A regular meeting of the Southold Town Planning Board was
held at 7:30 p.m. , Thursday, October 16, . 1980 at the Town Hall,
Main Road, Southold, New York. Present were:
Chairman Henry E. Raynor, Jr.

7:30 p.m. Public Hearing on the question of the approval of the
minor subdivision of Mary Ruth and Norman Whitehead located at
East Marion. Mr. Raynor read the legal notice ' of hearing and
presented proof of publication in the Long Island Traveler-Watchman.
Mr. Raynor: There is a receipt in the file for the application .
fee in the amount of $100. There is a waiver of requirements to
the Suffolk County Department of Planning. There is correspondence
from this board to the Department of Environmental Conservation
regarding the State Environmental Quality Review Act. There is
correspondence resolving tonight for the public hearing and
correspondence declaring Southold Town Planning Board lead agency.
There is a short. Environmental Assessment Form signed by Robert
Gillispie III representing the applicants. There is a statement
signed by Mr. Gillispie regarding grading, roads and drainage. Is
there anyone present this evening that would like to speak in
opposition to the proposed minor subdivision. Hearing none, is
there anyone present this evening that would like to speak in
favor. Hearing none, is there anyone with any information that
should come before this board at this time. Mr. Wall, Mr. Latham,
Mr. Orlowski? (all negative) Mr. Gordon.
Mr. Gordon: It designates 40,000 square feet for lots 2 and 4.
Does that include the parcel out on the beach?
Mr. Raynor: It should be exclusive. (The property was measured
and it was determined that it was exclusive. ) There being no
further comments we will declare this hearing closed.

7:45 p.m. Public Hearing on the question of the approval of the
preliminary map of the subdivision to be known as "Harbor Lights,
Section IV" located at Southold. Harold Reese appeared for the
developers. Mr. Raynor read the legal notice of hearing and presented
proof of publication in the Long Island Traveler-Watchman.
Mr. Raynor'. We have in the file receipt from the Town Clerk' s
Office for the filing fee, correspondence from this board and a
description of the property and legal notice, correspondence
from this board resolving lead agency for the Southold Town
Planning Board. There are former maps of the property and a copy
of applicant' s application, metes and bounds description, resolution
in correspondence approving the sketch paln on July 28th. I do not
see any recommendations to date from the Superintendent of Highways.
That pretty well completes the file. Is there anyone present this
evening that would like to speak in objection to the proposed
subdivision to be known as "Harbor Llights, Section IV"? Hearing
none, is there anyone present this evening that would like to
speak in favor of this proposed subdivision? Hearing none, is there
anyone present that has any information that is pertinent to this
board for this subdivision? Mr. Gordon, Mr. Latham, Mr. Orlowski,
Mr. Wall? (All negative) Before this board can make any
.determination it will need some specifics on engineering work
returned from the Highway Superintendent' s Office. I do have one
question regarding the amount of park and playground that has been
set aside.
Mr. Reese: The park and playground was designated for the whole
area when this was first in.
Mr. Raynor: Thank you. That saves me looking through all the
maps. There being no one 'that wishes to be heard, I will declare
the hearing closed.
Ernest Radford. Minor subdivision. Mr. Radford appeared before
the board. Mr. Latham was asked to make an inspection of the
property to see if a reservation should be made for a possible
road in the area.
On motion made by Mr. Latham, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency for the subdivision of property of Ernest Radford for
the State Environmental Quality Review Act for property located at
East Marion. This project is unlisted and an initial
determination of non-significance has been made.

On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED to approve the revised site plan of the Southold
Savings Bank to include the following changes:
1. Elimination of eight parking spaces.
2. Increase from two to three lanes of traffic at the
drive-up facility.
3. Retention of the zuxiliary parking field located on the
easterly side of Youngs Avenue containing 86 parking
spaces.

On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED to approve sketch map dated June 18, 1980 of the
minor subdivision of property of Katie J. Dexter located on the
north side of Park Avenue at Mattituck.

On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency for the State Environmental Quality Review Act for the
subdivision of property of Katie J. Dexter located on the north
side of Park Avenue at Mattituck. This project is unlisted and an
initial determination of non-significance has been made.

On motion made by Mr. Latham, seconded by Mr. Wall, it was
RESOLVED to approve the sketch map dated June 18, 1980 of the
minor subdivision of property of Katie J' Dexter located on the
south side of Park Avenue at Mattituck.

On motion made by Mr. Orlowski, seconded by Mr. Wall, it was

On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED that upon review of the survey for Hilary Pridgen as
_requested by the Zoning Board of Appeals, the Southold Town_ Planning
Board recommends to that body that the property be divided into
three lots with lot lines running east and west with a right-of-way
over same.

