That the said Board of Trustees and the Town of Southold are'released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. Box 2124 Greenport, NY 11944 RE: GARDINER'S BAY ESTATES HOMEOWNERS ASSOCIATION GARDINER'S BAY ESTATES, EAST MARION SCTM# 37-1-23 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 21, 2008 regarding the above matter: WHEREAS, Costello Marine Contracting Corp., on behalf of GARDINER'S BAY ESTATES HOMEOWNERS ASSOCIATION applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 28, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 5 & 6 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the use of non-treated lumber on all decking, the square footage on the proposed 4'x30' float is the same as a 6'x20' float, and 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of GARDINER'S BAY ESTATES HOMEOWNERS ASSOCIATION to remove one 4'x48', two Tx14', one 6.2'x16' existing floating docks and two existing anchor pilings entirely; remove existing 3'x13.5' wooden ramp; extend existing 3'x25' fixed dock 10'; reinstall floating docks and pilings that were removed 15' further west and 10' further south than previous; reinstall existing 3'x13.5' wooden ramp; and install one new 4'x30', one 4'x20' floating dock section and one new anchor piling on the east end, with the conditions of the use of non-treated lumber on all decking, the square footage of the proposed 4'x30' float is the same as a 6'x20' float, and as depicted on the site plan prepared by Costello Marine Contracting Corp. last dated June 5, 2008, and received on June 6, 2008. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,it is my recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSITENT with the LWRP. Pursuant to 4 275-11 Construction and operation standards for docks-in the water structures,floating docks may be no larger than six feet wide and 20 feet long except on Fishers Island if the need is demonstrated. The proposed action includes a floating dock significantly larger than the permitted 6' x 20' floating dock Pursuant to�- 275-11. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. The applicant must demonstrate that the following dock standards pursuant to &275-11 Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock .structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [11 Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating,fishing, shellfishing, waterskiing and other water-dependant activities; [3] Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; [4] Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock; [5] Whether the dock will cause degradation of surface water quality and natural resources; [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina)and widgeon grass (Ruppia maritima) or shellfish; [8] Whether the dock will unduly restrict tidal flow or water circulation; [9] Whether the dock will be safe when constructed; [I0] Whether the dock will adversely affect views, viewsheds and vistas important to the community; [111 Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and [121 Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service Policy 5 Protect and improve water quality and supply in the Town of Southold. To reduce a dock's potential adverse impacts to the marine environment preservatives is prohibited for use in sheathing and decking on structures in the wetlands as well as on anv part of a structure in low tidal flow wetland areas as determined by the Trustees. Whereas the proposed project description does not describe the type of materials to be used. The use of pre-treated lumber with any preservatives as defined in&275-11 as (any part of a structure)in low tidal flow wetland areas will be determined by the Trustees. §275-11 Construction and operation standards. C. In water. The following standards are required for all in-water operations adjacent to residential properties. Operations conducted on properties zoned MI or M2 may be given greater flexibility in these requirements given the water-dependent nature of their use. (2) Docks. (a) Standards for residential and commercial docks;general rules. It shall be the policy of the Town of Southold that all docks shall be designed, constructed and located so as to reduce a dock's potential adverse impacts to navigation,public safety, waterway congestion, access to public trust lands and water, and natural resources and habitats. The proposed location provides enough space for safe navigation and it is located in an area where the wetlands are scarce. Policy 2 Preserve historic resources of the Town of Southold. This project location has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. Our proposal will not have a negative impact on the visual quality or scenic resources. This proposal is consistent with the area. This property has an existing dock and other private docks are near by. NATURAL COAST POLICIES Policy 4 Minimize loss of life, structures,and natural resources from flooding and erosion. This project has will have no flooding or erosion concerns. Policy 5 Protect and improve water quality and supply in the Town of Southold. Our proposal will not have any impact of the water quality or supply in the Town of Southold. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem. Our proposed dock facility will have minimal effects on the ecosystem. When the pilings are removed and reinstall there will be a disturbance to the ecosystem but nothing that will not re-establish within a few weeks. We have submitted application to all other governing agencies (DEC, ACOE, DOS) and we will adhere to any special conditions placed on this project in order to protect the wetlands on this site. Policy 7 Protect and improve air quality in the Town of Southold. Our proposal will not have any impact on the air quality in the Town of Southold. Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. PUBLIC COAST POLICIES Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. Our proposal will give the property owners the ability the access their boats and engage in the recreational use of town waters. The dock will not inhibit others ability to access these same waters. The entire structure will not extend pass the Homeowner's Association's owned underwater lands. WORKING COAST POLICIES Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water- dependent uses in suitable locations. This is a waterfront piece of property. With the addition section of dock, members will be able to safe board their boats. The members of this association will be engaging in water-dependent activities such as kayacking, fishing, site seeing, water-skiing and swimming. Policy 11 Promote sustainable use of living marine resources in the Town of Southold. The proposed location was chosen to protect the tidal wetlands as much as possible. The additional section of dock is minimal in size and will have limited negative impacts on the living marine resources. Policy 12 Protect agricultural lands in the Town of Southold.
