HomeMy WebLinkAboutTB-03/23/1948 1-35 Meeting of March 23, 1948 The Southold Town Board met at the office of Supervisor Norman E. `-? Klipp- at Greenport on Tuesday, ,March 23, 1948. The meeting was called to order at 1:30 P.M. with the following present: Supervisor, Klipp; Justices, Terry, Tuthill, Albertson and Clark;-George C. Terry, Esq. , Acting Attorney in the absence of Town Attorney, Rensselaer G. Terry; end Town Clerk, Booth. The minutes of the previous meeting were read and duly approved- as read. -r--- A public hearing was held at the . office of the Supervisor ' at Greenport, on Tuesday, March 23, 1948, to consider a proposed Town Ordinance prohibiting and regulating the disposal of garbage and rubbish. The - - Town Clerk presented proof of publication of such hearing. Super- . visor Klipp opened the hearing at 2 P.M. and read the call of the meeting. He then called upon any person present wishing to speak � either for or against the proposed ordinance. Mr. Walter E. Hyatt representing several property owners at Hortons . > Point at Southold spoke in favor of the proposed ordinance. A coaa- , � munbation was read from Howard M. Terry, a commissioner o.f' the Southold Fire District, stating his approval of the proposed or- dinance. There was no opposition expressed to said proposed ordin- ance. The Supervisor declared the hearing closed at 2:30 P.M, 1 Moved by Justice Clark; seconded by Justice Terry, and on roll call the following ordinance was unanimously adopted by the Town Board. -� SOUTHOLD TOWN ORDINANCE PROHIBITING AND REGULATING THE DISPOSAL OF GARBAGE AND RUBBISH SECTION E. _. DEFINITIONS r� As used in -this ordinance, the term ."person" shall mean any ^; person firm or corporation, other than the authorized employees. .of the Town of Southold; the term- "garbage" shall mean any animal -* or. vegetable refuse, offal, swill, garbage, papers, ashes, junk, rub- bish, discarded machinery, furniture, building or construction materials, dirt, leaves and the like; the term "attendant" shall mean any employee of, the Town of Southold in charge of the existing Town Dump and or any garbage disposal area under the direction of the Town Superintendent of Highways; the-, term "garbage disposal area" shall mean any premises designated by the Town Board as the Official dump. - �. SECTION 2. DUMPING PROHIBITED GENERALLY J, No person shall throw, cast or deposit, or cause to be thrown, . rr cast or deposited any garbage upon any premises within the Town of Southold except `on written authorization by the Town'Board, which authorization may be revoked on thirty days notice. Nothing con -, � tained in this section shall be construed to .-prevent the temporary accumulation of garbage by a resident of the Town upon pr®tses occupied by him to the extent that is ordinary or necessary for his personal household requirements, nor to prevent the disposal of garbage at any Town Dump or garbage disposal area maintained ..or authorized by the Town of Southold, nor to prevent the proper use of receptacles placed upon the streets or other public places �— in the Town for the depositing of papers. SECTION 3. INVITATIONS TO DUMP BROHIBITED No- person shall by erecting signs or other invitation offer -any premises within the Town as a place for the disposal of garbage, or allow any persons, publicly or- privately, to dispose .of garba§e ti on any premises in the Town. SECTION 4. CONVEYANCE AND TRANSPORTATION OF GARBAGE. No person shall convey or transport garbage through the streets of the Town of Southold in any cart, wagon, vehicle or by any other .means unless adequate care is taken to prevent the blowing away or spilling of garbage in the streets. �- SECTION 5. PENALTY Any person violating any of 'the provisions or setions of this ordinance' or any ,part thereof' shall-,,pay a penalty of. not less than '`- Five Dollars nor more than Fifty- Dollars for the- first offense' and not less than Twenty-five Dollars nor more• than One•Hundred Dollars• for each' subsequent offense. In addition to •the foregoing penaltyq it is hereby ordained that a .violation' of this ordinance or any part thereof shall ddastitute disorderly conduct and the person guilty of such violation shall be a disorderly person. SECTION 6. This ordinance shall not apply to any territory included within the limits of the incorporated Village of Greenport. By order, of the Southold Town Bdadd. Ralph P. Booth a 1 T Town Clerk. The above ordinance becomes effective on the 15th day of April,1948. The Board held a lengthy 'discussion on the Fishers Island' Ferry District: A communication was read from the family of the late Louis S. Tuthill, bxpressing the appreciation of the family for the sympathy of the Board: Moved by Justice Tuthill; seconded by Justice Albertson; Resolved: That the Superintendent of Highways be and hereby is auth- orized to sell one 1931 Reo dump truck,one 1934 International dump truck, one 1936 Diamond T. dump truck for a total price of $15000 Unanimously adopted. Moved by Justice Terry; seconded by Justice Albertson: . Resolved: That any expenses incurred by any Town Official- in promoting any plans of operation for the Fishers Island Ferry District be charged against said Ferry District in accordance with Sec. 202 A. SubvDiv. 3 of the Town Law. Unanimously adopted. . Moved by Justice Albertson; seconded by Justice Terry: -�- Resolved: That the monthly audit meeting of this Board will be held at the office of the Supervisor on Tuesday, April 6, 1948, at 1:30 P.M.
