Findings: The project meets all the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code. The issuance of an Administrative Permit allows for the operations as indicated on the application prepared by Scott Hilary, received on June 16, 2008. Special Conditions: None. Inspections: Final inspection. If the proposed activities do not meet the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code, a Wetland Permit will be required. The purpose for the proposed action is to prohibit unauthorized access to and from the Town of Southold's R-O-W to the neighboring property, SCTM#45-5-2. Attached in support of the Administrative permit application are a tax map, survey, aerial, and photos referencing the location of the proposed action. The split rail fence will be installed by Southold Town's DPW. Action: Scott A. Hilary, on behalf of the Town of Southold's Land Preservation department requests an Administrative permit to install approximately 40 feet of split rail fence. Located: 70380 Main Road,Greenport.SCTM#45-5-5. The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon my site assessment and as well all the records available to me, it is my recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. The proposed action is in compliance with 275-5 (B) as referenced below and therefore is consistent with LWRP sub-policy 6.3. 6.3 Protect and restore tidal and freshwater wetlands. (�`� �l�J A. Concrete footings are not permitted within wetlands. The installation of approximately 40' of split rail fence within the minimum setback of the wetland boundary will not have an undue adverse impact on the fresh water wetlands.
