CORDON JAMES WALL A regular meeting of the Southold Town Planning Board was held at 7: 30 p.m. , Tuesday, March 27, 1979 at the Town Hall, Main Road,Southold, New York. Present were: Henry E. Raynor, Jr. , Vice-Chairman Frank S. Coyle, Member Frederick E. Gordon, Member James Wall, Member Douglas Love , L. I. Traveler-Watchman Sharon Romano , Suffolk Times Millicent Gossner, League of Women Voters 7:30 p.m. Public Hearing on the question of the approval of the minor subdivision -of property of Philip Ofrias , Jr. , and Sharon Ofrias. Philip Ofrias ; Jr. , Esq. appeared. Mr. Raynor read the legal notice of hearing and presented proofs of publication from the Suffolk Times and the L. I. Traveler- Watchman. Mr. Raynor: This is a minor subdivision of two lots. We have in the file check from the: applicant along with the , application for approval of plat signed and not We have copies of the map, proof of publication in the L. I. Traveler-Watchman, schedule of covenants with regard to the real property described and correspondence .,from the board to the attorney. As this is a minor subdivision of two lots and abuts an existing town road, there is no report from the Superintendent of Highways .with regard to this subdivision. As is the policy with this board, we will ask if there is anyone present this evening that would like to speak in opposition to this subdivision of property of- Philip Ofrias. Hearing none , is there anyone present that would like to speak in favor of this subdivision. Mr. Ofria,s : Our purpose is it doesn't prove to be very saleable the way it is and by separating the house on 1-1/4 acre and the other 1-1/4 acre with the barn may be more marketable. We- would rather sell it the way it is. OuVown feeling is it .would detract to divide it but it. depends on the buyer. . Planning Board -2- March 27, 1979 Mr. Raynor: The board also notes with the covenants there is a clause that the present applicant make no further application for subdivision of this property. Usually we have a standard form covenant and I think probably you may have included it all. Mr. Ofrias : I spoke with Bob Tasker before preparing it and he felt it would be appropriate. Mr. Raynor: Fine. In review of the map I see one kind of glaring feature and that is that the parcels are not numbered. Mr. Coyle : Mine has numbers. There was further discussion here- and it was determined that Mr. Van Tuyl had sent one copy of thVamended map. This map was the one Mr. Coyle had with the numbers on it. Mr. Ofrias : You wanted them numbered and a note as to no further subdivision. I have mote copies. You must have one that was done before. Mr. Gordon: The ordinance calls for a 50 foot setback and 150 feet at the building line. You would lose a little bit here. Mr. Raynor: The building lot would have to be back in here. Mr. Gordon: I should have picked that up on preliminary. In other words , the building line would be 50 feet back. Mr. Ofrias : You are right. If you go back at all it will be less than 150 feet. Mr. Raynor: The building inspector would probably insist the house be spotted in there. Mr. Gordon: He might give you a hard time. There was more discussion back and forth on this item. Mr. Raynor: The setback line is going to have to be shown. We are dealing with a two lot minor. This could be dotted in. Whatever action the board would take would be subject to the setback line being shown. We are just alerting you you might have a problem in the future as far as the building inspector is concerned. It is probably not critical. Is there any member of the board that has anything they would like to add with respect to this applicant. Mr. Coyle : It is a beautiful estate to be cut up. My map shows that there should be no further subdivision which should be.,,part of the record. Mr. Raynor: We will have to have five more copies with the numbers on them. Mr. Ofrias : Anything he does now will have the numbers. Planning Board -3- March 27, 1979 Mr. Raynor: They will have to be filed with us. Does anyone else that is present have any information that is;-,,,pertinent to the application being heard. Hearing none , I will declare the hearing closed. Michael Morris Estate. Marge Malone and Terri Elak appeared. Mrs . Malone said she had talked with the building inspector about access and he had said something about 280A of the Town Law. She has been informed that Longboat Lane will be 80% completed by the end of the year. Mr. Raynor suggested they endeavor to get use over the existing road (Longboat Lane) as the right''--of-way is extremely long and would be costly to construct and maintain. There will also have to be a right-of-way across the bottom of the lots. It will be necessary to have a written agreement with the developer of Soundview Acres at Orient. 