CTM 104-1-20 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS: The applicants' property consists of 15,294 square feet in size with 70 feet along Lilac Lane (a private lane). The property is improved with a single- family dwelling and accessory frame garage, as shown on the May 30, 2001 survey prepared by Northstar Surveying, P.C. BASIS OF APPLICATION: This is a request for a Special Exception under Southold Town Zoning Code Article III, Section 280-13B(14), sub-sections (a)-(d). The Applicant/Owner proposes a Bed and Breakfast accessory use in their owner-occupied residence, incidental to their occupancy as a single-family dwelling use, with two guest bedrooms for lodging and serving of breakfast to not more than four (4) casual, transient roomers. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 27, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: APPLICANT'S REQUEST: The applicants are requesting authorization by special permit as provided by Section 280-13B of the Zoning Code, for an Accessory Bed and Page 2—April 10, 2008 ZBA#6141—R and P.Frerking (B &B) CTM 104-1-20 Breakfast for use of two existing bedrooms in their home for overnight guests, with breakfast for these guests. REASONS FOR BOARD ACTION. DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspections, and in considering the general standards set fourth in Code Section 280-142 (formerly 100-263), the Board makes the following findings: 1) This use as requested is reasonable in relation to the District in which is located, adjacent use districts, and nearby and adjacent residential uses. A. Grant of special exception for a limited size bed and breakfast establishment will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Board finds that, if no more than two rooms are rented at any one time and no off-premises parking is permitted, there will be no significant impact on the neighbors. B. The safety, heath, welfare, comfort, convenience and order of the Town will not be adversely affected by the proposed accessory Bed and Breakfast use and its location. C. The structure will be readily accessible for fire and police protection. D. The proposed use will be in harmony with, will promote the general purpose and intent of, the Zoning Code, and will be compatible with its surroundings and the character of the neighborhood and community in general. 2) This authorization is for a Special Exception related to this Bed and Breakfast as an accessory use in conjunction with the applicant (as owner) of this single-family dwelling and will not prevent the orderly and reasonable use of adjacent properties, and the use has adequate parking and available open space. 3) This accessory use will not prevent orderly and reasonable uses proposed or existing in adjacent use districts. The Board finds that, if no more than two rooms are rented at any one time and no off-premises parking is permitted, there will be no significant impact on the neighbors. Page 3—April 10, 2008 ZBA#6141—R and P.Frerking (B &B) CTM 104-1-20 4) No evidence has been submitted to show that the safety, health, welfare, comfort, convenience, order of the town would be adversely affected by a Bed and Breakfast as an accessory use utilizing two existing bedroom areas of this existing single-family dwelling. 5) This accessory use is an authorized zoning use subject to a Special Exception review and approval by the Board of Appeals and determinations by the Building Inspector for other safety and health regulations under a Certificate of Occupancy and/or Certificate of Compliance. 6) No adverse conditions were found after considering items listed under Sections 280- i42 and 280-143 (formerly 100-263 and 100-264) of the Zoning Code. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the"special exception, as applied for, concerning an Accessory Bed-and- Breakfast in the owner's home, subject to the following Conditions: 1. No more than two rooms shall be rented as B & B guest rooms. 2. Lodging and serving of breakfast shall be limited to four persons (B & B occupants). 3. There shall be no off-premises parking. 4. Smoke alarms shall be provided (as per code) on each floor and in each guest room. 5. The dwelling shall meet Codes providing at least two exits and a window size large enough for emergency egress in each guest room. 6. There shall be no exterior signage identifying the use as a bed-and-breakfast (except as per code). 7. THE CHAIRM4kN: Is there anyone also who wishes to speak for this application? (There was no response.) THE CHURYAN: Is there anyone present who wishes to speak against this application? MR. WILLARD LAWRENCE: I live on Sterling Road across from Boyd. He has a good size piece, 1501 x 2001 . The lot diagonally across the street is owned by Maline. I think these two properties are behind Maline's property. Does he want to combine them? MR. OLSEN: He wants to sell separately. , MR. LAWRENCE: I would say in view of the way things are developing that Mr. Kirwan should sell the two lots in one piece. THE CHAIRMAN: It seems to me that this is a case where the Board could go either way. The Board should be guided by the surrounding area. However, I believe, that wherever possible the Board should not go down to a 14,000 square foot lot. There are cases where there is one remaining lot and it really doesn't make much difference what size it is as it would be an unusual hardship to require that the lot be kept vacant.
