Meeting of October 3, 1950
A public hearing was held at the office of Supervisor Norman E. Klipp
� at Greenport, on Tuesday, Oct. 3, 1950. The meeting was duly opened
at 8 PM. , in accordance with the legal notice published in the
Town N�.wspapers� The following members of the Board being present:
Supervisor Klipp; Justices Terry, Tuthill, Albertson and Clark;
Town Attorney Terry and Town Clerk Booth.
The purpose of this meeting was to consider a proposed contract with the
j Village of Greenport for the furnishing of fire protection hydrant rental
and water supply to the East-West Greenport Fire Protection District.
The Supervisor read the call of the meeting and called upon any person
present who wished to speak either for or against the existing contract.
La.wyer 'Stanley . Corwin,representing certain residents of the East-West
a Fire Protection District could not attend the meeting fte requested
the Supervisor to read his viewsson the matter. He igas not in accord
with the present contract. He stated the rate was too high and could
be cut in half.
Otis Burt, Mayor of the Village of Greenport , stated that, in accordance
with the contract, the Village Board could not reduce the rate. Harold
Thornhill, a resident of the East-West Greenport Fire Protection District,
w stated it would be agreeable to him to go along at the same rate if it
could not be reduced. Harry Monsell was notin agreement with
Lawyer Corwin a,s to the rate being cut in half, he stated that the price
of hydrants and fire apparatus was very high and to form a special
fire district would be very expensive, he also stated that 6o% of thee,
:I fires in the past year were in the limits of the East-West Greenport
Fire Dastection District. The hearing duly closed at 8:45 P.M.

f° A RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING
$100)000 FISHERS ISLAND FERRY DISTRICT (SERIAL) BONDS,
OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NElat YORK, TO PAY
t THE COST OF ACQUISITION -OF A FERRY.

WHEREAS, pursuant to Chapter 699 of the Laws of 1947, Fishers Island
. Ferry District of the Town of Southold, Suffolk County, New York, is
authorized to acquire, operate and maintain a ferry for ferry service
from convenient points on Fishers Island across the waters of Bong Island
Sound and to the adjacent waters or attributary thereto to points- within
and without the State of New York; and
WHEREAS, such Fishers Island Ferry District has been duly created
I pursuant to such Capter 699 of the Laws of 1947, as amended, and it is
nog+ desired to purchase a 110 foot diesel passenger ferry known as the
"Mystic Isle" from the Erie Isles Ferry Company of Middle Bass , Ohio; and
WHEREAS, the estimated purchase •price thereof, including incidental
expenses in connection therewith, is $100,000; NOW THEREFORE,
BE IT
RESOLVED, by the Town Board of the Town of Southold, Suffolk County,
NexDvYork, as follows:
Section 1. Pursuant to Chapter '699 of the Laws of 1947 and on behalf
of. the Fishers Island Ferry District, the purchase from the Erie Isles
Ferry Company of Middlg Bass , Ohio, of the 110 foot 8 inch overall diesel
driven, welded steel passenger and auto ferry "Mystic Isle" , said "Mystic Isle'
having the following registered particulars:
_F Official No. 242,®b4 - Length 103 ' - Beam 32 ' 0" - Depth 9' 9" -
% Gross tonnage 431 - Net tonnage 361 - Triple Screw -Oil-Passenger , at a total
estimated cost, including incidental expenses , of, $100,000 is hereby
authorized.
' Section The plan of financing such object of purpose is by the
issuance of not exceeding $100,000 serial bonds hereinafter authorized.
No down payment is required since the cost of such improvement is to be
assessed upon benefited property within the Fishers Island Ferry District,
an area smaller than the area of the 'Town of Southold.

Section � For the purpose of paying the cost of the aforesaid
object or purpose, there are .hereby authorized to be issued $100,000
serial bonds of said Town, each to be designated substantially FISHERS ISLAND
FERRY DISTRICT (SERIAL) BOND, 1950, dated October 1, 1950, in the denomi-
nation of $1,000 each, . numbered .from 1 to 100, both inclusive, maturing
in numerical order in the amount of $10,000 on October 1 in each of the
years 1951 to 1960, both inclusive , and bearing interd�t at a rate not
exceeding five per centum per annum payable semi-annually April 1 and
October 1. Such bonds shall be in bearer coupon form with the privilege
of conversion into bonds registered as to both principal and interest and r
shall be .payable as to both principal and interest in lawful money of the
United States of America at THE FIRST NATIONAL BANK OF GREENPORT,
in GREENPORT, New York, which by contract is the paying agent of the
issuer. Such bonds shall be signed in the name of the Toiaof aouthold
by. its Supervisor and sealed with its corporate seal, attested by its
Town Clerk, and the interest coupons shall bear the facsimile signature
of its Supervisor. it
Section 4. All other matters except as provided herein relating to
such bonds shall be determined by the Supervisor. Such bonds shall
contain substantially the recital of validity clause provided for in