100 foot setback from the top of the bluff will have to be shown. The right-of- way on the:,bottom of the lots must be 25 feet wide. Mr. Raynor made the following report regarding his meeting on Friday, March 16, 1979 with the Executive Committee of the Fire Chiefs Council and Fire Commissioners Council. The meeting was held at the Cutchogue Firehouse. In Article 106-33B it was suggested that the following sentence be removed "there shall be a minimum of one fire hydrant and/or fire well for each 30 dwelling lots shown on the subdivision map. " Remove the word "bronze screen" and insert "stainless steel screen" was recommended. The 350 gallon per minute pumping capacity figure should remain. It was also recommended that the 8 inch casing and 20 foot minimum length on screen be left in specs for fire well. It was requested that the Planning Board supply a map to the respective fire district commissioners and recommendations would be forth- aoming within thirty days from said fire commissioners. It was agreed that the district commissioners would be able to meet within the thirty day response period so that a recommendation could be back to the Planning Board within this time frame. Final determination of fire hydrant and/or fire wells will naturally be a Planning Board decision. The following letter was read from the Southold Town Fire District Officers Association. March 20,1979 Planning Board Town of Southold Town Hall Southold, New York Gentlemen: Planning Board -4- March 27, 1979 The Southold Town Fire District Officers Association would like to recommend the following. changes and additions to the regulations for Subdivisions pertaining to requirements for farewells for your consideration. Eliminate the number of dwellings required for each firewell. The determination as to the need for fire protection should be at the discretion of the fire district involved. Location of farewells should be determined by the Officers of the Fire District. A map of the proposed subdivision should be sent to the Commissioners of the Fire District. The Fire District will respond within 30 days as to the need of farewells. The well should be at least 8 inch minimum, 20 foot stainless steel screen minimum, mesh. to be determined as to type of strata encountered, should produce 350 GPM. Final testing and approval by the Board of Commissioners with notifications of acceptance to the Planning Board. Thank you for consideration and cooperation. /s/ Henry F. Moisa, Secretary Mr. Raynor feels that this should be taken under consideration as well as some of the ideas .that were worked on in January and sit down with the Town Attorney soon and work out what should be put in the Code. The decision of where the fire hydrants and/or farewells should be has to come from the Planning Board but the Fire Commissioners have more experience and the Board should try to utilize their suggestions and recommendations. Mr. Wall was asked how this would affect Fishers Island and he said they go overboard and had the equipment to take care of this and wouldn't be in need of fire hydrants or farewells. Charles Witherspoon minor subdivision. Stanley .Corwin, Esq. appeared. Both lots are oversized so the board would require restrictive covenants so there would be no application for resubmission. Mr. Corwin was asked if there would be any objection to a covenant that there be no further subdivision of the parcel directly to the west of number 1. Mr. Corwin said he didn't feel he could make that representation foi/bhe owner. Then he said he could give a covenant not to subdivide the adjacent piece. TheBoard will take the sketch map under consideration and give some determination with regard to it. .! Planning Board 51- March 27, 1979 HenrZ Walsh minor subdivision. Stanley Corwin, Esq. appeared. The 17 7b plan presented by Mr. Walsh is no longer valid. Mr. Corwin is willing to go along with a two lot minor and a restriction that any further subdivision would be major subdi�Tision. The lots will have to be numbered and the Board will get back to Mr. Corwin. Sebastian' s Cove , Section I. The following letter was forwarded To the Board from Mr. Stan Pauzer ofthe Soil and Water Conservation District in Riverhead. Dear Stan: We need the following information to develop specific drainage recommendations for the "Sebastian' s Cove , Section One" Subdivision: 1. an accurate topographic map with 2�-foot contours (1-foot contours would be more desirable) . 2. soil profiles of the test holes. 3. design details of the catch basins planned for Sebastian' s Cove Road. 4. plans for development and stabilization of the playground area. Unless we can obtain this information, only general comments can be developed. /s/ Marc Usher District Conservationist A letter is to be written to Mr. Toumanoff enclosing these recommendations telling him that the Soil and Water Conservation District wants more information and nothing can be done until such information is forthcoming. The Planning Board will forward information to the District upon receipt of same. The Board will also not process this application any further until such time as Mr. Toumanoff lets the Board know what his plans are for Sections II and III. .Long Pond Estates , Section One. The Board has received a letter from the Dept.of Environmental Conservation as to