On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was
RESOLVED to disapprove the sketch map of the minor subdivision
of Roger H. & Richard J. Praetorius located at Mattituck.
After discussion Mr. Gordon withdrew his motion and Mr.
Orlowski withdrew his second.
On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED to approve the sketch map of the minor subdivision
of Roger H. & Richard J. Praetorius located at Mattituck, said
map dated September 1 1979.
Vote of the Board: Ayes: Raynor, Gordon, Latham, Wall

On motion made by Mr. Latham, seconded by Mr. Wall, it was
RESOLVED to set 8:00 p.m. , Monday, November 3, 1980 at the
Town Hall, Main Road, Southold, New York, as the time and place
for a public hearing on the question of the approval of the minor
subdivision of Roger H. & Richard J. Praetorius located at
Mattituck.

On motion made by Mr. Wall, seconded by Mr. Gordon, it was
RESOLVED to rescind the following action by -the Southold
Town Planning Board taken at a regular meeting held May 5, 1980
based on the opinion of the Town. Attorney that the Planning Board
cannot change lot lines established by the Zoning Board of
Appeals:
"RESOLVED to disapprove the map of the minor subdivision of
Thomas V. Perillo & Edith M. Perillo located at Laurel and dated
February 15, 1980 due to the configuration of Lot 2 as a flag lot. "

On motion made by Mr. Wall, seconded by Mr. Latham, it was
RESOLVED to rescind the following action by the Southold
Town Planning Board taken at a regular meeting held August 20,
1980 based on the opinion of the Town Attorney that the Planning
Board cannot change lot lines established by the Zoning Board of
Appeals:
"RESOLVED to approve the sketch map of the minor subdivision
of Thomas V. & Edith M. Perillo located at Laurel, said map dated
July 179 1980. "

RESOLVED to approve the sk;etoh map of the minor subdivision
of Thomas V. Perillo & Edith M. Perillo located at Laurel and
dated February 15, 1980.

The Suffolk County Planning Commission has disapproved the
map of the minor subdivision of Thomas V. Perillo and Edith M.
Perillo located at Laurel in part because "The Commission feels
that it has no -right to approve a subdivision with substandard
lots. " The Planning Board would like to inquire of the Suffolk
County Planning Commission as to the basis for this statement.

On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED that the Southold Town Planning Board has reviewed
the proposal of Raymond J. Kerester & Associates to set off a
parcel of land containing a house, said parcel containing 53,800
square feet with 150 foot road frontage. It is the determination
of the Planning Board that this set-ff does not constitute a
subdivision pursuant to the Code of Southold Subdivision of Land
Regulations Chapter A106-13.
Vote of the Board: Ayes : Raynor, Gordon, Latham, Orlowski,
Wall
Abigail Wickham, attorney for the applicant, requested that
her application for a minor subdivision be withdrawn. The above
action will be transmitted to the Building Department.
Frank Zanowski minor subdivision. Abigail Wickham, attorney,
appeared. Mr. Raynor requested Mr. Orlowski to inspect the property
to see if a cross street should be provided in this area.
On motion made by Mr. Wall, seconded by Mr. Latham, it was
RESOLVED to approve the sketch map of the minor subdivision
of Baxter Properties, Inc. located at Cutchogue, said map dated
September 26, 1979.

On motion made by Mr. Latham, seconded by Mr. Wall, it was
RESOLVED to amend the resolution approving the minor
subdivision of Anita McNulty and Helen McNulty to:
1. Eliminate condition 1 which reads "Elimination of
flaglots making Lot No. 1 the full width of the property
with a 25 foot right=of-way over that property running
to Lot No. 2 with a 10 or 15 foot right-of-way to
Peconic Bay running over Lot No. 211 . This is based on
the opinion of the Town Attorney that the Planning Board
cannot change lot lines established by the Zoning Board
of Appeals.
2. Over-riding condition noted as 2a in the resolution,
which is a condition of the Suffolk County Planning
Commission and reads "No residential structure shall be
constructed within 100 feet of Peconic Bay" . The Board
agrees that a 50 foot setback on the bay is sufficient.