Section 52.00 of the Local Finance Law and shall otherwise be, in such
form and contain such recitals , in addition to those required by
Section 51.00 of the Local Finance Law, as the Supervisor shall determine.
Section 5. It is hereby determined that subdivision 26 of
paragraph afof Section 11.00 of the Local Finance Law applies to such
object or purpose and that the period of probable usefulness thereof is
10 years , computed from October 1, 1950,'; no bond anticipation notes laving
been issued prior thereto. I
Section 6. The powers and duties of advertising such bonds for
sale, conducting the sAle and awarding the bonds , are hereby delegated to 4;
the Supervisor who shall: advertise such bonds for sale , conduct the sale J
andeaward the bonds in such manner .�s he shall deem best for the interests
of Laid Town, provided, however, that mn the exercise of these delegated
powers he shall comply fully with the provisions of the Local Finance
Law and any order or rule of the -State Comptroller applicable to the
sale of "unicipal bonds . The receipt of the Supervisor shall be a full
acquittance to the purchaser of such bonds who shall not be obliged to
see to the application of the purchase money.
Section 7. The faith and credit of the Town of Southold are hereby
pledged for the payment of the principal of and interest on saki bonds as
the same become due and payable . `'aid bonds shall be payable in the L
first instance from a levy upon all property- within the Fishers Island
Ferry District, but if not paid from such source all the taxable real
property in said Town shall be subject to the annual , l'evy of a tax
sufficient to pay the principal of and interest on said bonds as the same
become due and 'payable without limitation as to rate or amount.
Section 6. Mt is biereby determined that no obligations other than' the
bonds a�.thorized by this resolution have been heretofore issued by chid
Mpwn on behalf of said Fishers Island Ferry District and that the total
indebtedness authorized byythis resolution plus all other indebtedness
heretofore incurred on behalf of said Fishers Island Ferry District does '
not exceed $100,000.
Section The validity of such bonds may be contested only if:
1. Such bonds are authorized for an object or purpose for which the
Town of. Southold is not authorized to expend money,. 'or
2. The provisions of law which should be compiled with at the date ¢
of publication of this resolution .are not substantially complied
with,
and an action suit or g g
9 proceeding contesting such validity is commenced �within twenty days after the date of such publication, or .
3. Such bonds are 'authorize'd in. violation of the provisions of
the Constitution.
Section 10. This resolution which tal4es effect immediately shall be �1 published in full in THE SUFFOLK TIMES - Ir,.
and in THE LONG ISLAND TRAVELER- R
MATTITUCK WATCHMAN newspapers of said Town, together with a notice of the

The following resolution was offered by Justice Ralph Tuthill,
who moved its adoption, seconded by Justice Harry Terry, to-wit:
BOND ANTICIPATION NOTE EESOLUTION DATED OCTOBER 39 1950.
A RESOLUTION AUTHORIZING THEIISSUANCE OF NOT EXCEEDING
$1009000 BOND ANTICIPATION NOTES OF THE TOWN OF SOUTHOLD,
SUFFOLK COUNTY, NEW YORK, TO PAY THE COST OF ACQUISITION OF
A FERRY.
WHEREAS, at this meeting the Town Board of the Down of Southold,
Suffolk County, New York, on behalf of the Fishers Island Ferry Listrict,
authorized the issuance of not exceeding E100,000 serial bonds of said
Town to pay the cost of the purchase from the Erie Isles Ferry Company of
Middle Bass , Ohio , of a 110 foot 8 inch overall diesel driven, welded
steel passenger and. auto ferry "Mystic Isle" NOW THEREFORE BE IT.
RESOLVED, by the Town Board of the lown'of Southold, Suffolk County,
New York, as follows:
Section 1. In anticipation of, the sale and issuance of said
$1009000 bonds there Pre hereby authorized to be issued bond anticipation
notes of said Town in- an amount not exceeding the aggregate principAl
amount of $100,000, and such parr is hereby delegated to the Town
Supervisor of said Town, the Chief Fiscal Officer , but no such notes
shall be issued by said Supervisor unless he shall have first filed with
the Finance Board (the Town Board) of said Town, a certificate authorizing
the issuance of such notes , which certificate shall contain the statements
required by Section 30100 of the Local Finance Law, provided, however,
that such notes shall mature not more than one year from the date of the
note first issued hereunder: Such certificate shall be properly dated
and signed by said Supervisor and shall be a public record.
Section 2. That the proceeds of said notes shall be used solely
for the same object or purpose for which the proceeds of .sa.le of . said
$100,000 bonds may be expended, and said notes shall be paid from the
proceeds of the sale of said bonds , or otherwise redeemed in the manner
provided by law.

The question of the adoption of the foregoing resolution was duly
put to a vote on roll call which resulted as follows:
