(631)765-1809•Fax(631)765-9064 RE EIVED FINDINGS, DELIBERATIONS AND DETERMINATIO AY 6 MEETING OF MAY 8, 2008 Q_' . Southold ows-Clerk- ZBA# 6155 - CHRISTOPHER and EVELYN CONKLIN Property Location: 3400 Ole Jule Lane, Mattituck CTM 122-4-20.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicants' property is improved with a single-family, one-story home, and contains 35,222 square feet with 130 feet along Ole Jule Lane and average depth of 185 feet between the street and the bulkhead adjacent to the dredged canal of James Creek. BASIS OF APPLICATION: Zoning Code Section 280-116B, based on the Building Inspector's April 2, 2008 Notice of Disapproval, amended April 23, 2008, concerning as-built decks and proposed second-story addition(s) to their existing single-family dwelling. The second-story addition is noted as being +/- 50 feet from the existing bulkhead, and the as-built deck addition noted as being 37 feet from the bulkhead. Zoning Code Article XXII Section 280-116B states: All buildings or structures located on lots upon which a bulkhead, concrete wall, riprap or similar structure exists and which are adjacent to tidal water bodies other than sounds shall be set back not less than 75 feet from the bulkhead. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated April 17, 2008 states that the application is considered'a matter for local determination as there appears to be no significant county-wide or inter-community impact. TOWN CODE CHAPTER 268 LWRP: It is also determined under Chapter 268-3-B that this application is exempt from review inasmuch as it is a minor action (concerning replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site). This was Y , Page 2—May 8,2008 ZBA#6155—C.and E.Conklin CTM No. 122-4-20.1 also the determination issued by the Town pursuant to a January 5, 2007 recommendation from the Town LWRP Coordinator. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 24, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The deck is open and unroofed (as-built) and extends around the southeastern corner of the dwelling with its setback at 37 feet from the bulkhead at its closest point. Also proposed is a second-floor addition over the existing first floor area without changing the existing nonconforming setback of 50 feet from the bulkhead. These additions are shown on the survey amended April 4, 2008, prepared by John T. Metzger, Land Surveyor to show greater detail and setbacks from these construction areas. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The deck construction (as-built) and the existing dwelling over which a second-floor is proposed, have existed. The as- built deck is in need of repair or replacement, while maintaining the same nonconforming location which is 37 feet from the bulkhead at its closest point measured at the southerly point. 2. Town Law§267-b(3)(b)(2). The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance. The house was built prior to 1986, as shown on the January 8, 1986 survey prepared by Roderick VanTuyl, P.C. 3. Town Law §267-b(3)(b)(3). The variance granted is not substantial. The house with nonconforming setbacks existed for many years in this location and is now in need of being replaced or repaired. 4. Town Law §267-b(3)(b)(5). The difficulty has not been self created. The decks were in existence when the applicants purchased the house. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of a restored deck and second-floor, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3—May 8,2008 ZBA#6155—C.and E. Conklin CTM No. 122-4-20.1 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Weisman, and duly carried, to Grant the variance as applied for, as shown on the survey amended April 4, 2008, prepared by John T. Metzger, Land Surveyor. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Vote of the Board: Ayes: Members Goehringer Chairman) va, D' Simon, and Weisman. This Resolution was duly adopted (5-0). ER-D" P. N.Y. 11971 TELEPHONE 1516)765.1809 ACTION OF THE ZONING BOARD OF APPEALS Appeal No. 2994 Application Dated May 20, 1982 TO: Mr. Norman Addy as agent for Ms. Estelle L. Weinrib(Appellant(s)J Box 262 27 West 86th Street Mattituck, NY 11952 New York, NY 10024 At a Meeting of the Zoning Board of Appeals held on June 26, 1982 the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article Section [X] Request for Variance to the Zoning Ordinance Article III , Section 100-32 ( ] Rectuest for T is e public hearing on thmatter was held on June 17, 1982. Upon application of ESTELLE L. WEINRIB, 27 West 86th Street, New York, NY 10024 (by Norman Addy) for a Variance to the Zoning Ordinance, Article II Section 100-32 for permission to construct accessory building in the front and/or -side-yard area at 3400 Ole Jule Lane, Mattituck; bounded north by Wood; west by Canal; south by Kimmins; east by Ole Jule Lane; County Tax Map Parcel No. 1000-122-4-20. The board made the following findings and determination: By this appeal, appellant seeks permission to construct a 10' by 12, accessory storage building back-to-back of existing accessory building located in the frontyard area, 67 to the north property line and 77 feet to Ole Jule Lane. The premises in question contains an area of approxi- mately 36,000 square feet with 130' frontage along Ole Jule Lane and 255' frontage along James Creek, Existing on the premises are a one-family private dwelling with attached deck and accessory building in the frontyard area. It is the consensus of the board that similar circumstances are existing and the relief requested is minimal. The board agrees with the reasoning of appellant. In considering this appeal, the board determines that the variance request is not substantial;, that the circumstances herein are unique and practical difficulties have been shown; that by allowing the variance no substantial detriment to adjoining properties would be created; that the difficulty cannot be obviated by a method, feasible to appellant, other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance. On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, that the application of ESTELLE L. WEINRIB by Norman Addy as agent, for permission to construct accessory storage building in the front and/or side yard areas, be and hereby IS APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the 10' by 12' storage building be no closer than 67 feet to the north property line and no closer than 77 feet to Ole Jule Lane; (CONTINUED ON PAGE TWO) DATED: July 26, 1982. CHAIRMAN, SOUTHOLD TOWN ZONING BOARD OF APPEALS Form ZB4 (rev. 12/81) Page 2 - Appeal No. 2994 J Matter of Estelle L. Weinrib Decision Rendered June 26, 1982 2. That the storage building may never be used for sleeping quarters and is to remain as a storage building, as stated in this application; 3. That this storage building shall not exceed the size 10' by 121 . Location of Property: 3400 Ole Jule Lane, Mattituck, NY; County Tax Map Parcel No. 1000-122-4-20. Vote of the Board: Ayes: Messrs.
