(631)765-1809-Fax(631)765-9064 �.�O fAV 1 9 2008 FINDINGS, DELIBERATIONS, AND DETERMINATION � Q MEETING DATE: MAY 8, 2008 z Wi1 CI9 ZBA# 6142 - JAMES MESKOURIS PROPERTY LOCATION: 1350 Sound Beach Drive, Mattituck CTM 106-1-36.1 (formerly 36) PROPERTY FACTS/DESCRIPTION: The subject property is a 13,847 square foot non-conforming waterfront lot along Long Island Sound in the Residential R40 District with a 50.23' wide frontage on Sound Beach Drive and is improved with a one story single family residence. BASIS OF APPLICATION: Request for a Variance under Section 280-124, based on the Building Inspector's March 25, 2008 amended Notice of Disapproval concerning proposed additions and alterations to the existing single-family dwelling, which new construction will result in a lot coverage exceeding the code limitation. LWRP DETERMINATION: The Southold Town LWRP Coordinator has determined that this variance application is exempt from Chapter 95, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP) standards because -the proposed construction is landward of and over the existing one story dwelling fronting on Long Island Sound. RELIEF REQUESTED: The applicant proposes to construct a two story addition with a 22' x24.7' footprint, on the landward side of their existing single family detached house. The proposed front yard setback will be conforming at 35' and a variance is needed for a proposed 42% lot coverage where the code permits a maximum of 20% lot coverage. ADDITIONAL INFORMATION: On April 19, 2000 ZBA Variance #4807 granted the owner/applicant a roof overhang with support columns over an existing wood deck in both side yards and on the seaward side of the existing dwelling, noting that temporary structures like awnings have been unable to withstand the severe weather conditions in the area. To date that overhang has not been constructed. The current application proposes to construct said colonnaded roof overhangs at a reduced width from what was granted by variance # 34807, which became more conforming. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law �267-b(3)(b)(3)0). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Like the owner/applicant's Page 2—May 8, 2008 ZBA#6142 -James Meskouris CTM# 106-1-36.1 property, many lots in this neighborhood are about 50 feet wide and are improved with homes that were built in the 1950's and 1960's as summer cottages with small side yards. Modest additions, like that proposed by the applicant, have been made to many of theses homes over time. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The owner/applicant's dwelling was made non-conforming in terms of lot coverage by the Town's change in the code that re-defined the buildable lot area for purposes of calculating lot coverage by eliminating portions of land under water, adjacent to or containing water features such as wetlands. This decision also made many previously conforming lots in the owner/applicant's neighborhood non-conforming relative to lot coverage. 3. Town Law §267-b(3)(b)(3). The variance granted herein is substantial at 42%. Before the code was changed (see 2 above), improvements to the subject property constituted a17.3% lot coverage to the Mean High Water Mark. Based upon the current definition of buildable area, the existing lot coverage is 39.2% to the Coastal Erosion Hazard Line. The proposed 2 story addition will add an additional 543.4 Square Feet to the lot coverage 4. Town Law §267-b(3)(b)(5). The difficulty has been self-created insofar as the applicant chooses to construct an addition that exceeds the current code. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is flat and construction will be landward of the existing waterfront residence. A new sanitary system and drywells will be installed. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition to their home, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Members Simon and Oliva, and duly carried, to GRANT the variance as applied for, and shown on the survey stamped by John Metzger, Licensed Land Surveyor, Peconic Surveyors P.C. dated January 15, 2008 and revised April 28, 2008, and photocopies (Y4" scale) of architectural drawings consisting of elevations, plans and a plumbing schematic dated December 9, 2007 (numbered pages 3,4,5,6,7, and 10, each sheet initialed JD). Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The proposed bedroom addition is landward of the existing waterfront residence and conforms to the front yard setback. The covered porch over the existing deck on the seaward side of the house received a variance in 2000. Prior to construction, the code changed and eliminated 50% of the lot area of the property from the lot coverage calculation. The proposed construction does not comply with the lot coverage requirements. The addition extends only 22 feet toward the road and is 24.7 in width. The plans were completed but the building permit could not be issued due to the change in the code. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The only location for the addition is on the landward side of the house. The existing residence will be retained and is one story in height. The addition will improve the look of the residence and provide needed living area. The elimination of 50% of the lot area requires any addition to the foot print to obtain a variance. The only alternative is to build a second floor over the existing structure which would be extremely costly and not desired by the owner. (3) The amount of relief requested is not substantial because: The Board granted a variance for the covered porch, the change in the code has undermined that variance. The property is the smae, the neighborhood is the same, merely the definition of buildable lot area has caused the property to be reduced in half. Many of the homes on Sound Beach Drive have become nonconforming due to the reduction in the buildable area/lot size. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The addition is landward of the existing waterfront residence. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is EXEMPT from LWRP review pursuant to § 268-3. The condition of approval was to leave the deck "open to the sky" . The subject property is also known as Lot 38 Map of Captain Kidd Estates . Mr. Meskouris' s family also owns the adj,acent properties to the north and south. The adjacent homes also received variances for decks . The family' s properties are Tax lot 37 which is also known as Lot 39 and 40 of Captain Kidd Estates and Tax Lot 35 which is also known as Lot 37 of Captain Kidd Estates . In 2000 the owner applied to cover the deck with a roof in Appeal No 4807 . This application was heard at the same time as the neighboring properties (tax lot 37 & 35) also requested variances to cover over the decks . The Transcript of the hearings combines the discussions of the three properties . Adding to the confusion, mar client had Christine Rivera, the contractor, build a model to illustrate the cover over the existing deck on the subject property. The other lots had drawings prepared by Penny Lumber. In review of the file, the model is not with the file only the drawings for the other variances . ' S5 The appeal at this time is reducing the amount of roof approved in V 2000 . The deck which was approved in 1990 and again reviewed in 2000 is being replaced by pavers on grade in order to reduce the overall lot coverage of "structures" . In addition, the. owner requests an addition on the landward side of the house . Prior to redefining the lot area of properties, this proposed addition would be only . 19% lot coverage to Mean High Water. The surrounding homes are similarly developed with lot coverage prior to the change in the code. The code change removed 34 of the property from calculation of lot area resulting in a lot coverage of 370. These properties have been owned by the same family prior to the change to the code language . There has been no change to the property or neighboring properties which justifies such a regulatory taking. The property is along Long Island Sound protected by a beach and beach grass as well as a bulkhead. The code revision was adopted primarily to limit the size of homes on acres of regulated wetlands . In addition to: the professionally drawn plans and elevations in your file, I have drawn a simple sketch of the roof overview. MEMBER COLLINS: Oh, OK. MRS. RIVERA: 1300 and 1350 both having the same home owner, Chris Meskouris and when they gave me the disapproval they only gave it to me for one and not both. MEMBER COLLINS: OK, I mean have denials for both but its only an application for one and then the cases back in 1990, they're were two Zoning Board of Appeals proceedings. The only thing you have to watch is the one that's 307 because you're right on the corner of the erosion and hazard line, and just to make sure that overhang doesn't go any closer over- CHAIRMAN GOEHRINGER: Yeah, you might have to pull that one back just a little bit. MRS. RIVERA: Well it would be pulled back because the depth is approximately 2 feet from that erosion line so that the comer post will be back at least that. CHAIRMAN GOEHRINGER: OK. The premises in question is located in the "Low-Density Residential R-40" Zone District and is referred to as District Page 2 - Appl. No. 3957 - MESKOURIS decision, continued: ) 1000, Section 106, Block 01, Lot 37 on the Suffolk County Tax Maps, situate along the northerly side of Sound Beach Drive, Mattituck, Town of Southold, New York. 2. The subject premises as exists: (a) contains a total , lot area of -- 15,096 sq. ft. with 75. 00 ft. road frontage (lot width j ; (b) was conveyed by separate deed to the Meskourises by Deed at Liber 10959 page 396 on August 24, 1989, and immediately adjoining the subject lot to the west exists other premises, in common ownership, of the Meskourises conveyed by Deed at Liber 10849 page 466 on April 11, 1989. (c) is improved with a single-family dwelling as shown by the May 14, 1990 survey prepared by Anthony W. Lewandowski, L.S. with setbacks as exist at 63 .5 feet from the southerly {front} property line, six feet from the easterly {side} property line, 108+- feet from the average high water mark (to the north) of the Long Island Sound, and 13+ feet from the westerly {side} property line. 3 . Article IIIA, Section 100-30A.3 of the current zoning code (as amended January 9, 1989) requires a minimum lot area of 40,000 square feet and minimum side yards at 15 and 20 feet for a total of 35 feet. 4. Article XXIII,, Section 100-239dA( 2) requires a setback of not less than 100 feet from the average (ordinary) highwater mark of Long Island Sound for new buildings. 5. The relief sought by this application are variances for approval of: (a) the subject lot with a lot area of 12,506 sq. ft. (per filed map) and lot width of 75 feet, said land presently improved with an existing one-family dwelling; (b) proposed open deck construction to be set back 92+- feet from the average highwater mark along the Long Island Sound and 1-1/2 feet from the westerly side yard, and total side yards at 7-1/2 feet; 6. Kidd Estates; (c) the total lot area, to the ordinary highwater mark of the Long Island Sound, is shown to be 15,096 sq. ft. (d) the total coverage of the lot, with the proposed deck, is 2320+- and a variance is not necessary since the total coverage of the parcel by buildings is less than the maximum 20a of lot area to the highwater mark. 7. In considering this application, the Board also finds and determines: (a) the relief as granted will not in turn increase the dwelling unit density, since the parcel is believed to have been improved with a dwelling before 1960; (b) the evidence submitted and practical difficulties claimed are sufficient to warrant a grant of this variance; (c) there will be no substantial change in the character of the immediate neighborhood or detriment to adjoining properties; (d) the difficulties cannot be obviated by some method feasible to the appellant to pursue, other than a variance; (e) that similar relief was granted to County Tax Map Lot 1000-106-1-35 (Subdivision Lot 37) located immediately to the west of this parcel; (f) that in view of the manner in which the difficulties arose, and in considering all the above factors, the interests of justice will be served by granting the variance, as conditionally noted below. Accordingly, on motion by Mr. Doyen, seconded by Mr. Grigonis, it was RESOLVED, to GRANT the relief as requested (and noted in paragraph #5, supra) , in the Matter of the Application of CHRIS, JAMES and PETER MESKOURIS under Appl.
