The meeting was called to order ,.T at 1:30 P.M, , with the following present: Supervisor Klipp; Justices Terry, Tuthill, Albertson and Clark' Town Superintendent of Highways Price; Town Attorney Terry and Town Clerk Booth. The Minutes of the previous meeting were read and were duly approved as read. Moved by Justice Clark, seconded by Justice 'Terry: Resolved: That the regular monthly audit meeting of this Board will be held at the office of Supervisor at Greenport , on Thurs. , Oct. 51 1950, -} at 1:30 P.M. -, Unanimously adopted. Moved by Justice Tuthill, seconded by Justice Albertson: _T Resbl.ved: That the Town Assessors be authorized to attend the annual convention. of National Association of Assessing Officers to be held at •� Atlantic City, N.J. , on Oct. 8 to -Oct, 12, 19509 Necessary expenses incurred by the assessors attending this meeting is a proper charge against the town. Unahimously adopted. The following Resolution offered by Superintendent of Highways Harold Price - and seconded by Justice Harry Terry was unanimously adopted by the Town Board: Whereas , Almighty God has, in his infinite wisdom, seen fit to remove from our midst, Jozef Kozlowski, a faithful and conscientious employee of the Southold Town Highway Department for over twenty-two years , Now ThereforeBe It Resolved: That we, the members of the Southold Town Board , .do hereby express our heartfelt sympathy to the members of his family, and Be It Further Resolved: That a copy of this resolution be spread upon the Minutes of the Town Board, and that the Town Clerk cause a copy thereof transmitted to his family. - Moved by Justice Clark, seconded by Justice Tuthill: T ,4 Whereas, Henry F. Santacroce has resigned as temporary_ Police Patrolman (Constable) from the Town Police Department, Town of Southold r Therefore Be It Resolved: ` That Joseph Sawiski be and hereby is appointed temporary Police Patrolman\(Constable) of the Town of Southold Police Department from September 22, 1950, to October 20, 19509 both dates inclusive , Be It Further Resolved: That Joseph Sawiski be compensated for such "A position at the rate of .$ 6. 50 per day. Unanimously adopted. Moved by Justice Tuthill, seconded by Justice Clark: -� Resolved: That Wilbur J. July, of Mattituck, be and hereby is appointed ` X Special Constable- to direct traffic at the Mattituck School crossing, at a salary of $4.00 per day for each school day worked, effective -, September 25, 1950, he to serve, at the pleasure of the Board. Unanimously adopted. ..y Moved by Justice Clark, seconded by Justice Terry: Resolved: That a public hearing will be held at the Village Hall, Greenport, on Tuesday, October 3 , 1950, at 8 o 'clock P.M. , for the purpose of considering a proposed contract with the Village of Greenport for the furnishing of fire protection to the East-West Fire Protection ` District for a period of five years commencing Jan. 1, 1951. -� Unanimously adopted. Moved by Justice Tuthill, seconded by Justice Clark: Resolved: That the street lighting contract between the Town of Southold and the Long Island Lighting Company for the Mattituck Lighting District #I ` be and hereby is approved by the Town Board, said contract is for a term of five years and expires on Sept. �51- 1955. Unanimously adopted. C S4 The hearing on -the matter of purchasing machinery for the Town Highway Dept. , which was advertised in accordance with Section 142 of the Highway Law, was duly opened at 2 o 'clock P.M. No person appeared before the Board to speak either for or against this item mentioned in the legal notice . The hearing was closed at 2:30 P.M. Moved by Justice Terry, seconded by Justice Tuthill: Whereas , thB Town Superintemdent of Highways did, on the _19th day of Sept. , 1950, duly recommend the purchase of certain (Machinery) (equipment) pursuant to provisions of Section 142 of the Highway Law, and a notice of' such recommendation has been duly published as provided in such section. Now Therefore Be It Resolved that pursuant to Section 142 of the Highway Law the Town Superintendent of Highways is hereby authorized to purchase from Muni.typal Machinery Co , with the approval of the County Superintendent of Highways: One--LNelson Bucket Loaded with Rotate Screen_,.