SUBJECT: Refund of Fee under ZBA#6147 — Eve Seber and Carlo Voelker
A full refund ($400) in the above-noted file reference is recommended for the reason that
the applicant decided to re-submit under a different application to all the Departments
involved, after creating a new lot based on a 1979 approval, and their desire to change the
status of one parcel into two separate building parcels.
Copies of the applicant's letter requesting a refund and Town's original receipt for payment
are enclosed for reference purposes. The refund should be given to the name of check that
was processed: New England Barns Inc., P.O. Box 1447, Matttituck, NY 11952.

The proposed construction,on this conforming 47,520 square foot lot in the R-40 District is not permitted
pursuant to Article XXIII Section 280-122,which states;
"Nothing in this article shall be deemed to prevent the remodeling reconstruction or enlargement of a
non-conforming building containing a conforming use, provided that such action does not create any
new non-conformance or increase the degree of non-conformance with regard to the regulations
pertaining to such buildings_"
The existing single family dwelling notes an existing single side yard setback of 11.5 feet.That setback will be
maintained with the proposed second story addition.Pursuant to the ZBA's interpretation in Walz(#5309) such
additions and alterations will thus constitute an increase in the degree of non-conformance.
Pursuant to Article XXIII Section 280-114, which states,
"No building or premises shall be used and no building or part thereof shall be erected or altered in the
A-C, R-80, R-120, R-200 and R-400 Districts unless the same conforms to the Bulk Schedule and
Parking Schedule incorporated into this chapter with the same force and effect as if such regulations
were set forth herein full."

.Eve Sober and Carlo Voelker are proposing to construct a second floor addition to an existing
single story residence. The design of the existing building is a 1970'5 style,wedge-shaped structure that.
creates a number of construction issues when attempting torcmodel it.(Please see construction plans.)
The Bulk schedule requires a side yard setback:of 15'. The existing garage is 11.5' from the east
side yard,and the existing deck is 8.5' from the same side yard. However,as this deck was constructed-to
accommodate the unusual wedge-shape of the house,it leaves little or no room for reasonable or aesthetic
deck design.The ultimate intention is to increase the rear deck so as to provide an area that-is adequate
enough to enjoy the rear of the property.
Our proposed house 649n would square-off the foundation and house (please see'drawings.#•1
atld#2). As illustrated on these drawings,the proposed deck would be squared to the new house'and`:
would,consequently, provide the appropriate sized space and the improved aesthetic we are;attemptitfg.to
achieve. However,by squaring the deck to the new house orientation,the side yard_setbacic.%the deck is

further reduced to from 8.5'to 6,61,
Pursuant to Article XXIII,Section 280-114,we are requesting an 8.4' side yard setback relief to
accommodate our proposed deck and our proposed second floor addition to the existing residence.
The Southold'Towfi Trustees held a public meeting regarding our proposal-and subsequently
approved it by issuing Permit 46805. The DEC is currentlyreviewing the same proposal:

(1) An undesirable change will not be produced in the CHARACTER of the neigh CWAM iAQREAMr

The proposed house and deck design is infinitely more suitable to the character of the neighborhood than the existing structure.
The existing structure is outdated and has no similarities to any other building in the area.
(2) The benefit sought by the applicant CANNOT be achieved by some other method feasible for the applicant to
pursue,other than an area variance,because:
It would compromise the design of the structure which has been carefully crafted to increase the benefits to the neighborhood
character and the physical environment.
(3) The amount of relief requested is not substantial because:
The existing setback distance of the deck is 8.5' from the east side yard. We are requesting an additional relief of 1.9.',or 12%
of the permitted 15' setback.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the
neighborhood or district because:
The proposed building and landscape design will.create more of a natural buffer between the developed area and the wetlands.
This will have a positive effect on the physical and environmental conditions.