designation of lead agency in this matter. On motion made by Mr. Coyle , seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board inform the New York State Department of Environmental Conservation that it does not wish lead agency status forthe subdivision known as "Long Pond Estates , Section One" . ThePlanning Board has already had final hearings with regard to this application and the process Planning Board -6- March 27, 1979 involved with the town is in its final steps. Therefore , it would be inconsistent for the Planning Board to desire lead agency status. Vote of the Board: Ayes : Raynor, Coyle, Gordon, Wall Fontana - George Friedman appeared. . Mr. Friedman was advised that Mr. Fontana should come in for a four lot minor subdivision with a 25 foot right-of-way. There should also be access to Mattituck Creek for the lot owners on the road. Mr. Friedman will return. Mr. Coyle made a motion, seconded by Mr. Gordon and-.,carried that the request of Peter Kreh to have the right-of-way to his property named .Kreh Road be granted. On motion. made by Mr. Gordon, seconded by Mr. Coyle , it was RESOLVED to over-ride the condition of/the Suffolk County Planning Commission as regards the subdivision of Peter Sledjeski in that a 50 foot right-of-way be provided for the following reason. The Stillo minor subdivision is an approved pre-existing minor subdivision in the Town of Southold with a 30 foot right- of-way and�i t would make no sense toL-Irun a 50 foot right-of-way into a 30 foot right-of-way. Vote of the Board:. Ayes : Raynor, Coyle, Gordon, Wall On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to grant approval to the sketch map of the minor subdivision of Peter Sledjeski subject to a 15 foot right-of-way being shown on the westerly side of the property for Rose and securing of a curb cut from the -State of New York. Vote of the Board: Ayes : Raynor, Coyle , Gordon, Wall On motion made by Mr. Wall, seconded by Mr. Gordon, it was RESOLVED to set 7: 30, Monday, April 16, 1979 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of property of Thomas and Jean Jones. Vote of the Board: Ayes : Raynor, Coyle , Gordon, Wall Planning Board -7 - March 27, 1979 Mr. Raynor announced the the Natural Resource Class from Mattituck Cutchogue High School will be at the town hall on Thursday to find out something about subdivisions. Any board members that can be at the TownHall are welcome. Mr. Raynor announced a meeting at the Supt.of Highways office - with regard to Greenbriar Acres roads. This meeting will be held Wednesday morning at 8:30 a.m. Southold Savings Bank has requested an inspection of its property with regard to the site plan which was approved by the Planning Board. Mr. Gordon will make the inspection on Thursday and report back to the board. Moebius maps were distributed to the Board. This subdivision is in conjunction with,.the Board of Appeals as one of the lots is undersized. On motion made by Mr. Coyle , seconded by Mr. Gordon, it was RESOLVED to approve the site plan of Lawrence Kirk. Vote of the Board: Ayes : Raynor, Coyle, Gordon, Wall Motion was made by Mr. Coyle, seconded by Mr. Gordon and carried to accept and approve the report of John W. Davis //46 regarding the minor subdivisions of Hale and Hughes. The Orient Hills report from the Soil and Water Conservation District was received and reviewed and will be forwarded to the developer. The Board has received an invitation from L. I. Planners to attend their meeting this week. The secretary will write a letter and state that we have an interest in this organization but will be unable to attend. V_ Planning Board =g- March 27,1979 On motion made by Mr. Coyle , sectiaded by Mr. Wall, it was RESOLVED to recommend to the Southold Town Board release of the bond for the subdivision "Oregon View Estates" as per recommendation of the Planning Board Inspector, John W. Davis. Vote of the Board: Ayes : Raynor, Coyle , Gordon, Wall Mr. Wall will check and see whose responsibility it is to fix Crescent Avenue on Fishers Island. He sees no problem with a two lot minor of the property that Mr. Walsh proposes. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to approve the sketch map of the property of Charles Witherspoon for a two-lot minor subdivision subject to covenants for the property on the westerly side that it will not be further subdivided. Vote of the Board: Ayes : Raynor, Coyle , Gordon, Wall On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to approve the map of the minor subdivision of Philip Ofrias , Jr. and Sharon Ofrias subject to numbering of the lots. Vote of the Board: Ayes : Raynor, Coyle, Gordon, Wall Motion was made by Mr. Gordon, seconded by Mr. Coyle and carried to approve the minutes of the regular meeting of February 13, 1979- .Motion was made by Mr. Gordon, seconded by Mr. Coyle and carried to approve the minutes of the regular meeting of March 5, 1979. There being no further business to comei,„before the Board, Mr. Coyle ,,made a motion, seconded by Mr. Gordon and carried to adjourn thgfneeting.