__Model C�-1111_,with 12'�ads in Dlace of 9"" , F. 0. B. Coram,_L_I. for a total price of _ Eight thousand nine hundred sixty five Dollars. ($89965.00) delivered At Coram, LI., New Yorker and to - be delivered on or about October 10, 1950. The Town Superintendent' of Highway is hereby authorized, subject to the . - approval of the County Superintendent of Highways , to surrender to the above-named vendor -,r- One (Hais Bucket Loader) with attachments) as part payment for the above (machinery) (equipment) to be purchased. The terms of payment will be as follows: _ Tradepin allowance $ 1, 540.00 r_ Check drawn on Machinery Fund $ Check from proceeds of obligations $_ 7 100 Total $_ 8,965.00 A contract of purchase for the item purchase shall be duly executed b between the Twwn Superintendent of Highways and such vendor, and when duly approved by 'the CoLuItY Superindendent of Highways, it shall become effective. When such contract . has been duly executed and approved, the Supervisor is authorized to complete such purchase upon delivery of the item purchased in accordance with the terms of such resolution and such contract, and, to pay' the above amount(s) specified to be paid ` by check or checks. (1) by a check drawn on the Machiner Fund (Item 3) for ti (2) by a check in the amount of $ 7,4 ,-G0 , drawn on the account established from the proceeds of obligations to be issued pursuant to the Local Finance Law to finance such purchase . THAT WHEREAS the Town toard of the lown'of Southold, New York, after due public notice , by a resolution duly adopted on the 19th day --- of September , 1950, authorized the Town Superintendent of Highways t purchase certain machinery for highway conttruction and maintenances at a total cost of 9040. , subject to the approval of the Bounty Superintendent of Highways and provided that 7500 of such cost was to be paid from proceeds of obligations to be issued pursuant to the Local Finance Law, ardl WHEREAS a contract of purchase for such machinery was duly entered into by the Town Superintendent of Highways on the 19th day of September, 1950, which contract has been duly approved by the County Superintendent of Highways. NOW, THEREFORE, BE IT RESOLVED: 1. That the specific oUject or purpose for which a capital note is to be issued pursuant to this resolution is to finance the• cost of certain highway machinery known as a:- Nelson Bucket Loader Model Q-11 with rotary screen and 12 inch pads. 2'. The maximum cost of such machinery is 9040. , and the plan of financing such cost is as follows: -By machinery traded in pursuant to Section 142 of the Highway Law of the value of $ 1 40 . The balance of the cost is to be provided by the issuance of a capital note in the amount of 00 , pursuant to this resolution. 3. The following determinations are hereby made: (a) The period of probable usefulness of such equipment is five years. (b) The subdivision of paragraph afof Section 11.00 of the Local Finance Law which is applicable in the circumstances is subdivision 112811 . (c) The proposed maturity of the obligation authorized by this resolution will not be in excess of one year. 4. That, except as herein specifically prescribed, said note shall be of the date , terms , form, contents and place of payment and at a rate of interest not exceeding. TWO (2%) per centum per .annum, as may be determined by the Town Supervisor, consistent, however, with the provisiohs of the said Local Finance Law of 'the State of New York; and shall be executed in the name of the slid Town by its 'upervisor and the Seal of said Town shall be attached thereto. 5. That said note shall be sold at private sale by the Town Supervisor at a price of not less than par value and accrued interest, if any, and upon due execution and sale of said note the same shall be delivered to the purchaser upon payment by him to the town "upervisor of the purchase P price ih cash; and the receipt of such Supervisor shall be a full acquitance to such purchaser who shall not be obliged . to see to the application of the purchase money. 6". The full faith and credit of the Town ofouthold, New York, are pledged to the punctual payment of principal acid interest on said note. 7. This resolution shall take effect immediately. The, TOWN OF SOUTHOLD, in the County of Suffolk, a municipality of the State of New York, hereby acknowledges itself indebted and for value received promises to pay to the the sum of _D611ARS, on the day of , together with interest thereon from the date hereof at the rate of payable annually. Both principal and interest of this note will be paid in lawful money of the United States' of America, at the office of the Supervisor of the Town of Southold, Greenport, Suffolk County,. NewYork. This Note may not be converted to registered form. This Note is the 'only note of an authorized issue in the amount of $ 7500.00 for the purposedof financing the purchase of certain highway machinery. This Note is issued pursuant to the provisions of a resolution entitled "Capital Note Resolution",, duly adopted by the Town Board of such Town of "outhold, on September 19, 1950; and the privilege is herein reserved by the said Town of Southold to pre-pay the whole or any part of the unpaid balance of the principal sum hereof at any time without penalty.
