall install sanitary sewer - facilities in a manner prescribed by the Suffolk County Department of Health and the Suffolk County Department of Environmental Control. " (20) Article IV, Section 7 , C - Add to first sentence: "and Town Board Highway Committee. " (21) Article IV, Section 8 , A - Change last sentence to read: "When recreation areas are required, the Planning Board shall determine the number of acres to be reserved on , the basis of providing four (4) acres of recreation area for every one hundred (100) families or'. living units. " (22) Article IV, Section 8 , E - There was discussion about changing the amount of money in lieu of land per gross acre to $5 ,000 or 50 of the fair market value of the total acreage proposed for the subdivision. (23) Article IV, Section 8 , I - There was discussion about a list of acceptable trees for subdivisions . Southold Town Planning Board Southold Town Board of Appeals - 10 - December 4 , 1972 Southold Town Board (24) Article IV, Section 8 , J - There was discussion as to revising the depth at road ends at tidewater (25) Article V, . Section 4 - Mr.TTasker will check into adding New York State requirements . (26) Mr. Tasker said the Planning Board may require a disclosure statement of the principals of a corporation. (27) Mr . Tasker said there was a recent court decision that states a municipality cannot require a developer tto put drainage facilities in public roads .