Paradise Point Corporation. Mr. William B. Smith presented maps
of this subdivision. Mr. Raynor and Mr. Gordon will inspect the
property. The Board will require an affidavit of ownership as
this is a corporation.
Orient Hills. A letter has been received from real estate sales-
person Burt G. Lewis, Jr. inquiring as to how long it would take
to obtain final approval of the preliminary map as filed. The
matter reverts to sketch map and in all probability will take a
minimum of one year to process.
Mr. Orlowski made a motion, seconded by Mr. Wall and carried
that at the request of the Zoning Board of Appeals for an opinion
of the Planning Board regarding the split of property of Thurber,
the Planning Board does not favorably view such a spolit because
of the close proximity to salt water and the possible intrusion
on the water shed. This property is on Mattituck Creek.
On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED to accept the following conditions placed on the
minor subdivision of property of Lloyd Terry by the Suffolk County
Planning Commission and the same be placed on the map:
1. No clearing, except that required for ordinary maintenance,
or grading shall be done within the setback area along the
top of the bluff and on the face of the bluff in order to
help prevent the erosion of the bluff.
2. No stormwater resulting from the development and improve-
ment of the subdivision or any of its lots shall be
discharged over the top edge of the bluff or down its
face in any.imanner.
3. -Access to the beach shall be restricted to a single location
on each lot and then only by a suitable structure designed
and constructed so as not to disturb the stability of the
bluff.
4. No sanit�iry disposal facility shall be located within 100
feet of the top of the bluff.
5. There shall not be any further subdivision of this
property without the review and approval of the Town
Planning Board.
The Planning Board does hereby over-ride the following condition
of the Suffolk County Planning Commission:

Elimination of Lot 4 so as to make this subdivision a minor
subdivision.
The Planning. Board offers the following reasons for the over-ride:
1. The developer has signed a covenant and is prepared to file
same in the Suffolk County Clerk' s Office that the remainder of the
property, if ever developed, will be presented as a major
subdivision. The Planning Board looks upon the minor subdivision
as Section I of this property.
2. It is in the best interest of the Town of Southold to
maintain as much open land as reasonably possible. This is a viable
farm and the land being set off as lots will enable the owner to
continue with farming on the remainder.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED to rescind the following action by the Southold Town
Planning Board taken at a regular meeting held September 22, 1980
based on the opinion of the Town Attorney that the Planning Board
cannot change lot lines established by the zoning Board of Appeals:
"RESOLVED to disapprove the sketch map of the minor
subdivision of Joseph Gajeski dated June 30, 1980, said
property located at Southold. "

RESOLVED to approve the sketch map dated June 20, 1980 of
Joseph Gajeski for property located at Southold.

On motion made by Mr. Wall, seconded by Mr. Gordon, it was
RESOLVED to set 8:15 p.m. , Monday, November 3, 1980 at the
Town Hall, Main Road, Southold, New York, as the time and place for
a public hearing on the question of the approval of the minor,
subdivision of Joseph Gajeski located at Southold.

On motion made by Mr. Wall, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board has reviewed
the proposal of Ann P. O'Sullivan & Rosemary M. Breslin to set
off a parcel of land containing a house, said parcel containing
43,562 square feet with 120.60 feet road frontage. It is the
determination of the Planning Board that this set-off does not
constitute a subdivision pursuant to the Code of Southold
Subdivision of Land Regulations Chapter A106-13.
Vote of the Board: Ayes: Raynor, Gordon, Wall, Latham,
Orlowski
Golden View Estates. Abigail Wickham, attorney for the developer,
has presented this map in a sketch submission. Mr. Raynor and Mr.
Orlowski will make a field inspection of the property. A certificate
of disclosure will be, necessary.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board has reviewed
the proposal of Dwight A. Horne to divide property into two lots,
each of which contains a dwelling. It is the determination of the
Southold Town Planning Board that this set-off does not constitute
a subdivision pursuant to the Code of Southold Subdivision of land
Regulations Chapter A106-13.

On motion made by Mr. Latham, seconded by Mr. Gordon, it was
RESOLVED that whereas the variance sought by Mr. Harry Baglivi
pertains to Minor Subdivision #10 of George Matthews duly approved
and signed by the chairman of the Southold Town Planning Board that
it deserves consideration as such.

The Planning Board reviewed bonds for subdivisions on which
the time has expired according to Town Law to complete improvements.
The consensus of the Board was that these bonds should not be
extended and -the matter will be referred to the Town Board for
action.

Chairman Raynor designated Vice-Chairman Frederick Gordon to
serve on the committee for limited two-family housing in the Town
of Southold.
Chairman Raynor designated Member Ritchie Latham to serve on
the wetlands acquisition committee.
Chairman Raynor designated Member Bennett Orlowski to serve
on the highway committee.
It has come to the attention of the board that a building is
nearly completed on Fishers Island without subdivision approval from
the Town of Southold. The Building Department is to be notified on
this matter. (FIDCO Fox Avenue - Rodrigez)
There being no further business to come before the Board, Mr.
Latham made a motion, seconded by Mr. Orlowski and carried to
adjourn the meeting. Meeting adjourned at 10:15 p.m.
